Short title, commencement and application:- (1) These regulations may be called the National Highways Authority of India (House Rent Allowance and Leased Accommodation) Regulations, 1997. (2) They shall come into force with effect from 1.4.1996. (3) They shall apply to all officers and employees in whole time employment of the Authority. 2. Definitions:- In these regulations, unless the context otherwise requires:- (a) “Committee” means a committee constituted under Regulation 4. (b) “Competent Authority” means the Chairman or a Member or any other officer authorized as such by the Authority in this behalf; (c) “Headquarters” in relation to an officer or employee, means the city or town in which the officer or employee has been posted for the time being. (d) “Officer or Employee” means any person who is in whole time employment of the Authority; 3. Hiring of accommodation:— (1) The Authority may, from time to time, take residential accommodation on rent or lease and allot the same to the eligible officers or employees. (2) Before hiring or leasing any house or flat, the Competent Authority or the Deputy General Manager (Admn.) shall execute an agreement in Form-I annexed to these regulations. (3) An officer or employee, who owns a flat or house or in the name of the member of his family in the vicinity of his headquarters may also enter into a self-lease agreement in Form-II annexed to these regulations in relation to such flat or house with the Authority. (4) Where a lease agreement has been entered into under sub-regulation (3), the Authority may allot the leased house or flat to the owner or to any other officer or employee. 4. Committee:- (1) For the purpose of assessing the housing requirement of the officers and employees, and making allotment of leased accommodation, there shall be a committee comprising of officers of the Authority as constituted by the Chairman or a Member authorized by the Authority in this behalf. (2) The committee constituted under sub-regulation (1) shall -6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (a) assess the housing requirement of its officers and employees; (b) determine the rental value of house/flat offered to the Authority for lease/rent including the house/flat offered for self-lease. (3) The committee after examination of the matters placed before it, shall forward its recommendation to the Competent Authority. 5. Entitlement for leased accommodation:- The entitlement for a leased house or flat shall be determined in accordance with the following table:- TABLE S. House Rent Allowance without production of rent receipt:- An officer or employee who has not been provided with a residential accommodation by the Authority shall be eligible to be granted House Rent Allowance at the rate of thirty per cent of his basic pay if the headquarters of such officer or employee is in Delhi or Bombay, and twenty-five per cent of his basic pay if his headquarters happens to be in any other city, without the production of rent receipt from the landlord. 7. Recovery of rent:- Where an officer or employee has been provided with residential accommodation by the Authority, ten per cent of his basic pay shall be deducted from his salary as his contribution towards the rent and he shall not be entitled to any House Rent Allowance admissible under these regulations. 8. Residuary matters:- Matters with respect to which no specific provision has been made in these regulations shall be regulated in accordance with the guidelines issued by the Department of Public Enterprises with regard to the payment of House Rent Allowance to the employees or the central public enterprises, as amended from time to time. 9. Power to interpret:- If any question arises regarding the interpretation of any or all the provisions of these regulations, the decision of the Chairman shall be final. 10. Power to relax:- The Chairman, may relax any or all the provisions contained in these regulations, after recording reasons for relaxing in writing. Short title, commencement and application:- These regulations may be called the National Highways Authority of India (House Rent Allowance and Leased Accommodation) Amendment Regulations, 2000. (2) They shall come into force with effect from the following dates:— (a) Provisions of paras 2 and 4 of this notification shall come into effect from 1.4.1999. (b) Provisions of para 3 of this notification shall come into effect from 18.5.1998. 2. For regulation 5 of the National Highways Authority of India (House Rent Allowance and Leased Accommodation) Regulations, 1997 (hereinafter referred to as the principal regulations), the following regulation shall be substituted, namely:- “5. Entitlement for leased accommodation:- The entitlement for leased accommodation shall be as given below:- (a) A-1 cities - 40% of the maximum of the scale. (b) A/B-1/B-2 cities - 25% of the maximum of the scale. (c) C class cities - 17.5% of the maximum of the scale. (d) Unclassified cities - 15% of the maximum of the scale. Provided that in addition the officers and employees will be paid two months rent each year for petty repairs.” 3. In regulation 6 of the principal regulations, after word “Bombay”, the words “or Chennai or Calcutta” shall be inserted. 4. For regulation 7 of the principal regulations, the following regulation shall be substituted, namely:- “7. Recovery of rent:- Where an officer or employee has been provided with residential accommodation on Authority lease, a monthly recovery ranging from Rs.113 to Rs.510 shall be made from his salary and in case of self-lease, a monthly recovery ranging from Rs.1000 to Rs.2000 shall be made as his contribution towards the rent and he shall not be entitled to any House Rent Allowance admissible under these regulations.” NARENDRA KUMAR, Member (Administration) [ ADVT-III/4/Exty./122/13] Explanatory Memorandum The Authority, in its meeting held on 22.10.2013, has decided to give retrospective effect to these Regulations from the date of their approval in the respective meetings of the Authority. Short title, commencement and application:- These regulations may be called the National Highways Authority of India (House Rent Allowance and Leased Accommodation) Amendment Regulations, 2004. (2) They shall come into force with effect from 19.6.2004. 2. For sub-regulation (3) of regulation 1 of the National Highways Authority of India (House Rent Allowance and Leased Accommodation) Regulations, 1997 (hereinafter referred to as the principal regulations), the following regulation shall be substituted, namely:- “(3) They shall apply to all officers and employees in whole time employment of the Authority, including the staff.” 3. For sub-regulation (d) of regulation (2) of the principal regulations, the following regulation shall be substituted, namely:- “(d) “officer or employee” means any person who is in whole time employment of the Authority, including the staff.” 4. For regulation 7 of the principal regulations, the following regulation shall be substituted, namely:- “7.
