Revised Pension Rules, 1980 read with Rule 20 of Andhra Pradesh Civil Services
(Classification Control & Appeal) Rules,1991 on the allegation of irregularities in
regularization of services of Sri H.Venkatesh, Daily Wage Worker in S.T. Boys Hostel,
Pulivendula, Kadapa District as cook – Imposing punishment of 10% cut in pension

ORDER:
In the reference 1st read above, the District Collector, Kadapa has requested
the Director, Tribal Welfare, Hyderabad to take suitable disciplinary action against
Sri D.Prakash, Assistant Tribal Welfare Officer (Retd.), Kadapa who committed
irregularities while recommending to the Government for regularization of services of
H.Venkatesh, daily wage worker in S.T.Boys Hostel, Pulivendula, Kadapa District as
Cook, by producing fabricated record and also requested to take necessary action for
cancellation of G.O.Rt.No.432 Social Welfare (TW.Ser.III) Department dated
18.6.2008, so as to issue termination orders to H.Venkatesh, Daily Wage Worker.
2. In the reference 2nd read above, orders were issued canceling the orders issued
in G.O.Rt.No.432 Social Welfare(TW.Ser.III) Department dated 18.6.2008
i.e. regularizing the services of Sri H.Venkatesu, Daily wage worker in S.T.Boys
Hostel, Pulivendula, Kadapa Dist. as Cook.
3. In the reference 3rd read above, sanction orders were issued for initiating
disciplinary proceedings under Rule 9 of Andhra Pradesh Revised Pension Rules, 1980
against Sri D.Prakash, Assistant Tribal Welfare Officer (Retd.) and articles of charges
were also issued and directed him to submit his explanation.
4. In the reference 4th read above, the Charged Officer has submitted his
explanation.::2::
5. In the reference 5th read above, while sending the explanation of the Charged
Officer, it was requested the Commissioner of Tribal Welfare, Hyderabad to furnish
his specific remarks to Government for taking further action.
6. In the reference 6th read above, the Commissioner of Tribal Welfare,
Hyderabad has informed that as the Charged Officer has denied the charges framed
against him it would be appropriate if a detailed inquiry is conducted into the charges
in the manner laid down under Rule 20 of Andhra Pradesh Civil Services (Classification
Control & Appeal) Rules,1991.
7. Accordingly, in the reference 7th read above, orders were issued appointing
Sri V.China Veerabhadrudu, Additional Director, office of the Commissioner of Tribal
Welfare, Hyderabad as Enquiry Officer, and District Tribal Welfare Officer, Kadapa as
Presenting Officer. In the reference 8th read above, the Enquiry Officer has submitted
his report.
8. In the reference 9th read above a Show Cause Notice was issued to the Charged
Officer and directed him to state why punishment of 10% (ten percent) cut in pension
permanently under Rule 9 of Andhra Pradesh Revised Pension Rules, 1980 shall not be
imposed on him as the charges framed against him was held proved and directed him
to submit his explanation if any. In the reference 10th read above, the Charged Officer
has submitted his explanation to Government.
9. In the reference 11th read above, while forwarding the explanation of the
Charged Officer it was requested the Commissioner of Tribal Welfare, Hyderabad to
send her specific remarks on it to Government. In the reference 12th read above, the
Commissioner of Tribal Welfare, Hyderabad has submitted her specific remarks to
Government.
10. Government after careful examination hereby order to impose the punishment
of 10% (Ten percent) cut in pension permanently under Rule (9) of Andhra Pradesh
Revised Pension Rules, 1980 against Sri D.Prakash, Assistant Tribal Welfare Officer
(Retd.) for irregularities in regularization of services of Sri H.Venkatesu, Daily Wage
Worker in S.T. Boys Hostel, Pulivendula, Kadapa District as cook.
11. The Commissioner of Tribal Welfare, Hyderabad shall take necessary action
accordingly.
