Prasad, the then Deputy Director (SW) West Godavari district– Articles of Charges – Issued. ------------------------------------------------------------------------------- SOCIAL WELFARE (SER.II.1) DEPARTMENT G.O.Rt.No. 164 Dated: 13-03-2012 ORDER: It is proposed to hold an inquiry against Sri A.V.V.D.M. Prasad, the then Deputy Director (SW), West Godavari district and presently working in the office of Commissioner of Social Welfare, Andhra Pradesh, Hyderabad in accordance with the procedure laid down in Rule 20 of the Andhra Pradesh Civil Services (Classification, Control & Appeal) Rules, 1991. 2. The substance of the imputations of irregularities in respect of which the inquiry is proposed to be held is set out in the enclosed statement of Articles of Charges (Annexure-I). A statement of imputations of irregularities in support of each Article of Charge is enclosed (Annexure-II). A list of documents by which, and a list of witnesses by whom, the articles of charges are proposed to be sustained are also enclosed (Annexure-III & IV). 3. Sri A.V.V.D.M. Prasad, the then DD (SW), West Godavari District is directed to submit his written statement of defence within 10 working days from the date of receipt of this order. He is also to state whether he desires to be heard in person. 4. Sri A.V.V.D.M. Prasad, the then DD (SW), West Godavari District is informed that an inquiry will be held only in respect of those Articles of Charges as are not admitted. He should therefore, specifically admit or deny each article of charge. 5. Sri A.V.V.D.M. Prasad, the then DD (SW), West Godavari District is further informed that if he does not submit his written statement of defence on or before the period stipulated in para 3 above or otherwise fails or refuses to comply with the provisions of rule 20 of APCS (CCA) Rules, 1991 or the orders / directions issued in pursuance of the said rules, the Inquiring Authority may hold the inquiry against him ex-parte. 6. Attention of Sri A.V.V.D.M. Prasad, the then DD (SW), West Godavari District is invited to Rule 24 of the A.P. Civil Services (Conduct) Rules, 1964, under which no Government Servant shall bring or attempt to bring any political or outside influence to bear upon any superior authority to further his interests in respect of matters pertaining to his service under the Government. If any representation is received on his behalf from another person in respect of any matter dealt with these proceedings, it will be presumed that Sri A.V.V.D.M. Prasad, the then DD (SW), West Godavari District is aware of such a representation and that it has been made at his instance and action will be taken against him for violation of Rule 24 of the A.P. Prasad, while working as Deputy Director (SW), West Godavari District at Eluru failed to supervise the disbursement of scholarship amounts in the district, which paved way for misappropriation of scholarship amounts of SC/ST/BC students by the Principal, Col.D.S.Raju Polytechnic College, Poduru, West Godavari District. Article-2: That Sri A.V.V.D.M. Prasad while working as Deputy Director (SW), West Godavari District at Eluru failed to review the work of the Assistant Social Welfare Officers and failed in taking all possible steps to ensure the integrity and devotion to duty of all Government servants for the time being under his control and authority, which paved way for misappropriation of Scholarship amounts by the said College. Article-3: That Sri A.V.V.D.M. Prasad while working as Deputy Director (SW), West Godavari District at Eluru in connivance with the Principal, Col.D.S.Raju Polytechnic College, Poduru, West Godavari District failed to follow the procedures laid down in G.O.Ms.No.90, Social Welfare (SW.Edn.2) Department, Dated: 30-7-2002. He had willfully and deliberately failed in discharging his legitimate duties paving way for misappropriation of scholarship amounts by the said College. Thus, Sri A.V.V.D.M. Prasad while working as Deputy Director (SW), West Godavari District at Eluru by his above mentioned acts has exhibited lack of integrity, devotion to duty, and conduct un-becoming of a Government Servant and thereby violated Rules 3 (1), (2) & (5) of Andhra Pradesh Civil Services (Conduct) Rules, 1964. PRASAD, FORMER DEPUTY DIRECTOR (SW), WEST GODAVARI DISTRICT NOW WORKING AS DEPUTY DIRECTOR (SW) IN THE O/O CSW, AP, HYDERABAD. Sri A.V.V.D.M. Prasad S/o Sri Somaraju is a native of Rajahmundry, East Godavari District. He joined Government Service on 5-10-1990 as District Social Welfare Officer in Social Welfare Department and worked as District Social Welfare Officer up to 21-4- 1994. Further, he was promoted as Deputy Director (SW) and joined duty on 22-4-94. His date of birth is 1-7-1954. His date of attaining superannuation is 30-6-2012. He is referred herein-after to as Government Servant (GS). Article-1: When the Government Servant was working as Deputy Director (SW), West Godavari District at Eluru, the College authorities of Col.D.S.Raju Polytechnic College, Poduru, West Godavari district committed the following irregularities and misappropriated Scholarship amounts: a) Distributed the scholarship amounts to SC/ST/BC students without observing 75% attendance of the students in violation of the rules; prepared fake acquittance rolls; b) The Principal and Assistant concerned with Scholarships seat have misappropriated the Scholarship amounts meant for Polasupudi Pandu S/o. Yadava Raju, R/o. Gopalapuram village and mandal and Vennapur Edukondala S/o. Papa Rao, R/o. Vennappuvaripalem, Achanta mandal, who had discontinued their studies by submitting fake and fabricated records; The scholarship amounts were renewed during the year 2005-2006 though they have discontinued the studies in the beginning of the year 2004-2005 and the amounts were also shown disbursed to the concerned students. c) Failed to disburse the scholarship amounts by way of account payee cheques; d) Failed to maintain the cash book for the amounts withdrawn from the college account; e) Failed to get the accounts audited by the State Audit Department; f) There were several withdrawals on self cheques and cash deposits into the college accounts of SBH, Palakollu and Indian Bank, Poduru. The failure of the GS in supervising the disbursement paved way for misappropriation of scholarship amounts by the said College. Article-2: When the Government Servant was working as Deputy Director (SW), West Godavari District at Eluru, Smt.S.Veda Kumari, the then Assistant Social Welfare Officer, Poduru (retired on 31-05-2007) failed to reconcile the accounts and also failed to verify the sanctions and relevant acquittances submitted by the said College. Thus the Government Servant failed to review the work of the ASWO and failed in taking all possible steps to ensure the integrity and devotion to duty of all Government servants for the time being under his control and authority, which paved way for misappropriation of Scholarship amounts by the said College.::2:: Article-3: The Government Servant willfully and deliberately violated the following procedures laid down in G.O.Ms.No.90, Social Welfare (SW.Edn.2) Department, Dated: 30-7-2002: a) The Deputy Director (SW) shall deposit the Banker Cheques / Drafts in College Account and see that the disbursement is done within 10 days. But there was abnormal delay in disbursement of scholarship amounts to the students by the management of the said College. For instance, the Deputy Director (SW) sent scholarship amounts through cheque to the said college on 20-10- 2005, but the Principal has furnished the acquittance on 17-3- 2003, i.e., after lapse of 4 months. b) The Deputy Director (SW) shall carry out a minimum of 20% inspection of unaided colleges, Para Medical colleges, Polytechnics, ITCs, Law and other such courses and a minimum of 5% of all other colleges at random. But, the GS did not take any steps to verify the records such as cash book, acquittance and other procedures of disbursement of scholarship amounts. c) The ASWO shall inspect the colleges along with the application forms and verify the entries in the application form with reference to College Admission Register and conduct physical verification of students duly identifying with photos, who have applied for scholarships (100% verification). The GS did not make the ASWO concerned to check up the distribution of scholarship. d) The Deputy Director (SW) shall have frequent interaction with the Principals of colleges and review the attendance, performance of the students, disbursements of scholarships and utilization of fee at least, once in a quarter. But the GS did not review the subject with the Principals / ASWOs and students. Thus, Sri A.V.V.D.M. Prasad, the then Deputy Director (SW) now working as Deputy Director (SW), O/o. the Commissioner of Social Welfare, Andhra Pradesh, Hyderabad by his above-mentioned acts, has exhibited lack of integrity, devotion to duty, utter failure in supervision, and conduct un-becoming of a Government Servant and thereby contravened Rules 3 (1), (2) & (5) of APCS (Conduct) Rules, 1964.
