People – Sanction of Rs.68,009/- towards balance decretal charges, as ordered in AS
No.2037/1995 in OP.No.63/85 – Orders - Issued.

O R D E R:
In the reference 3rd read above, the Chief Commissioner of Land Administration,
A.P., Hyderabad has reported that the District Collector, Anantapur/Commissioner of
Social Welfare, A.P., Hyderabad vide references 2nd and 3rd read above, has stated that
the LAO/RDO, Anantapur has acquired land to an extent of Ac.3.50 Cts inSy.NO.297-2
situated at Anantapur Town and Mandal, and passed award No.2/79-80, dated 31.01.1980
duly fixing the market value at Rs.20,000/- per acre. As per the request of the claimants,
reference made U/s 18 of the LA Act. The Principal Sub-Judge, Anantapur in his orders
dated 01.10.1992 in OP. No. 63/85 has enhanced the market value from Rs.20,000/- to
Rs.80,000/- per acre in addition to all amended benefits of LA Act. Since the land value
is more than 50% enhanced, the LAO/RDO, Anantapur has filed an appeal in the
Hon’ble High Court. In the mean time the Sr. Civil Judge, has attached the properties of
the RDO’s Office in EP.No.25/93. The Hon’ble High Court has granted stay and
directed the LAO to deposit half of the decretal charges. Accordingly an amount of
RS.5,42,624/- deposited towards half of the decretal charges by the LAO/RDO..
Subsequently the Hon’ble High Court in its orders 09.3.2006 in AS No.2037/1995 has
confirmed the lower Court order. The Government Pleader, A.P., High Court has opined
that it is not a fit case to file further appeal in the Supreme Court of India vide his Lr.
dated 21.6.2006. The District Collector, Anantapur has submitted proposals for sanction
of Rs 67,996/- towards payment of balance decretal charges as per the Hon’ble High
Court orders dated 09.3.2006 in AS.NO.2037/95 in OP.No.63/85 for the land acquired to
an extent of Ac.1.15 Cts in Sy.No.297-2 situated at Anantapur Town & Mandal of
Anantapur District for providing house sites to the weaker section people.
2. The Special Chief Secretary & Chief Commissioner of Land Administration,
A.P., Hyderabad after verification and scrutiny of the proposals/calculation sheet
submitted by the Dist Collector, Anantapur/ Commissioner of Social Welfare, A.P.,
Hyderabad, has sent comparative calculation sheet for sanction of Rs.68,009/- towards
payment of balance decretal charges as per the Hon’ble High Court orders dated
09.3.2006 in AS.NO.2037/95 in OP.No.63/85 for the land acquired to an extent of
Ac.1.15 Cts in Sy.No.297-2 situated at Anantapur Town & Mandal of Anantapur District
for providing house sites to the weaker section people. He has further stated that the
Commissioner of Legal Affairs has opined that file may be processed for release of
balance decretal amount subject to correct calculation.

3. After careful examination of the matter, Government hereby accord sanction to
the Commissioner of Social Welfare, A.P., Hyderabad for release an amount of
Rs.68,009/- (Rupees sixty eight thousand and nine only) to the District Collector,
Anantapur, towards payment of balance decretal charges as per the orders of the Hon’bleHigh Court dated 09.3.2006 in AS.No.2037/95 in OP.No.63/85 for the land acquired to
an extent of Ac.1.15 Cts in Sy.No.297-2 situated at Anantapur Town & Mandal of
Anantapur District for providing house sites to the weaker section people.
4. The amount of expenditure sanctioned in para (3) above shall be met within the
BE.2011-12 and debited to the following Head of Account.
“2225-Welfare of Scheduled Castes, Scheduled Tribes and other Backward Classes
– 01 – Welfare of Scheduled Castes – M.H.283- Housing – G.H.11-Normal State
Plan – SH(08) Acquisition of House Sites to weaker sections in Indiramma
Programme – 310/312 – Other Grant – in – Aid”.
5. The Commissioner of Social Welfare, A.P., Hyderabad is directed to issue
necessary proceedings to the District Collector, Anantapur accordingly.
6. The District Collector, Anantapur shall verify the calculation sheet submitted by
the Land Acquisition Officer once again, before issue of proceedings for releasing the
amount. If any discrepancy/excess claim is found in the calculation sheet in future, the
Land Acquisition Officer shall be held solely responsible.
7. This order does not require the concurrence of Finance (Expr.SW) Department, as
per their instructions issued vide U.O Note No.12869/ 196 / A1/Esp.SW/2009 dated
22.5.2009 and U.O No.5926/256/A1/1/Expr.SW/09, dated 17.08.2009.
