Ms. No. 16, Labour Welfare and Skill Development (P1), 15th February 2023, மா(cid:210) 3, ²ðA¼¶, F¼õœÀõ˜ ݇´&2054.] No. SRO B-6/2023.—In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Tamil Nadu hereby makes the following amendment to the Special Rules for the Tamil Nadu Employment and Training Subordinate Service (Section7-B in Volume III of the Tamil Nadu Services Manual, 1970). 2. The amendments hereby made shall be deemed to have come into force with effect on and from the 5th April, 2010. Training Officers in the Industrial Training Institutes / Centres in column (1) against the “Method of Appointment”, in column (2), in item (ii) (b), the expression, “and five years service as Assistant Training Officer” shall be deleted. . (2) In the ANNEXURE, referred to in sub-rule (b) of rule 5 against the category “Training Officers in the- lndustrial Training institutes/Centers” in column (1), against the method of appointment “Promotion” in column (2) for the qualifications in column (3), (i). the existing paragraph shall be numbered as 1 (a) and after the expression ‘All India Council for Technical Education’ (AICTE), the expression ‘and’ shall be added. (ii). after paragraph 1 (a) the following shall be added, 1 (b) Must have put in service as Assistant Training Officer in the Industrial Training Institutes / Centres and/ or under the Apprentices Act, 1961 (Central Act 52 of 1961) and / or as Supervisor (Maintenance) / Supervisor (Electrical in the Industrial Training Institutes / Centres and / or as Purchase Assistant in the office of the Director of Employrnent and Training for a period of not less than two years; or 2 (a) Must have passed Secondary School Leaving Certificate Examination; and 2(b) Must possess National Apprenticeship Certificate issued under the Apprentices Act, 1961 (Central Act 52 of 1961) or Certificate of Apprenticeship under the National Apprenticeship Training Scheme issued by the National Council for Training in Vocational Trades or National Trade Certificate issued by the National Council for Training in Vocational Trades or Diploma in Craftsmanship issued by the Government of India or any other equivalent Certificates issued by the Government of India or Industrial School Certificate or Craftsmanship certificate issued by the Department of Industries and Commerce or by the Department of Employment and Training or any other equivalent qualifications; and 2(c) Must have put in service as Assistant Training Offi cer in the Industrial Training Institutes / Centres and / or under the Apprentices Act, 1961 (Central Act 52 of 1961) and / or as Supervisor (Maintenance) and / or as Supervisor (Electrical) in the Industrial Training Institutes / Centres and / or as Purchase Assistant in the offi ce of the Director of Employment and Training for a period, not less than fi ve years. Ms. No. 130, Law(OP-III), 20th February 2023.] No. SRO B-7/2023.—In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Tamil Nadu, hereby makes the following amendments to the Special Rules for the Tamil Nadu General Service (Section 16 in Volume-II of the Tamil Nadu Services Manual, 2016) :— 2. In the said Special Rules,— (1) in Part-I, after Class XIX and the entries thereunder, the following Class and entries shall be inserted, namely:— "Class XIX A-Additional Secretary to Government in Law Department and Joint Secretary to Government in Law Department. "; and (2) in Part-II, after "CLASS XIX - SECRETARY TO GOVERNMENT, LAW DEPARTMENT AND REMEMBRANCER OF LEGAL AFFAIRS" and the rules thereunder, the following Class and rules shall be inserted, namely:— "CLASS XIX A - ADDITIONAL SECRETARY TO GOVERNMENT IN LAW DEPARTMENT AND JOINT SECRETARY TO GOVERNMENT IN LAW DEPARTMENT. 1. Constitution.—This Class shall consist of the following categories of officers, namely:- Category 1 - Additional Secretary to Government, Law Department. Category 2 - Joint Secretary to Government, Law Department. 2. Appointment.—Appointment to the categories specified in column (2) of the table below shall be made by the methods specified in the corresponding entries in column (3) thereof:- T(cid:3472)(cid:3469) T(cid:3465)(cid:3466)(cid:3476)(cid:3469) Sl.No. Category Method of appointment (1) (2) (3) 1. Additional Secretary to Government, (a) by promotion from among the holders of the post of Law Department Joint Secretary to Government in Law Department; or (b) if no candidate is available for appointment by promotion, by direct recruitment; or (c) for special reasons, by recruitment by transfer from among of the holders of the post of District Judge (Selection Grade) in the Tamil Nadu State Judicial Service. 2. Joint Secretary to Government, (a) by promotion from among the holders of the Law Department post of Deputy Secretary to Government in Law Department; or (b) if no candidate is available for appointment by promotion, by direct recruitment; or (c) for special reasons, by recruitment by transfer from among the holders of the post of District Judge (Entry level) in the Tamil Nadu State Judicial Service. 3. Preparation of approved list.—The crucial date for preparation of approved list for the categories in this class shall be the 1st January of every year; 4. Qualifications.-No person shall be eligible for appointment to this Class by direct recruitment unless he - (a) possesses any degree in Law awarded by any University or Institution recognised by the University Grants Commission and recognised by the Bar Council of India for the purpose of enrolment as an Advocate; and (b) must have completed 40 years of age and must not have completed 50 years of age on the first day of January of the year in which the selection for appointment is made; and (c) must have practiced as an advocate in any court of India for a period of at least nine years for appointment to the ·post of Additional Secretary to Government in Law Department and for a period of atleast eight years for appointment14 TAMIL NADU GOVERNMENT GAZETTE [Part III—Sec. 1(b) to the post of Joint Secretary to Government in Law Department during the period of 12 years preceeding the first day of January of the year in which the selection for appointment is made. 5. Probation.- Every person appointed to the posts by direct recruitment shall, from the date on which he joins duty, be on probation for a total period of two years on duty within a continuous period of three years. 6. Reservation of Appointments.—The principle of reservation of appointments contained in section 27 of the Tamil Nadu Government Servants (Conditions of Service) Act, 2016 (Tamil Nadu Act 14 of 2016) shall apply to appointment by direct recruitment to the posts in this class.’’.
