प्रयोग करत े हुए, भारतीय जिजिष्ट पहचान प्राजधकरण आधार (नामांकन एिं अद्यतन) जिजनयम, 2021 म ें और संिोधन करने के जलए जनम्नजलजखत जिजनयम बनाता ह,ै नामत: :— 1. सजं िप्त नाम और प्रारंभ.-(1) इन जिजनयमों को आधार (नामांकन एिं अद्यतन) संिोधन जिजनयम, 2023 कहा िाएगा। (2) य ेजिजनयम सरकारी रािपत्र में इनके प्रकािन की तारीख से प्रिृत्त होंगे। 2. आधार (नामांकन एि ं अद्यतन) जिजनयम, 2016 (जिसे यहा ाँ इसके बाि मूल जिजनयम के रूप म ें संिर्भित दकया गया ह)ै , के जिजनयम 2 म,ें उप-जिजनयम (1) म,ें — (क) खडं (छ) के बाि, जनम्नजलजखत खंड अंतःस्ट्थाजपत दकया िाएगा, नामत: :— ‘(छक)''डेटाबेस'' से अजभप्राय डटे ा के सगं रित संग्रहण से ह,ै जिसे दकसी कंप्यूटर नेटिकि स े इलक्े रॉजनकी रूप में संग्रजहत और एक्सेस दकया िाता ह;ै ’; (ख) खडं (ड) के जलए, जनम्नजलजखत खंड को प्रजतस्ट्थाजपत दकया िाएगा, नामत: :— 6197 GI/2023 (1)2 THE सिस्ट्य, या ऐसे व्यजि के जिजधक संरिक से ह,ै— (i) जिसके बारे म ें उस व्यजि के सबं ंधी होन े का प्रमाण िने े िाला िस्ट्तािेि या इलेक्रॉजनकी अजभलेख प्रस्ट्तुत दकया गया ह;ै और (ii) िो ऐसे व्यजि का जपता-माता या संरिक ह;ै’। 3. मलू जिजनयम म,ें जिजनयम 4 और 5 के जलए, जनम्नजलजखत जिजनयम प्रजतस्ट्थाजपत दकए िाएगं े, नामत: :— “4. िनसाजं ययकीय सचू ना.—(1) दकसी ऐसे व्यजि, िो नामांकन करा रहा ह ै और जिसकी आयु पांच िर् ि स े अजधक ह,ै के संबंध में जनम्नजलजखत िनसांजययकीय सूचना संग्रजहत की िाएगी, नामत: :— (क) नाम; (ख) िन्म जतजथ; (ग) ललंग; और (घ) पता। (2) उप-जिजनयम (1) में संिर्भित िनसांजययकीय सूचना के अजतररि, नामांकन के िौरान नामांकन प्रदक्रया से गुिरन े िाल े व्यजि के संबंध में जनम्नजलजखत िनसांजययकीय सूचना, ऐसे व्यजि के जिकल्प पर, नामांकन के िौरान संग्रजहत की िा सकती ह,ै नामत: :— a) मोबाइल नंबर; और b) ईमेल पता। (3) उप-जिजनयम (2) म ें दकसी बात के होते हुए भी, यदि कोई अजनिासी भारतीय या जिििे ी नागररक नामांकन चाहता ह,ै तो उसे अपना ईमले पता प्रस्ट्तुत करना होगा। स्ट्पष्टीकरण.—इन जिजनयमों के प्रयोिनाथि, "अजनिासी भारतीय" का अजभप्राय एक ऐसे व्यजि से होगा िो िधै भारतीय पासपोटि रखन े िाला भारत का नागररक ह ै ककंत ु अजधजनयम की धारा 2 के खडं (फ) म ें यथा पररभाजर्त जनिासी नहीं ह।ै (4) यदि कोई नामांकन चाहन े िाला व्यजि एक बालक या ऐसा व्यजि ह ै जिसके संबंध म ें एक जिजधक संरिक जनयुि दकया गया ह ै और िह उप-जिजनयम (1) के अंतगित पररिार के मुजखया द्वारा पुजष्ट के िररए अपनी पहचान स्ट्थाजपत करना चाहता ह,ै िनसांजययकीय सूचना के अजतररि, ऐस े बालक या व्यजि के संबंध में जनम्नजलजखत अजतररि सूचना नामांकन के िौरान संग्रजहत की िाएगी, नामत:— (क) पररिार के मुजखया का नाम; (ख) नामांकन चाहने िाल ेव्यजि के साथ पररिार के मुजखया का संबंध; (ग) पररिार के मुजखया का आधार नंबर; और (घ) पररिार के मुजखया की बायोमेररक सूचना। 5. पाचं िर् ि स े कम आय ु के बालक के नामाकं न के जलए सचू ना.—नामांकन की प्रदक्रया से गिु र रह े पांच िर्ि स े कम आयु के बालक के संबंध म ेंजनम्नजलजखत सूचना संग्रजहत की िाएगी, नामत: :— (क) नाम; (ख) िन्म जतजथ; (ग) ललंग; (घ) चेहरे की छजि; (ङ) माता-जपता या संरिक का आधार नंबर, बालक के साथ संबंध के ब्यौरे सजहत;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 (च) माता-जपता या संरिक की बायोमेररक सूचना, उसके पत े सजहत: परंतु यह दक यदि माता-जपता या संरिक का आधार नंबर उपलब्ध नहीं है, तो इसके कारण ििि दकए िाएंग े :परंतु यह और दक खंड (च) में संिर्भित माता-जपता या संरिक की पहचान बायोमेररक-आधाररत अजधप्रमाणन के िररए स्ट्थाजपत की िाएगी।”। 4. मलू जिजनयम म,ें जिजनयम 10 के जलए, जनम्नजलजखत जिजनयम प्रजतस्ट्थाजपत दकया िाएगा, नामत: :— “10. सचू ना प्रस्ट्ततु करना और सत्यापन करना.—(1) नामांकन चाहन े िाल े व्यजि को अनुसूची I म ें दिय े हुए प्ररूप म ेंआिेिन िमा करना होगा और— (क) नामांकन केंद्र पर, मलू रूप में, सत्यापन और स्ट्कैलनंग के जलए, पहचान के प्रमाण और पते के प्रमाण और, िहां लागू हो, िन्म जतजथ का प्रमाण या संबंध का प्रमाण या िोनों, िैसी भी जस्ट्थजत हो, के सायय के तौर पर एक या अजधक िस्ट्तािेिों को प्रस्ट्तुत करना होगा; या (ख) ऐसी सूचना की तैयारी या अनुरजित से संबंजधत प्राजधकाररयों के डेटाबेस से खंड (क) म ें संिर्भित प्रमाणों के सायय की इलेक्रॉजनकी रूप से सूचना प्राप्त करने के जलए अपनी सहमजत िेगा : परंतु यह दक ऐसा प्रस्ट्तुजतकरण या सूचना की इलेक्रॉजनकी प्राजप्त नामांकन की प्रदक्रया के जलए प्राजधकरण द्वारा प्रित्त या अजधकृत सॉफ्टिेयर द्वारा समर्थित होन े के अध्यधीन होगी । (2) उप-जिजनयम (1) में संिर्भति प्रमाणों के सायय के रूप में प्रस्ट्तुत दकया िा सकने िाले िस्ट्तािेिों की एक सूची अनुसूची II म ेंह।ै (3) दकसी व्यजि की पहचान के प्रमाण और पते के प्रमाण म ेंिस्ट्तािेिों का संग्रहण आिश्यक नहीं होगा िहां- (क) भारत के महापंिीयक द्वारा बायोमेररक सूचना या िनसांजययकीय सूचना का नामांकन या अद्यतन दकया गया ह;ै या (ख) उि प्रमाणों के सायय की इलेक्रॉजनकी सूचना, ऐसी सूचना को तैयार करने या उसका अनुरजित करने िाल ेप्राजधकाररयों द्वारा तैयार या अनरु जित डेटाबेस से उपलब्ध ह।ै (4) नामांकन की प्रदक्रया के भाग के रूप म ें संग्रजहत की गई सूचना का सत्यापन अनुसचू ी III म ें जिजनर्ििष्ट िस्ट्तािेिों या उप-जिजनयम (1) के खंड (क) में संिर्भित प्रमाणों की इलेक्रॉजनकी सूचना के आधार पर दकया िाएगा : परंतु यह दक ऐसे सत्यापन के प्रयोिनाथि केंद्र सरकार या राज्य सरकार के दकसी मंत्रालय, जिभाग या एिेंसी की सहायता ली िा सकेगी।“। 5. मूल जिजनयम म,ें जिजनयम 16 म,ें िब्ि "प्राजधकरण द्वारा समय-समय पर जनर्ििष्ट प्रदक्रया" के स्ट्थान पर, "इस अध्याय म ेंजनर्ििष्ट प्रदक्रया" िब्ि प्रजतस्ट्थाजपत दकये िाएगं े। 6. मूल जिजनयम म,ें जिजनयम 16क के जलए, जनम्नजलजखत जिजनयम प्रजतस्ट्थाजपत दकया िाएगा, नामत: :— “16क. िस्ट्ताििे या सचू ना अद्यतन करना.—एक आधार नंबर धारक, उसे समनुिेजित आधार नंबर के सृितन की तारीख से 10 िर्ि की प्रत्येक अिजध के पूरा होने पर, जिजनयम 10 में संिर्भित पहचान के प्रमाण और पत े के प्रमाण के रूप में िस्ट्तािेिों या सूचना को, जनम्न द्वारा, न्यूनतम एक बार अद्यजतत कर सकेगा,— (क) ऐसे िस्ट्तािेिों को दकसी नामांकन केंद्र या अद्यतन केंद्र या नामांकन और अद्यतन केंद्र पर जिजनयम 10 के उप-जिजनयम (1) के खडं (क) के अंतगित िस्ट्तािेिों की प्रस्ट्तुजत के संबंध म ें यथा उपबंजधत के समान रीजत से प्रस्ट्तुत करके; (ख) प्राजधकरण की िेबसाइट या मोबाइल एजप्लकेिन पर ऐसे िस्ट्तािेिों की प्रजतयां इलेक्रॉजनकी रूप से ऐस ेअपलोड करके, जिस प्रकार इस प्रयोिनाथि ऐसी िेबसाइट या एजप्लकेिन, िैसी भी जस्ट्थजत हो, पर दिया गया ह;ै या4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ग) ऐसी सूचना को तैयार करने या उसका अनुरिण करन े िाले प्राजधकाररयों के डेटाबेस से उि प्रमाणों के सायय की इलेक्रॉजनकी रूप स ेप्राप्त करने के जलए अपनी सहमजत ि ेकर, तादक केंद्रीय पहचान आंकड़ा जनिेपागार में उसकी सूचना की सतत िुद्धता सुजनजित करन े म ेंसहायता हो : परंत ु यह दक ऐसा प्रस्ट्तुजतकरण, इलेक्रॉजनकी अपलोलडगं या इलेक्रॉजनकी प्राजप्त नामांकन की प्रदक्रया के जलए प्राजधकरण द्वारा प्रित्त या अजधकृत सॉफ्टिेयर द्वारा समर्थित होन े के अध्यधीन होगी।“। 7. मलू जिजनयम म,ें जिजनयम 27 में, उप-जिजनयम (1) म,ें खंड (क) के जलए, जनम्नजलजखत खंड को प्रजतस्ट्थाजपत दकया िाएगा, नामत: :— "(क) यदि यह स्ट्थाजपत हो िाता ह ै दक एक ही व्यजि को एक से अजधक आधार नंबर िारी दकए गए हैं, तो सबसे पहल े समनुिेजित दकए गए आधार नंबर को बनाए रखा िाएगा और बाि के सभी आधार नंबर हटा दिए िाएंगे;"। 8. मलू जिजनयम म,ें जिजनयम 28 के बाि, जनम्नजलजखत जिजनयम को अंतर्निजिष्ट दकया िाएगा, नामत: :— “28क. कुछ आधार नबं रों का जनजरक्रयण.—जिजनयमन 28 म ें जनजहत दकसी भी बात पर प्रजतकूल प्रभाि डाल े जबना, दकसी ऐस े जििेिी नागररक के संबंध म ें िो नामांकन चाहता ह ै या िो आधार संयया धारक है, आधार संयया को जनजरक्रय दकया िा सकता ह,ै— (क) भारत म ेंरहन ेके जलए उनके िीिा की िैधता की अिजध समाप्त होने पर; या (ख) िहा ं प्राजधकरण संतष्टु ह ै दक ऐसा जििेिी नागररक भारत में प्रिेि या रहन े के जलए पासपोटि (भारत म ें प्रिेि) अजधजनयम, 1920 (1920 का 34), इसके अंतगित बनाए गए जनयम और गृह मंत्रालय के द्वारा इस संबंध में समय-समय पर िारी दििाजनिेिों के अंतगित आिश्यकताओं की पूर्ति नहीं करता ह।ै ”। 9. मलू जिजनयम म,ें जिजनयम 35 के बाि, जनम्नजलजखत जिजनयम को अंतर्निजिष्ट दकया िाएगा, नामत: :— “36. प्रत्यायोजित िजि या कृत्य स ेसबं जं धत काय ि या बात करना.—(1) कोई भी कायि या बात िो इन जिजनयमों के तहत प्राजधकरण द्वारा की िानी ह ै या की िा सकती ह,ै िह प्राजधकरण के दकसी ऐसे सिस्ट्य या अजधकारी या दकसी अन्य व्यजि द्वारा भी की िा सकेगी जिसे प्राजधकरण न े अजधजनयम की धारा 51 के अंतगित जलजखत रूप म ें सामान्य या जििेर् आिेि द्वारा संबंजधत िजि या कृत्य प्रत्यायोजित दकया ह।ै (2) प्राजधकरण यह जनजित कर सकता ह ै दक उप-जिजनयम (1) के अंतगित दकसी सिस्ट्य, अजधकारी या अन्य व्यजि द्वारा दकया गया कोई कायि या काम उि उप-जिजनयम म ें यथा संिर्भित प्रत्यायोजित िजि या कृत्य स े संबंजधत ह ैया नहीं।“। 10. मलू जिजनयम में, “अनुसचू ी I”, “अनुसूची II” और “अनसु ूची III” के जलए, जनम्नजलजखत अनुसूजचयों को प्रजतस्ट्थाजपत दकया िाएगा, नामत: :—[भाग III—खण् ड साल से अजधक समय पूि ििारी दकया गया था और अपडेट नहीं दकया गया है, तो यह अनुिंसा की िाती ह ैदक िनसांजययकीय सूचना की जनरंतर सटीकता के जलए सहायक िस्ट्तािेि (पीओआई/पीओए) को अपडेट रखें।[भाग III—खण् ड 4] No. HQ-21026/1/2022-LEGAL-HQ (E).—In exercise of the powers conferred by sub-sections (1) and (2) of section 54 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016), the Unique Identification Authority of India hereby makes the following regulations to further amend the Aadhaar (Enrolment and Update) Regulations, 2016 (2 of 2016), namely:— 1. Short title and commencement.—(1) The Aadhaar (Enrolment and Update) Amendment Regulations, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Aadhaar (Enrolment and Update) Regulations, 2016 (hereinafter referred to as the principal regulations), in regulation 2, in sub-regulation (1),— (a) after clause (f), the following clause shall be inserted, namely:— ‘(fa)“database” means the organised collection of data, generally stored and accessed in electronic form from a computer network;’; (b)for clause (k), the following clause shall be substituted, namely:— ‘(k) “head of family” means such member of the family of an individual undergoing the process of enrolment or update of his demographic information or biometric information, or the legal guardian of such individual,— (iii) in respect of whom a document or electronic record evidencing proof of relationship with that individual is submitted; and (iv) who is the father, mother or guardian of such individual;’. 3. In the principal regulations, for regulations 4 and 5, the following regulations shall be substituted, namely:— “4. Demographic information.—(1) The following demographic information in respect of an individual who is undergoing enrolment and who is above five years of age shall be collected, namely:— a) Name; b) Date of birth; c) Gender; and d) Address. (2) In addition to the demographic information referred to in sub-regulation (1), the following demographic information in respect of the individual undergoing the enrolment process may be collected during enrolment, at the option of such individual, namely:—[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 29 a) Mobile number; and b) Email address. (3) Notwithstanding anything contained in sub-regulation (2), if a NonResident Indian or a foreign national seeks enrolment, he shall be required to furnish his email address. Explanation.—For the purposes of these regulations, “Non Resident Indian” shall mean a person who is a citizen of India holding a valid Indian passport but not a resident as defined in clause (v) of section 2 of the Act. (4) If an individual who seeks to enrol is a child or an individual in respect of whom a legal guardian has been appointed and seeks to establish his identity through confirmation of the same by the head of family, in addition to the demographic information under sub-regulation (1), the following additional information in respect of such child or individual shall be collected during enrolment, namely:— a) Name of the head of family; b) Relationship of the head of family with the individual seeking to enrol; c) Aadhaar number of the head of family; and d) Biometric information of the head of family. 5. Information for enrolment of a child below five years of age.—The following information in respect of a child below the age of five years who is undergoing enrolment shall be collected, namely:— a) Name; b) Date of birth; c) Gender; d) Facial image; e) Aadhaar number of parents or the guardian, along with the details of the relationship with the child; f) Biometric information of either parent or the guardian, along with his address: Provided that if the Aadhaar number of the parents or guardian is not available, the reasons for the same shall be recorded: Provided further that the identity of the parent or guardian referred to in clause (f) shall be established through biometric-based authentication.”. 4. In the principal regulations, for regulation 10, the following regulation shall be substituted, namely:— “10. Submission and verification of information.—(1) An individual who seeks to enrol shall be required to submit an application in the form set out in Schedule I and shall— a) present at the enrolment centre, in original, for verification and scanning, one or more documents evidencing proof of identity and proof of address and, where applicable, proof of date of birth or proof of relationship or both, as the case may be; or b) give his consent for electronically obtaining the information evidencing the proofs referred to in clause (a) from the databases of the authorities dealing with the preparation or maintenance of such information: Provided that such presentation or electronic obtaining of information shall be subject to the software provided or authorised by the Authority for carrying out the process of enrolment supporting the same. (2) A list of documents that may be presented to evidence the proofs referred to in sub-regulation (1) is in Schedule II. (3) Collection of documents evidencing proof of identity and proof of address of an individual shall not be necessary where— (a) an enrolment or update of biometric information or demographic information has been carried out by the Registrar General of India; or (b) electronic information evidencing the said proofs is available from the databases prepared or maintained by the authorities dealing with the preparation or maintenance of such information.30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (4) Verification of the information collected as part of the process of enrolment shall be done on the basis of documents specified in Schedule III or electronic information evidencing the proofs referred to in clause (a) of sub-regulation (1): Provided that assistance of any Ministry, Department or agency of the Central Government or a State Government may be taken for the purpose of such verification.”. 5. In the principal regulations, in regulation 16, for the words “procedure as specified by the Authority from time to time”, the words “procedure as specified in this Chapter” shall be substituted. 6. In the principal regulations, for regulation16A, the following regulation shall be substituted, namely:— “16A. Update of documents or information.—An Aadhaar number holder may, on completion of every period of 10 years from the date of generation of the Aadhaar number assigned to him, update the documents or the information evidencing proof of identity and proof of address as referred to in regulation 10, at least once, by— (a) presenting such documents at an enrolment centre or update centre or enrolment and update centre in like manner as is provided in respect of presentation of documents under clause (a) of sub- regulation (1) of regulation 10; (b) electronically uploading copies of such documents on the website or mobile application of the Authority, in the manner provided for this purpose on such website or application, as the case may be; or (c) giving his consent for electronically obtaining the information evidencing the said proofs from the databases of the authorities dealing with the preparation or maintenance of such information, so as to help ensure the continued accuracy of his information in the Central Identities Data Repository: Provided that such presentation, electronic uploading or electronic obtaining shall be subject to the software provided or authorised by the Authority for carrying out the process of update supporting the same.”. 7. In the principal regulations, in regulation 27, in sub-regulation (1), for clause (a), the following clause shall be substituted, namely:— “(a) If it is established that more than one Aadhaar numbers have been issued to the same person, the Aadhaar number assigned the earliest shall be retained and all subsequent Aadhaar numbers omitted;”. 8. In the principal regulations, after regulation 28, the following regulation shall be inserted, namely:— “28A. Deactivation of certain Aadhaar numbers.—Without prejudice to anything contained in regulation 28, in respect of a foreign national who is seeking enrolment or is an Aadhaar number holder, Aadhaar number may be deactivated— (a) upon expiry of the period of validity of their visa for stay in India; or (b) where the Authority is satisfied that such foreign national does not fulfil the requirements for his entry into or stay in India under the Passport (Entry into India) Act, 1920 (34 of 1920), the rules made thereunder and guidelines issued by the Ministry of Home Affairs in this regard from time to time.”. 9. In the principal regulations, after regulation 35, the following regulation shall be inserted, namely:— “36. Doing of act or thing related to delegated power or function.—(1) Any act or thing that is to be or may be done by the Authority under these regulations may also be done by any Member or officer of the Authority or any other person to whom the Authority has delegated the related power or function by general or special order in writing, under section 51 of the Act. (2) The Authority may determine whether or not an act or thing done by a Member, officer or other person under sub-regulation (1) is related to a power or function delegated as referred to in the said sub-regulation.”. 10.
