Energy Department – Extension of the utilization period of the Government
Guarantee sanctioned to APSPDCL vide G.O.Ms.No.107, Energy (Pr.III) Department,
dt.04.10.2008 for further two years i.e., 2010-11 and 2011-2012 for Government
Guarantee of an amount of Rs.17.11 crores out of available Government Guarantee
of Rs.18.02 crores – Orders - Issued.

O R D E R:
In the reference 1st read above, Government have issued orders in
G.O.Ms.No.146, Energy (Pr.III) Department, dated 30.11.2006 read with
G.O.Ms.No.84, Energy (Pr.III) Department, dt.13.08.2007 according Government
Guarantee for Rs.384.287 crores (Rs.366.267 crores from M/s Rural Electrification
Corporation Limited, New Delhi and Rs.18.02 crores from Power Finance Corporation
Limited, New Delhi) for availing Loan assistance of Rs.1280.96 crores (Rs.1220.88
crores from REC Limited and Rs.60.08 crores from M/s PFC Ltd.,) by the APSPDCL for
documentation of New Schemes during the years 2006-07 and 2007-08.
2. In the reference 2nd read above, Government have also issued orders in
G.O.Ms.No.107, Energy (Pr.III) Department, dated 4.10.2008 for further extension
of the utilization period of the Government Guarantee sanctioned to APSPDCL for
two years i.e., 2008-09 and 2009-10. As such, the Government Guarantee period
has expired by 31.03.2010.
3. The Chairman & Managing Director, APSPDCL in his letter 3rd read above, has
informed that, under G.O.Ms.No.107, Energy (Pr.III) Department, dated 4.10.2008
some amounts were utilised for documentation of the schemes for loan assistance
from M/s. REC Limited by providing 30% of Government Guarantee and Rs.0.387574
crores is available towards 30% Government Guarantee under REC Schemes and
Rs.18.02 crores is available towards 30% Government Guarantee under PFC
Conductor Schemes.
4. He has further stated that Government of India introduced a new scheme of
R-APDRP (Restructured Accelerated Power Development and Reforms Programme)
during XI Plan financed through M/s.PFC Limited (Nodal agency) and M/s PFC has
sanctioned 12 projects for implementing the projects under Part-B of R-APDRP with a
loan amount of Rs.17.11 crores being 25% of the sanctioned project (GOI loan) and
the steering committee approved for a loan amount of Rs.68.43 crores. Further the
time for utilization of Government Guarantee upto 31.03.2012 is necessary to
complete the ring fencing works as inspected by the TPIEA appointed by M/s PFC
Limited time is needed upto June, 2011 and further Part B works are to be taken up
only after confirmation of AT&C losses for the month of July, August, September,
2011 by PFC Limited.
5. The Chairman & Managing Director, APSPDCL has therefore requested the
Government for extension of the utilization period of the Government Guarantee
sanctioned vide G.O.Ms.No.107, Energy (Pr.III) Department, dated 04.10.2008, up
to 31.03.2012 and also issue the undertaking letter to M/s PFC Limited for
Government Guarantee of an amount of Rs.17.11 crores out of available Government
Guarantee of Rs.18.02 crores.

6. Government after careful examination of the matter, hereby accord for
extension of the utilization period of the Government Guarantee sanctioned to
APSPDCL vide G.O.Ms.No.107, Energy (Pr.III) Department, dt.04.10.2008 for
further two years i.e., 2010-11 and 2011-2012 for Government Guarantee of an
amount of Rs.17.11 crores out of available Government Guarantee of Rs.18.02
crores subject to condition that in case of default in repay the loan amount to PFC
the amount in default in the interest shall be recovered from the dues payable to
APSPDCL at source.
7. This order issues with the concurrence of Finance (DCM) Department vide
their U.O.No.2708/28/A2/Expr.AHFFCS&E/12, Dt.24-02-2012.
