L.-33004/99 सी.जी.-डी.एल.-अ.-31012024-251665 xxxGIDHxxx CG-DL-E-31012024-251665 xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 69] नई दिल्ली, बधु िार, िनिरी 31, 2024/माघ 11, 1945 No. 69] NEW DELHI, WEDNESDAY, JANUARY 31, 2024/MAGHA 11, 1945 भारतीय जिजिष्ट पहचान प्राजधकरण अजधसचू ना नई दिल्ली, 31 िनिरी, 2024 फा. स.ं एचक्य-ू 13073/1/2020-एयटू ीएच.II(ई).—आधार (जित्तीय और अन्य सहाजयदकयों, प्रसुजिधाओं और सेिाओं का लजययत पररिान) अजधजनयम, 2016 (2016 का 18) की धारा 54 की उप-धारा (1) और (2) द्वारा प्रित्त िजियों का प्रयोग करते हुए, भारतीय जिजिष्ट पहचान प्राजधकरण एतद्द्वारा आधार (अजधप्रमाणन के पालन हते ु फीस का भुगतान) जिजनयम, 2023 को संिोजधत करन े के जलए जनम्नजलजखत जिजनयम बनाता ह,ै नामत: :— 1. सजं िप्त नाम और प्रारंभ.—(1) इन जिजनयमों को आधार (अजधप्रमाणन के पालन हते ु फीस का भुगतान) संिोधन जिजनयम, 2024 कहा िाएगा। (2) य ेसरकारी रािपत्र में इनके प्रकािन की तारीख से प्रिृत्त होंगे। 2. आधार (अजधप्रमाणन के पालन हते ु फीस का भुगतान) जिजनयम, 2023 (जिन्ह ें इसम ें इसके पश् चात ् मलू जिजनयम कहा गया ह)ै , के जिजनयम 3 म,ें स्ट्पष्टीकरण म,ें "उप-जिजनयम" िब्ि के पश्चात्, "और उप-जिजनयम (5)” िब्ि, कोष्ठक और अंक अंत:स्ट्थाजपत दकए िाएंगे। 3. मूल जिजनयमों म,ें जिजनयम 3 में, उप-जिजनयम (3) के पश् चात्, जनम्नजलजखत जिजनयम अंत:स्ट्थाजपत दकया िाएगा, नामत: :— "(4) िहां पूिव में प्रस्ट्ततु दकए गए दकसी आधार नंबर, ऐसे आधार नंबर के लोप या जनजरियण या ऐसे जनजरिय दकए गए आधार नंबर के पनु : सदिय दकए िाने पर, का तत्पश्चात् लोप या जनजरियण या पनु : सदिय होना हुआ है, 611 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] के संबंध में अद्यतीकरण की जस्ट्थजत सजहत अजधप्रमाणन करन े के जलए अनुरोधकता व संस्ट्था द्वारा प्राजधकरण के साथ कोई समझौता ज्ञापन या करार दकया गया ह,ै आधार नंबर का अजधप्रमाणन करन े के संबधं म ें प्राजधकरण द्वारा बनाए गए जिजनयमों के अनुसार ऐसे अद्यतीकरण के रूप में प्राप्त पश्चात्िती दकसी भी प्रजतदिया के जलए, ऐसे प्रत्येक अद्यतीकरण के जलए अनुरोधकता व संस्ट्था को पांच रुपये की फीस प्रभाय व होगी : परंत ु यह दक, िहां ऐसा अद्यतीकरण सीआईडीआर म ें आधार नंबर धारकों की सूचना के अनुरिण करन,े सीआईडीआर म ें सतत िुद्धता के जलए उनके ितवमान ब्यौरों को अद्यतीकृत करने, आधार नंबरों की सूचना का प्रसंस्ट्करण करन े और सीआईडीआर म ें िांच करने सजहत, प्राजधकरण के कृत्यों के जनरपािन और िजियों के प्रयोग के जहतों में हो, प्राजधकरण, आिेि द्वारा, ऐसी फीस को ऐसी सीमा तक अजधत्यजित कर सकेगा िैसी दक ऐसे आििे म ें जिजनर्िवष्ट की िाए। (5) उप-जिजनयम (4) के अतं गतव फीस— (क) लाग ूकरों सजहत होगी; (ख) जिस कैलेंडर माह में आधार (अजधप्रमाणन के पालन हते ु फीस का भुगतान) संिोधन जिजनयम, 2024 प्रिृत्त हुआ ह,ै उसकी समाजप्त से चौबीस कैलेंडर महीनों की प्रत्येक अिजध के पूरा होन े पर, ऐसी अिजध की समाजप्त के कैलेंडर माह के उपभोिा मूल्य सूचकांक के अनुपात के समानुपात में, जनकटतम िस पसै े तक पूणाांदकत हो, पुनरीजित हो िाएगी : परंतु यह दक प्राजधकरण, अजधसूचना द्वारा, ऐसे पुनरीिण को ऐसी अिजध तक आस्ट्थजगत कर सकता ह ैिैसा िह जिजनर्िवष्ट करे।"। 4. मलू जिजनयमों म,ें जिजनयम 4 के पश्चात्, जनम्नजलजखत जिजनयम अंत:स्ट्थाजपत दकया िाएगा, नामत: :— "12. प्रत्यायोजित िजि या कृत्य स े सबं जं धत काय व या बात को करना.—(1) ऐसा कोई कायव या बात िो प्राजधकरण द्वारा इन जिजनयमों के अंतगवत दकया िाना अपेजित ह ै या दकया िा सकता ह,ै प्राजधकरण के ऐस े सिस्ट्य या अजधकारी या दकसी अन्य व्यजि द्वारा भी दकया िा सकता ह ै जिसे प्राजधकरण ने संबंजधत िजि या कृत्य, अजधजनयम की धारा 51 के अंतगवत, सामान्य या जिजिष्ट जलजखत आिेि द्वारा प्रत्यायोजित दकया ह।ै (2) प्राजधकरण, उप-जिजनयम (1) के अंतगवत एक सिस्ट्य, अजधकारी या अन्य व्यजि द्वारा दकया गया कोई कायव या बात उि उप-जिजनयम में जनर्िष्टव प्रत्यायोजित िजि या कृत्य से संबंजधत ह ैया नहीं, अिधाररत कर सकेगा।"। संिीि यािि, जनिेिक [जिज्ञापन-III/4/असा./724/2023-24] नोट : मलू जिजनयम अजधसूचना एफ. स.ं एचक्य-ू 13073/1/2020/ एयूटीएच.II.एचक्यू(ई), दिनांक 29 जसतंबर, 2023 द्वारा भारत का रािपत्र, असाधारण भाग-III, खंड 4 में दिनांक 3 अिूबर, 2023 को प्रकाजित दकए गए थे। UNIQUE IDENTIFICATION AUTHORITY OF INDIA NOTIFICATION New Delhi, the 31st January, 2024 F. No. HQ-13073/1/2020-AUTH.II (E).—In exercise of the powers conferred by sub-sections (1) and (2) of section 54 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016), the Unique Identification Authority of India hereby makes the following regulations to amend the Aadhaar (Payment of Fees for Performance of Authentication) Regulations, 2023, namely:— 1. Short title and commencement.—(1) These regulations may be called the Aadhaar (Payment of Fees for Performance of Authentication) Amendment Regulations, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Aadhaar (Payment of Fees for Performance of Authentication) Regulations, 2023 (hereinafter referred to as the principal regulations), in regulation 3, in the Explanation, after the word “sub-regulation”, the words, brackets and figure “and sub-regulation (5)” shall be inserted.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 3. In the principal regulations, in regulation 3, after sub-regulation (3), the following sub-regulations shall be inserted, namely:— “(4) Where a requesting entity has entered into a Memorandum of Understanding or agreement with the Authority for performing authentication with update regarding the status as to whether any Aadhaar number previously submitted has been subsequently omitted or deactivated or re-activated, for any response subsequently received by way of such update in accordance with the regulations made by the Authority in respect of performance of authentication of Aadhaar numbers, a fee of five rupees shall be chargeable to such requesting entity for every such update: Provided that the Authority may, where such update is in the interests of performance of its functions and exercise of its powers, including the maintenance of information of Aadhaar number holders in CIDR, updating of their current details for continued accuracy in CIDR, processing of information of Aadhaar numbers and inquiry into CIDR, by order, waive such fee, to such extent as such order may specify. (5) The fee under sub-regulation (4)— (a) shall be inclusive of applicable taxes; (b) shall, upon completion of every period of twenty-four calendar months from the end of the calendar month in which the Aadhaar (Payment of Fees for Performance of Authentication) Amendment Regulations, 2024 came into force, stand revised in proportion to the ratio of the Consumer Price Index for the calendar month at the end of such period to that for the calendar month in which the said regulations came into force, rounded off to the nearest ten paise: Provided that the Authority may, by notification, defer such revision by such period as it may specify.”. 4. In the principal regulations, after regulation 4, the following regulation shall be inserted, namely:— “5. Doing of act or thing related to delegated power or function.—(1) Any act or thing that is to be or may be done by the Authority under these regulations may also be done by any Member or officer of the Authority or any other person to whom the Authority has delegated the related power or function by general or special order in writing, under section 51 of the Act. (2) The Authority may determine whether or not an act or thing done by a Member, officer or other person under sub-regulation (1) related to a power or function delegated as referred to in the said sub-regulation.”.
