L.-33004/99 सी.जी.-एच.आर.-अ.-25112024-258890 xxxGIDHxxx CG-HR-E-25112024-258890 xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 927] िई कदल्ली, बुधिार, ििम्ब र 20, 2024/कार्तकम 29, 1946 No. 927] NEW DELHI, WEDNESDAY, NOVEMBER 20, 2024/KARTIKA 29, 1946 सयं क्तु जिद्यतु जिजियामक आयोग (गोिा राज्य और सघं राज्य क्षत्रे ) अजधसचू िा गरुु ग्राम 12 ििम्ब र,2024 फा.स.ं िईे आरसी स.ं 34/2024––जिद्यतु अजधजियम, 2004 की धारा 91 और 181 तथा िेईआरसी (अजधकाररयों एिं कममचाररयों की भती सचं ालि एिं सेिा ितें) जिजियम, 2009 के अध्याय IV, पैरा 18.2 के तहत प्रदाि की गई िजक्तयों का प्रयोग करते हुए सयं ुक्त जिद्युत जिजियामक आयोग जिम्नजलजखत जिजियम बिाता ह:ै - 1. सजं क्षप्त िीर्कम , प्रारंभ और अिप्रु योग की सीमा i. इि जिजियमों को संयुक्त जिद्यतु जिजियामक आयोग (जचककत्सा सुजिधा) जिजियम, 2024 कहा िाएगा। ii. ये जियम आयोग के अध्यक्ष और सदस्ट्यों को छोड़कर जियजमत जियुजक्त, प्रजतजियुजक्त या अल्पकाजलक अिबु ंध पर कायमरत सभी कमचम ाररयों, सेिाजिित्तृ कममचाररयों और उिके पररिारों पर लागू होंगे। iii. ये जिजियम आजधकाररक रािपत्र में प्रकािि की जतजथ से लागू होंगे। 2. पररभार्ाए ँ इि जिजियमों में, िब तक कक सदं भम से अन्यथा आिश्यक ि हो: - i. "प्राजधकृत/अजधसजू चत मजे डकल प्रजै टिििर" का अथम ह,ै एक पिं ीकृत मेजडकल प्रैजटिििर जिसके पास समय-समय पर संिोजधत भारतीय जचककत्सा पररर्द अजधजियम, 1956 के तहत मान्यता प्राप्त जडग्री हो, या ककसी जिश्वजिद्यालय/ 7487 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] सांजिजधक बोडम/ पररर्द/ भारतीय जचककत्सा और होम्योपैथी सकं ाय से आयुिदे / यिू ािी/ जसद्ध/ होम्योपैथी में कम स े कम 4 िर्म की अिजध की जडग्री या जडप्लोमा हो और िो भारतीय जचककत्सा केंद्रीय पररर्द अजधजियम, 1970/होम्योपैथी केंद्रीय पररर्द अजधजियम, 1973 की अिुसूजचयों में िाजमल हो और राज्य जचककत्सा पररर्द के साथ पिं ीकृत हो। ii. "आयोग" का अथम ह ैसयं ुक्त जिद्यतु जियामक आयोग (गोिा राज्य और संघ राज्य क्षेत्र) iii. "जियत्रं ण अजधकारी" का अथम, आयोग के सजचि या ककसी अन्य अजधकारी से है, जिसे इि जिजियमों के प्रयोिि के जलए आयोग द्वारा ऐसी िजक्तयाँ सौंपी िाती ह।ैं iv. "कमचम ारी" का तात्पयम आयोग द्वारा जियुक्त ककसी भी व्यजक्त से है, जिसे सयं ुक्त जिद्युत जिजियामक आयोग द्वारा इि जिजियमों के तहत लाभ प्राप्त करिे की अिमु जत दी गई ह ै और इसमें िे कमचम ारी भी िाजमल हैं, िो आयोग से सेिाजिित्तृ हुए ह ैं(60 िर्म की आयु में या िसै ा कक केंद्र सरकार तय करे), जिन्होंिे आयोग में स्ट्थायी रूप से अििोजर्त होिे के बाद कम से कम 5 िर्म की सेिा की ह।ै " सिे ाजििृजत्त से पहले जचककत्सा अक्षमता पर अपिी सेिाजििृजत्त के मामले में कमचम ारी भी इि जिजियमों के तहत लाभ प्राप्त करिे के जलए पात्र होंगे। साििम जिक क्षेत्र के उपक्रमों/सरकारी/स्ट्िायत्त जिकाय/सांजिजधक जिकाय आकद में जियजमत कममचारी के रूप में 20 िर्म से अजधक की सेिा प्रदाि करिे के पश्चात, स्ट्िैजछछक सेिाजििजृ त्त के मामले में कममचारी को आयोग को जलजखत रूप में कम से कम तीि माह का िोरिस दिे ा होगा, जिसे स्ट्िैजछछक सेिाजििृजत्त की जतजथ के अिुसार िोड़ा िाएगा तथा आयोग में न्यिू तम 05 िर्म की सेिा भी प्रदाि की होगी। v. "पररिार" का तात्पयम कममचारी के पजत/पत्नी, माता-जपता, अजििाजहत बहिें, िाबाजलग/अजििाजहत भाई, जिधिा पुजत्रयाँ, जिधिा बहिें, बच्चे और सौतेले बच्चे (काििू ी रूप से गोद जलए गए बच्चों सजहत) से है, िो समय-समय पर संिोजधत भारत सरकार के सीएस (एमए) जियमों के प्रािधािों के अिुसार कमचम ारी पर पूणतम ः आजित ह।ैं vi. "मरीि" का तात्पयम आयोग के ककसी कममचारी या उसके पररिार के सदस्ट्य से है, जिस पर ये जिजियम लागू होते ह ैं और जिसे जचककत्सा देखभाल और उपचार की आिश्यकता होती ह।ै vii. पररिार के सदस्ट्य भी जचककत्सा देखभाल और उपचार के हकदार होंगे, भले ही िे कमचम ारी के साथ िहीं रहते हों। viii. "सीिीएचएस लाभाथी" सीिीएचएस जियमों के अिसु ार सीिीएचएस सुजिधा का लाभ उठा सकते ह ैं और िे उक्त सुजिधा के जलए पात्र िहीं होंगे। ix. जचककत्सा सुजिधाओं का लाभ केिल तभी उठाया िा सकता ह ै िब सेिाजििृत्त कमचम ारी और उसका/उसकी पजत/पत्नी केन्द्र/राज्य सरकार/साििम जिक क्षेत्र के उपक्रम/अन्य प्राजधकरण आकद से या उसके माध्यम से कोई जचककत्सा सुजिधा प्राप्त िहीं कर रह ेहों। x. कमचम ारी और उसके आजित पररिार के सदस्ट्यों (िैसा कक समय-समय पर संिोजधत केन्द्रीय सेिा (जचककत्सा सहायक) जियम, 1944 में पररभाजर्त ह)ै को जचककत्सा सुजिधाएं केिल भारत में या अन्यथा जििर्े रूप से बताए गए उपचार के जलए ही स्ट्िीकायम होगी। xi. “सचू ीबद्ध अस्ट्पताल एि ं डायग्नोजस्ट्िक सिें र” का अथम ह ै सरकारी अस्ट्पताल/डायग्नोजस्ट्िक सेंिर, जिसमें स्ट्िास्ट््य एिं पररिार कल्याण मत्रं ालय द्वारा समय-समय पर संिोजधत जििर्े और सामान्य उपचार और डायग्नोजस्ट्िक प्रकक्रयाओं के जलए सीिीएचएस के तहत सभी मान्यता प्राप्त जििी अस्ट्पताल/डायग्नोजस्ट्िक सेंिर िाजमल ह ैं या संयुक्त जिद्युत जियामक आयोग द्वारा अजधसूजचत/अजधकृत कोई भी जििी अस्ट्पताल/डायग्नोजस्ट्िक सेंिर। इसके बाद ककए गए ककसी भी प्रकार का पररितिम स्ट्िचाजलत रूप से लाभार्थमयों पर लागू होंगे। xii. "उपचार" का अथम ह ै उस अस्ट्पताल में उपलब्ध सभी जचककत्सा और सर्िकम ल जचककत्सा सुजिधाओं का उपयोग जिसम ें कमचम ारी का उपचार ककया िाता हो:- क. ऐसे पथै ोलॉजिकल, बैटिीररयोलॉजिकल, रेजडयोलॉजिकल, उन्नत प्रौद्योजगकी जिजध या अन्य जिजधयों की सेिाएं जिन्ह ें अजधकृत जचककत्सा सहायक द्वारा आिश्यक समझा िाए; ख. ऐसी दिाइयाँ, िीका, सीरम या अन्य जचककत्सीय उपकरणों की आपूर्तम िो सामान्यतः अस्ट्पताल में उपलब्ध ह ैं और िो सीएस (एमए) जियमों के तहत स्ट्िीकायम ह;ैं ग. ऐसी दिाइयों, िीकों, सीरम या अन्य जचककत्सीय उपकरणों की आपूर्तम, िो सामान्यतः उपलब्ध िहीं होते हैं, िसै ा कक अजधकृत जचककत्सा सहायक जलजखत रूप में प्रमाजणत कर सकता ह ै कक िे कमचम ारी के स्ट्िास्ट््य में सुधार या उसकी जस्ट्थजत में सुधार के जलए आिश्यक ह,ैं जसिाय िीचे उजल्लजखत मदों के:-:-[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 i. ऐसे उपक्रम िो दिा िहीं हैं, बजल्क मुख्य रूप से आहार, िॉजिक, प्रसाधि उपक्रम या कीिाणुिािक ह ैं और अिसु चू ी I में जिर्दमष्ट महगं ी दिाएं, िॉजिक, लटै सेरिि या अन्य बहुमूल्य और प्रोप्राइिेरी उपक्रम ह;ैं ii. और अिसु चू ी II में जिर्दमष्ट महगं ी दिाएँ, िॉजिक, लैटसरे िि या अन्य बहुमूल्य और प्रोप्राइिेरी उपक्रम जििके जलए समाि जचककत्सीय मल्ू य की दिाएँ उपलब्ध ह।ैं घ. आयुिेकदक, यिू ािी, जसद्ध और होम्योपैजथक दिाओं की सचू ी, जिसके जलए ररफंड स्ट्िीकायम ह ै िो अिसु चू ी III के समाि पररजिष्ट में भी उजल्लजखत ह।ै ङ. ऐसे आिास िो सामान्यतः जिजियमि 8 में जिधामररत पात्रता के अिुसार अस्ट्पताल में उपलब्ध कराई िाती ह।ै च. एलोपैथी, होम्योपैथी, आयुिेकदक, यूिािी और जसद्ध प्रणाली सजहत जचककत्सा की एक एकीकृत प्रणाली से िड़ु े कफजियोथेरेपी और अन्य उपचार; छ. ऐसी िर्सिंग िो सामान्यतः अस्ट्पताल द्वारा भती मरीिों को प्रदाि की िाती है; तथा ज. इि जिजियमों में जििर्े ज्ञ परामिम का िणिम ककया गया है, लेककि इसमें कमचम ारी के अिुरोध पर आहार या भोिि या जिजियमि 8 में िर्णमत से बेहतर आिास िाजमल िहीं ह।ै 3. आयोग द्वारा कमचम ाररयों के अिुरोध पर, क्षेत्रिार, संबंजधत पंिीकृत मेजडकल प्रैजटिििर के पंिीकरण संख्या के साथ जप्रजस्ट्क्रप्िि सजहत आिश्यक प्रामाजणक दस्ट्ताििे के आधार पर, प्राजधकृत मेजडकल प्रैजटिििर की सूची तयै ार और रख-रखाि की िाएगी। यकद कोई कमचम ारी इस आयोग/सीिीएचएस-मान्यता प्राप्त अस्ट्पताल (अपिे एएमए से रेफरल प्राप्त करिे के बाद) के साथ सचू ीबद्ध अस्ट्पताल से ओपीडी उपचार प्राप्त करता है, तो उस सूचीबद्ध अस्ट्पताल के उपजस्ट्थत डॉटिर को भी आयोग के जलए प्राजधकृत/अजधसूजचत मेजडकल प्रैजटिििर मािा िाएगा। 4. आउिडोर उपचार प्राप्त करि ेकी प्रकक्रया i. इस आयोग के अजधकारी और कममचारी/सेिाजिित्तृ /अजधिर्र्तम ा प्राप्त कमचम ारी, स्ट्ियं और अपिे आजितों सजहत पररिार के सदस्ट्यों के जलए ओपीडी उपचार के जलए जचककत्सा व्यय की प्रजत पूर्तम के जलए पात्र होंगे, जिसकी िार्र्कम सीमा, उस िेति मैररटस के अंजतम सेल पर आधाररत होगी जिसमें िे कायमरत ह/ैंथे, यह प्रजत पूर्तम प्रत्यके जित्तीय िर्म में अप्रलै से माचम तक लागू होगी, जिसके जलए उन्ह ें अजधकृत/अजधसूजचत जचककत्सा व्यिसाजययों से दिा/परीक्षण एिं िाचं के जबल/िकद िोि के साथ पचाम प्रस्ट्ततु करिा होगा। ii. इस िार्र्मक सीमा में एमआरआई, सीिी स्ट्कैि, एंजियोग्राफी आकद िैसे प्रमुख परीक्षणों पर ककए गए व्यय िाजमल िहीं ह,ैं जििकी प्रजत पूर्तम िास्ट्तजिक आधार पर या सीिीएचएस द्वारा जिधामररत सीमा, िो भी कम हो, के आधार पर की िाएगी। iii. ऊपर दिामई गई िार्र्मक अजधकतम राजि का दािा अिुलग्नक-II में कदए गए प्रपत्र के अिसु ार जचककत्सा जबल/िकद ज्ञापि प्रस्ट्ततु करके ककया िा सकता ह।ै 5. इिडोर उपचार का लाभ उठाि ेकी प्रकक्रया i. कमचम ारी/सेिाजिित्तृ कमचम ारी और उिके आजित समय-समय पर िारी सीिीएचएस सचू ी में उजल्लजखत अस्ट्पतालों या संयुक्त जिद्युत जियामक आयोग द्वारा अजधसूजचत/अजधकृत अस्ट्पतालों या ककसी जििी अस्ट्पताल/डायग्नोजस्ट्िक सेंिर स े इिडोर उपचार ले सकते ह ैं और इस संबंध में कमचम ाररयों द्वारा ककए गए खचम की प्रजतपूर्तम आयोग द्वारा समय-समय पर संिोजधत स्ट्िीकायम दरों के अिसु ार की िाएगी। ii. यकद आपातकालीि जस्ट्थजत में ककसी जििी अस्ट्पताल/िर्सगिं होम (स्ट्िास्ट््य एिं पररिार कल्याण मत्रं ालय द्वारा समय-समय पर िारी सीिीएचएस सचू ी में उजल्लजखत अस्ट्पतालों या आयोग द्वारा अजधकृत अस्ट्पतालों के अलािा) से उपचार प्राप्त ककया िाता ह,ै तो ऐसे उपचार के जलए िास्ट्तजिक व्यय की प्रजतपूर्तम सीिीएचएस में जिधामररत दरों या ककए गए का कम से कम सीजमत दर प्रजतपूर्तम की िाएगी। iii. आयोग के कमचम ारी स्ट्िास्ट््य एिं पररिार मत्रं ालय द्वारा समय-समय पर संिोजधत पकै ेि दरों के अिुसार उपचार की लागत, पैथोलॉजिकल, रेजडयोलॉजिकल, स्ट्कैनिंग, अस्ट्पताल आिास, िर्सिंग होम सुजिधाओं आकद सजहत जचककत्सा उपचार के जलए पात्र होंगे।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] iv. आयोग के कमचम ारी अजधकृत/अजधसूजचत मेजडकल प्रैजटिििर/उपजस्ट्थत जचककत्सक की सलाह पर ककसी भी सचू ीबद्ध अस्ट्पताल/डायग्नोजस्ट्िक सेंिर में जचककत्सा उपचार प्राप्त कर सकता ह।ै हालाँकक, आपातकालीि जस्ट्थजत में िे सीधे अपि े जििास स्ट्थाि के जिकितम ककसी जििी या मान्यता प्राप्त जििी अस्ट्पताल/डायग्नोजस्ट्िक सेंिर में भी िा सकते ह।ैं v. जििी गैर-मान्यता प्राप्त अस्ट्पतालों/डायग्नोजस्ट्िक सेंिर को जटलजिकल परीक्षण आकद के जलए भगु ताि ककए गए िल्ु क की प्रजतपूर्तम सीिीएचएस लाभार्थयम ों के जलए जिधामररत दरों के अिुसार की िाएगी। िहां कोई दर जिधामररत िहीं है, िहां ककए गए व्यय की प्रजतपूर्तम िास्ट्तजिक आधार पर की िाएगी। vi. यकद ककसी सूचीबद्ध अस्ट्पताल/ डायग्नोजस्ट्िक सेंिर में उपचार के दौराि जििर्े िर्सगिं की आिश्यकता हो िाती ह ै तो कमचम ारी या उसके पररिार के कोई सदस्ट्य को उसके उपचार को ध्याि में रखते हुए जििर्े िर्सिंग का लाभ उठा सकता ह।ै ऐसी जििेर् िर्सिंग के जलए प्रजतपूर्तम की िािे िाली राजि उस राजि तक सीजमत होगी, िो उस अिजध के जलए संबंजधत कमचम ारी के िते ि के 25% से अजधक हो, जिसके जलए जििर्े िर्सगिं आिश्यक थी। इस प्रयोिि के जलए प्रभारी जचककत्सा अजधकारी से जचककत्सा अधीक्षक द्वारा प्रजत हस्ट्ताक्षररत प्रमाण पत्र प्रस्ट्ततु ककया िािा होगा। vii. लाभाथी (िेईआरसी के कमचम ारी/सेिाजिित्तृ कममचारी) जिन्होंिे सीिीएचएस सुजिधाओं/केन्द्रीय सेिा (जचककत्सा उपजस्ट्थजत) जियम, 1944 का लाभ उठािे के अलािा जचककत्सा बीमा पॉजलजसयों की सदस्ट्यता ली है, उन्ह ें दोिों स्रोतों स े प्रजत पूर्तम का दािा करिे की अिमु जत दी िा सकती है, बिते कक ऐसे स्रोतों से प्रजतपूर्तम लाभाथी द्वारा उपचार पर ककए गए कुल व्यय से अजधक ि हो। यकद लाभाथी द्वारा मूल िाउचर/जबल के जिरुद्ध जचककत्सा दािा पहले बीमा कंपिी से ककया िाता ह,ै तो बीमा कंपिी लाभाथी को प्रजत पूर्तम की गई राजि को दिातम े हुए एक प्रमाण पत्र िारी करेगी। संबंजधत बीमा कंपिी ऐसे मामलों में मलू िाउचर/जबल अपिे पास रख लेगी। इसके बाद लाभाथी अपिे िेर् जचककत्सा दािे को िाउचर/जबल की प्रमाजणत फोिो कॉपी के साथ िेईआरसी को प्रस्ट्ततु करेगा, साथ ही िाउचर/जबल के पीछे बीमा कंपिी की मुहर भी लगािी होगी। लाभाथी को प्रजत पूर्तम केिल अिमु ोकदत दरों के अिुसार स्ट्िीकायम राजि तक ही सीजमत होगी, बिते कक दोिों संस्ट्थाओं (बीमा कंपिी और िईे आरसी) द्वारा प्रजत पूर्तम की गई कुल राजि लाभाथी द्वारा ककए गए कुल व्यय से अजधक ि हो। viii. इिडोर उपचार की अिजध के जलए पैकेि दरें जिम्नािुसार ह:ैं क. जििेर् प्रकक्रया के जलए 12 कदि। ख. अन्य प्रकक्रयाओं के जलए 7-8 कदि। ग. लैप्रोस्ट्कोजपक सिरम ी के जलए 3 कदि। घ. सामान्य िाचँ / छोिी प्रकक्रयाओं की िाचँ (ओपेडी) जलए 1 कदि। 6. सिे ाजिित्तृ कमचम ारी के जलए मजे डकल काड मके पिं ीकरण/ििीिीकरण हते ुआिदे ि की प्रकक्रया: - i. िो कमचम ारी सेिाजििृजत्त के बाद स्ट्ियं/पजत/पत्नी/आजितों (िैसा कक समय-समय पर संिोजधत केंद्रीय सेिा (जचककत्सा सहायक) जियम, 1944 में पररभाजर्त ह)ै के जलए जचककत्सा लाभ प्राप्त करिे का इछछुक है, उसे सेिाजििृजत्त/स्ट्िैजछछक सेिाजििृजत्त/जचककत्सा अक्षमता पर सेिाजििृजत्त की जतजथ से तीि महीिे पहले आयोग से ‘अिलु ग्नक III’ में जिर्दमष्ट प्रारूप के अिसु ार जिकल्प प्रस्ट्ततु करिा होगा। अगर ककसी कमचम ारी की सेिाजििृजत्त से पहले मृत्यु हो िाती ह ै तो ऐसी जस्ट्थजत म ें कमचम ारी के आजित इि जचककत्सा सुजिधाओं का जिकल्प चिु सकते ह।ैं ii. ऐसे कममचारी/आजित को आिेदि की जतजथ से एक महीिे के भीतर ‘अिलु ग्नक IV’ में जिर्दमष्ट प्रारूप के अिुसार मेजडकल काडम िारी करके पिं ीकृत ककया िाएगा। िारी ककया गया मेजडकल काडम कमचम ारी की सेिाजििृजत्त या मृत्यु की जतजथ स े पाँच िर्म की अिजध के जलए िैध होगा। iii. अगर पररिार (समय-समय पर संिोजधत केन्द्रीय सेिा (जचककत्सा सहायक) जियम, 1944 में पररभाजर्त) के ब्यौरे म ें ककसी प्रकार का पररितिम ककया िाता ह ै तो, इसकी सचू िा तुरन्त इस आयोग को जलजखत रूप में देिा होगा अतः आयोग द्वारा सचू िा प्राप्त होिे पर एक सप्ताह के भीतर संिोजधत मेजडकेल काडम िारी कर कदया िाएगा। iv. मेजडकल काडम का ििीिीकरण हर पाचँ साल में ककया िाएगा। कमचम ारी/आजितों (िसै ा कक समय-समय पर संिोजधत केंद्रीय सेिा (जचककत्सा सहायक) जियम, 1944 में पररभाजर्त ककया गया ह)ै को मेजडकल काडम की समाजप्त से तीि महीि े पहले ििीिीकरण के जलए सजचि, िेईआरसी को आिेदि करिा होगा (अिुलग्नक IV में प्रारूप के अिसु ार), िो आिेदि की जतजथ से एक महीिे की अिजध के भीतर ही िया मेजडकल काडम िारी करके ििीिीकरण की स्ट्िीकृजत प्रदाि करेंगे।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 v. सेिाजििृजत्त के बाद कमचम ारी की मृत्यु की जस्ट्थजत में, पजत/पत्नी और पररिार के अन्य पात्र आजित सदस्ट्य (िैसा कक समय- समय पर संिोजधत केन्द्रीय सेिा (जचककत्सा सहायक) जियम, 1944 में पररभाजर्त ककया गया ह)ै इस सुजिधा का लाभ लेिा िारी रख सकते ह।ैं vi. मेजडकल काडम उस जतजथ से अमान्य हो िाएगी, जिस कदि कमचम ारी या उसके आजित (िैसा कक समय-समय पर संिोजधत केन्द्रीय सिे ा (जचककत्सा सहायक) जियम, 1944 में पररभाजर्त ह)ै द्वारा पात्रता की कोई भी ितें परू ी िहीं की िाएगी। 7. जचककत्सा उपचार हते ुअजग्रम राजि i. इिडोर उपचार पर होिे िाले सभी खचे आरंभ में कमचम ारी को स्ट्िंय ही उठािे होंगे और उपचार परू ा होिे पर जचककत्सा प्रजतपूर्तम के जलए दािा करिा होगा। हालांकक, कमचम ारी के अिरु ोध पर सक्षम प्राजधकारी, िेईआरसी उसे जिम्नजलजखत मामलों में अपिे और अपिे पररिार के सदस्ट्यों के जलए जचककत्सा देखभाल और उपचार पर होिे िाले खचम पर अजग्रम राजि दे सकता ह,ै बिते कक आयोग से अिुमोदि प्राप्त करिे के बाद एएमए/सीिीएचएस पिै लबद्ध अस्ट्पताल द्वारा िैध जप्रजस्ट्क्रप्िि और अिमु ाि प्रस्ट्ततु करिा होगा। क. अस्ट्पताल में इिडोर उपचार के जलए ख. िीबी/कैंसर के मामले में ओपीडी उपचार के जलए ii. अजग्रम राजि, उपचार करिे िाले एएमए द्वारा अिमु ाजित या अस्ट्पताल द्वारा माँगी गई राजि के 90% से अजधक िहीं होगी। iii. कमचम ारी को दी गई अजग्रम राजि को जचककत्सा दािे में समायोजित ककया िाएगा तथा िर्े राजि, यकद कोई हो, तत्काल िापस कर दी िाएगी। iv. सामान्यतः, आयोग के साथ समझौता करिे िाले मान्यता प्राप्त जििी अस्ट्पताल/डायग्नोजस्ट्िक केन्द्र पैकेि दर के जलए अिमु ोकदत दरें ही चािम करेगा ि े आपातकालीि मामलों में ऋण की सुजिधाएँ भी प्रदाि करेंगे और स्ट्िीकृत दरों के अिुसार प्रजतपूर्तम के जलए जबल आयोग को प्रस्ट्ततु करेंगे। हालांकक, अगर अस्ट्पताल/डायग्नोजस्ट्िक सेंिर इलाि, कमरे का ककराया, दिाइयां, जिजभन्न िाचँ आकद की लागत का तत्काल भगु ताि करिे पर िोर दते े हैं, तो आयोग सीिीएचएस लाभार्थमयों के जलए जिधामररत पकै ेि दर के अिसु ार अिुमाजित खचम के 90% की सीमा तक अजग्रम भुगताि को मंिरू ी दे सकता ह ै और संबंजधत अस्ट्पताल या लाभाथी के िाम पर अकाउंि पये ी चके िारी कर सकता ह।ै लाभाथी द्वारा अंजतम दािा प्रस्ट्ततु करि े पर िर्े भुगताि ककया िाएगा। 8. आिास जििी पैिलबद्ध अस्ट्पतालों में इिडोर उपचार के जलए अजधकाररयों/कमचम ाररयों की जिजभन्न िेजणयों के जलए िाडम की पात्रता जिम्नािसु ार होगी: - क्र. 7ि ें सीपीसी के अिसु ार िते ि मरै रटस म ें िाड मपात्रता कमरे का ककराया स.ं िते ि स्ट्तर (लिे ल) (₹ म)ें 1. एल 6 तक सामान्य ₹ 1500/- प्रजत कदि 2. एल 7 से एल 10 तक अद्ध-म जििी ₹ 3000/- प्रजत कदि 3. एल 11 और उससे अजधक जििी ₹ 4500/- प्रजत कदि 4. सामान्य िाचँ सामान्य िाचँ (6-8 घंिे प्रिेि) ₹500/- प्रजत कदि सभी प्रकार के कमरे के जलए 9. जचककत्सा दाि ेका प्रस्ट्तजु तकरण i. ककसी बीमारी के जििर्े दौर के जलए जचककत्सा व्यय की प्रजतपूर्तम के जलए अंजतम दािे आमतौर पर उपचार परू ा होिे की तारीख से तीि (3) महीिे के भीतर प्रस्ट्ततु ककए िाएंगे। ii. प्रजतपूर्तम के जलए सभी दािों के साथ डॉटिर का जप्रसकक्रप्िि, केजमस्ट्ि का कैि मेमो, परामिम/दिाइयों आकद के संबंध म ें डॉटिर/अस्ट्पताल की रसीद (िैसा कक इि जिजियमों के तहत आिश्यक ह)ै दािा फामम के साथ प्रस्ट्ततु ककया िाएगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] iii. इिडोर/आईपीडी उपचार के जलए जचककत्सा दािों हते ु आिदे ि अिलु ग्नक-I में कदए गए जिधामररत प्रपत्र में प्रस्ट्ततु ककया िाएगा। iv. ओपीडी उपचार के जलए जचककत्सा दािों हते ु आिदे ि अिलु ग्नक-II में कदए गए जिधामररत प्रपत्र में प्रस्ट्ततु ककया िाएगा। v. सेिाजििृत्त कमचम ारी के संबंध में आउिडोर उपचार के जलए महीि ेमें एक बार दािा ककया िा सकता ह ै vi. इिडोर उपचार पर होिे िाले सभी खचे िुरू में कमचम ारी को स्ट्ियं िहि करिा होगा तथा उपचार परू ा होिे के बाद जचककत्सा प्रजतपूर्तम का दािा करिा होगा। vii. सीिीएचएस लाभाथी अपिे जचककत्सा दािे सीिीएचएस जियमों के अिसु ार प्रस्ट्तुत करेंगे। viii. सेिाजििृत्त कमचम ारी या उसके आजित (िसै ा कक समय-समय पर संिोजधत केन्द्रीय सेिा (जचककत्सा सहायक) जियम, 1944 में पररभाजर्त ह)ै की गभं ीर बीमारी के कारण अस्ट्पताल में भती होिे की आिश्यकता होिे 72 घंिों के भीतर सजचि, िेईआरसी को जलजखत रुप में (ई-मेल, फैटस आकद के माध्यम से) सूचिा भिे िी होगी। ix. कमचम ारी को जडस्ट्चािम की जतजथ से तीि महीिे के भीतर जिधामररत प्रारूप में सभी संबंजधत िाउचर/दस्ट्ताििे ों के साथ मलू रूप में िेईआरसी को जचककत्सा दािा प्रस्ट्ततु करिा होगा। िेईआरसी का प्रिासि प्रभाग, दािा पत्रों को स्ट्िीकार करिे स े पहले यह सत्याजपत और सुजिजश्चत करेगा कक सभी आिश्यक दस्ट्ताििे संलग्न ह ै की िहीं और जचककत्सा दािे की प्राजप्त के प्रमाण के रूप में दािदे ार को कदिांककत पािती िारी करेगा। x. यकद जचककत्सा दािा के दस्ट्ताििे ों/कागजातों में कोई कमी/अतं राल पाया िाता है, तो िेईआरसी, उि कागजात को अपि े पास रखेगा और जचककत्सा दािा की प्राजप्त की जतजथ से एक महीिे के भीतर कजमयों/अिलोकिों की सचू ी कमचम ारी को भिे ेगा ताकक कजमयों/अभािों को दरू ककया िा सके। यकद कजमयों को दरू करिे के जलए आिश्यक कारमिाई करिा अत्यतं आिश्यक ह,ै तो लाभाथी को पूण मरुप से जचककत्सा दािा िापस ककया िा सकता ह।ै xi. िेईआरसी के मेजडकल जिजियमों के अिुसार जचककत्सा दािे की िाचँ और कारमिाई की िािी चाजहए। स्ट्िीकायम पाई गई राजि का भुगताि उपरोक्त ितों के अिुसार पाररत ककया िाएगा। लेखा प्रभाग, िेईआरसी द्वारा जचककत्सा दािे की प्राजप्त की जतजथ से तीि महीिे के भीतर लाभाथी के बैंक खाते में ऑिलाइि माध्यम से (लाभाथी द्वारा जचककत्सा दािे म ें कमी/अभाि, यकद कोई हो, को दरू करिे में जलया गया समय छोड़कर) भगु ताि ककया िाएगा । 10. िब पजत और पत्नी दोिों सिे ा म ेंहो ऐसे मामले में िहां पजत और पत्नी दोिों सेिा में ह ैंऔर अपिे संबंजधत जियोक्ता से जचककत्सा सुजिधाओं के जलए पात्र हैं, उन्ह,ें साथ ही पात्र आजितों को, उसकी जस्ट्थजत के अिसु ार जचककत्सा ररयायत सुजिधा का लाभ उठािे की अिमु जत दी िा सकती ह।ै इस प्रयोिि के जलए, उन्ह ेंअपिे संबंजधत अजधकाररयों को एक संयुक्त घोर्णा प्रस्ट्ततु करिी चाजहए कक पत्नी/पजत और बच्चों के संबंध में जचककत्सा उपजस्ट्थजत और उपचार पर ककए गए जचककत्सा व्यय की प्रजत पूर्तम के जलए दािा कौि करेगा। उपरोक्त घोर्णा दो प्रजतयों में प्रस्ट्ततु की िािी चाजहए और प्रत्यके की एक प्रजत उिके संबंजधत कायामलय में उिमें से प्रत्यके की व्यजक्तगत फाइल में दिम की िाएगी। यह घोर्णा तब तक लागू रहगे ी िब तक कक पजत और पत्नी दोिों द्वारा जलजखत रूप में स्ट्पष्ट अिुरोध पर इसे संिोजधत िहीं ककया िाता ह,ै उदाहरण के जलए, दोिों में से ककसी की पदोन्नजत, स्ट्थािातं रण, इस्ट्तीफा आकद की जस्ट्थजत में। 11. ऐस ेमामल ेिहा ँपररिार मख्ु यालय (स्ट्िेिि) के बाहर रहता है i. िहाँ कमचम ारी का पररिार उस स्ट्थाि पर िहीं रहता ह ै िहाँ कममचारी तिै ात है, इस जस्ट्थजत में िे जचककत्सा उपचार का लाभ उठा सकते ह ैंऔर ऐसे उपचार पर ककए गए व्यय की प्रजतपर्ू तम आयोग द्वारा जिजियमों म ेंजिधामररत सीमा के अधीि की िाती ह।ै ii. अपिे मख्ु यालय के अलािा ककसी अन्य स्ट्थाि पर बीमार पड़िे िाले कमचम ारी या उिके पररिारों के सदस्ट्य, या आजधकाररक दौरों के दौराि बीमार पड़िे िाले कमचम ारी, उपरोक्त आधार पर जचककत्सा व्यय की प्रजतपूर्तम प्राप्त कर सकत े ह।ैं 12. सीिीएचएस द्वारा जिधारम रत दरों के अिुसार रु.4,000/- और उससे अजधक की लागत िाले ककसी भी परीक्षण को एक प्रमुख परीक्षण मािा िाएगा और ऐसे परीक्षणों की प्रजतपूर्तम प्रत्यके िणे ी के कमचम ारी के जलए आउिडोर उपचार प्राप्त करिे के जलए जिधामररत िार्र्कम सीमा के अजतररक्त होगी, बिते कक लाभाथी अपिा उपचार सीिीएचएस अस्ट्पताल और डायग्नोजस्ट्िक सेंिर/लबै की सचू ी में उजल्लजखत सरकारी/मान्यता प्राप्त अस्ट्पताल/डायग्नोजस्ट्िक सेंिर में ककया । यकद की गई परीक्षण दर सीिीएचएस द्वारा जिधामररत सूची के अिसु ार िहीं है, तो एम्स द्वारा जिधामररत सचू ी दरों पर जिचार ककया िाएगा। यकद, सीिीएचएस या एम्स द्वारा जिधामररत दरों पर िहीं ककया गया हो तो, ककए गए खचम की प्रजतपूर्तम िास्ट्तजिक आधार पर की िाएगी।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7 13. अजधकारी/कममचारी ककसी भी डेंिल सििम से 'मिे र डेंिल उपचार' करा सकता ह।ै 'मेिर उपचार' में अन्य बातों के साथ-साथ जिम्नजलजखत प्रकृजत के उपचार िाजमल होंगे और उिकी प्रजतपूर्तम प्रत्येक के अिरुु प गए अजधकतम िुल्क या िास्ट्तजिक व्यय, िो भी कम हो, पर की िाएगी:- क. फ्लैप सिमरी- पूरा िबड़ा रु. 20,000/- ख. िबड़े के फ्रैटचर का कफटसेिि रु. 5,000/- ग. ट्यमू र एटसीजि रु. 4,000/- घ. िबड़े का ररसेटिि रु. 12,000/- ङ. फूल डेन्चर रु. 8,000/- 14. कृजत्रम उपकरणों की खरीद की प्रजतपर्ू त म जिजभन्न कृजत्रम उपकरणों की खरीद/प्रजतस्ट्थापि/मरम्मत/समायोिि के जलए की गई व्यय की प्रजतपूर्तम, स्ट्िास्ट््य एिं पररिार कल्याण मंत्रालय द्वारा कदिाकं 08/07/2014 को िारी कायामलय ज्ञापि और इस संबंध में केंद्र सरकार के बाद के आदेिों/कदिाजिदेिों, यकद कोई हो, द्वारा जियंजत्रत की िाती ह।ै पोजलयो िैसी बीमाररयों के मामले में, िहाँ ककसी बच्चे को कोई उपकरण लगाया िाता ह,ै जिसे बच्चे के बढ़िे या प्रभाजित जहस्ट्से में सुधार होिे पर समय-समय पर पुिः समायोजित या प्रजतस्ट्थाजपत करिा पड़ता ह,ै ऐसे रोजगयों के मामले में बूि (ितू े) की लागत की प्रजतपूर्तम की अिमु जत है, यकद अस्ट्पतालों म ें संबंजधत जििेर्ज्ञता के जििेर्ज्ञ द्वारा इसे आिश्यक प्रमाजणत ककया गया हो। 15. अन्य ित ें i. सीएस (एमए) जियम, 1944 के जियम 2 (एच) (iii) की अिसु चू ी I और II में जिर्दमष्ट अस्ट्िीकायम दिाएं प्रजतपूर्तम योग्य िहीं ह।ैं ii. आयोग में सक्षम प्राजधकारी को ककसी भी दािे या दाि ेके भाग को िो अपेजक्षत ितम परू ा िहीं करता हो, अस्ट्िीकार करिे का अजधकार ह।ै iii. आयोग के ककसी कमचम ारी या उसके पररिार के ककसी सदस्ट्य को रांसप्लांिेिि के जलए अंग दाि करिे िाले व्यजक्त की सिरम ी और िल्य जचककत्सा के बाद की देखभाल पर हुए व्यय की प्रजतपूर्तम सीिीएचएस में जिधामररत दर के अिसु ार या िास्ट्तजिक के अिसु ार, िो भी कम हो, की िाएगी। iv. जचककत्सा दािों की प्रजतपूर्तम के कारण होिे िाले व्यय की जिगरािी जतमाही आधार पर की िाएगी, जिसके जलए उस जििर्े िर्म के जलए जचककत्सा व्यय (इिडोर और आउिडोर उपचार) के जलए बििीय प्रािधाि के एक-चौथाई के बराबर राजि का बेंचमाकम लागू ककया िाएगा। ककसी जििेर् माह में उपयुमटच बचें माकम सीमा से अजधक होिे की जस्ट्थजत में आयोग का अध्यक्ष ऐसे व्यय को मिं ूरी दिे े के जलए सक्षम प्राजधकारी होगा। 16. एम्बलु सें िल्ु क प्रसूजत या गंभीर बीमारी के आपातकालीि मामलों या चोि के मामले में अस्ट्पताल में भती होिे के जलए एम्बुलसें िुल्क की प्रजतपूर्तम की िाएगी। यकद आपातकालीि जस्ट्थजत में या एम्बुलसें की अिपु लब्धता के कारण रोगी को ले िािे के जलए िैटसी िसै े साििम जिक पररिहि का उपयोग ककया गया ह,ै तो भुगताि ककए गए िास्ट्तजिक िल्ु क की प्रजतपूर्त मकी िाएगी। 17. गभािम स्ट्था की जचककत्सकीय समाजप्त गभामिस्ट्था के जचककत्सीय समापि पर ककए गए व्यय का पूणरूम प से प्रजतपूर्तम की िाएगी, बिते कक यह जचककत्सीय गभमपात अजधजियम, 1971 के तहत मान्यता प्राप्त या अिुमोकदत सरकारी/अन्य अस्ट्पतालों में ककया गया हो। 18. िार्र्कम जचककत्सा स्ट्िास्ट््य िाचँ िेईआरसी के 40 िर्म से अजधक आयु के अजधकारी एिं कमचम ारी, मान्यता प्राप्त अस्ट्पताल से एक जित्तीय िर्म में िार्र्कम जचककत्सा िाचं करा सकते ह।ैं इस पर होिे िाले व्यय की प्रजत पूर्तम जिजियमि 4 में जिधामररत समग्र सीमा के अधीि की िाएगी। इस योििा में, जिम्नजलजखत पकै ेि दरें लागू होंगी:- िार्र्कम जचककत्सा िांच की दर मजहला अजधकारी एिं कमचम ारी - रु. 10,000/- पुरुर् अजधकारी एिं कममचारी - रु. 7,500/- 19. समीक्षा करि ेकी िजक्त इि जिजियमों की समीक्षा करिे का अजधकार आयोग को होगा।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 20. व्य ाख्य ा यकद इि जिजियमों के अतं गतम जचककत्सा सहायक या उपचार में ककसी सेिा को िाजमल ककए िाि े के संबंध में कोई प्रश्न उठता ह ै तो इि जिजियमों की व्याख्या के संबंध में इसे आयोग को भिे ा िाएगा जिसका जिणयम अंजतम होगा। 21. जिजियमों पर जियत्रं ण िहाँ आयोग के अध्यक्ष का यह जिचार हो कक ऐसा करिा आिश्यक या समीचीि है, िहाँ िह कारणों को जलजखत रूप में दिम करके इि जिजियमों के ककसी भी प्रािधाि में छूि दे सकता ह।ै 22. सामान्य i. मान्यता प्राप्त अस्ट्पताल/ डायग्नोजस्ट्िक सेंिर आिश्यक दिाएँ और मािक गुणित्ता की सभी जडस्ट्पोिेबल जिजिध िस्ट्तएु ँ प्रदाि करेंगे और इसे इस आयोग के कमचम ाररयों के माध्यम से िहीं खरीदा िाएगा। ii. ऐसी सेिा से उत्पन्न होिे िाली ककसी भी काििू ी देयता का जिपिारा अस्ट्पताल/डायग्नोजस्ट्िक सेंिर द्वारा ककया िाएगा और यह पूरी तरह से उिकी जिम्मेदारी होगी। iii. इि जिजियमों में िाजमल ि होिे िाले सभी मामलों के जलए सीएस (एमए) जियम / सीिीएचएस में जिधामररत प्रािधाि लाग ू होंगे। iv. सीएस (एमए) जियम 1944/सीिीएचएस के संबंध में केन्द्र सरकार द्वारा समय-समय पर िारी ककए गए कोई भी कदिाजिदेि/जियम, उिके िारी होिे की जतजथ से इस आयोग पर स्ट्ितः ही लागू होंगे। v. सुजिधाओं के दरुु पयोग होिे पर ककसी भी समय सुजिधाएँ िापस ली िा सकती ह।ैं vi. कमचम ारी/पजत/पत्नी/आजित (समय-समय पर संिोजधत केंद्रीय सिे ा (जचककत्सा सहायक) जियम, 1944 में पररभाजर्त) द्वारा प्रस्ट्ततु दािों की जििुद्धता या अन्य के संबंध में ककसी भी संदहे के मामले में, िेईआरसी को अपिे कमचम ारी को जिदिे देिे का अजधकार होगा। इसके जलए कमचम ारी को िईे आरसी पिै ल में िाजमल अस्ट्पताल के अजधकृत मेजडकल प्रैजटिििर (एएमपी) के समक्ष उपजस्ट्थत होिा होगा और जियुक्त एएमपी पैिल में िाजमल अस्ट्पताल से दसू री राय प्राप्त होिे तक कोई प्रजतपूर्तम िहीं की िाएगी। vii. िेईआरसी के पास अपिे प्राजधकृत प्रजतजिजध के माध्यम से संबंजधत अस्ट्पताल के ररकाडों का जिरीक्षण करिे का अजधकार भी ह ै िहाँ कमचम ारी/उसके आजित (समय-समय पर संिोजधत केंद्रीय सेिा (जचककत्सा सहायक) जियम, 1944 में यथा पररभाजर्त) को उपचार के जलए भती ककया था। viii. यकद, मेजडकल बोडम की जसफाररिों के आधार पर या अन्यथा यह पाया िाता ह ै कक ककसी कममचारी द्वारा सुजिधा का दरुु पयोग ककया गया ह,ै तो उसे जचककत्सा लाभ से तुरंत िंजचत ककया िा सकता ह ै और जियमों के अिसु ार या उजचत समझ े िािे पर कारमिाई की िा सकती ह।ै . ix. िेईआरसी के पास इि जिजियमों के कदिाजिदेिों को आंजिक या पणू म रूप से संिोजधत करिे का अजधकार ह।ै एस.डी. िमाम, सजचि (प्रभारी) [जिज्ञापि-III/4/असा./696/2024-25] अिलु ग्नक -I जचककत्सा दाि े(आईपीडी उपचार) के जलए आिदे ि पत्र िईे आरसी के कमचम ारी या उिके आजित पररिार के सदस्ट्यों का अस्ट्पताल म ें उपचार/परीक्षण िाचँ के जलए जचककत्सा सहायक /उपचार के सबं धं म ेंककए गए जचककत्सा के खचों की िापसी का दािा करि ेके जलए आिदे ि पत्र: 1. कमचम ारी का िाम और पदिाम (स्ट्पष्ट अक्षरों में) : i. जििाजहत या अजििाजहत : ii यकद जििाजहत ह,ैं तो िह स्ट्थाि िहां पत्नी/पजत कायमरत ह ैं : 2. मौजलक जियमों के अन्तगतम पररभाजर्त कममचारी का िते ि और कोई अन्य : पररलजब्धयां जिन्ह ेंअलग से दिायम ा िािा चाजहए 3. ितमम ाि पता :[भाग III—खण् ड 4] भारत का िह हकदार था, उपलब्ध िहीं था) i भोिि : i. सर्िकम ल ऑपरेिि या मेजडकल ररिमेंि या कन्फॉइिमेंि : ii. पैथोलॉजिकल, बटै िीररयोलॉजिकल, रेजडयोलॉजिकल या अन्य समाि : परीक्षण क. उस अस्ट्पताल या प्रयोगिाला का िाम िहां परीक्षण और िाचं की गई; और : ख. टया यह अस्ट्पताल में इस मामले के प्रभारी जचककत्सा अजधकारी/एएमए की : सलाह पर ककया गया ह,ै यकद हा ँतो इस संदभम में िारी प्रमाण पत्र/मेजडकल प्रेिकक्रप्िि संलग्न ककया िाए। v दिाइयाँ : vi. जििेर् दिाए ँ : : (कैि ममे ो और आिश्यक प्रमाणपत्र/डॉटिर की सलाह संलग्न की िाए) vii. साधारण िर्सिंग : viii. जििेर् िर्सिंग, अथामत् िे िसें, जिन्ह ें जििेर् रूप से मररिों के जलए : जियुक्त ककया िाता ह।ै बताएँ कक टया उन्ह ें अस्ट्पताल में इस मामले के प्रभारी जचककत्सा अजधकारी की सलाह पर या कमचम ारी या रोगी के अिरु ोध पर तिै ात ककया गया ह।ै अतः मामले के प्रभारी जचककत्सा अजधकारी द्वारा प्राप्त प्रमाण पत्र और अस्ट्पताल के जचककत्सा अधीक्षक द्वारा प्रजतहस्ट्ताक्षररत प्रमाण पत्र संलग्न ककया िाए। ix एम्बुलेंस का िुल्क: : ix. Short Title, Extent of Application and Commencement i. These regulations may be called the Joint Electricity Regulatory Commission (Medical Facility) Regulations, 2024. ii. These shall apply to all the employees of the Commission on regular appointment, deputation or short- term contract, retired employees and their families excluding the Chairperson and Members of the Commission. iii. These Regulations shall come into effect from the date of publication in the official Gazette. 2. Definitions In these Regulations, unless the context otherwise requires: - i. “Authorised/Notified Medical Practitioner” means a registered medical practitioner having a degree recognized under the Indian Medical Council Act, 1956 as amended from time to time, or a Registered Medical Practitioner holding Degree or Diploma in Ayurveda/Unani/Siddha/Homeopathy of not less than 4 years duration from a University/Statutory Board/Council/Faculty of Indian Medicine and Homeopathy and equivalent, included in the Schedules of Indian Medicine Central Council Act, 1970/Homeopathy Central Council Act, 1973, as the case may be and registered with the State Medical Council. ii. “Commission” means Joint Electricity Regulatory Commission (For the State of Goa & UTs)14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] iii. “Controlling Officer” means Secretary of the Commission or any other officer to whom such powers may be delegated by the Commission for the purpose of these Regulations. iv. “Employee” means any person appointed by and on the rolls of the Commission, who is allowed to avail the benefit under these regulations by the Joint Electricity Regulatory Commission and also includes the employees who have superannuated (at the age of 60 or as decide by the Central Government) from the Commission, having rendered service of not less than 5 years, after being permanently absorbed in the Commission." Employees in case of his/her retirement on medical incapacitation before superannuation shall also be eligible to avail the benefit under these regulations. Employees in case of his/her voluntary retirement by giving notice of not less than three months in writing to the Commission after he/she rendered more than 20 years of service in PSUs/Government/Autonomous Body /Statutory body etc. as a regular Employee, put together as on date of voluntary retirement and must have also put a minimum of 05 years of service in this Commission. v. “Family” means the employee’s spouse, parents, unmarried sisters, minor /unmarried brothers, widowed daughters, widowed sisters, children and step children (including legally adopted children) wholly dependent upon the employee as per provisions of CS (MA) Rules of Govt. of India as amended from time to time. vi. “Patient” means an employee of the Commission or their family members to whom these Regulations apply and who is in need of medical attendance and treatment. vii. The members of the family shall also be entitled to medical attendance and treatment even if they do not stay with the employee. viii. “CGHS beneficiary” may avail CGHS facility as per CGHS Rules and shall not be entitled to these facilities. ix. The medical facilities can be availed only if the retired employee and his/her spouse are not availing any medical facilities from or through the Central/State Government/Public Sector Undertaking/ other authority etc. x. Medical facilities to the employee and his / her dependent family members (as defined in the Central Services (Medical Attendance) Rules, 1944 as amended from time to time) will be admissible for the treatment undergone only in India or otherwise stated specifically. xi. “Empanelled Hospital and Diagnostic Centre” means the Government Hospitals/Diagnostic Centres including all recognised Private Hospital/Diagnostic Centres under CGHS for Specialised and General-Purpose Treatment and Diagnostic Procedures recognised vide Ministry of Health & Family Welfare as amended from time to time or any private Hospital/Diagnostic Centre notified/authorised by the Joint Electricity Regulatory Commission. Any changes subsequently made shall automatically apply to the beneficiaries. xii. “Treatment” means the use of all medical and surgical facilities available at the hospital in which the employee is treated and includes: - a. The services of such pathological, bacteriological, radiological, advance technology method or other methods as are considered necessary by the authorised medical attendant; b. The supply of such medicines, vaccines, sera or other therapeutic substances as are ordinarily available in the hospital and as are admissible under CS (MA) Rules; c. The supply of such medicines, vaccines, sera or other therapeutic substances not ordinarily so available as the authorised medical attendant may certify in writing to be essential for recovery or for the prevention of serious deterioration in the condition of an employee except the items mentioned below, namely: - i. preparations which are not medicines but are primarily foods, tonics, toilet preparations or disinfectants and expensive drugs, tonics, laxatives or other elegant and proprietary preparations as specified in Schedule I; and ii. expensive drugs, tonics, laxatives or other elegant and proprietary preparations as specified as Schedule II for which drugs of equal therapeutic value are available. d. A list of Ayurvedic, Unani, Siddha and Homoeopathic medicines for which a refund is admissible is also given in the same Appendix as Schedule III.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 15 e. Such accommodation as is ordinarily provided in the hospital as per entitlement as laid down in Regulation 8. f. Physiotherapy and other treatments associated with an integrated system of medicine including, allopathy, Homeopathy, ayurvedic, Unani and Siddha system; g. Such nursing as is ordinarily provided to in-patients by the hospital; and h. The specialist consultation is described in these regulations but does not include diet or provisions at the request of the employee or accommodation superior to that described in Regulation 8 . 3. A list of Authorised Medical Practitioners will be prepared and maintained by the Commission, area-wise, on the request of the employees and based on relevant documentary proof including prescription with the registration number of the concerned Registered Medical Practitioner. If an employee is receiving OPD treatment from the empanelled hospital with this Commission /CGHS- recognised hospital (after getting the referral from his AMA), the attending doctor of that empanelled hospital will also be treated as a deemed authorised/Notified Medical Practitioner for the Commission. 4. Procedure for availing outdoor treatment i. The officers and staff/retired/superannuated employees of this Commission, will be entitled for reimbursement of medical expenses for OPD treatment for themselves and their family members including dependents with the annual limits based on the last cell of the corresponding pay matrix in which they are /were working, applicable from April to March every financial year on production of prescription from authorised/notified Medical Practitioners along with bills/cash memos of medicine/test & Investigations. ii. This annual limit is not inclusive of the expenses incurred on major tests such as MRI, CT scan, Angiography etc. which will be reimbursable on an actual basis or the limits laid down by CGHS, whichever is lower. iii. The annual ceiling amounts indicated above can be claimed on production of medical bills/cash memos as per proforma at Annexure-II. 5. Procedure for availing indoor treatment i. Employees/Retired Employees and their dependants may take indoor treatment from the empanelled hospitals mentioned in CGHS list issued from time to time or the hospitals or any private Hospital/Diagnostic Centre notified/authorised by the Joint Electricity Regulatory Commission and the expenses incurred by the employees in this regard will be reimbursed by the Commission to the employee as the case may be, subject to admissibility and rates prescribed in the CGHS as amended from time to time. ii. In case treatment is obtained from any private hospital/nursing home (i.e. other than hospitals mentioned in the CGHS list issued from time to time by the MoHFW or Hospitals authorised by the Commission) in an emergency the reimbursement for such treatment will be limited to the rates prescribed in CGHS or actual expenses incurred, whichever is less. iii. The employees of the Commission shall be entitled for medical treatment including the cost of treatment, pathological, radiological, scanning, hospital accommodation, nursing home facilities etc. as per the package rates prescribed by the Ministry of Health and Family as amended from time to time. iv. The employees of the Commission may get medical treatment in any of the empanelled hospital/diagnostic centre on the advice of Authorised/Notified Medical Practitioner/attending physician. However, in case of emergency they may directly go to any private or recognised private hospital/diagnostic centre nearest to their place of residence. v. The charges paid for clinical tests, etc, to a private non-recognised hospitals/diagnostic centre shall be reimbursable as per rates prescribed for CGHS beneficiaries. Where there are no rates prescribed, the expenses incurred shall be reimbursed on actual basis. vi. If during treatment in an empanelled hospital/diagnostic centre, special nursing becomes necessary, the employee or a member of his family shall be entitled to such special nursing as may be deemed essential for the recovery or for the prevention of serious deterioration in the condition of the patient having regard to the nature of the disease. The amount to be reimbursed for such special nursing shall be limited to the amount, which is in excess of 25% of the pay of the employee concerned for the period for which special nursing was necessary. For this purpose, a16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] certificate from the Medical Officer-in-charge countersigned by the Medical Superintendent shall be produced. vii. The beneficiaries (employee/retired employee of JERC) who have subscribed to Medical Insurance Policies in addition to availing CGHS facilities / Central Services (Medical Attendance) Rules, 1944, may be allowed to claim reimbursement from both the sources subject to the condition that the reimbursement from such sources should not exceed the total expenditure incurred by the beneficiary on the treatment. If the medical claim against the original vouchers/bills is raised by the beneficiary first from the insurance company, then the insurance company will issue a certificate indicating the amount reimbursed to the beneficiary. The insurance company concerned will retain the original vouchers/bills in such cases. The beneficiary would then prefer his/her remaining medical claim along with photocopies of vouchers/bills duly certified by him/her, along with a stamp of the insurance company on the reverse of the vouchers / bills to the JERC. Reimbursement to the beneficiary shall be restricted only to the admissible amount as per approved rates subject to the condition that the total amount reimbursed by the two entities (Insurance Company & JERC) does not exceed the total expenditure incurred by the beneficiary viii. Package rates for the duration of indoor treatment are as follows: a. 12 days for specialized procedure. b. 7-8 days for other procedures. c. 3 days for laparoscopic surgery. d. 1 day for day care/minor procedures (OPD). 6. Procedure for application for registration/renewal of medical card for retired employee: - i. An employee who is willing to avail the medical benefits for self/spouse/dependants (as defined in the Central Services (Medical Attendance) Rules, 1944 as amended from time to time) after retirement shall submit an option within a period of three months prior to the date of superannuation/Voluntary retirement/retirement on Medical Incapacitation from the Commission as per format specified in ‘Annexure III’. Provided that in case of death of an employee prior to his/her superannuation, the dependents of such employee can opt for these medical facilities. ii. Such employee/dependent shall be registered by issuing medical card as per format specified in ‘Annexure IV’ within one month from the date of application. The medical card issued shall be valid for a period of five years from the date of superannuation or death of the employee, as the case may be. iii. Provided that in case of any change in the family (as defined in the Central Services (Medical Attendance) Rules, 1944 as amended from time to time) details, the same shall be intimated immediately to this Commission, in writing, who shall on receipt of such intimation issue a modified medical card within one week. iv. The Medical card shall be renewed every five years. The employee/ dependents (as defined in the Central Services (Medical Attendance) Rules, 1944 as amended from time to time) shall be required to apply for renewal within three months prior to the expiry of the medical card (as per format in Annexure IV) to the Secretary, JERC, who shall within a period of one month of the application convey the approval of renewal by issuance of a new medical card. v. In the event of death of the employee after retirement, the spouse and other eligible dependant member of the family (as defined in the Central Services (Medical Attendance) Rules, 1944 as amended from time to time) may continue to avail the facility. vi. The Medical Card shall be rendered invalid from the date any of the eligibility conditions ceases to be fulfilled by the employee or his/her dependant (as defined in the Central Services (Medical Attendance) Rules, 1944 as amended from time to time). 7. Advance for Medical Treatment i. All expenses on indoor treatment shall initially be met by the employee himself and shall claim for medical reimbursement on completion of the treatment. However, on the request of the employee, the competent Authority, JERC may grant an advance to enable him/her initially to meet expenditure on medical attendance and treatment for himself/herself and members of his/her family in the following cases subject to production of a valid prescription and estimate by AMA/CGHS empanelled Hospital, after obtaining approval from the Commission. a. For indoor treatment at a hospital b. For OPD treatment in the case of TB/Cancer[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 17 ii. The amount of advance shall not exceed 90% of the amount estimated by the treating AMA or demanded by such hospital. iii. The advance paid to the employee shall be adjusted against the medical claim and balance, if any, shall be refunded forthwith. iv. Normally the recognised private hospitals/diagnostic centres who entered into agreement with the Commission shall charge the rates approved for the package rate. They shall also extend credit facilities in emergency cases and submit the bill for reimbursement as per approved rates to the Commission. However, in case of hospitals/ diagnostics centres insisting on immediate payment of the cost of treatment, room rent, medicines, various test, etc., the Commission may sanction advance payment to the extent of 90% of approximate expenses as per package rate prescribed for CGHS beneficiaries and issue an account payee Cheque either in the name of the hospital concerned or beneficiary. The balance payment shall be made on submission of final claim by the beneficiary. 8. Accommodation Entitlement of wards for various categories of officers/officials for indoor treatment in Private Empanelled Hospitals will be as follows: - SI. Final claims for reimbursement of medical expenses for a particular spell of illness shall ordinarily be preferred within three (3) months, from the date of completion of the treatments. ii. All claims for reimbursement should be accompanied with the doctor’s prescription, chemist’s cash memo, doctors/hospital receipt in respect of consultations/medicines etc. (as required under these Regulations), shall be submitted along with the claim form. iii. The application for medical claims for Indoor/IPD treatment shall be submitted in the prescribed form given at Annexure-I. iv. The application for medical claims for OPD treatment shall be submitted in the prescribed form given at Annexure-II. v. Claim for outdoor treatment in respect of retired employee may be preferred once in a month. vi. All expenses on indoor treatment shall initially be met by the employee himself and shall claim for medical reimbursement on completion of the treatment. vii. CGHS beneficiaries will submit their medical claims as per CGHS rules. viii. An intimation in writing (through email, fax, etc.) regarding retired employee or his/her dependant (as defined in the Central Services (Medical Attendance) Rules, 1944 as amended from time to time) for serious illness needing hospitalization to be sent to the Secretary, JERC within 72 hours of the hospitalization. ix. The employee shall submit the medical claim in the prescribed format with all relevant supporting vouchers/documents ‘in original’, to the JERC within three months from the date of discharge. The Administration division of JERC shall verify and ensure, before accepting the claim papers that all relevant documents are enclosed and issue a dated acknowledgement to the claimant in token of receipt of the medical claim. x. If any deficiencies / gaps are found in the medical claim documents/papers, the JERC, shall retain the papers and communicate the list of deficiencies /observations to the employee for removing the deficiencies/shortcomings within one month from the date of the receipt of medical claim. The medical claim may also be returned in original to the beneficiary, if it is absolutely necessary for doing the needful to remove the deficiencies. xi. The medical claim should be scrutinized and processed as per this Medical Regulations of JERC. The amount found admissible may be passed for payment, subject to conditions as stated above. The payment shall be credited online in the Bank Account of the beneficiary within three months by Accounts Division, JERC (excluding the time taken by the beneficiary in attending18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] the deficiencies / shortcomings, if any, in medical claim) from the date of the receipt of the medical claim. 10. When both Husband and Wife are in service In case where both husband and wife are in service and eligible for medical facilities from their respective employer, they, as well as eligible dependants, may be allowed to avail of the medical concessions facility according to his/her status. For this purpose, they should furnish to their respective authorities a joint declaration as to who will prefer the claim for reimbursement of medical expenses incurred on the medical attendance and treatment in respect of wife/husband and the children. The above declaration should be submitted in duplicate and a copy of each shall be recorded in the personal file of each of them in their respective office. This declaration shall remain in force till such time as it is revised on the express request in writing by both the husband and the wife, e.g., in the event of promotion, transfer, resignation, etc., of either of the two. 11. Cases where the family stays outside Headquarters (Station) i. Where the family of the employee does not reside at the same place where the employee is posted, they may avail of medical treatment and the expenditure incurred on such treatment shall be reimbursed by the Commission subject to the ceilings prescribed in the Regulations. ii. Employees or members of their families falling ill at a place other than his/her headquarters, or employees falling ill during official tours, are entitled to reimbursement of medical expenses on the same basis as above. 12. Any test costing Rs.4,000/- and above as per rates prescribed by CGHS shall be treated as a major test and reimbursement of such tests shall be in addition to the annual limit prescribed for each category of employee for availing outdoor treatment provided it has been performed at Govt./recognized hospital/diagnostic centres mentioned in CGHS list of Hospital & Diagnostic Centres/Lab. In case, the test is not prescribed as per CGHS rate list, the rates prescribed by the AIIMS list will be taken into consideration. Where, there is no rate prescribed either in CGHS or AIIMS lists, the expenses incurred shall be reimbursable on actual basis. 13. Officers/officials shall be entitled to have ‘major dental treatment’ from any dental surgeon. ‘Major treatment’ shall, inter alia, include treatment of the following nature and reimbursement thereof shall be at maximum charges indicated against each or actual expenditure, whichever is less:- a. Flap Surgery- full mouth Rs. 20,000/- b. Fixation of fracture of Jaw Rs. 5,000/- c. Tumor Excision Rs. 4,000/- d. Resection of Jaw Rs. 12,000/- e. Full denture Rs. 8,000/- 14. Reimbursement of purchase of artificial Appliances Reimbursement of expenses for purchase/ replacement/repair/ adjustment of various artificial appliances will be governed by the office memorandum issued by MoH&FW dated 08.07.2014 and subsequent orders/ guidelines, if any, of the Central Government, in this regard. In the case of diseases like Polio, where an appliance is fitted to a child, which has to be readjusted or replaced periodically as the child grows or the affected part improves, reimbursement of cost of boot (shoe) in the case of such patients is permissible if certified as essential by a specialist in the concerned speciality in the hospitals. 15. Other Conditions i. Inadmissible medicines as specified in Schedules I and II of Rule 2(h) (iii) of the CS (MA) Rules, 1944 are not reimbursable. ii. The competent authority in the Commission shall be empowered to disallow any claims or part of the claim which does not satisfy the required condition for such claim. iii. Expenses incurred on the surgery and post-operative care of the donor of an organ for transplantation to an employee of the Commission or to a member of his family shall be reimbursed as per rate prescribed in CGHS or as per actual whichever is less. iv. The expenditure on account of reimbursement of medical claims shall be monitored quarterly by applying the benchmark of an amount equivalent to one-fourth of the budgetary provision for medical expenses (for indoor as well as outdoor treatment) for that particular year. In the[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 19 event of such expenditure exceeding the aforesaid benchmark ceiling in any particular month, the Chairperson of the Commission shall be the competent authority to approve such expenditure in excess of the benchmark ceiling. 16. Ambulance Charges Ambulance charges for admission to the hospital in case of maternity or serious illness, emergency cases or injury shall be reimbursed. In case public transport such as Taxi has been used to carry the patient in emergency or non-availability of Ambulance, actual charges paid shall be reimbursed. 17. Medical termination of pregnancy The expenditure incurred on medical termination of pregnancy shall be reimbursed in full provided it has been performed at Govt./other hospitals recognized or approved under the Medical Termination of Pregnancy Act 1971. 18. Annual Medical Health check-up The officers and staff of JERC above 40 years of age, may undergo an annual medical examination in a financial year from a recognised hospital. The expenditure on this will be reimbursed subject to the overall ceiling laid down in Regulation 4 . In this scheme, the following package rates will be applicable:- Rate of Annual Medical Examination Female Officer and Staff - Rs. 10,000/- Male Officer and Staff - Rs. 7,500/- 19. Power to review The power to review these Regulations shall vest with the Commission. 20. Interpretation If any question arises as to whether any service is included in medical attendance or treatment under these Regulations as to the interpretation of these Regulations, it shall be referred to the Commission whose decision thereon shall be final. 21. Power to relax Where the Chairperson of the Commission is of the view that it is necessary or expedient so to do, he may, for reasons to be recorded in writing, relax any of the provisions of these Regulations. 22. General i. The recognised hospitals/diagnostic centres will provide necessary medicines and all disposable sundries of standard quality and will not get them purchased through employees of this Commission. ii. Any legal liability coming out of such service shall be dealt by the hospital/diagnostic centre and it shall be their responsibility alone. iii. For all matters which are not covered in these Regulations, the provisions laid down in the CS (MA) Rules / CGHS will be applicable. iv. Any guidelines/rule position issued by the Central Govt. regarding CS (MA), Rules, 1944/CGHS from time to time, will automatically be applicable on this Commission, from the date of their issuance. v. The facilities shall be liable to be withdrawn at any time for misuse or abuse of the facility. vi. In case of any doubt regarding the genuineness or otherwise of the claims preferred by the employee/spouse/dependant (as defined in the Central Services (Medical Attendance) Rules, 1944 as amended from time to time), the JERC reserves the right to direct the employee to be present before an Authorized Medical Practitioner (AMP) of JERC / empanelled hospital and no reimbursement shall be made till the second opinion is received from the appointed AMP / empanelled hospital. vii. The JERC also reserves the right to inspect the records of the Hospital concerned where the employee/his or her dependant (as defined in the Central Services (Medical Attendance) Rules, 1944 as amended from time to time) was admitted for undertaking treatment, through its authorized representative.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] viii. If, on the basis of recommendations of the Medical Board or otherwise it is found that there is misuse of the facility by any employee, he /she may be summarily debarred from the medical benefits and action may be taken as per rules or as deemed fit. ix.
