का.आ. 1415(अ).—िम्मू और कश्मीर पीपुल्स लीग (िेकेपीएल) के चार गुट, अथाचत ् िेकेपीएल (मुख़्तार अहमद
विा), िेकेपीएल (बिीर अहमद तोता), िेकेपीएल (गलु ाम मोहम्मद ख़ान उर्च सोपोरी), जिसे िम्मू और कश्मीर पीपुल्स
पॉजलटटकल लीग के रूप म ें भी िाना िाता ह ै और याकूब िेख़ के नेतृत्व म ें िेकेपीएल (अज़ीज़ िेख़), जवजधजवरुद्ध
दियाकलापों म ें संजलप्त ह,ै िो दिे की अखडं ता, संप्रभुता और सरु क्षा के जलए प्रजतकूल ह;ैं
और, िेकेपीएल के उपरोक्त गटु ों के सदस्ट्य िम्म-ू कश्मीर म ें अलगाववाद को बढावा देने के जलए आतंकवादी
दियाकलापों और भारत जवरोधी दष्प्ु प्रचार का समथचन करन े म ेंसजम्मजलत रह े ह;ैं
और, िेकेपीएल के उपरोक्त गुटों के नेता और सदस्ट्य, िम्मू और कश्मीर म ें सुरक्षा बलों पर लगातार पत्थरबािी
कराने समेत जवजधजवरुद्ध दियाकलापों को अंिाम देने के जलए िम्मू और कश्मीर के जवजभन्न भागों म ें हहसक प्रदिचनकाटरयों
को िुटाने म ें सजम्मजलत रह ेह;ैं
और, िेकेपीएल के उपरोक्त गटु , िम्मू और कश्मीर के लोगों को जनवाचचन म ें भाग न लने े के जलए लगातार
भड़काते रह े ह ैं और इस प्रकार इन् होंने भारतीय लोकतंत्र के सवं ैधाजनक दजृ ि स े बुजनयादी मान्यता प्राप्त, मूल जसद्धांतों को
जनिाना बनाया ह ैऔर अवरोध उत्पन्न दकया ह;ै
और, िेकेपीएल के उपरोक्त गटु ों के सदस्ट्यों के दियाकलापों स े देि के संवैधाजनक प्राजधकार और संवैधाजनक
व्यवस्ट्था के प्रजत घोर अनादर प्रदर्शित होता ह;ै

और िेकेपीएल के उपरोक्त गुट राष्ट्र-जवरोधी और जवध्वंसक दियाकलापों म ें सजम्मजलत होकर भारत स े िम्मू और
कश्मीर के अलगाव को प्रोत्साहन देन,े सहायता करन े और इसके जलए उकसान;े लोगों के बीच नफरत के बीि बोन;े लोगों
को लोक व्यवस्ट्था अजस्ट्थर करन े के जलए आंदोलन करन;े िम्मू और कश्मीर को भारत संघ स े पृथक करने के जलए हजथयार
उठाने के जलए प्रोत्साजहत करने; स्ट्थाजपत सरकार के जवरुद्ध नफरत को बढावा देने और िम्मू-कश्मीर म ें कई मौकों पर
जनवाचचनों का बजहष्प्कार करने और िम्म-ू कश्मीर म ें भारत के गणतंत्र ददवस एव ं स्ट्वतंत्रता ददवस पर 'काला ददवस' और बंद
का खुलकर आह्वान करन े की दियाकलापों म ें जलप् त ह;ै
और, केंद्रीय सरकार की यह भी राय ह ै दक यदद िेकेपीएल के उपरोक्त गुटों के जवजधजवरुद्ध दियाकलापों पर तरु ंत
अंकुि और जनयंत्रण नहीं लगाया गया, तो वह जनम्न जलजखत के जलए इस अवसर का लाभ उठाएगी –
(i) दिे की क्षेत्रीय अखडं ता, सुरक्षा और संप्रभुता के जलए हाजनकारक राष्ट्र-जवरोधी दियाकलापों को िारी रखन े
के जलए;
(ii) िम्मू और कश्मीर राज्य के भारत सघं के साथ जवलय पर जववाद खड़ा करते हुए, उसे संघ स े अलग करन े
की वकालत िारी रखन े के जलए; और
(iii) भारत के प्रजत अप्रीजत पदै ा करने और लोक व्यवस्ट्था को बाजधत करने के इराद े स े िम्म-ू कश्मीर के लोगों के
बीच झूठी कहानी गढन े और राष्ट्र जवरोधी भावनाओं का प्रचार िारी रखन े के जलए;
और, उपयुचक्त उजल्लजखत कारणों स े केंद्रीय सरकार का यह दढृ मत ह ै दक िेकेपीएल के उपरोक्त गुटों के
दियाकलापों को ध्यान म ें रखते हुए, िम्मू और कश्मीर पीपल्ु स लीग (िेकेपीएल) के उपरोक्त चार गुट अथातच ् िेकेपीएल
(मुख़्तार अहमद वज़ा), िेकेपीएल (बिीर अहमद तोता), िेकेपीएल (गलु ाम मोहम्मद ख़ान उर्च सोपोरी), जिसे िम्मू और
कश्मीर पीपुल्स पॉजलटटकल लीग के रूप म ें भी िाना िाता ह,ै और याकूब िेख़ के नेतृत्व म ें िेकेपीएल (अज़ीज़ िेख़) को
'तत्काल प्रभाव स े'जवजधजवरुद्ध संगम' घोजित करना आवश्यक ह;ै
अत: अब, केंद्रीय सरकार जवजधजवरुद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 (1967 का 37) की धारा 3 की
उप-धारा (1) द्वारा प्रदत्त िजक्तयों का प्रयोग करते हुए, िम्मू और कश्मीर पीपल्ु स लीग (िेकेपीएल) के चार गुट अथाचत ्
िेकेपीएल (मुख़्तार अहमद विा), िेकेपीएल (बिीर अहमद तोता), िेकेपीएल (गलु ाम मोहम्मद ख़ान उर्च सोपोरी), जिसे
िम्मू और कश्मीर पीपल्ु स पॉजलटटकल लीग के रूप म ें भी िाना िाता ह,ै और याकूब िेख़ के नेतृत्व म ें िेकेपीएल (अज़ीज़
िेख़) को जवजधजवरुद्ध सगं म घोजित करती ह;ै
उपयुचक् त पटरजस्ट्थजतयों को ध्यान म ें रखत े हुए, केंद्रीय सरकार का दढृ मत ह ै दक िम्मू और कश्मीर पीपुल्स लीग
(िेकेपीएल) के चार गुट अथातच ् िेकेपीएल (मख़्ु तार अहमद विा), िेकेपीएल (बिीर अहमद तोता), िेकेपीएल (गलु ाम
मोहम्मद ख़ान सोपोरी), जिसे िम्मू और कश्मीर पीपल्ु स पॉजलटटकल लीग के रूप म ें भी िाना िाता ह,ै और याकूब िेख़ के
नेतृत्व म ें िेकेपीएल (अज़ीज़ िख़े ) को तत्काल प्रभाव स े एक 'जवजधजवरुद्ध संगम' घोजित करना आवश्यक ह,ै और तदनुसार,
उक्त अजधजनयम की धारा 3 की उप-धारा (3) के परंतुक द्वारा प्रदत्त िजक्तयों का प्रयोग करते हुए, केंद्रीय सरकार जनदेि
देती ह ै दक यह अजधसूचना, उक्त अजधजनयम की धारा 4 के अधीन दकए िा सकन े वाले दकसी भी आदेि के अध्यधीन,
रािपत्र म ें इसके प्रकािन की तारीख स े पांच वि च की अवजध के जलए प्रभावी होगी।

NOTIFICATION
New Delhi, the 15th March, 2024
S.O. 1415(E).—Whereas, the four factions of Jammu and Kashmir Peoples League (JKPL), namely, JKPL
(Mukhtar Ahmed Waza), JKPL (Bashir Ahmad Tota), JKPL (Ghulam Mohammad Khan @Sopori) also known as
Jammu and Kashmir Peoples Political League and JKPL (Aziz Sheikh) led by Yaqoob Sheikh, are indulging in
unlawful activities, which are prejudicial to the integrity, sovereignty and security of the country;
And, whereas, members of the abovesaid factions of JKPL have remained involved in supporting terrorist
activities and anti-India propaganda for fuelling secessionism in Jammu and Kashmir;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3
And, whereas, the leaders and members of the abovesaid factions of JKPL have been involved in mobilising
violent protests in various parts of Jammu and Kashmir for perpetrating unlawful activities, including sustained stone-
pelting on Security Forces in Jammu and Kashmir;
And, whereas, abovesaid factions of JKPL have constantly asked to the people of Jammu and Kashmir to
refrain from taking part in elections and thereby targeted and hampered the very basic constitutionally recognised
fundamentals of Indian democracy;
And, whereas, the members of abovesaid factions of JKPL, by their activities show sheer disrespect towards
the constitutional authority and constitutional set up of the country;
And whereas, abovesaid factions of JKPL are involved in promoting, aiding and abetting secession of
Jammu and Kashmir from India by involving in anti-national and subversive activities; sowing seeds of dis-affection
amongst people; exhorting people to destabilise public order; encouraging the use of arms to separate Jammu and
Kashmir from the Union of India; promoting hatred against established Government, giving clarion call to boycott
elections on multiple occasions and for ‘Black Day’ and Shutdown on the Republic Day and Independence Day of
India in Jammu and Kashmir;
And, whereas, the Central Government is of the opinion that if there is no immediate curb or control of
unlawful activities of the abovesaid factions of JKPL, they will use this opportunity to –
(i) continue with the anti-national activities which are detrimental to the territorial integrity, security and
sovereignty of the country;
(ii) continue advocating the secession of Jammu and Kashmir form the Union of India while disputing its
accession to the Union of India; and
(iii) continue propagating false narrative and anti-national sentiments among the people of Jammu and
Kashmir with the intention to cause disaffection against India and disrupt public order;
And, whereas, the Central Government for the above-mentioned reasons is firmly of the opinion that having
regard to the activities of the abovesaid factions of JKPL, it is necessary to declare the abovesaid four factions of
Jammu and Kashmir Peoples League (JKPL), namely, JKPL (Mukhtar Ahmed Waza), JKPL (Bashir Ahmad Tota),
JKPL (Ghulam Mohammad Khan @Sopori) also known as Jammu and Kashmir Peoples Political League and JKPL
(Aziz Sheikh) led by Yaqoob Sheikh as ‘unlawful associations’ with immediate effect;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 of the Unlawful Activities
(Prevention) Act, 1967 (37 of 1967), the Central Government hereby declares the four factions of Jammu and
Kashmir Peoples League (JKPL), namely, JKPL (Mukhtar Ahmed Waza), JKPL (Bashir Ahmad Tota), JKPL
(Ghulam Mohammad Khan @Sopori) also known as Jammu and Kashmir Peoples Political League and JKPL (Aziz
Sheikh) led by Yaqoob Sheikh as unlawful associations;
The Central Government, having regard to the above circumstances, is of firm opinion that it is necessary to
declare the four factions of Jammu and Kashmir Peoples League (JKPL), namely, JKPL (Mukhtar Ahmed Waza),
JKPL (Bashir Ahmad Tota), JKPL (Ghulam Mohammad Khan @Sopori) also known as Jammu and Kashmir Peoples
Political League and JKPL (Aziz Sheikh) led by Yaqoob Sheikh as ‘unlawful associations’ with immediate effect, and
accordingly, in exercise of the powers conferred by the proviso to sub-section (3) of section 3 of the said Act, the
Central Government hereby directs that this notification shall, subject to any order that may be made under section 4
of the said Act, have effect for a period of five years from the date of its publication in the Official Gazette.
