Constitution.—This Class shall consist of the following categories of officers, namely:- Category 1 - Additional Secretary to Government, Law Department. Category 2 - Joint Secretary to Government, Law Department. 2. Joint Secretary to Government, (a) by promotion from among the holders of the Law Department post of Deputy Secretary to Government in Law Department; or (b) if no candidate is available for appointment by promotion, by direct recruitment; or (c) for special reasons, by recruitment by transfer from among the holders of the post of District Judge (Entry level) in the Tamil Nadu State Judicial Service. 3. Preparation of approved list.—The crucial date for preparation of approved list for the categories in this class shall be the 1st January of every year; 4. Qualifications.-No person shall be eligible for appointment to this Class by direct recruitment unless he - (a) possesses any degree in Law awarded by any University or Institution recognised by the University Grants Commission and recognised by the Bar Council of India for the purpose of enrolment as an Advocate; and (b) must have completed 40 years of age and must not have completed 50 years of age on the first day of January of the year in which the selection for appointment is made; and (c) must have practiced as an advocate in any court of India for a period of at least nine years for appointment to the ·post of Additional Secretary to Government in Law Department and for a period of atleast eight years for appointment14 TAMIL NADU GOVERNMENT GAZETTE [Part III—Sec. 1(b) to the post of Joint Secretary to Government in Law Department during the period of 12 years preceeding the first day of January of the year in which the selection for appointment is made. 5. Probation.- Every person appointed to the posts by direct recruitment shall, from the date on which he joins duty, be on probation for a total period of two years on duty within a continuous period of three years. 6. Reservation of Appointments.—The principle of reservation of appointments contained in section 27 of the Tamil Nadu Government Servants (Conditions of Service) Act, 2016 (Tamil Nadu Act 14 of 2016) shall apply to appointment by direct recruitment to the posts in this class.’’.
