From the Secretary, Andhra Pradesh Public Service Commission, Lr.No.1652/RT-I/1/2011, dated:01-12-2011. -oOo- ORDER:- On receipt of credible information on certain serious financial irregularities committed by the Wardens / Matrons of Social Welfare Hostels in Warangal District in maintenance of Hostels / Institutions during the year 1993-94, the Joint Director (Vigilance), O/o the Commissioner of Social Welfare, A.P., Hyderabad, conducted preliminary enquiry into the irregularities committed by the Wardens /Matrons and submitted the report. 2. Definite charges were framed against (32) Wardens / Matrons including Sri K.Chandraiah, formerly Warden, SW Boys Hostel, Shayampet and SW Boys Hostel, Nallabelli, now retired Hostel Welfare Officer, Gr-II based on the report of Joint Director (Vigilance). After receipt of the explanations from the Charged Officers, the Assistant Director (Legal Cell), O/o the Commissioner of Social Welfare, Hyderabad, was appointed as Common Enquiry Officer under Rule, 24 (1) of APCS (CC&A) Rules vide Commissioner of Social Welfare’s Procgs.No.M1/21006/94, dated 04.06.1995, to conduct detailed enquiry. The Assistant Director (Legal Cell) conducted enquiry and submitted his report on 30.12.1995. 3. The District Collector, Warangal, who is the disciplinary authority in respect of Wardens / Matrons, after receipt of the enquiry report, has passed final orders imposing the penalties against the Wardens/Matrons duly following the procedure contemplated in APCS (CC&A) Rules, 1991. 4. Government, in the reference 1st read above, observed that without conducting special audit and without assessing the actual misappropriation of (P.T.O…):: 2 :: amounts in the case of Social Welfare Hostels, the penalties already imposed based on the enquiry report by the District Collector/Commissioner of Social Welfare, does not seem to be in order and in the result it may whittle down the CBCID case in process. The Government, has therefore, accorded permission to the Commissioner of Social Welfare, A.P., Hyderabad, to reopen the cases of misappropriation of Government funds in Social Welfare Hostels in Warangal District, and to take up fresh enquiry under Rule 41 of Andhra Pradesh Civil Services (CC&A) Rules, 1991. 5. In the reference 2nd read above, the Commissioner of Social Welfare, A.P., Hyderabad, has issued orders for reopening the disciplinary cases against (31) Warden/ Matrons under Rule 41 of Andhra Pradesh Civil Services (CC&A) Rules, 1991. 6. Government vide G.O 3rd read above, issued orders for conducting of Special Audit on the misappropriation of Government funds and financial irregularities in Government Welfare Hostels/Other Institutions of Warangal District, for a period of three years from 1991-92 to 1993-94. The Special Audit Party conducted the audit of all the Government Social Welfare Hostels/Other Institutions in the District for the periods from 1991-92 to 1993-94 and submitted their reports to the Commissioner of Social Welfare, A.P., Hyderabad. 7. In the reference 4th read above, the Commissioner of Social Welfare, has communicated the Special Audit Reports to the District Collector, Warangal for taking further action in the matter. 8. In the reference 5th read above, charges have been framed against Sri K.Chandraiah, formerly warden SW Boys Hostel, Shayampet and SW Boys Hostel, Nallabelli, now retired Hostel Welfare Officer, Gr-II for irregularities committed in maintenance of Hostels during 1991-92 to 1993-94. Sri K.Chandraiah, has submitted his written statement of defence. 9. In the reference 6th read above, the District Collector has appointed the Revenue Divisional Officer, Warangal as Enquiry Officer and Assistant Social Welfare Officer concerned as Presenting Officer. The Revenue Divisional Officer, Warangal has submitted his report. 10. In the reference 7th read above, after examining the enquiry report submitted by the Inquiring Authority, the District Collector disagreed with the findings of the Inquiry officer and served show cause notice enclosing disagreement note to Sri K.Chandraiah, formerly warden SW Boys Hostel, Shayampet and SW Boys Hostel, Nallabelli, now retired HWO, Gr-II. 11. In the reference 8th read above, Sri K.Chandraiah, formerly warden, SW Boys Hostel, shayampet and SW Boys Hostel, Nallabelli now retired HWO Gr-II has submitted his explanation. 12. As the Charged Officer Sri K. Chandraiah retired from service on 31-08-2006, in the reference 9th read above, Government, issued a show cause notice to Sri K.Chandraiah, formerly warden SW Boys Hostel, Shayampet and SW Boys Hostel, Nallabelli, now retired HWO, Gr-II, directed to explain as to why a penalty of stoppage of 15% cut in pension for a period of (3) years besides recovery of the misappropriated amount of Rs.1,29,879/- and 94,728/-, should not be imposed against him for the irregularities committed by him and reply to Government within (15) days from the date of receipt of the show cause notice. 13. In the reference 10th read above Sri. K.Chandraiah, formerly Warden, SW Boys Hostel, Shayampet and SW Boys Hostel, Nallabelli, now retired HWO, Gr-II has submitted his explanation. 14. When the matter was referred to the Andhra Pradesh Public Service Commission and the Andhra Pradesh Public Service Commission have furnished there advice vide letter in the reference 11th read above. After careful examination of the entire issue, Government hereby order to impose penalty of 15% cut in pension for a period of (3) years besides recovery of the misappropriated amount of Rs. 1,29,879/- and 94,728/- from Sri. K.Chandraiah, formerly Warden, SW Boys Hostel, Shayampet and SW Boys Hostel, Nallabelli, now retired HWO, Gr-II as per Rules in force. 16.
