In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India and in supersession of the Special Rules for the Tamil Nadu Geology and Mining Service, the Governor of Tamil Nadu hereby re-issues the following Special Rules for the Tamil Nadu Geology and Mining Service (Section 48 in Volume-II of the Tamil Nadu Services Manual, 2016):- Rules 1) Constitution:- The service shall consist of the following classes and categories of posts, namely:- Class - I : Additional Director of Geology and Mining. Class – II : Joint Director of Geology and Mining. Class – III Category – 1 : Deputy Director of Geology and Mining Category – 2 : Deputy Director (Chemicals). Class – IV Category – 1 : Assistant Director of Geology and Mining Category – 2 : Assistant Director (Chemicals). Class – V : Administrative Officer. Appointment:- (a) Appointment to the categories specified in column (2) of the table below, shall be made by the method of appointment specified in the corresponding entries in column (3) thereof:- Table Sl.No. Category Method of appointment (1) (2) (3) 1 Additional Director of Geology and Mining : Promotion from among the holders of the post of Joint Director of Geology and Mining. 2. Administrative Officer : Recruitment by transfer from senior among the holders of the post of Manager or Superintendent or Store Keeper, Grade I in the Department of Geology and Mining in the Tamil Nadu Ministerial Service. (b) Promotion shall be made on the grounds of merit and ability, seniority being considered where merit and ability are approximately equal. 3. Appointing Authority:- The appointing authority for all the posts shall be the Government. 4. Qualification:- (a) No person shall be eligible for appointment to the categories specified in column (2) of the table below, unless he possesses the qualifications specified in the corresponding entries in column (3) thereof:- Table Sl.No Category Qualification (1) (2) (3) 1) Assistant Director of Geology and Mining. Must have rendered service for a period of not less than three years in the post of Assistant Geologist. 2) Assistant Director (Chemicals). Must have rendered service for a period of not less than three years in the post of Chemist. 5. Probation:- (a) Every person appointed to the categories by recruitment by transfer shall, from the date on which he joins duty, be on probation for a total period of one year on duty within a continuous period of two years. (b) The Commissioner or Director of Geology and Mining, as the case may be, shall be the authority competent to declare the completion of probation in respect of the categories classified in Class IV and Class V. 6. Postings and Transfers:- The authority for effecting postings and transfers and sanction of leave in respect of the category of Additional Director of Geology and Mining shall be the Government and in respect of all other categories, the competent authority shall be the Commissioner or the Director of Geology and Mining, as the case may be.TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY 3 7. Preparation of annual list of approved candidates:- A list of approved candidates for appointment to the categories by promotion and by recruitment by transfer shall be prepared annually and the crucial date on which the candidates should possess the prescribed qualifications shall be the 15th April of every year. (b) Appointment to any of the categories, except to the categories of Draughtsman and Surveyor, shall be made on grounds of merit and ability, seniority being considered only where merit and ability are approximately equal. 3. Appointing Authority:- The appointing authority for all the categories shall be the Commissioner or the Director of Geology and Mining, as the case may be. 4. Reservation of appointment:- The provisions contained in Section 27 of the Tamil Nadu Government Servants (Conditions of Service) Act, 2016 (Tamil Nadu Act 14 of 2016) relating to rule of reservation shall apply to the categories for which candidates are appointed by direct recruitment. 5. Qualification:- (a) No person shall be eligible for appointment by direct recruitment to the categories of Assistant Geologist, Chemist and the Laboratory Attender, if he has completed or will complete the age of 30 years, on the first day of July of the year in which the recruitment is made: Provided that on and from 13.09.2021 till 12.09.2026, the maximum age limit for appointment to the said categories shall be thirty two years. Test:- (a) Every person appointed to the category of Assistant Geologist shall within the period of his probation, pass the following tests, namely:- (1) The Tamil Nadu Government Office Manual Test; (2) Account test for Subordinate Officers, Part-I; (3) Account Test for Executive Officers; (4) Mines and Minerals Acts and Rules Tests Paper-I; (5) Mines and Minerals Acts and Rules Tests Paper-II; (6) Mines and Minerals Acts and Rules Test Paper-III; (7) Bharatiya Nyaya Sanhita, 2023 (Central Act 45 of 2023) (General Principles); (8) Bharatiya Nyaya Sanhita, 2023 (Central Act 45 of 2023) (Detailed Applications); (9) Bharatiya Nagarik Suraksha Sanhita, 2023 (Central Act 46 of 2023) (General Principles); and (10) Bharatiya Nagarik Suraksha Sanhita 2023 (Central Act 46 of 2023) (Detailed Applications); (b) Every person appointed to the category of Chemist shall within the period of his probation shall pass the Account Test for Executive Officers or the Account test for Subordinate Officers, Part-I. 8. Preparation of annual list of approved candidates:- A list of approved candidates for appointment to the categories by direct recruitment, transfer and recruitment by transfer shall be prepared annually and the crucial date on which the candidates should possess the prescribed qualifications shall be the 15th April of every year. 9. Unit for appointment, discharge etc:- For the purpose of appointment, transfer, discharge etc., the entire State shall be deemed as one unit. 10. Postings and Transfers:- The authority for effecting postings and transfers and sanction of leave in respect of all the categories shall be the Commissioner or the Director of Geology and Mining, as the case may be. 11. Savings Clause:- Nothing contained in these rules shall adversely affect any person holding the post on the date of re-issue of these rules.
