September, 2019 No. JERC: 1/2009.—In exercise of the powers conferred by Section 181 of the Electricity Act, 2003 (36 of 2003) and all other powers enabling the Commission in this behalf and after previous publication, the Joint Electricity Regulatory Commission for the State of Goa & Union Territories hereby makes the following amendments in the Joint Electricity Regulatory Commission for the State of Goa & Union Territories (Conduct of Business) Regulations, 2009 and as amended by 1st, 2nd, 3rd, & 4th amendment from time to time. 1. Short Title, Commencement and Extent (1) These Regulations shall be called the Joint Electricity Regulatory Commission for the State of Goa and Union Territories (Conduct of Business) (5th Amendment) Regulations, 2019. (2) These Regulations shall come into force from the date of their publication in official Gazette. (3) These regulations extend to the State of Goa and the Union Territories of Andaman & Nicobar Islands, Chandigarh, Dadra and Nagar Haveli, Daman & Diu, Lakshadweep and Puducherry. 2. The schedule of fees and charges under Regulation 68 of Chapter VIII of the Joint Electricity Regulatory Commission for the State of Goa & Union Territories (Conduct of Business) Regulations, 2009 and as amended by 1st, 2nd , 3rd & 4th amendment from time to time is amended as under:- SCHEDULE OF FEES & CHARGES Sl. No. DESCRIPTION FEES (IN RS) 1 Adjudication of dispute regarding Rs 20,000 (Rupees Twenty Thousand only) for the first 1 MW of availability of transmission facility transmission capacity sought and Rs 5,000 (Rupees Five Thousand under the second proviso to sub-section only) per MW thereafter, subject to a maximum of Rs 5,00,000 (2) of Section 9 of the Electricity Act, (Rupees Five Lakh only) 2003. 2 Initial licence fee upon grant of licence Rs 5,00,000 (Rupees Five Lakhs) as “on account” payment pending under Section 15 of the Act determination of fees by the concerned Government 3 Annual Licence Fees: 3(i) Transmission Licence inclusive Rs 2500/- (Rupees Twenty-Five hundred) per MW of transmission Integrated Utilities having network capacity contracts in force during the year or part thereof, subject to above 33kV a minimum of Rs 5,00,000 (Rupees Five Lakh only) 3(ii) Distribution Licence 0.15% (percent) of revenues (excluding taxes, and duties) from the proposed sales (as proposed by the petitioner) and at existing tariff (approved by the Commission) of electricity for that respective year 3(iii) Trading Licence: As per Clause 6.5 of JERC (Electricity Trading) Regulation, 2010 4 Application seeking prior approval 0.01% (Zero-point zero one percent) of the value of the transaction under Section 17 of the Act. for which approval is sought, subject to a minimum of Rs 5,00,000 (Rupees Five Lakh only) and maximum of Rs 20,00,000 (Rupees Twenty Lakh only) 5.
