(च) अध्याय III के िीर्षक के जलए, "आधार नंबरों का सृिन और उनका पररिान" िीर्षक प्रजतस्ट्थाजपत दकया िाएगा; (छ) जिजनयम 14 और जिजनयम 28 के उप-जिजनयम (1) के खडं (क) और (ख) म ें "जनिासी" िब्ि, िहां कहीं भी िह आता ह,ै के जलए, "आधार नंबर धारक" िब्ि प्रजतस्ट्थाजपत दकए िाएंग;े (ि) अध्याय IV के िीर्षक के जलए, "आधार नंबर धारक की सूचना का अद्यतीकरण" िीर्षक प्रजतस्ट्थाजपत दकया िाएगा; (झ) जिजनयम 19क म,ें "जिजनयम 19 में जनधाषररत जनिाजसयों की िानकारी" िब्िों और अंको के जलए, "आधार नंबर धारकों की जिजनयम 19 म ेंयथा-जनर्िष्टष सूचना" िब्ि और अंक प्रजतस्ट्थाजपत दकए िाएंग;े (ञ) जिजनयम 20 में, "जनिाजसयों से" िब्ि के जलए, "नामांकन चाहने िाले व्यजियों और आधार नबं र धारकों" िब्ि प्रजतस्ट्थाजपत दकए िाएंग;े (ट) जिजनयम 21 और 32 और अनुसूची V म,ें "जनिाजसयों" िब्ि, िहां कहीं भी िह आता ह,ै के जलए, "नामांकन चाहने िाले व्यजियों और आधार नंबर धारकों" िब्ि प्रजतस्ट्थाजपत दकए िाएंग,े और "जनिासी" िब्ि, िहां कहीं भी िह आता ह,ै के जलए, "नामांकन चाहने िाले व्यजि और आधार नंबर धारक" िब्ि प्रजतस्ट्थाजपत दकए िाएंगे; (ठ) जिजनयम 24 में, "जनिासी" िब्ि का लोप दकया िाएगा; (ड) जिजनयम 28 के उप-जिजनयम (1) के खंड (घ) में, "जनिासी की िनसांजययकीय" िब्िों के जलए, "िनसांजययकीय" िब्ि प्रजतस्ट्थाजपत दकया िाएगा; (ढ) जिजनयम 31 के उप-जिजनयम (1) म,ें "जनिासी" िब्ि के जलए, "संबंजधत व्यजि" िब्ि प्रजतस्ट्थाजपत दकए िाएंगे; और (ण) जिजनयम 31 के उप-जिजनयम (2) म,ें "जनिासी" िब्ि के जलए, "आधार नंबर धारक" िब्ि प्रजतस्ट्थाजपत दकए िाएंगे। 3. मलू जिजनयमों म,ें जिजनयम 27 के जलए, जनम्नजलजखत जिजनयम प्रजतस्ट्थाजपत दकया िाएगा, नामत: :— "27. ऐस े मामल े जिनम ें आधार नबं र का लोप होगा.—(1) िहां प्राजधकरण संतष्टु ह ै दक एक ही व्यजि को एक स े अजधक आधार नंबर िारी कर दिए गए ह,ैं सबसे पहले समनिु ेजित आधार नंबर प्रजतधाररत दकया िाएगा और सभी पश्चात्िती आधार नंबरों का लोप दकया िाएगा। (2) िहां प्राजधकरण संतुष्ट ह ै दक आधार नंबर एक ऐस ेव्यजि के जलए सृजित दकया गया था िो नामांकन के समय— (क) जिजनयम 6 के उप-जिजनयम (2) के अंतगषत बायोमेररक अपिाि सजहत नामांकन के जलए पात्र नहीं था परंत ु जिसका नामांकन ऐसे अपिािों के जनपटान की उसमें यथा-जनर्िष्टष प्रदियानुसार दकया गया था; या (ख) पांच िर्ष का या उसस े अजधक आयु का था परंत ु उसका नामांकन जबना बायोमेररक प्रग्रहण (कैप् चर) के दकया गया था, ऐसा आधार नंबर का लोप दकया िाएगा। (3) आधार नंबर धारक, अट्ठारह िर्ष की आयु प्राप्त करने पर, अनसु ूची VI में दिए गए प्रपत्र अनसु ार, ऐसी आयु प्राप्त करने के छः मजहनों की कालािजध के भीतर, आधार नंबर को रद्द करन े के जलए प्राजधकरण के िेत्रीय कायाषलय को एक आिेिन िे सकता ह ैऔर—[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 (क) उसकी पहचान को अजधप्रमाणन करके या ऐसे अन्य साधन द्वारा जिसे प्राजधकरण इस संबंध म ें जिजनर्िष्टष करे, स्ट्थाजपत करन े के पश्चात;म और (ख) रद्दकरण के जलए उसके आिेिन के संबंध म ें संगत तथ्यों के बारे म ें स्ट्िय ं को संतष्टु करन े के प्रयोिनाथ ष ऐसी प्रदिया जिसे प्राजधकरण उसकी िेबसाइट पर इस संबंध में जिजनर्िष्टष करे, का अनुसरण करन े के पश्चात,म और ऐसे आिेिन की प्राजप्त और खडं (क) और (ख) म ें जनर्िष्टष अपिे ाओं की पूर्त ष पर, प्राजधकरण, अपेिाओं की ऐसी पूर्तष की तारीख स े तीन मजहन े की कालािजध के भीतर, उसके आिेिन पर जनणषय लगे ा और, यदि िह ऐस े आधार नंबर धारक की रद्दकरण के जलए पात्रता के संबंध म ेंसंतुष्ट ह ैतो, उसे रद्द कर िगे ा : परंत ु यह दक आधार (नामांकन और अद्यतन) जद्वतीय संिोधन जिजनयम, 2024 के प्रारंभ पर या उससे पूि ष रद्दकरण के जलए दकए गए दकसी आिेिन पर प्राजधकरण द्वारा इस जिजनयम के अनुसार कारषिाई की िाएगी।"। 4. मलू जिजनयमों म,ें जिजनयम 29 म,ें — (क) उप-जिजनयम (1) म,ें "लोप अथिा जिजनजरियण की अपिे ा रखने िाले ररपोटष अथिा पहचाने गए मामले की फील्ड स्ट्तर पर िांच की िा सकती ह ै जिसम ें उस व्यजि की सुनिाई िाजमल ह,ै जिसके आधार नंबर का लोप या उसका जनजरियण दकया िाना ह।ै " िब्िों के जलए, जनम्नजलजखत िब्ि, कोष्ठक और अंक प्रजतस्ट्थाजपत दकए िाएंगे, नामत: :— "दकसी मामले जिसे लोप या जनजरियण की आिश्यकता िाल े संभाजित मामले के रूप में प्रजतिेदित दकया िाए या पहचाना िाए, के जलए मैिानी िांच जिसमें उन व्यजियों जिनके आधार नंबरों का लोप या जनजरियण दकया िाना हो की सुनिाई सजममजलत हो सकती ह,ै या अजधजनयम की धारा 23 की उप-धारा (2) के खंड (ठ) के अतं गतष जनरीिण, िांच या सपं रीिा, की आिश्यकता हो सकती ह।ै "; और (ख) उप-जिजनयम (1) के पश्चात,म जनम्नजलजखत उप-जिजनयम अंत:स्ट्थाजपत दकया िाएगा, नामत: :— "(1क) उप-जिजनयम (1) में यथा-जनर्िष्टष िांच के अनुसरण म,ें आधार नंबर और उससे संबंजधत सूचना का लोप या उस े जनजरिय करन े के जलए, प्राजधकरण उसके कब्ि े या जनयंत्रण म ें आधार नंबर धारक की सूचना, जिसमें सीआईडीआर म ें संग्रजहत सूचना भी है, तक पहुचं िे सकता ह ै या उसका उपयोग कर सकता ह ै या उसको प्रकट कर सकता ह ै: परंतु यह दक सूचना तक ऐसी पहुचं या उसका ऐसा उपयोग या प्रकटन धारा 29 की उप-धारा (1), (2) और (4) के अतं गतष सचू ना साझा करने के जनबंधन के अध्यधीन होगा।"। 5. मलू जिजनयमों म,ें "अनुसूची-VI" म,ें "(इन जिजनयमनों के जिजनयमन 27(1)(ग) को िेख)ें " के जलए, "[जिजनयम 27(3) िेख]ें ", प्रजतस्ट्थाजपत दकया िाएगा। सजलल कुमार, जनिेिक [जिज्ञापन-III/4/असा./715/2023-24] नोट : मूल जिजनयमों अजधसूचना संयया 13012/64/2016/जिजध/यूआईडीएआई (2016 की संयया 2), दिनांक 12 जसतंबर, 2016 को भारत का रािपत्र, असाधारण, भाग III, खंड 4 में दिनांक 14 जसतंबर, 2016 में प्रकाजित दकया गया था और उन्ह ें अंजतम बार अजधसूचना संयया एचक्य-ू 16026/1/2023-ईय-ू आई-एचक्यू (ई), दिनांक 16 िनिरी, 2024 के द्वारा संिोजधत दकया गया था। UNIQUE IDENTIFICATION AUTHORITY OF INDIA NOTIFICATION New Delhi, the 25th January, 2024 F. No. HQ-16016/1/2023-EU-I-HQ (E).—In exercise of the powers conferred by sub-sections (1) and (2) of section 54 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016), the Unique Identification Authority of India hereby makes the following regulations to further amend the Aadhaar (Enrolment and Update) Regulations, 2016, namely:— 1. Short title and commencement.—(1) These regulations may be called the Aadhaar (Enrolment and Update) Second Amendment Regulations, 2024.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Aadhaar (Enrolment and Update) Regulations, 2016 (hereinafter referred to as the principal regulations),— (a) for the word “a resident”, the words “an Aadhaar number holder” shall be substituted in clause (b) of sub-regulation (1) of regulation 2; (b) for the word “residents and updating their information”, the words “individuals seeking to enrol and updating information of Aadhaar number holders” shall be substituted in clause (i) of sub-regulation (1) of regulation 2; (c) for the word “residents” wherever it occurs, the words “individuals seeking to enrol” shall be substituted in clauses (j) and (m) of sub-regulation (1) of regulation 2 and regulations 6, 7, 9 and 15; (d) for the words “residents’ information”, the words “information of Aadhaar number holders” shall be substituted in sub-regulation (2) of regulation 7; (e) for the title of Chapter II, the title “ENROLMENT PROCESS” shall be substituted; (f) for the title of Chapter III, the title “GENERATION OF AADHAAR NUMBERS AND THEIR DELIVERY” shall be substituted; (g) for the word “resident” wherever it occurs, the words “Aadhaar number holder” shall be substituted in regulations 14 and clauses (a) and (b) of sub-regulation (1) of regulation 28; (h) for the title of Chapter IV, the title “UPDATE OF INFORMATION OF AADHAAR NUMBER HOLDER” shall be substituted; (i) for the words “residents’ information prescribed at Regulation”, the words “information of Aadhaar number holders as referred to in regulation” shall be substituted in regulation 19A; (j) for the words “residents, not exceeding an amount specified by the Authority,”, the words “individuals seeking to enrol and Aadhaar number holders, not exceeding such amount as the Authority may specify” shall be substituted in regulation 20; (k) for the word “residents” wherever it occurs, the words “individuals seeking to enrol and Aadhaar number holders” shall be substituted in regulations 21 and 32 and Schedule V; (l) the word “resident” shall be omitted in regulation 24; (m) for the words “resident demographics”, the words “demographic information” shall be substituted in clause (d) of sub-regulation (1) of regulation 28; (n) for the word “residents”, the words “the individual concerned” shall be substituted in sub-regulation (1) of regulation 31; and (o) for the word “a resident”, the words “the Aadhaar number holder” shall be substituted in sub-regulation (2) of regulation 31. 3. In the principal regulations, for regulation 27, the following regulation shall be substituted, namely:— “27. Cases requiring omission of Aadhaar number.—(1) Where the Authority is satisfied that more than one Aadhaar numbers have been issued to the same person, the Aadhaar number assigned the earliest shall be retained and all subsequent Aadhaar numbers omitted. (2) Where the Authority is satisfied that an Aadhaar number was generated for an individual who, at the time of enrolment,— (a) was not eligible for enrolment with biometric exception under sub-regulation (2) of regulation 6 but whose enrolment was carried out following the procedure for handling of such exceptions as referred to therein; or (b) was aged five years or above but was enrolled without capturing his biometrics, such Aadhaar number shall be omitted. (3) An Aadhaar number holder may, upon attaining the age of eighteen years, make an application for cancellation of his Aadhaar number as per the form set out in Schedule VI, to a Regional Office of the Authority, within a period of six months from the date on which he attains such age and after— (a) establishing his identity by performing authentication or by such other means as the Authority may specify in this behalf; and[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 (b) following such procedure as the Authority may specify in this behalf on its website, for the purpose of satisfying itself as to the relevant facts regarding his application for cancellation, and, upon receipt of such application and fulfilment of the requirements referred to in clauses (a) and (b), the Authority shall, within a period of three months from the date of such fulfilment of requirements, take a decision on his application and, if satisfied regarding the eligibility of such Aadhaar number holder for cancellation, cancel the same: Provided that any application for cancellation made on or before the commencement of the Aadhaar (Enrolment and Update) Second Amendment Regulations, 2024 shall be processed by the Authority in accordance with this regulation.”. 4. In the principal regulations, in regulation 29,— (a) in sub-regulation (1), for the word “deactivated”, the following words, brackets and figures shall be substituted, namely:— “deactivated, or an inspection, inquiry or audit under clause (l) of sub-section (2) of section 23 of the Act”; and (b) after sub-regulation (1), the following sub-regulation shall be inserted, namely:— “(1A) For omitting or deactivating an Aadhaar number and information relating thereto, pursuant to an inquiry as referred to in sub-regulation (1), the Authority may give access to or use or disclose information of the Aadhaar number holder, in the possession or control of the Authority, including information stored in the CIDR: Provided that such giving of access to or use or disclosure of information shall be subject to the restriction on sharing of identity information under sub-sections (1), (2) and (4) of section 29.”. 5. In the principal regulations, in Schedule VI, for “[See regulation 27(1)(c)]”, “[See regulation 27(3)]” shall be substituted.
