Ms. No. 22, Home, Prohibition and Excise (VI), 30th July 2019, Ý® 14, Mè£K, F¼õœÀõ˜ ݇´-2050.] No. SRO A-26/2019.—In exercise of the powers conferred by Section 54 of the Tamil Nadu Prohibition Act, 1937 (Tamil Nadu Act X of 1937), the Governor of Tamil Nadu hereby makes the following amendments to the Tamil Nadu Liquor Retail Vending (in Shops and Bars) Rules, 2003. In the said Rules,— (1) in rule 2,— (a) in clause (i), for the expression " the shortest pathway", the expression "the shortest public pathway" shall be substituted; (b) after clause (p), the following clause shall be inserted, namely:- "(pp) "Population" means the figure of population as officially published in the latest census."; (2) in rule 8,— (a) in sub-rule (1), for the expression "in other areas 100 (hundred) metres" the expression "in other areas within 100 (hundred) metres" shall be substituted; (b) in sub-rule (1), after the provisos thereto, the following Explanations shall be added, namely:- "Explanation (1).- (a) wherever the distance of the shop from the place of worship or educational institution needs to be determined, distance shall be measured from the entry door of the shop to the- (i) nearest gate of the place of worship or educational institution, when such place of worship or educational institution has a compound wall; or (ii) nearest entrance of the place of worship or educational institution, when such place of worship or educational institution has no compound wall. (b) When the retail vending shop is located alongwith other shops within a building, the distance would be, the sum total of the length of the shortest public pathway, lane, Street or Road, generally used by the memberes of the public till the entry gate of the building in which the shop is located and thereafter, the shortest pathway used by the people to reach the entry door of the shop. Explanation (2).- (a) Wherever the distance of the shop from the outer edge of National or State Highway or service lane along the Highway needs to be determined, the same shall be measued from the entry door of the shop to the outer edge of the National or State Highways or of a service lane along such highway. (b) when the retail vending shop is located alongwith other shops within a building, the distance would be, the sum total of the length of the shortest public pathway, lane, Street or Road, generally used by the members of the public from the outer edge of National or State Highways or service lane along the Highways till the nearest entry gate of the building in which the shop is located and thereafter, the shortest pathway used by the people to reach the entry door of the shop."
