लोगों में वैमनस्ट्य के बीि बोते हुए; लोगों को जवजध-व्यवस्ट्थका भंग करने के जलए उकसाते हुए; िम्मू और कश्मीर को भारत संघ से अलग करने के जलए सिस्त्र संघर् के प्रयोग को प्रोत्साजहत करते हुए; और िम् म ू और कश् मीर में कई अवसरों पर जनवा चनों का बजहष् कार करने का आह्वान करके स्ट्थकाजपत सरकार के जवरुद्ध नफरत फैलात े हुए िम्मू और कश्मीर को भारत से अलग करन े को बढावा िेने, उसमें सहायता करन े और िष्ु प्रेररत करने म ेंसजम्मजलत ह;ै और, केंद्रीय सरकार दक यह राय ह ै दक यदि मुजस्ट्लम कॉन्फ्रेंस िम्मू और कश्मीर (सुमिी गुट) के जवजधजवरुद्ध दियाकलापों पर तत्काल कोई प्रजतबन्फ्ध या जनयंत्रण नहीं दकया गया, तो वह इस अवसर का जनम्नजलजखत के जलए प्रयोग करेगा - (i) िेि की भौजतक अखंडता, सुरक्षा और संप्रभतु ा के जलए हाजनकारक राष्ट्र-जवरोधी दियाकलापों को िारी रखना; (ii) भारत संघ में िम् मू और कश् मीर के जवलय पर जववाि खा ा करते हुए िम्मू-कश्मीर को भारत संघ स े अलग करन े का समथक न िारी रखना; और (iii) भारत के जवरुद्ध असंतोर् उत्पन्न करन े और लोक व्यवस्ट्थका को बाजधत करन े के आिय से िम्मू-कश्मीर के लोगों के बीच जमथ्या वृतांत और राष्ट्र-जवरोधी भावनाओं का प्रचार करना िारी रखना; और, उपयु क्त कारणों से केंद्रीय सरकार दक यह राय ह ै दक मजु स्ट्लम कॉन्फ्रेंस िम्मू और कश्मीर (सुमिी गुट) के दियाकलापों को ध्यान में रखत े हुए, मुजस्ट्लम कॉन्फ्रेंस िम्मू और कश्मीर (सुमिी गुट) (एमसीिेके-एस) को तत्काल प्रभाव स े एक 'जवजधजवरुद्ध संगठन' घोजर्त करना आवश्यक ह;ै अतः अब, केंद्रीय सरकार, जवजधजवरुद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 (1967 का 37) की धारा 3 की उप-धारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, मुजस्ट्लम कांरेंस िम्मू और कश्मीर (समु िी गुट) (एमसीिेके-एस) को एक जवजधजवरुद्ध संगठन घोजर्त करती ह ै केंद्रीय सरकार की उपयु क्त पररजस्ट्थकजतयों को ध्यान म ें रखत े हुए, का यह िढृ अजभमत ह ै दक मुजस्ट्लम कॉन्फ्रेंस िम्म ू और कश्मीर (सुमिी गुट) (एमसीिेके-एस) को तत्काल प्रभाव से एक 'जवजधजवरुद्ध संगठन' के रूप में घोजर्त करना आवश्यक ह,ै और तिनुसार, केंद्रीय सरकार उक्त अजधजनयम की धारा 3 की उप-धारा (3) के परंतुक द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, जनििे िेती ह ै दक यह अजधसूचना, दकसी आिेि के अध्यधीन िो उक्त अजधजनयम दक धारा-4 के अधीन दकया िाय,े रािपत्र म ेंइसके प्रकािन की तारीख स ेपांच वर् की अवजध के जलए प्रभावी होगी [फा. सं.14017/07/2024-एनआई-एमएफओ] प्रवीण वजिष्ठ, अपर सजचव[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 28th February, 2024 S.O. 935(E).— Whereas, the Muslim Conference Jammu and Kashmir (Sumji faction), (hereinafter referred to as the MCJK-S), chaired by Ghulam Nabi Sumji is known for its anti-India and pro-Pakistan propaganda; And, whereas, members of the MCJK-S have remained involved in supporting terrorist activities and providing logistic support to terrorists in Jammu and Kashmir; And, whereas, the leaders and members of MCJK-S have been involved in raising funds through various sources including Pakistan and its proxy organisations for perpetrating unlawful activities, including supporting terrorist activities, sustained stone-pelting on Security Forces in Jammu and Kashmir; And, whereas, MCJK-S has constantly asked to the people of Kashmir to refrain from taking part in elections and thereby targeted and hampered the very basic constitutionally recognized fundamentals of Indian democracy; And, whereas, the MCJK-S and its members by their activities show sheer disrespect towards the constitutional authority and constitutional set up of the country; And, whereas, the MCJK-S and its members, have been indulging in unlawful activities, which are prejudicial to the integrity, sovereignty, and security of the country; And whereas, MCJK-S is involved in promoting, aiding and abetting secession of Jammu and Kashmir from India by involving in anti-national and subversive activities; sowing seeds of dis-affection amongst people; exhorting people to destabilise law and order; encouraging the use of arms to separate Jammu and Kashmir from the Union of India; and promoting hatred against established Government by giving clarion call to boycott elections on multiple occasions in Jammu and Kashmir; And, whereas, the Central Government is of the opinion that if there is no immediate curb or control of unlawful activities of the Muslim Conference Jammu and Kashmir (Sumji faction), it will use this opportunity to – (i) continue with the anti-national activities which are detrimental to the territorial integrity, security and sovereignty of the country; (ii) continue advocating the secession of Jammu and Kashmir form the Union of India while disputing its accession to the Union of India; and (iii) continue propagating false narrative and anti-national sentiments among the people of Jammu and Kashmir with the intention to cause disaffection against India and disrupt public order; And, whereas, the Central Government for the above-mentioned reasons is firmly of the opinion that having regard to the activities of the Muslim Conference Jammu and Kashmir (Sumji faction), it is necessary to declare the Muslim Conference Jammu and Kashmir (Sumji faction) (MCJK-S) as an ‘unlawful association’ with immediate effect; Now, Therefore, in exercise of the powers conferred by sub-section (1) of the section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), the Central Government hereby declares the Muslim Conference Jammu and Kashmir (Sumji faction) (MCJK-S) as an unlawful association; The Central Government, having regard to the above circumstances, is of firm opinion that it is necessary to declare the Muslim Conference Jammu and Kashmir (Sumji faction) (MCJK-S) as an ‘unlawful association’ with immediate effect, and accordingly, in exercise of the powers conferred by the proviso to sub-section (3) of section 3 of the said Act, the Central Government hereby directs that this notification shall, subject to any order that may be made under section 4 of the said Act, have effect for a period of five years from the date of its publication in the Official Gazette.
