और जहा ं तक आयोग ने पाया िक िविनयम(cid:7298) की शत(cid:7300) और पिरभाषा(cid:7312) म(cid:7286) कुछ स्प(cid:7397)ता लाने के िलए िव(cid:7378)ुत के क्षे(cid:7074)
म(cid:7286) हुए पिरवतर्न(cid:7298) के अनुरूप मूल िविनयम, 2009 और (cid:7079)थम संशोधन िविनयम 2013 म(cid:7286) संशोधन करने की
आवश्यकता अिनवायर् ह।ै
इसिलए अब िव(cid:7378)ुत अिधिनयम, 2003 (2003 का 36) की धारा 42 (6) और धारा 181 के तहत (cid:7079)द(cid:7275) शि(cid:7334)य(cid:7298)
तथा अन्य सभी शि(cid:7334)य(cid:7298) का (cid:7079)योग करते हुए, आयोग ने मूल िविनयम, 2009 और (cid:7079)थम संशोधन िविनयम, 2013
म(cid:7286) भी संशोधन करने का (cid:7079)स्ताव िकया ह ै तथा िव(cid:7378)ुत (िपछले (cid:7079)काशन की (cid:7079)ि(cid:7059)या) िनयम, 2005 की धारा 181 की
उप-धारा (3) (cid:7367)ारा अपेिक्षत अनुसार, संशोधन िविनयम(cid:7298) के (cid:7079)ारूप को सभी व् यिक् तय(cid:7298), िजनके इससे (cid:7079)भािवत होने
की संभावना ह,ै की सूचना के िलए एत(cid:7375)ारा (cid:7079)कािशत िकया जाता ह ै तथा एत(cid:7375)ारा नोिटस िदया जाता ह ै िक

संशोधन िविनयम(cid:7298) के उक् त (cid:7079)ारूप, िजस पर कोई आपि(cid:7275) या सुझाव, जो उक् त अविध के अंदर (cid:7079)ाप् त ह(cid:7298)गे, पर
अिधसूचना की तारीख से तीस (30) िदन(cid:7298) की समाि(cid:7385) के बाद िवचार िकया जाएगा।

1. लघु शीषर्क, िवस्तार और (cid:7079)ारंभण
(1) इन िविनयम(cid:7298) को गोवा राज् य और क(cid:7286)(cid:7076) शािसत (cid:7079)दशे (cid:7298) के िलए संयु(cid:7334) िव(cid:7378)ुत िविनयामक आयोग
(लोकपाल की िनयुि(cid:7334) और कायर्क्षे(cid:7074)) तृतीय संशोधन िविनयम, 2017 कहा जाएगा।
(2) ये िविनयम सरकारी राजप(cid:7074) म(cid:7286) उनके (cid:7079)काशन की तारीख से लागू ह(cid:7298)गे।
(2) मलू िविनयम, 2009 के िविनयम 3(4) म (cid:7286) सशं ोधन और (cid:7079)थम सशं ोधन िविनयम, 2013 - िविनयम 3(4)
को िन(cid:7388)ानसु ार बदला जाएगा:-
आयोग (cid:7367)ारा िनयु(cid:7334) लोकपाल िविध, (cid:7079)बंधन, इंजीिनय(cid:7411)रंग, िव(cid:7275), अथर्शा(cid:7403), वािणज्य, लोक (cid:7079)शासन के
िकसी भी क्षे(cid:7074) का अनुभवी व् यिक् त, जो िवशेषकर िवधुत क्षे(cid:7074) म(cid:7286) सत् यिनष् ठ, िवख् यात और अच् छी साख
रखता हो, िजसने भारत सरकार म(cid:7286) संयुक् त सिचव या समकक्ष या भारत सरकार/ राज्य सरकार म(cid:7286) अपर
िजला न्यायाधीश या मुख् य इंजीिनयर या समकक्ष या अनुसूची 'क' केन्(cid:7076)ीय सावर्जिनक क्षे(cid:7074) के उप(cid:7059)म
(सीपीएसयू) म(cid:7286) महा(cid:7079)बंधक या समकक्ष या िकसी भी सावर्जिनक या िनजी क्षे(cid:7074) के उप(cid:7059)म म(cid:7286) समकक्ष के रूप
म(cid:7286) या गैर-सरकारी संगठन, िजसका आयोग की राय म(cid:7286) अनुभव का स्तर उपयुर्क् त के समकक्ष माना जा
सकता ह,ै म(cid:7286) कायर् िकया हो। उपयुर्(cid:7334) के बावजूद, आयोग अपने िकसी भी अिधकारी को लोकपाल के रूप म(cid:7286)
कायर् करने के िलए िन(cid:7416)द(cid:7397)र् कर सकता ह।ै
(3) मलू िविनयम, 2009 के िविनयमन 9(3) के बाद िन(cid:7388)िलिखत नए िविनयम जोड़े जाएंग े
"3 (क) – छूट दने े का अिधकार
आयोग, जन िहत म(cid:7286) इन िविनयम(cid:7298) के िकसी (cid:7079)ावधान म(cid:7286) छूट द े सकता ह ै िजसके कारण(cid:7298) को िलिखत म(cid:7286) दजर्
िकया जाना चािहए।

NOTIFICATION
Gurgaon, the 12th June, 2017
No. JERC-3/2009.—WHEREAS the Joint Electricity Regulatory Commission for the State of Goa and Union
Territories (hereinafter referred to as “the Commission”) notified the Joint Electricity Regulatory Commission for the
State of Goa and Union Territories (Appointment and Functioning of Ombudsman) Regulations, 2009 (hereinafter
referred to as “the Principal Regulations, 2009”);
AND WHEREAS the Commission notified the Joint Electricity Regulatory Commission for the State of Goa and Union
territories (Appointment and Functioning of Ombudsman) First Amendment Regulations, 2013.
AND WHEREAS the Commission observed that there is an imperative need to amend the Principal Regulations, 2009
and also the First Amendment Regulations, 2013 in line with the changes in the electricity sector to bring in some clarity
in the terms and definition of the Regulations.
NOW THEREFORE in exercise of powers conferred under Section 42 (6) and Section 181 of the Electricity Act, 2003
(36 of 2003) and all other powers enabling it in that behalf, the Commission proposes to amend the Principal
Regulations, 2009 and also the First Amendment Regulations, 2013 and as required by sub-section (3) of section 181 of
the said Act and Rule 3 of the Electricity (Procedure for Previous Publication) Rules, 2005, the draft amendment
regulations are hereby published for the information of all the persons likely to be affected thereby, and notice is hereby
given that the said draft amendment regulations will be taken into consideration after the expiry of thirty (30) days from
the date of notification together with any objections or suggestions which may, within the aforesaid period, be received in
respect thereto.

The objections or suggestions in this behalf should be addressed to the Secretary, Joint Electricity Regulatory

DRAFT REGULATIONS
1. SHORT TITLE, EXTENT AND COMMENCEMENT
(1) These Regulations may be called the Joint Electricity Regulatory Commission for the State of Goa and UTs
(Appointment and Functioning of Ombudsman) Third Amendment Regulations, 2017.
(2) These Regulations shall come into force with effect from the date of their publication in official Gazette.
(2) Amendment of Regulation 3 (4) of Principal Regulations, 2009 and First Amendment of Regulations, 2013-
Regulation 3 (4) shall be replaced as under:-
The Ombudsman appointed by the Commission shall be a person of integrity, repute and standing preferably in the
electricity sector having experience in any of the areas of Law, Management, Engineering, Finance, Economics,
Commerce, Public Administration who has served at the level of Joint Secretary to the Government of India or
equivalent or as Additional District Judge or Chief Engineer in the Government of India / State Government or
equivalent or General Manager in Schedule ‘A’ Central Public Sector Undertaking (CPSU) or equivalent in any
public or private sector undertaking or a non-governmental organization whose level of experience in the opinion of
the Commission can be treated as comparable to the aforesaid. Notwithstanding anything above, the Commission
may designate any of its Officers to act as the Ombudsman.
(3) The following new Regulation shall be inserted after Regulation 9(3) of the Principal Regulations, 2009
“3(a) – Power to Relax
The Commission may, in public interest and for the reasons to be recorded in writing relax any provision of these
Regulations.
