(क) प्रासंजगकता के जिजिि मुद्दर पर जििेर्ज्ञ सलाह प्रदाि करिा और आयोग की सहायता करिा; या (ख) सिोत्तम प्रथाओं का अध्ययि करिा, डेटा का जिश्लेर्ण करिा, बेंचमाकि जिकजसत करिा, या कोई अन्य समाि उद्देश्य; या (ग) ऐस े कायों के जिष्पादि के जलए अिुभि और योग्यता की आिश्यकता होती ह ैिो या तो आयोग के भीतर उपलब्ध िहीं ह ैं या, आयोग की राय म,ें परामिी की जियुजक्त गुणित्ता, समय या दकसी अन्य के संदभि म ेंकायि को पूरा करिे का अजधक प्रभाििाली और कुिल तरीका होगा; या (घ) आयोग को उसके कायों को करिे म ें सहायता करिा, यदद आयोग इस बात से संतुि ह ै दक आयोग म ें काम की मा्ा में िृजि हुई ह ैया जिजभन्न बाधाओं के कारण जियजमत पद िहीं भरे िा सके ह।ैं '' 4. सिं ोधि जिजियमर के जिजियम 7 म ेंसिं ोधि संिोधि जिजियम, 2015 का जिजियम 7ख जिरस्ट्त दकया िाता ह।ै 5. मलू जिजियमर के जिजियम 8 म ेंसिं ोधि:- मूल जिजियमर के जिजियम 8 स ेसंलग् ि ताजलका को जिम्नजलजखत ताजलका स ेप्रजतस्ट्थाजपत दकया िाएगा:- िग ि अिभु ि कजिष्ठ परामिी/ ठरसचि एसोजसएट िून्य से तीि िर् ि तक परामिी/ अिुसंधाि अजधकारी तीि से दस िर्ि तक िठरष्ठ परामिी/ िठरष्ठ अिुसंधाि अजधकारी दस से पन्रह िर्ि तक सलाहकार/ प्रधाि अिुसंधाि अजधकारी* पन्रह िर् ि और उससे अजधक * इस श्रेणी म ेंकोई ऊपरी आय ुसीमा िहीं होगी। 6. मलू जिजियमर के जिजियम 10 म ें सिं ोधि मूल जिजियमर के जिजियम 10 के िीर्िक को जिम्नजलजखत से प्रजतस्ट्थाजपत दकया िाएगा:- '10. सस्ट्ंथागत परामर्ियिर की जियजुक्त 7. प्रथम सिं ोधि जिजियमर के जिजियम 18ख म ेंसिं ोधि प्रथम संिोधि जिजियम, 2015 के जिजियम 18ख को जिम्नजलजखत के साथ प्रजतस्ट्थाजपत दकया िाएगा:-[भाग III—खण् ड 4] भारत का रािप् : असाधारण 3 जिजियम 18ख परामिी का चयि (1) आयोग के सजचि आयोग की िेबसाइट और दो प्रमुख समाचार-प्र म ें िोठटस प्रकाजित करके और िहां तक संभि हो, इच्छुक व्यजक्तयर िारा आिेदि करिे के जलए न्यूितम दो सप्ताह की अिजध देकर आिेदि आमंज्त करेंगे। (2) िोठटस प्रकाजित करि े स े पहल,े सजचि जियजमत पदर के जिरुि भती को जियंज्त करि े िाले आयोग के जिजियमर के प्रासंजगक प्रािधािर या पठरकजल्पत कतिव्यर/ काय ि को पूरा करिे के जलए आिश्यक जििेर्ज्ञता को ध्याि म ेंरखते हुए योग्यता और अिुभि आिश्यकताओं की पहचाि करेगा। (3) परामिी को िै्जणक योग्यता, िर्ों की संख्या म ें कुल अिुभि, डोमेि जििेर्ज्ञता और प्रदेय उत् पाद के जलए आिश्यक ज्ञाि के अिरूु प जिम्नजलजखत श्रेजणयर में उजचत कायाित्मक पदिाम के साथ जियुक्त दकया िाएगा:- िग ि अिभु ि योग्यता (पणू ििर्ों म)ें कजिष्ठ परामिी/ ठरसचि एसोजसएट िून्य स े तीि िर्ि तक िैसा दक िोठटस िारी करत े समय काय िकी परामिी/ अिुसंधाि अजधकारी तीि से दस िर्ि तक आिश्यकता के अिुरूप जिणिय जलया िाए। िठरष्ठ परामिी/ िठरष्ठ अिुसंधाि अजधकारी दस स ेपन्रह िर्ि तक सलाहकार/ प्रधाि अिुसंधाि अजधकारी* पन्रह िर्ि और उससे अजधक *इस श्रेणी म ें कोई ऊपरी आयु सीमा िहीं होगी। (4) आयोग सीईसी का गिि करेगा जिसमें सजचि, जिदेिक िाजमल हरगे, जिसम ें उस कायि ््े का ज्ञाि रखिे िाले अजतठरक्त सदस्ट्य को िाजमल करि े का जिकल्प होगा जिसके जलए परामि ि सेिाए ं प्राप्त की िािी ह।ैं ऐस े मामले म ें िहा ं परामिी की जियुजक्त का प्रस्ट्ताि िठरष्ठ अिसु धं ाि अजधकारी या प्रधाि अिसु धं ाि अजधकारी के पद के बराबर ह,ै िहा ं सीईसी का िेतृत्ि आयोग के एक सदस्ट्य िारा दकया िाएगा। सीईसी उम्मीदिारर के साथ संिाद करेगा और आयोग की मंिूरी के जलए ऐसे परामर्िियर को भुगताि दकए िािे िाले िुल्क के साथ-साथ परामिी के रूप म ें जियुजक्त के जलए उपयुक्त व्यजक्तयर के िामर की जसफाठरि करेगा। (5) स्ट्टाफ परामिी को िुरुआत में दो िर्ि की अिजध के जलए जियक्तु दकया िाएगा। जियुजक्त की अिजध, उम्मीदिार के संतोर्ििक प्रदििि के आधार पर, प्रत्येक अिसर पर एक िर् ि तक की अिजध के जलए ब़ााई िा सकती ह,ै िो कुल जमलाकर पााँच िर्ि तक सीजमत ह।ै योग्य मामलर में, जपछले िर्ि के दौराि प्रदििि के आधार पर आयोग की मंिरू ी से िुल्क में 10% तक की िार्र्िक िृजि दी िा सकती ह।ै 8. अिसु चू ी म ेंसिं ोधि (व्यजक्तगत परामर्ियि र के जलए िल्ु क) अिुसूची के साथ संलग्ि ताजलका को जिम्नजलजखत ताजलका स ेप्रजतस्ट्थाजपत दकया िाता ह:ै- (क) दैजिक आधार पर जियुजक्त के मामले म ें िग ि प्रजत मािि ददिस अजधकतम िल्ु क* कजिष्ठ परामिी/ ठरसचि एसोजसएट रु. 2500/- परामिी/ अिुसंधाि अजधकारी रु. 3500/- िठरष्ठ परामिी/ िठरष्ठ अिुसंधाि अजधकारी रु. 6000/- सलाहकार/ प्रधाि अिुसंधाि अजधकारी रु. 10000/-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ख) माजसक आधार पर जियुजक्त के मामले म ें िग ि माजसक िल्ु क सीमा* (₹ म)ें ठरसचि एसोजसएट/ कजिष्ि परामिी 40000/- से 55000/- अिुसंधाि अजधकारी/ परामिी 55,000/- स े 90,000/- िठरष्ठ अिुसंधाि अजधकारी/ िठरष्ठ परामिी 80,000/- स े 1,25,000/- प्रधाि अिुसंधाि अजधकारी/ सलाहकार 1,20,000/- से 2,00,000/- *करर को छोड़कर, यदद लाग ूहो। एस. डी. िमाि, सजचि (प्रभारी), िेईआरसी [जिज्ञापि-III/4/असा./322/2023-24] ठटप्पणी:- (1) गोिा राज्य और संघ राज्य ्े्र के जलए संयक्तु जिद्युत जिजियामक आयोग (परामर्िियर की जियुजक्त) जिजियम, 2009 को ददिांक 15 फरिरी, 2010 के भारत के रािप् (असाधारण) के भाग III - खडं 4, सं. 47 म ें प्रकाजित दकया गया था। (2) गोिा राज्य और संघ राज्य ्े्र के जलए संयुक्त जिद्युत जिजियामक आयोग (परामर्िियर की जियुजक्त), (प्रथम संिोधि) जिजियम, 2015 को ददिांक 22 िििरी, 2015 के भारत के रािप् (असाधारण) के भाग III खंड 4, सं. 23 म ेंप्रकाजित दकया गया था। JOINT ELECTRICITY REGULATORY COMMISSION (For the State of Goa and Union Territories) NOTIFICATION Gurugram, the 27th July, 2023 JOINT ELECTRICITY REGULATORY COMMISSION FOR THE STATE OF GOA AND UNION TERRITORIES (APPOINTMENT OF CONSULTANTS) (SECOND AMENDMENT) REGULATIONS, 2023 No. JERC 8/2009.—In exercise of powers conferred under Section 91 (4) read with Section 181 of the Electricity Act, 2003 (36 of 2003) and all other powers enabling it in that behalf, and after previous publication, the Joint Electricity Regulatory Commission for the State of Goa and Union Territories hereby makes the following amendments in the Joint Electricity Regulatory Commission for the State of Goa and Union Territories (Appointment of Consultants) Regulations, 2009 and its First Amendment Regulations, 2015. 1. Short Title and Commencement: (i) These Regulations may be called the Joint Electricity Regulatory Commission (Appointment of Consultants) (Second Amendment) Regulations, 2023. (ii) These Regulations shall come into force from the date of their publication in official Gazette. 2. Amendment in Regulation 2 Definitions Insertion of sub-clause after (d) (e) Consultancy Evaluation Committee hereinafter referred to CEC means the Committee constituted under Regulation 18.[भाग III—खण् ड 4] भारत का रािप् : असाधारण 5 3. Amendment in Regulation 3 of the Principal Regulations Existing Regulation 3 shall be replaced with the following: - “3. Scope of Work (1) Consultants may be engaged for all or any of the following purposes, namely:- (a) providing expert advice on specific issues of relevance and assist the Commission; or (b) conducting study of best practices, analyzing data, developing bench marks, or any other similar purposes; or (c) performance of tasks requiring experience and qualifications which are either not available within the Commission or, in the opinion of the Commission, the engagement of consultant shall be a more efficacious and efficient method of completing the task in terms of quality, time or for any other consideration; or (d) assisting the Commission in performing their functions, if the Commission is satisfied that there has been increase in quantum of work in the Commission or regular posts could not be filled due to various constraints.’’ 4. Amendment in Regulation 7 of amendment Regulations Regulation 7 B of Amendment Regulations,2015 is repealed. 5. Amendment to Regulation 8 of the Principal Regulations: -\ The table appended to the Regulation 8 of the Principal Regulations shall be substituted with the following table: - Category Experience Junior Consultants/Research Associate Zero to upto Three Years Consultants/Research Officer Three to upto Ten Years Senior Consultants/Senior Research Officer Ten to upto Fifteen Years Advisors/Principal Research Officer* Fifteen Years and above *There shall be no upper age limit in this category 6. Amendment in Regulation 10 of the Principal Regulations Heading of Regulation 10 of principal regulation shall be substituted with the following: - ‘10. Engagement of Institutional Consultants’ 7. Amendment in Regulation 18 B of First Amendment Regulations Regulation 18 B of First Amendment regulations, 2015 shall be substituted with the following:- Regulation 18 B Selection of Consultant (1) The Secretary of the Commission shall invite applications by publishing notice on the Commission’s website and in two leading newspapers and by giving, as far as possible, a period of minimum two weeks for making applications by interested persons. (2) Before publishing the notice, the Secretary shall identify the qualification and experience requirements keeping in view the relevant provisions of the Commission’s Regulations governing the recruitment against regular posts or expertise required towards performing the duties/task envisaged. (3) The Consultant shall be engaged with appropriate functional designation, in the following categories, commensurate with the academic qualifications, total experience in number of years, domain expertise and knowledge required for the deliverables:- Category Experience Qualifications (in completed years) Junior Consultants/Research Associate Zero to upto three years As may be decided at the time of issue of notice, Consultants/Research Officer Three to upto commensurate with the Ten years requirement of work.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] Senior Consultants/Senior Research Ten to upto Fifteen years Officer Advisors/Principal Research Officer* Fifteen Years and above *There shall be no upper age limit in this category (4) The Commission shall constitute the CEC comprising the Secretary, Director(s) with an option to include additional member having knowledge in the area of work for which the consultancy services are to be obtained. In case where the Consultant proposed to be engaged is equivalent to the post of Senior Research Officer or Principal Research Officer, the CEC shall be headed by a Member of the Commission. The CEC shall interact with the candidates and recommend names of suitable persons for engagement as consultants along with fee to be paid to such consultants for approval of the Commission. (5) The Staff Consultant shall be engaged initially for a period of two years. The period of engagement may be extended, based on satisfactory performance of the candidate, by a period up to one year, on each occasion, limited to a total period of five years. In deserving cases, an annual escalation upto 10% on the fee may be given with the approval of the Commission based on the performance during the preceding year." 8.
