L.-33004/99 सी.जी.-डी.एxलx.x-GअID.-H2x2x0x 92025-266291 CG-DLxx-xEG-I2D2E0x9x2x0 25-266291 असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 4123] नई दिल्ली, सोमिार, जसतम्ब र 22, 2025/भाद्र 31, 1947 No. 4123] NEW DELHI, MONDAY, SEPTEMBER 22, 2025/BHADRA 31, 1947 गहृ मत्रं ालय अजधसचू ना नई दिल्ली, 22 जसतम्बर, 2025 का.आ. 4241(अ).—िबदक, निे नल सोिजलस्ट्ट काउंजसल ऑफ नागालडैं (खापलागं ) (जिस ेइसके बाि एनएससीएन (के) कहा गया ह)ै अपन े सभी गटु ों, िाखाओं और अग्रणी सगं ठनों के साथ ऐसी गजतजिजधयों म ेंिाजमल रहा ह ैिो भारत की संप्रभुता एिं अखडं ता के जलए हाजनकारक है; और िबदक, केंद्र सरकार की राय ह ैदक एनएससीएन (के) ने,- (क) भारतीय संघ से अलग होकर भारत-म्यांमार क्षेत्र के नागा आबािी िाले क्षेत्रों को िाजमल करत ेहुए एक संप्रभु नागालडैं बनाने का अपना लक्ष्य घोजित दकया हुआ ह;ै (ख) उल्फा (आई), पीआरईपीएके और पीएलए िैसे अन्य गरै कानूनी संगठनों के साथ संरेजखत दकया हुआ है; (ग) व्यापाररयों, सरकारी अजधकाररयों और अन्य नागररकों स े दफरौती और िबरन धन िसूली के जलए अपहरण म ेंसंजलप्तता की हुई ह;ैं (घ) अिैध हजथयार और गोला-बारूि रख ेह;ैं (ङ) हजथयार और अन्य सहायता प्राप्त करने के जलए अन्य िेिों में भारत जिरोधी ताकतों से सहायता प्राप्त की हुई ह।ै और िबदक, 28 जसतंबर, 2020 से 30 अप्रैल, 2025 की अिजध के िौरान एनएससीएन (के) के मामल े म ें जनम्नजलजखत गजतजिजधयां पाई गई ह,ैं नामतः:- 6239 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (क) पुजलस या सुरक्षा बलों की काययिाही में इसके तेरह यूिी कैडर मारे गए; (ख) इसके कैडरों के जिरुद्ध इकहत्तर मामल े िि य दकए गए, छप् पन आरोप पत्र िाजखल दकए गए तथा पतैं ीस पर मुकिमा चलाया गया; (ग) इसके कैडर अन्य इक्यािन आपराजधक गजतजिजधयों म ेंिाजमल रहे; (घ) इसके पचासी कैडरों की जगरफ्तारी हुई एिं उनहत्तर कैडरों द्वारा आत्मसमपयण दकया गया; (ङ) इसके पास से उनहत्तर हजथयार, बािन मैगिीन, नौ सौ इकतीस जिंिा कारतूस, िस ग्रेनेड, एक सौ पचास डेटोनेटर, तीन जिस्ट्फोटक िेल टयूब,ें िो सौ ग्राम राइनाइरोटोलुईन, डेढ़ दकलोग्राम इम्प्रोिाइज्ड एक् सप् लोजसि जडिाइस और आठ सौ ग्राम अन्य जिस्ट्फोटक बरामि हुए; और िबदक, नागालैण्ड , मजणपुर और अरूणाचल प्रिेि की सरकारों ने भी जिजधजिरुद्ध दरिययाकलाप (जनिारण) अजधजनयम, 1967 (1967 का 37) के तहत एनएससीएन (के) को जिजधजिरुद्ध सगं म घोजित करने की जसफाररि की है; और िबदक, केंद्र सरकार की यह राय ह ै दक एनएससीएन (के) की उपरोक्त गजतजिजधयां भारत की संप्रभुता और अखंडता के जलए हाजनकारक ह,ैं और यदि इन्ह ें तरु ंत रोका और जनयंजत्रत नहीं दकया िाता ह,ै तो एनएससीएन (के) खुि को और अजधक सगं रठत और हजथयारबंि करेगा, अपन े कैडरों का जिस्ट्तार करेगा, पररष्कृत हजथयार खरीिगे ा, नागररकों और सुरक्षा बलों के िीिन का नुकसान करेगा और इस तरह यह अपनी राष्ट्र जिरोधी गजतजिजधयों को तेि कर सकता ह;ै और िबदक, केंद्र सरकार की यह राय ह ैदक उपरोक्त कारणों से, एनएससीएन (के), अपन ेगुटों, िाखाओं और अग्रणी संगठनों के साथ, एक जिजधजिरुद्ध संगम ह;ै अब इसजलए, जिजधजिरुद्ध दरिययाकलाप (जनिारण) अजधजनयम, 1967 (1967 का 37) (जिसे इसके पश्चात् उक्त अजधजनयम कहा िाएगा) की धारा 3 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, केंद्र सरकार एतद्द्वारा निे नल सोिजलस्ट्ट काउंजसल ऑफ नागालैंड (खापलांग) [एनएससीएन (के)] को उसके सभी गुटों, िाखाओं और अग्रणी सगं ठनों के साथ जिजधजिरुद्ध संगम के रूप में घोजित करती ह;ै केंद्र सरकार का मत ह ै दक निे नल सोिजलस्ट्ट काउंजसल ऑफ नागालडैं (खापलांग) की उपरोक्त गैरकानूनी गजतजिजधयों, और इसके द्वारा जिगत में की गई गजतजिजधयों, को ध्यान में रखते हुए ऐसी पररजस्ट्थजतयां मौिूि ह ैंजिसके कारण नेिनल सोिजलस्ट्ट काउंजसल ऑफ नागालैंड (खापलागं ) [एनएससीएन (के)] को, उसके सभी गुटों, िाखाओं और अग्रणी संगठनों के साथ 28 जसतंबर, 2025 से, तत्काल प्रभाि से जिजधजिरुद्ध संगम घोजित करना आिश्यक हो िाता ह।ै अत: उक्त अजधजनयम की धारा 3 की उपधारा (3) के परंतुक द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए, एतद्द्वारा जनिेि दिया िाता ह ै दक यह अजधसूचना, उक्त अजधजनयम की धारा 4 के तहत दकसी आिेि के अध् यधीन, 28 जसतंबर, 2025 से तत्क ाल प्रभाि स े पांच ििय के जलए प्रभािी होगी। [संख्या. 11011/02/2025-एनई. V] रािीि कुमार, संयुक्त सजचि MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 22nd September, 2025 S.O. 4241(E).—WHEREAS, the National Socialist Council of Nagaland (Khaplang) along with all its factions, wings and front organisations [hereinafter referred to as NSCN (K)] has been involved in such activities which are prejudicial to the sovereignty and integrity of India; AND WHEREAS, the Central Government is of the opinion that the NSCN (K) has,- (a) declared its aim to create a sovereign Nagaland incorporating the Naga inhabited areas of Indo-Myanmar region by secession from the Indian Union; (b) aligned itself with other unlawful associations like the ULFA(I), PREPAK and PLA; (c) indulged in kidnapping for ransom and extortion of money from businessmen, Government officials and other civilians; (d) possessed illegal arms and ammunitions; and (e) obtained assistance from anti-India forces in other countries to procure arms and other assistance. AND WHEREAS, the following activities have been noted in the case of NSCN (K), during the period from 28th September, 2020 to 30th April, 2025, namely:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (a) killing of thirteen UG cadres in police or security forces action; (b) registration of seventy-one cases against its cadres with fifty-six charge sheets filed and thirty-five cadres prosecuted; (c) involvement of its cadres in fifty-one other criminal activities; (d) arrest of eighty-five cadres and surrender by sixty-nine cadres; (e) recovery of sixty-nine arms, fifty-two Magazines, nine hundred thirty-one live rounds, ten grenades, one hundred fifty detonators, three explosives gel tubes, two hundred grams Trinitrotoluene, one and half kilogram Improvised Explosive Device and eight hundred grams other explosives. AND WHEREAS, the State Governments of Nagaland, Manipur and Arunachal Pradesh have also recommended for declaration of NSCN (K) as an unlawful association under the Unlawful Activities (Prevention) Act, 1967 (37 of 1967); AND WHEREAS, the Central Government is of the opinion that the aforesaid activities of NSCN (K) are detrimental to the sovereignty and integrity of India and if these are not immediately curbed and controlled, the NSCN (K) may further regroup and rearm itself, expand its cadres, procure sophisticated weapons, cause loss of lives of civilians and security forces and thereby accelerate its anti-national activities; AND WHEREAS, the Central Government is of the opinion that for the reasons aforesaid, the NSCN (K) together with its factions, wings and front organisations, is an unlawful association; NOW THEREFORE, in exercise of the powers conferred by sub-section (1) of section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), (hereinafter referred to as the said Act), the Central Government hereby declares the National Socialist Council of Nagaland (Khaplang) [NSCN (K)] along with all its factions, wings and front organisations as an unlawful association; The Central Government, having regard to the unlawful activities mentioned above and the unlawful activities committed in the past by the National Socialist Council of Nagaland (Khaplang), is further of the opinion that circumstances exist which render it necessary to declare the National Socialist Council of Nagaland (Khaplang) [NSCN (K)] along with all its factions, wings and front organisations to be an unlawful association with immediate effect from the 28th September, 2025 and accordingly, in exercise of the powers conferred by the proviso to sub-section (3) of section 3 of the said Act, hereby directs that this notification shall, subject to any order that may be made under section 4 of the said Act, have immediate effect from the 28th September, 2025 for a period of five years.
