From the Director General, Anti Corruption Bureau Rc.No.104/RCT-VSK/2010, dated 13.7.2010. 3. Govt.Memo.No.5225/TW.Ser.II.2/2010-1, dated 17.7.2010. 4. From the Commissioner of Tribal Welfare, Andhra Pradesh, Hyderabad Procgs.Rc.No.A1/6062/2010, dated 17.7.2010. 5. From the Director General, Anti Corruption Bureau, Rc.No.104/RCT-VSK/2010, dated 1.2.2011. 6. G.O.Rt.No.133, Social Welfare (TW.Ser.II.2) Department, dated 03-03-2012 * * * * ORDER: 1. In the reference 1st read above, the Director General, Anti Corruption Bureau, Hyderabad has reported that Sri Bankuru Suryanarayana, Assistant Tribal Welfare Officer, Mandasa was trapped on 06.07.2010 and arrested on the same day and remanded to judicial custody, and the A.O. has involved in a case of moral turpitude and the criminal case is under investigation. Hence, requested to suspend the Accused Officer in terms of Rule 8 (2) of the A.P.C.S.(CC&A) Rules, 1991. 2. In the reference 3rd read above, the Commissioner of Tribal Welfare, Hyderabad was requested to place the Accused Officer under suspension with immediate effect. Accordingly, in the reference 4th read above, the Commissioner of Tribal Welfare, Hyderabad has placed Sri Bankuru Suryanaryana, Assistant Tribal Welfare Officer, Mandasa, Srikakulam District under suspension w.e.f. 06.07.2010 in public interest until the conclusion of disciplinary proceedings / termination of all proceedings relating to the criminal charge(s). 3. In the reference 5th read above, the Director General, Anti Corruption Bureau, Hyderabad has reported that the Accused Officer demanded and accepted a bribe of Rs.5,000/- from the complainant for doing official favour to scrutinize, recommend and forward the diet bills of the boarders for the months of March,2010, April, 2010 of Ashrama Pathasala, Savaralingapuram, Nandigam Mandal of Srikakulam District and to submit the same to the Deputy Director (TW), Seethampeta for sanction was substantiated and recommended for prosecution in a court of law under section 7, 13 (2) r/w 13 (1) (d) of P.C.Act.1988. Further, it was also reported that the allegation that the A.O. has not submitted the Annual Property Statement to the Competent Authority was substantiated and recommended for Departmental Acton Rule 9 (7) r/w Rule 3 (1) and (2) of A.P.C.S. (Conduct) Rules, 1964. 4. In the reference 6th read above, orders were issued revoking the suspension of Sri Bankuru Suryanaryana, Assistant Tribal Welfare Officer, Mandasa, Srikakulam District reinstate him into service, without prejudice to the disciplinary proceedings pending / to arise against him in future and to post him to a non-focal post.::2:: 5. Government after considering the reports of the Director General, Anti Corruption Bureau in the reference 1st and 2nd and 5th read above and also taking into consideration the totality of circumstances of the case, it was decided to initiate Departmental Inquiry against Sri Bankuru Suryanaryana, Assistant Tribal Welfare Officer, Mandasa, Srikakulam District under A.P.C.S (CC&A) Rules, 1991 instead of Prosecution in Court of Law and initiating Departmental Action for violating of A.P.C.S (Conduct) Rules, 1964. The Director General, Anti Corruption Bureau is therefore requested to furnish Draft Articles of Charges against Sri Bankuru Suryanaryana, Assistant Tribal Welfare Officer for taking departmental action on the allegation of corruption.
