GOVERNMENT OF INDIA MINISTRY OF HOUSING AND URBAN AFFAIRS RAJYA SABHA UNSTARRED QUESTION NO. 1822 ANSWERED ON 09/03/2026 PM-UDAY AND MCD CLARIFICATION 1822. DR. M. THAMBIDURAI: Will the Minister of Housing and Urban Affairs be pleased to state: (a) whether registration of properties situated in unauthorised colonies of Delhi is permitted under the PM-UDAY scheme; (b) whether, after such registration, the said properties cease to fall under the jurisdiction/ authority of the Delhi Development Authority (DDA) and come under the jurisdiction of the Municipal Corporation of Delhi (MCD); (c) if so, the legal basis for such transfer of jurisdiction; and (d) if not, the present statutory position regarding land and property jurisdiction in unauthorised colonies covered under PM-UDAY? ANSWER THE MINISTER OF STATE IN THE MINISTRY OF HOUSING AND URBAN AFFAIRS (SHRI TOKHAN SAHU) (a) : PM-UDAY Scheme confers ownership rights to the residents of 1731 Unauthorized Colonies listed in the National Capital Territory of Delhi (Recognition of Property Rights of residents in Unauthorized Colonies) Regulations, 2019 (except the unauthorised colonies falling within the ambit of the exclusions provided under Regulation No. 7). Conveyance Deed are issued for properties falling on Government Land and Authorization Slip for properties falling on Private Land. After the execution of Conveyance Deed or Authorisation slip, the applicant may register the Conveyance Deed/ Authorization Slip with the concerned Sub Registrar under Revenue Department, GNCTD. (b) to (d) : DDA confers ownership rights to the residents of 1731 Unauthorized Colonies as per the provisions of National Capital Territory of Delhi (Recognition of Property Rights of residents in Unauthorized Colonies) Regulations, 2019. As regards regularization of building and legality thereof, this falls under the jurisdiction of MCD since these Unauthorised Colonies do not fall under the development area in terms of the provisions contained in Section 12 of the DD Act, 1957. *****
