L.-33004/99 सी.जी.-डी.एल.-अ.-04102023-249139 xxxGIDHxxx CG-DL-E-04102023-249139 xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 676] नई ददल्ली, मगं लिार, अक्त बू र 3, 2023/आजिन 11, 1945 No. 676] NEW DELHI, TUESDAY, OCTOBER 3, 2023/ASVINA 11, 1945 भारतीय जिजिष्ट पहचान प्राजधकरण अजधसचू ना नई ददल्ली, 29 जसतंबर, 2023 फा.स.ं एचक्य-ू 13073/1/2020-ऑथ-II(अ).—आधार (जित्तीय और अन्य सहाजयदकयों, प्रसुजिधाओं और सेिाओं का लजययत पररदान) अजधजनयम, 2016 (2016 का 18) की धारा 54 की उप-धारा (1) और (2) के तहत प्रदत्त िजियों का प्रयोग करत े हुए, भारतीय जिजिष्ट पहचान प्राजधकरण आधार (अजधप्रमाणन और ऑफलाइन सत्यापन) जिजनयम, 2021 में और संिोधन करने के जलए जनम्नजलजखत जिजनयम बनाता ह,ै नामत: :— 1. सजं िप्त नाम और प्रारंभ.—(1) इन जिजनयमों को आधार (अजधप्रमाणन और ऑफलाइन सत्यापन) संिोधन जिजनयम, 2023 कहा जाएगा। (2) य ेजिजनयम सरकारी राजपत्र में इनके प्रकािन की तारीख से प्रिृत्त होंगे। 2. आधार (अजधप्रमाणन और ऑफलाइन सत्यापन) जिजनयम, 2021 (इसके बाद मूल जिजनयम के रूप में संदर्भभत), के जिजनयम 12 म,ें — (क) उप-जिजनयम (1) के जलए, जनम्नजलजखत उप-जिजनयम को प्रजतस्ट्थाजपत दकया जाएगा, नामत: :— "(1) दकसी अजधप्रमाणन सुजिधा के उपयोग के जलए अनरु ोधकताा संस्ट्था के रूप में जनयुजि चाहने िाली एजेंसी या अन्य व्यजि जनयुजि के जलए प्राजधकरण को ऐसे प्रपत्र में आिेदन करेगा जैसा दक प्राजधकरण द्वारा ऐसी एजेंसी या व्यजि के द्वारा उसे दकए गए अनुरोध पर उपलब्ध कराया जाए : परंतु यह दक ऐसी एजेंसी या व्यजि, अनुरोधकताा संस्ट्था के रूप में जनयुजि होने पर, केिल ऐसे प्रयोजन के जलए अजधप्रमाणन करेगी जैसी दक— 6276 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (क) उप-धारा (4) के तहत अनुज्ञात की गई ह ै या िह अजधजनयम की धारा 4 की उप-धारा (7) में संदर्भभत दकसी भी जिजध के अंतगात अपेजित ह;ै या (ख) अजधजनयम की धारा 7 के तहत केंद्र सरकार या राज्य सरकार द्वारा अपेजित ह।ै "; (ख) उप-जिजनयम (2) के जलए, जनम्नजलजखत उप-जिजनयम को प्रजतस्ट्थाजपत दकया जाएगा, नामत: :— "(2) दकसी अजधप्रमाणन सुजिधा के उपयोग के जलए एएसए के रूप में जनयुजि चाहने िाली सस्ट्ं था जनयुजि के जलए प्राजधकरण को ऐसे प्रपत्र में आिेदन करेगी जैसा दक प्राजधकरण द्वारा ऐसी सस्ट्ं था के द्वारा उसे दकए गए अनुरोध पर उपलब्ध कराया जाए। (2क) एएसए के रूप म ेंजनयुजि चाहने िाली सस्ट्ं था अनुसूची क में जिजनर्ददष्ट मानदंडों की पूर्भत करेगी।”। 3. मूल जिजनयम म,ें जिजनयम 31 के बाद, जनम्नजलजखत जिजनयम को अंत:स्ट्थाजपत दकया जाएगा, नामत: :— “32. प्रत्यायोजजत िजि या कृत्य स े संबजं धत काय ा या बात करना.—(1) कोई भी काया या बात जो इन जिजनयमों के तहत प्राजधकरण द्वारा की जानी ह ै या की जा सकती ह,ै िह प्राजधकरण के दकसी ऐसे सदस्ट्य या अजधकारी या दकसी अन्य व्यजि द्वारा भी की जा सकेगी जजसे प्राजधकरण न े अजधजनयम की धारा 51 के अंतगात जलजखत रूप म ें सामान्य या जििेष आदेि द्वारा संबंजधत िजि या कृत्य प्रत्यायोजजत दकया ह।ै (2) प्राजधकरण यह अिधाररत कर सकता ह ै दक उप-जिजनयम (1) के अतं गता दकसी सदस्ट्य, अजधकारी या अन्य व्यजि द्वारा दकया गया कोई काया या बात उि उप-जिजनयम में यथा संदर्भभत प्रत्यायोजजत िजि या कृत्य स े संबंजधत ह ैया नहीं।”। 4. मूल जिजनयम म,ें जिद्यमान अनुसूची के जलए, जनम्नजलजखत अनुसूची को प्रजतस्ट्थाजपत दकया जाएगा, नामत: :— “अनुसूची क अजधप्रमाणन सिे ा एजजें सयों के पात्रता मानदंड [जिजनयम 12(2क) देखें] 1. एएसए के रूप में अपॉइंटमेंट की मांगकताा सस्ट्ं थाओं को जनम्नानुसार िगीकृत दकया गया ह ै: क्र. स.ं सगं ठन श्रणे ी श्रणे ी 1 केंद्र सरकार या राज्य सरकार का मंत्रालय या जिभाग या केंद्र सरकार या राज्य सरकार के स्ट्िाजमत्ि या जनयंत्रणाधीन उपक्रम श्रणे ी 2 केंद्रीय या राज्य अजधजनयम के अंतगता गरठत कोई प्राजधकार श्रणे ी 3 प्राजधकरण की राय म ेंराष्ट्रीय महत्ि की कोई अन्य संस्ट्था श्रणे ी 4 कंपनी अजधजनयम, 2013 (2013 का 18) के तहत भारत म ेंरजजस्ट्रीकृत कंपनी श्रणे ी 5 एयूए या केयूए 2. एएसए के रूप में जनयुजि के संबंध में संस्ट्थाओं के जलए तकनीकी और जित्तीय मानदंड इस प्रकार ह ैं: श्रणे ी जित्तीय अपिे ा तकनीकी अपिे ा श्रणे ी 1, 2 और 3 — — श्रणे ी 4 जपछल े तीन जित्तीय िषों के जलए दरू संचार सेिा प्रदाता {एक्सेस सेिाओं के जलए प्राजधकार प्राप्त लेखापरीजित जित्तीय जििरणों के यूजनफाईड लाइसेंस का धारक या यूजनफाईड एक्सेस सर्भिसेज़ अनुसार िार्भषक टनओा िर न्यूनतम लाइसेंस का धारक, जजसे भारतीय टेलीग्राफ अजधजनयम, 100 करोड़ रुपए 1885 (1885 का 13) की धारा 4 के तहत लाइसेंस प्रदान दकया गया ह}ै , जजसके पास भारत में न्यूनतम 100[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 3 मल्टीप्रोटोकॉल लेिल जस्ट्िचचग (एमपीएलएस) पॉइंटस् ऑफ प्रेजेंस (पीओपी) ह।ैं या नेटिका सेिा प्रदाता या जसस्ट्टम इंटीग्रेटर, जजसके पास डेटा रांसजमिन के जलए अजखल भारतीय स्ट्तर पर नेटिका कनेजक्टजिटी ह ै और जजसके पास भारत में न्यूनतम 100 एमपीएलएस पीओपी ह।ैं श्रणे ी 5 — ऐसे अजधप्रमाणन संव्यिहार मानदंड जैसे दक प्राजधकरण द्वारा समय-समय पर अिधाररत दकए जाएं, की पूर्भत करने िाला एयूए या केयूए।”। जनजखल जसन्हा, जनदेिक [जिज्ञापन-III/4/असा./457/2023-24] रटप्पणी : मूल जिजनयम ददनांक 8.11.2021 की अजधसूचना सं. के-11020/240/2021/ऑथ/ यूआईडीएआई (2021 का संख्याक 2) के तहत भारत के राजपत्र, असाधारण, भाग-III, खंड 4 म ें ददनांक 9 निंबर, 2021 को प्रकाजित दकए गए थे तथा अंजतम संिोधन ददनांक 24 फरिरी, 2023 की अजधसूचना संख्या एचक्यू- 13011/240/2021-ऑथ-II (2023 का संख्याक 01) के तहत दकया गया। UNIQUE IDENTIFICATION AUTHORITY OF INDIA NOTIFICATION New Delhi, the 29th September, 2023 F. No. HQ-13073/1/2020-AUTH.II(E).—In exercise of the powers conferred by sub-sections (1) and (2) of section 54 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016), the Unique Identification Authority of India hereby makes the following regulations to further amend the Aadhaar (Authentication and Offline Verification) Regulations, 2021, namely:— 1. Short title and commencement.—(1) These regulations may be called the Aadhaar (Authentication and Offline Verification) Amendment Regulations, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Aadhaar (Authentication and Offline Verification) Regulations, 2021 (hereinafter referred to as the principal regulations), in regulation 12,— (a) for sub-regulation (1), the following sub-regulation shall be substituted, namely:— “(1) An agency or other person seeking appointment as a requesting entity for use of an Authentication facility shall apply to the Authority for appointment, in such form as the Authority may provide upon request made to it by such agency or person: Provided that such agency or person, on appointment as requesting entity, shall perform authentication only for such purpose as is— (a) allowed under sub-section (4) or required under any law as referred to in sub-section (7) of section 4 of the Act; or (b) required by the Central Government or a State Government under section 7 of the Act.”; (b) for sub-regulation (2), the following sub-regulation shall be substituted, namely:— “(2) An entity seeking appointment as an ASA for use of an Authentication facility shall apply to the Authority for appointment, in such form as the Authority may provide upon request made to it by such entity. (2A) The entity seeking appointment as ASA shall fulfil the criteria specified in Schedule A.”. 3. In the principal regulations, after regulation 31, the following regulation shall be inserted, namely:—4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] “32. Doing of act or thing related to delegated power or function.—(1) Any act or thing that is to be or may be done by the Authority under these regulations may also be done by any Member or officer of the Authority or any other person to whom the Authority has delegated the related power or function by general or special order in writing, under section 51 of the Act. (2) The Authority may determine whether or not an act or thing done by a Member, officer or other person under sub-regulation (1) is related to a power or function delegated as referred to in the said sub-regulation.”. 4. In the principal regulations, for the existing Schedule, the following Schedule shall be substituted: “SCHEDULE A ELIGIBILITY CRITERIA OF AUTHENTICATION SERVICE AGENCIES [See regulation 12(2A)] 1. Entities seeking appointment as ASA are categorised as follows: S. No. Organisation category Category 1 A Ministry or Department of the Central Government ora State Government, or an undertaking owned or controlled by the Central Government or a State Government Category 2 An authority constituted under any Central or State Act Category 3 Any other entity of national importance in the opinion of the Authority Category 4 A company registered in India under the Companies Act, 2013 (18 of 2013) Category 5 An AUA or a KUA 2. The technical and financial criteria for entities for appointment as ASA are as under: Category Financial requirement Technical requirement Category 1, 2 and — — 3 Category 4 Annual turnover of at least ₹100 croreas A Telecom Service Provider {Unified Licensee per the audited financial statements for having Access Services authorisation or Unified last three financial years Access Services Licensee, granted licence under section 4 of the Indian Telegraph Act, 1885 (13 of 1885)}, having a minimum of 100 Multiprotocol Label Switching (MPLS) Points of Presence (PoP) in India OR A Network Service Provider or System Integrator having pan-India network connectivity for data transmission, having at least 100 MPLS PoPs in India Category 5 — An AUA or KUA that meets such authentication transaction criteria as the Authority may determine from time to time.”.
