का.आ. 4348(अ).— िम्मू एवं कश्मीर डेमोक्रेटिक फ्रीडम पािी (इसम ें इसके पश्चात् िेकेडीएफपी के रूप म ें
जनर्िष्टि दकया गया ह)ै का गठन वर्ि 1998 में िब्बीर अहमि िाह द्वारा दकया गया था, िो एक प्रमुख अलगाववािी और
अपन ेभारत जवरोधी तथा पादकस्ट्तान समथिक प्रचार के जलए िाना िाता ह;ै
और, िेकेडीएफपी के संस्ट्थापक ने कश्मीर को 'जववािास्ट्पि' कहा था तथा भारत के संजवधान के ढांच े के भीतर
दकसी भी समाधान को जनयम जवरुद्ध घोजर्त दकया था;
और, िेकेडीएफपी के सिस्ट्य िम्मू-कश्मीर में अलगाववािी गजतजवजधयों में आगे रह े ह ैं तथा एक अलग इस्ट्लाजमक
राष्ट्र बनाना चाहते ह;ैं
और, िेकेडीएफपी के नेता या सिस्ट्य आतंकवािी गजतजवजधयों का समथनि करन,े िम्मू-कश्मीर म ें सुरक्षा बलों पर
जनरंतर पथराव सजहत जवजधजवरुद्ध दक्रयाकलापों को अंिाम िेन े के जलए पादकस्ट्तान तथा उसके परोक्षी संगठनों सजहत
जवजभन्न स्रोतों के माध्यम स ेधन िुिाने म ेंसजम्मजलत रह ेह;ैं

और, िेकेडीएफपी तथा उसके सिस्ट्य अपनी गजतजवजधयों स े ििे की संवैधाजनक सत्ता तथा सवं ैधाजनक व्यवस्ट्था के
प्रजत पूणति या अनािर दिखाते ह;ैं
और, िेकेडीएफपी एव ं उसके नेता या सिस्ट्य, जविेर् रूप स े इसके संस्ट्थापक िब्बीर अहमि िाह, जवजधजवरुद्ध
दक्रयाकलापों में जलप्त रह ेह,ैं िो िेि की अखडं ता, संप्रभुता, सुरक्षा तथा सांप्रिाजयक सद्भाव के जलए प्रजतकूल ह;ैं
और, िेकेडीएफपी के प्रजतबंजधत आतंकवािी संगठनों के साथ संबंध दिखाने वाले कई इनपुि ह;ैं
और, िेकेडीएफपी तथा उसके सिस्ट्य िेि म ें आतंक का िासन स्ट्थाजपत करन े के आिय से हहसं क आतंकवािी
गजतजवजधयों म ें सजम्मजलत रह े ह,ैं जिससे राज्य की सुरक्षा एव ं लोक व्यवस्ट्था खतरे म ें पड़ गई ह,ै और इसकी राष्ट्र-जवरोधी
गजतजवजधयााँ भी राज्य की संवधै ाजनक सत्ता तथा संप्रभुता के प्रजत अनािर और असम्मान ििािते ह,ैं अतः इस संगठन के
जवरुद्ध तत्काल एव ंिीघ्र कारिवाई की आवश्यकता ह;ै
और, केंद्रीय सरकार की यह राय ह ैदक यदि िम्म ू एव ं कश्मीर डेमोक्रेटिक फ्रीडम पािी के जवजधजवरुद्ध दक्रयाकलापों
पर तत्काल कोई प्रजतबन्ध या जनयंत्रण नहीं दकया गया, तो वह इस अवसर को जनम्नजलजखत हते ु प्रयोग करेगी -
(i) राष्ट्र-जवरोधी गजतजवजधयााँ िारी रखने, िो िेि की क्षेत्रीय अखंडता, सुरक्षा एव ं संप्रभुता के जलए हाजनकारक
ह;ैं
(ii) भारत संघ म ें इसके अजधजमलन पर जववाि करते हुए िम्म-ू कश्मीर को भारत सघं स े पथृ क करन े का समथिन
िारी रखन;े
(iii) जवजध द्वारा स्ट्थाजपत सरकार को अजस्ट्थर करके भारत संघ के राज्यक्षेत्र स े एक इस्ट्लाजमक राज्य बनान े के
प्रयास सजहत अपनी जवद्रोही गजतजवजधयों को बढाने; और
(iv) भारत के जवरुद्ध असंतोर् पैिा करने और लोक व्यवस्ट्था को बाजधत करने के आिय से िम्मू-कश्मीर के लोगों
की राष्ट्र-जवरोधी भावनाओं का प्रचार करना िारी रखने;
और, उपयुिक्त कारणों से केंद्रीय सरकार का यह िढृ मत ह ै दक िम्मू एव ं कश्मीर डेमोक्रेटिक फ्रीडम पािी की
गजतजवजधयों को ध्यान में रखते हुए, िम्मू एव ं कश्मीर डेमोक्रेटिक फ्रीडम पािी (िेकेडीएफपी) को तत्काल प्रभाव स े
‘जवजधजवरुद्ध संगम’ घोजर्त करना आवश्यक ह;ै
अब, इसीजलए, केंद्रीय सरकार, जवजधजवरुद्ध दक्रयाकलाप (जनवारण) अजधजनयम, 1967 (1967 का 37) की धारा
3 की उप-धारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए, िम्मू एव ं कश्मीर डेमोक्रेटिक फ्रीडम पािी (िेकेडीएफपी) को
एक 'जवजधजवरुद्ध संगम' के रूप में घोजर्त करती ह।ै
और, उपरोक्त पटरजस्ट्थजतयों को ध्यान में रखते हुए, केंद्रीय सरकार का यह िढृ मत ह ै दक िम्मू एव ं कश्मीर
डेमोक्रेटिक फ्रीडम पािी (िेकेडीएफपी) को तत्काल प्रभाव से एक 'जवजधजवरुद्ध संगम' के रूप में, घोजर्त करना आवश्यक ह ै
और तिनुसार, केंद्रीय सरकार, उक्त अजधजनयम की धारा 3 की उप-धारा (3) के परंतुक द्वारा प्रित्त िजक्तयों का प्रयोग करत े
हुए, जनिेि िेती ह ै दक यह अजधसूचना, उक्त अजधजनयम की धारा 4 के अधीन दकए गए दकसी आिेि के अध्यधीन रहते हुए,
रािपत्र म ें इसके प्रकािन की तारीख से पांच वर् ि की अवजध के जलए प्रभावी होगी।

NOTIFICATION
New Delhi, the 5th October, 2023
S.O. 4348(E).—Whereas, the Jammu and Kashmir Democratic Freedom Party (hereinafter referred to as the
JKDFP) was formed in 1998 by Shabir Ahmad Shah, a prominent separatist known for his anti-India and pro-Pakistan
propaganda;
And whereas, the founder of the JKDFP had called Kashmir as a ‘dispute’ and ruled out any settlement
within the framework of the Constitution of India;
And Whereas, the members of the JKDFP have been at the forefront of secessionist activities in the Jammu
and Kashmir and want to create a separate Islamic State;
And Whereas, the leader or members of the JKDFP have been involved in raising funds through various
sources including Pakistan and its proxy organizations for perpetrating unlawful activities, including supporting
terrorist activities, sustained stone-pelting on Security Forces in Jammu and Kashmir;
And Whereas, the JKDFP and its members by their activities show sheer disrespect towards the
constitutional authority and constitutional set up of the country;
And Whereas, the JKDFP and its leaders or members, particularly its founder Shabir Ahmad Shah, have
been indulging in unlawful activities, which are prejudicial to the integrity, sovereignty, security and communal
harmony of the country;
And Whereas, there have been a number of inputs showing linkages of the JKDFP with banned terrorist
organizations;
And Whereas, the JKDFP and its members have been involved in the violent terrorist activities with an
intent to create a reign of terror in the country, thereby endangering the security and public order of the State, and its
anti-national activities also show disrespect and disregard to the constitutional authority and sovereignty of the State,
hence an immediate and prompt action is required against the organisation;
And Whereas, the Central Government is of the opinion that if there is no immediate curb or control of
unlawful activities of the Jammu and Kashmir Democratic Freedom Party, it will use this opportunity to –
(i) continue with the anti-national activities which are detrimental to the territorial integrity, security and
sovereignty of the country;
(ii) continue advocating the secession of the Jammu and Kashmir from the Union of India while disputing
its accession to the Union of India;
(iii) escalate its insurrectionary activities including attempt to carve out an Islamic State out of the territory
of the Union of India by destabilizing the Government established by law; and
(iv) continue propagating anti-national sentiments of the people of Jammu and Kashmir with the intention
to cause disaffection against India and disrupt public order;
And Whereas, the Central Government for the above-mentioned reasons is firmly of the opinion that having
regard to the activities of the Jammu and Kashmir Democratic Freedom Party, it is necessary to declare the Jammu
and Kashmir Democratic Freedom Party (JKDFP) as an ‘unlawful association’ with immediate effect;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 of the Unlawful
Activities (Prevention) Act, 1967 (37 of 1967), the Central Government hereby declares the Jammu and Kashmir
Democratic Freedom Party (JKDFP) as an unlawful association;
The Central Government, having regard to the above circumstances, is of firm opinion that it is necessary to
declare the Jammu and Kashmir Democratic Freedom Party (JKDFP) as an unlawful association with immediate
effect, and accordingly, in exercise of the powers conferred by the proviso to sub-section (3) of section 3 of the said
Act, the Central Government hereby directs that this notification shall, subject to any order that may be made under
section 4 of the said Act, have effect for a period of five years from the date of its publication in the Official Gazette.
