लोगों में वैमनस्ट्य के बीि बोते हुए; लोगों को जवजध-व्यवस्ट्र्ा भगं करन े के जलए उकसात े हुए; िम्मू और कश्मीर को प्रर्क करन े के जलए सिस्त्र संघष थ के प्रयोग को प्रोत्साजहत करत े हुए; और स्ट्र्ाजपत सरकार के जवरुद्ध घ्रणा को फैलात े हुए िम्म-ू कश्मीर को भारत स े प्रर्क करने को बढावा िेन,े उसम ें सहायता करने और उकसाने म ेंभी सजम्मजलत ह;ै और, केंद्रीय सरकार दक यह राय ह ै दक यदि मुजस्ट्लम कॉन्फ्रेंस िम्मू और कश्मीर (भट गुट) के जवजधजवरुद्ध कायथकलापों पर तत्काल कोई प्रजतबन्फ्ध या जनयंत्रण नहीं दकया गया, तो वह इस अवसर का जनम्नजलजखत के जलए प्रयोग करेगा - (i) ििे की भौजतक अखंडता, सुरक्षा और संप्रभुता के जलए हाजनकारक राष्ट्र-जवरोधी कायथकलापों को िारी रखना; (ii) भारत संघ म ें िम् म ू और कश् मीर के जवलय पर जववाि करत े हुए िम्मू-कश्मीर को भारत सघं स े पृर्क करन े का समर्थन िारी रखना; और (iii) भारत के जवरुद्ध असंतोष उत्पन्न करने और लोक व्यवस्ट्र्ा को बाजधत करने के आिय स े िम्म-ू कश्मीर के लोगों के बीच जमथ्या वृतांत और राष्ट्र-जवरोधी भावनाओं का प्रचार करना िारी रखना; और, अपर-उजल्लजखत कारणों स े केंद्रीय सरकार का यह िढृ अजभमत ह ै दक मुजस्ट्लम कॉन्फ्रेंस िम्मू और कश्मीर (भट गुट) के दियाकलापों को ध्यान म ें रखत े हुए, मुजस्ट्लम कॉन्फ्रेंस िम्मू और कश्मीर (भट गुट) (एमसीिेके-बी) को तत्काल प्रभाव स े एक 'जवजधजवरुद्ध संगठन' घोजषत करना आवश्यक ह।ै ; अतः अब, केंद्रीय सरकार, जवजधजवरुद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 (1967 का 37) की धारा 3 की उप-धारा (1) द्वारा प्रित्त िजियों का प्रयोग करत े हुए, मुजस्ट्लम कांरेंस िम्म ू और कश्मीर (भट गुट) (एमसीिेके-बी) को एक जवजधजवरुद्ध संगठन घोजषत करती ह।ै केंद्रीय सरकार की उपयुथक्त पररजस्ट्र्जतयों को ध्यान म ें रखत े हुए, का यह िढृ अजभमत ह ै दक मुजस्ट्लम कॉन्फ्रेंस िम्म ू और कश्मीर (भट गुट) (एमसीिेके-बी) को तत्काल प्रभाव स े एक 'जवजधजवरुद्ध संगठन' के रूप म ें घोजषत करना आवश्यक ह,ै और तिनुसार, केंद्रीय सरकार उि अजधजनयम की धारा 3 की उप-धारा (3) के परंतुक द्वारा प्रित्त िजियों का प्रयोग करत े हुए, जनिेि िेती ह ै दक यह अजधसूचना, दकसी आिेि के अध्यधीन िो उि अजधजनयम दक धारा-4 के अधीन दकया िाय,े रािपत्र म ें इसके प्रकािन की तारीख स े पांच वष थ की अवजध के जलए प्रभावी होगी। [फा. स.ं 14017/06/2024-एनआई-एमएफओ] प्रवीण वजिष्ठ, अपर सजचव[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 28th February, 2024 S.O. 934(E).—Whereas, the Muslim Conference Jammu and Kashmir (Bhat faction) (hereinafter referred to as the MCJK-B), chaired by Abdul Ghani Bhat have been indulging in unlawful activities, which are prejudicial to the integrity, sovereignty and security of the country; And, whereas, MCJK-B has linkages with banned terrorist organizations and has supported terrorism in Jammu and Kashmir And, whereas, the members of the MCJK-B have been indulging in generating feelings of hatred and disaffection against India to separate Jammu and Kashmir from Union of India; And, whereas, the leaders and members of the MCJK-B have been involved in raising funds through various sources including Pakistan and its proxy organizations for perpetrating unlawful activities, including supporting terrorist activities, sustained stone-pelting on Security Forces in Jammu and Kashmir; And, whereas, the MCJK-B and its members by their activities show sheer disrespect towards the constitutional authority and constitutional set up of the country; And whereas, MCJK-B by giving clarion call to boycott elections on multiple occasions, has also attempted to subvert the will of people and democratic process in Jammu and Kashmir; And whereas, MCJK-B is involved in promoting, aiding and abetting the secession of Jammu and Kashmir from India by involving itself in anti-national and subversive activities; sowing seeds of dis-affection amongst people; exhorting people to destabilise law and order; encouraging the use of armed struggle to separate Jammu and Kashmir; and promoting hatred against established Government; And, whereas, the Central Government is of the opinion that if there is no immediate curb or control of unlawful activities of the Muslim Conference Jammu and Kashmir (Bhat faction), it will use this opportunity to – (i) continue with the anti-national activities which are detrimental to the territorial integrity, security and sovereignty of the country; (ii) continue advocating the secession of Jammu and Kashmir form the Union of India while disputing its accession to the Union of India; and (iii) continue propagating false narrative and anti-national sentiments among the people of Jammu and Kashmir with the intention to cause disaffection against India and disrupt public order; And, whereas, the Central Government for the above-mentioned reasons is firmly of the opinion that having regard to the activities of the Muslim Conference Jammu and Kashmir (Bhat faction), it is necessary to declare the Muslim Conference Jammu and Kashmir (Bhat faction) (MCJK-B) as an ‘unlawful association’ with immediate effect; Now, Therefore, in exercise of the powers conferred by sub-section (1) of the section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), the Central Government hereby declares the Muslim Conference Jammu and Kashmir (Bhat faction) (MCJK-B) as an unlawful association; The Central Government, having regard to the above circumstances, is of firm opinion that it is necessary to declare the Muslim Conference Jammu and Kashmir (Bhat faction) (MCJK-B) as an ‘unlawful association’ with immediate effect, and accordingly, in exercise of the powers conferred by the proviso to sub-section (3) of section 3 of the said Act, the Central Government hereby directs that this notification shall, subject to any order that may be made under section 4 of the said Act, have effect for a period of five years from the date of its publication in the Official Gazette.
