In the reference 4th read above, the Hon’ble APAT has observed/ordered that “on
11-10-2011 the learned Government Pleader has placed before this Tribunal a letter
addressed by the 2nd respondent (i.e., the CSW, AP, Hyderabad) to the Government. It
is seen that the 2nd respondent has calculated the interest only on the delayed payment
of Gratuity, whereas the order passed by this Tribunal relates to entire retirement
benefits. Therefore, the 1st & 2nd respondents (i.e., Prl. Secretary to Govt., Social
Welfare Department and the Commissioner of Social Welfare, A.P. Hyderabad) are
directed to report back to this Tribunal the compliance orders in toto within a period of
three weeks failing which, they shall present before this Tribunal on 17-11-2011.”
2. In the reference 5th read above, the Commissioner of Social Welfare, AP,
Hyderabad has stated that, as per the above orders of Hon’ble APAT, Hyderabad,
interest on delayed Pensionary benefit from 30-01-1998 to 26-03-2004 @ 8% P.A is
worked as follows:
Total Eligible Pension Rs.1507/-
90% pension drawn by the Applicant from 01-12-1988 top 31-03-2004
Remaining 10% pension i.e., Rs. 151/-
Delayed period 30-12-1998 to 26-03-2004 i.e., 5 years 2 months 28 days
Total pension for the above period Rs.9498/-
Interest @ 8 % P.A Rs. 760/-
She is eligible for Rs. 760/- towards interest on pension.
3. Therefore the Commissioner of Social Welfare, AP, Hyderabad has requested
the Government to issue necessary orders in the matter in order to implement the
Hon’ble APAT orders.
4. Government after careful examination of the proposal of the Commissioner of
Social Welfare, A.P. Hyderabad hereby accord sanction for an amount of Rs. 760/-
(Rupees seven hundred and sixty only) for payment of interest @ 8% p.a. from
30.12.1998 to 26.03.2004 on pensionary benefits to Smt. Syed Mumtaz Bano W/o late
Sri S.A. Razack Quadri, Deputy Director (SW) (Retd.).

5. The above expenditure shall be debited under the Head of Account MH.2071-01-
MH.101-SH (04)-04/041 Pensions (Charged).
6. The Commissioner of Social Welfare, A.P. Hyderabad shall take necessary
action accordingly.
7. This order issues with the concurrence of Finance (Pension. I) Department vide
their U.O. No. 4935/42/A1/Pen.I/2012, Dated: 21.02.2012.
