और, केंद्रीय सरकार की राय म ें जेकेएलएफ-वाई ऐसी गजतजवजधयों म ें संजलप्त ह ै जो अन्य बातों के साथ-साथ जनम्नजलजखत आधारों पर दिे की अखंडता और सरु क्षा के प्रजतकूल ह,ैं अथाचत:्- 2022 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (1) प्रवतचन जनदिे ालय (ईडी) ने धन िोधन जनवारण अजधजनयम (पीएमएलए) के अधीन तारीख़ 14.06.2017 को एफआईआर स.ं ईसीआईआर / 03/डीएलजडे ओ-11/2017 पंजीकृत की ह।ै अन्वेिण के पश्चात, मामले म ें मख्ु य अजभयोजन जिकायत तारीख़ 24.08.2020 को फाइल की गई थी। इसके पश्चात यासीन मजलक को दोिारोजपत करत े हुए तारीख़ 09.01.2023 को एक अनुपूरक अजभयोजन जिकायत दजच की गई और जजसपर तारीख़ 10.01.2023 को संज्ञान जलया गया। यह मामला न्यायालय के समक्ष जवचारणाधीन ह;ै (2) जम्म ू और कश्मीर म ें अलगाववादी गजतजवजधयां करने के जलए जेकेएलएफ-वाई के कायचकताच मोहम्मद यासीन भट द्वारा हबीब रेस्ट्तरा,ं श्रीनगर म ें जेकेएलएफ-वाई के अन् य कायकच ताचओं के साथ बैठक आयोजजत करन े के जलए भारतीय दडं संजहता की धारा 121क और जवजधजवरुद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 की धारा 10 और धारा 13 के अधीन जेकेएलएफ-वाई के कायचकताचओं के जवरुद्ध कोठीबाग पुजलस स्ट्टेिन म ें मामला अपराध संख्या 23/2023 पंजीकृत दकया गया ह।ै इस मामले म ेंन् यायालय म ेंआरोप-पत्र दाजखल दकया गया ह;ै (3) जेकेएलएफ-वाई के कायाचलयों का उपयोग राष्‍टर की संप्रभुता और अखडं ता को हाजन पहुचं ान े वाल े तत्व ों को जवत् तीय सहायता प्रदान करने के कारण जेकेएलएफ-वाई के कायचकता च के जवरुद्ध जवजधजवरुद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 की धारा 10, धारा 11 और धारा 13 के अधीन पलु वामा पुजलस स्ट्टेिन म ें मामला अपराध संख्या 44/2019 पंजीकृत दकया गया ह।ै इस मामले की जांच हो रही ह;ै (4) राष्ट्र की संप्रभुता और अखडं ता के जलए संकट उत्पन्न करन े वाली जवध्वंसक गजतजवजधयों म ें संजलप्त होने के कारण जेकेएलएफ-वाई कायचकताचओं के जवरुद्ध जवजधजवरुद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 की धारा 10 और धारा 13 के अधीन हदं वाडा पजु लस स्ट्टेिन म ें मामला अपराध संख्या 42/2019 दजच दकया गया ह।ै इस मामले की जांच हो रही ह;ै (5) जेकेएलएफ-वाई को जवजधजवरुद्ध संगम घोजित करने के पश् चात, इसके द्वारा हडताल के सफल करने के आहवान की योजना बनाने के जलए जेकेएलएफ-वाई के दो कायचकताचओं के जवरुद्ध जवजधजवरुद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 की धारा 10 के अधीन गंदरबल पुजलस स्ट्टेिन म ें मामला अपराध संख्या 51/2019 पंजीकृत दकया गया ह।ै यह मामला न्यायालय के समक्ष जवचाराधीन ह;ै (6) राज्य की िांजत भंग करन े तथा राष्ट्र की संप्रभुता और अखडं ता के जलए संकट उत्पन्न करने के जलए अपनी गरै कानूनी गजतजवजधयों के जलए जेकेएलएफ-वाई कायचकताचओं के जवरुद्ध बडगाम पुजलस स्ट्टेिन म ें जवजधजवरुद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 की धारा 10, धारा 11 और धारा 13 के अधीन मामला अपराध संख्या 61/2019 पंजीकृत दकया गया ह।ै यह मामला न्यायालय के समक्ष जवचाराधीन ह;ै (7) जेकेएलएफ-वाई को एक जवजधजवरुद्ध संगम घोजित करन े के पश्चात जेकेएलएफ-वाई कायचकता च के जवरुद्ध हाजजन पुजलस स्ट्टेिन म ें जवजधजवरुद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 की धारा 10 और धारा 13 के अधीन मामला अपराध संख्या 11/2019 पंजीकृत दकया गया ह।ै यह मामला न्यायालय के समक्ष जवचाराधीन ह;ै (8) जम् म ू और कश् मीर म ें अलगाववादी और आतंकवादी गजतजवजधयों की फंडडग के जलए हवाला सजहत जवजभन्न अवैध चैनलों के माध्यम स े दिे और जवदेि म ें धन जुटान,े प्राप्त करने और एकत्र करने म ें सजम्मजलत होन े तथा साथ ही सुरक्षा बलों पर पथराव करके, जानबूझकर जवद्यालयों को जलाकर, सावचजजनक सम्पज्त को क्षजत पहुचं ाकर और सरकार के जवरुद्ध युद्ध छेडकर कश्मीर घाटी म ें व्यवधान उत्पन्न करन े की दजृि से बडा आपराजधक िडयंत्र रचने के अपराध के जलए जविेि एनआईए न्यायलय, नई ददल्ली द्वारा तारीख़ 25 मई, 2022 के आदिे के अधीन जेकेएलएफ- वाई के अध्यक्ष मोहम्मद यासीन मजलक के जवरुद्ध भारतीय दडं संजहता की धारा 120ख, धारा 121, धारा 121क और जवजधजवरुद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 की धारा 13, धारा 16, धारा 17, धारा 18, धारा 20, धारा 38, धारा 39 और धारा 40 के अधीन मामला अपराध संख्या आरसी-10/2017/एनआईए/डीएलआई तारीख़ 30 मई, 2017 पंजीकृत दकया गया था, जजसके अधीन मोहम् मद यासीन मजलक को आजीवन कारावास और दस लाख रुपय ेके जुमाचन े का दडं ददया गया; और, उपयुचक् त आधारों पर केंद्रीय सरकार की यह राय ह ैदक:- (i) जेकेएलएफ-वाई भारत की संप्रभुता और क्षेत्रीय अखंडता को बाजधत करने के उद्देश्य स े राष्ट्र-जवरोधी और जवध्वंसक गजतजवजधयों म ें सजम्मजलत ह;ै (ii) जेकेएलएफ-वाई आतंकी संगठनों के साथ जनकट संपकच म ें ह ै और जम्मू और कश्मीर और अन्य स्ट्थानों पर आतंकवाद और उग्रवाद का समथचन कर रहा ह;ै[भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 3 (iii) जेकेएलएफ-वाई भारतीय क्षत्रे के एक जहस्ट्स े को संघ स े अलग करने के दावों का समथचन करन े और उकसाने का काय च कर रहा ह ै तथा भारत की क्षत्रे ीय अखंडता को बाजधत करने वाली गजतजवजधयों और अजभव्यजियों म ें सजम्मजलत होकर इस मकसद स ेलडन े वाल े आतंकवादी और अलगाववादी समूहों का समथचन कर रहा ह;ै और, केंद्रीय सरकार की यह भी राय ह ै दक यदद जेकेएलएफ-वाई की जवजधजवरुद्ध गजतजवजधयों पर तुरंत अंकुि और जनयंत्रण नहीं लगाया गया, तो वह जनम्न जलजखत के जलए इस अवसर का लाभ उठाएगी – (i) जवजध द्वारा स्ट्थाजपत सरकार को अजस्ट्थर करत े हुए भारत सघं म ें स े एक अलग राज्य बनाने के प्रयास सजहत अपनी जवध्वंसक गजतजवजधयों को बढाना; (ii) जम्म ू और कश्मीर राज्य के भारत संघ के साथ जवलय पर जववाद खडा करते हुए उसे संघ स े अलग करने की वकालत जारी रखना; (iii) दिे की अखंडता और सुरक्षा के जलए प्रजतकूल राष्ट्र-जवरोधी और अलगाववादी भावनाओं का प्रचार करना; और (iv) अलगाववादी आंदोलनों को बढाना, उग्रवाद का समथचन करना और दिे म ें डहसा भडकाना; और, उपयुचि कारणों स े केंद्रीय सरकार का यह दढृ मत ह ै दक जेकेएलएफ-वाई की गजतजवजधयों को ध्यान म ें रखत े हुए, जम्मू कश् मीर जलब्रेिन फ्रंट (मोहम् मद यासीन मजलक गुट) को 'तत्काल प्रभाव स े एक जवजधजवरुद्ध संगम' घोजित करना आवश्यक ह;ै अत: अब, केंद्रीय सरकार जवजधजवरुद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 (1967 का 37) की धारा 3 की उप-धारा (1) द्वारा प्रद्त िजियों का प्रयोग करत े हुए, जम् म ू और कश् मीर जलब्रेिन फ्रंट (मोहम् मद यासीन मजलक गुट) को एक जवजधजवरुद्ध संगम घोजित करती ह;ै उपयुचक् त पररजस्ट्थजतयों को ध्यान म ेंरखत े हुए, केंद्रीय सरकार का यह दढृ मत ह ै दक जम् म ू और कश् मीर जलब्रेिन फ्रंट (मोहम् मद यासीन मजलक गुट) को तत्काल प्रभाव स े एक 'जवजधजवरुद्ध संगम' के रूप म ें घोजित करना आवश्यक ह,ै और तदनुसार, उि अजधजनयम की धारा 3 की उप-धारा (3) के परंतुक द्वारा प्रद्त िजियों का प्रयोग करत े हुए, केंद्रीय सरकार जनदेि दते ी ह ै दक यह अजधसूचना, दकसी ऐसे आदेि के अध्यधीन, जो उि अजधजनयम की धारा 4 के अधीन दकया जाए, वाले दकसी भी आदेि के अध्यधीन, िासकीय राजपत्र म ें इसके प्रकािन की तारीख स े पांच विच की अवजध के जलए प्रभावी होगी। [फा.स.ं 14017/21/2023-एनआई-एमएफओ] प्रवीण वजिष्ठ, अपर सजचव MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 15th March, 2024 S.O. 1416(E).—Whereas the Jammu and Kashmir Liberation Front (Mohd. Yasin Malik faction) (hereinafter referred to as the JKLF-Y) has been indulging in activities, which are prejudicial to security and public order and have the potential of disrupting the unity and integrity of the country; And whereas, in exercise of the powers conferred by sub-section (1) of section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), the Central Government declared the JKLF-Y as an unlawful association, vide, notification number S.O. 1403(E), dated the 22nd March, 2019; And, whereas, the Unlawful Activities (Prevention) Tribunal, constituted under section 5 of the Unlawful Activities (Prevention) Act, 1967 for the purpose of adjudicating whether or not there is sufficient cause for declaring the JKLF-Y as an unlawful association, by its order published, vide, notification number S.O. 3460 (E), dated the 25th September, 2019 has confirmed the declaration so made; And, whereas, the declaration of ban under sub-section (1) of section 6 of the Unlawful Activities (Prevention) Act, 1967, ceases on the 21st day of March, 2024; And, whereas, the Central Government is of the opinion that JKLF-Y is indulging in the activities which are prejudicial to the integrity and security of the country, inter alia, on the following grounds, namely:-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 1. The Directorate of Enforcement (ED) has registered FIR No. ECIR/03/DLZO-11/2017 dated 14.06.2017 under the Prevention of Money Laundering Act (PMLA). After Investigation, main prosecution complaint in the case was filed on 24.08.2020. Further, supplementary Prosecution Complaint was filed on 09.01.2023, arraigning Yasin Malik as accused and cognizance of which was taken on 10.01.2023. Matter is under trial before the court; 2. Case Crime No. 23/2023 has been registered at Kothibagh Police Station under section 121A of the Indian Penal Code and section 10 and 13 of the Unlawful Activities (Prevention) Act, 1967 against JKLF-Y activists for organizing meeting by Mohd. Yaseen Bhat, JKLF-Y activist in Habib Restaurant, Srinagar along with other JKLF-Y activists for undertaking separatist activities in Jammu and Kashmir. Chargesheet filed in the matter before the court; 3. Case Crime No. 44/2019 has been registered at Pulwama Police Station under section 10, 11 and 13 of the Unlawful Activities (Prevention) Act, 1967 against JKLF-Y activist for use of offices of JKLF-Y to provide financial support to the elements inimical to the sovereignty and integrity of the nation. The case is under investigation; 4. Case Crime No. 42/2019 has been registered at Handwara Police Station under section 10 and 13 of the Unlawful Activities (Prevention) Act, 1967 against JKLF-Y activists for subversive activities causing threat to the sovereignty and integrity of the nation. The case is under investigation; 5. Case Crime No. 51/2019 has been registered at Ganderbal Police Station under section 10 of the Unlawful Activities (Prevention) Act, 1967 against two JKLF-Y activists for planning of successful call given for hartal by the JKLF-Y after its declaration as an unlawful association. The case is under trial before the court. 6. Case Crime No. 61/2019 has been registered at Budgam Police Station under section 10, 11, and 13 of the Unlawful Activities (Prevention) Act, 1967 against JKLF-Y activists for their illegal activities in order to vitiate the peace of the State and to cause threat to the sovereignty and integrity of the nation. The case is under trial before the court. 7. Case Crime No. 11/2019 has been registered at Hajin Police Station under section 10 and 13 of the Unlawful Activities (Prevention) Act, 1967 against JKLF-Y activist after declaration of JKLF-Y as an unlawful association. The case is under trial before the court. 8. Mohd. Yasin Malik, Chairman, JKLF-Y has been sentenced with rigorous imprisonment for life and fine of rupees ten lakh by the Special NIA Court, New Delhi vide order dated the 25th May, 2022 in Case Crime No. RC-10/2017/NIA/DLI dated the 30th May, 2017 registered under sections 120B, 121, 121A of the Indian Penal Code and sections 13, 16, 17, 18, 20, 38, 39 and 40 of the Unlawful Activities (Prevention) Act, 1967 for involvement of JKLF-Y leader Yasin Malik for raising, receiving and collecting funds domestically and abroad through various illegal channels, including hawala, for funding separatist and terrorist activities in Jammu and Kashmir through the funds so collected and as such have entered into larger criminal conspiracy for causing disruption in the Kashmir valley by way of pelting stones on the security forces, systematically burning of schools, damage to public property and waging war against Government; And, whereas, on the basis of above grounds the Central Government is of the opinion that – (i) JKLF-Y is involved in anti-national and subversive activities intended to disrupt the sovereignty and territorial integrity of India; (ii) JKLF-Y is in close touch with militant outfits and is supporting extremism and militancy in Jammu and Kashmir and elsewhere; (iii) JKLF-Y is supporting and inciting claims for secession of a part of the Indian territory from the Union and supporting terrorist and separatist groups fighting for this purpose by indulging in activities and articulations intended to disrupt the territorial integrity of India; And, whereas, the Central Government is of the opinion that if the unlawful activities of the JKLF-Y are not curbed and controlled immediately, it will take the opportunity to – (i) escalate its subversive activities including attempt to carve out a separate State out of the territory of Union of India by destabilising the Government established by law; (ii) continue advocating the secession of Jammu and Kashmir from the Union of India while disputing the accession of the State of Jammu and Kashmir with the Union; (iii) propagate anti-national and separatist sentiments prejudicial to the territorial integrity and security of the country; and[भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 5 (iv) escalate secessionist movements, support militancy and incite violence in the country; And, whereas, the Central Government for the above-mentioned reasons is firmly of the opinion that having regard to the activities of the JKLF-Y, it is necessary to declare the Jammu and Kashmir Liberation Front (Mohd. Yasin Malik faction) as an ‘unlawful association’ with immediate effect; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), the Central Government hereby declares the Jammu and Kashmir Liberation Front (Mohd. Yasin Malik faction) as an unlawful association. The Central Government, having regard to the above circumstances, is of firm opinion that it is necessary to declare the Jammu and Kashmir Liberation Front (Mohd. Yasin Malik faction) as an ‘unlawful association’ with immediate effect, and accordingly, in exercise of the powers conferred by the proviso to sub-section (3) of section 3 of the said Act, the Central Government hereby directs that this notification shall, subject to any order that may be made under section 4 of the said Act, have effect for a period of five years from the date of its publication in the Official Gazette.
