Accordingly, the following Notification will be published in an Extra Ordinary issue of the Andhra Pradesh Gazette, dated 24-03-2012. DRAFT PRELIMINARY NOTIFICATION The following draft revision of Rentals specified in the Schedule should be levied in respect of Government Godowns and Transit Sheds situated at Kakinada Port which is proposed to be made in exercise of the power conferred by sub-section (1) of Section-35 read with clause ( JJ ) of Sub-Section (1) of Section-6 of the Indian Port Act 1908 (Central Act XV of 1908) and in supersession of the orders issued in G.O.Ms.No.48, I&I Department, dt. 19-12- 2008 the Government hereby publish for the general information in the A.P.Gazette as required under sub-section (2) of section 6 of the said act. Notice is hereby given that the said draft will be taken into consideration by the Government after expiry of thirty days from the date of its publication in the Andhra Pradesh Gazette. .Any objections or suggestions which may be received from any person with respect thereto before the aforesaid date will be considered by the Government of Andhra Pradesh. Objections and suggestions should be addressed to the Principal Secretary to Government, Infrastructure & Investment (Ports -I) Department, Andhra Pradesh, Secretariat, Hyderabad – 500022 in duplicate. SCHEDULE Class-A Godowns / Transit Sheds – Rs -100.00 (Rupees hundred only) per Square meter per month Class-B Godowns / Transit Sheds – Rs – 50.00 (Rupees fifty only) per Square meter per month. “There will be yearly enhancement by 10% on the above rents and the rates proposed above shall be in force for a period of three (3) years and thereafter fresh revision shall take place” The following shall be the terms and conditions for allotment of Godowns and Transit Sheds at Kakinada Port area specified in the Annexure to this order. Contd…2::2:: TERMS AND CONDITION Prior to the occupation of the Transit Sheds and Godowns an undertaking should be given by the allottees on the prescribed stamp paper agreeing to abide by the following conditions; namely:- (1.) To use the Godowns / Transit Shed for storing Export / Import cargo or for any marine purpose specifically approved by the State Port Department. (2.) The prescribed rent for the Godown / Transit Shed be payable to the State Port Department by the allottee in advance every month before occupation and during occupation of the Godown / Transit Shed. (3.) The Transit Shed / Godown shall be vacated within one week from the date of the notice given by the State Port Department leaving the Transit Shed / Godown in good substantive condition and in no case continue under occupation beyond six months. (4.) No inflammable combustible or explosive substance or goods shall be kept in the Godown / Transit Shed. (5.) Andhra Pradesh State Port Department shall be fully compensated by the occupant for any damages caused to the Transit Sheds / Godowns or loss sustained by the State Port Department during the period the Transit Shed / Godown is under occupation of the allottee. (6.) The Transit Shed / Godown shall not be sub-let to anybody or any concern under any circumstances or conditions without the prior permission of the Director of Ports in writing. (7.) The occupants shall pay charges towards Water, Electricity and assessments and outgoing payable in respect of the Transit Shed / Godown except the property tax payable to the Kakinada municipality. (8.) The State Port Department shall not be held responsible for any losses to the commodities stored by the occupants of the Transit Shed / Godown during the period of occupation. (9) The occupants shall pay the following penalty, over and above the normal rent, if they fail to vacate the Transit Shed / Godown in accordance with the condition 3 above. (i) If the occupant continues to be in occupation after the expiry of the notice period given by the State Port Department, they shall pay for the first week of such unauthorized occupation, a penalty equal to 25% of the prescribed monthly rent. For the next weeks unauthorized occupation, they shall pay a penalty equal to 50% of the full rent for the month. (ii) The State Port Department shall have the right to remove any or all the goods unauthorisedly stored in the Godowns, after the completion of two weeks of unauthorised occupation mentioned above and the Andhra Pradesh Port Department or the Government of Andhra Pradesh shall be held harmless and indemnified from all legal action or any action in their having exercise the above procedure. (10.) The occupant of the Transit Shed / Godown shall pay any difference of rent to the State Port Department, if the present rent is enhanced with retrospective effect from the date of occupation. (11.) The Port officer shall have the power to allocate the Transit Shed/ Godown Space in proportion of the cargo being handled for a particular commodity, so that the Godown space is equitably shared by all the Importers / Exporters at the Port, and (12.) If any damage occurs at the time of storing / Lifting the cargo, the allottee will bear the damage expenses and will be responsible for that. Contd…3::3:: ANNEXURE CLASS-“A” SL.No T.Sheds .
