L.-33004/99 सी.जी.-डी.एल.-अ.-25112024-258902 CG-DxLx-xEG-I2D5H1x1x2x0 24-258902 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 4663] नई दिल्ली, सोमवार, नवम्ब र 25, 2024/अग्रहायण 4, 1946 No. 4663] NEW DELHI, MONDAY, NOVEMBER 25, 2024/AGRAHAYANA 4, 1946 गहृ मत्रं ालय अजधसचू ना नई दिल्ली, 25 नवम् बर, 2024 का.आ. 5053(अ).—िबदक, यनू ाइटेड जलब्रिे न फ्रंट ऑफ असम (जिसे इसके बाि उल् फा कहा गया ह)ै अपने गुटों, िाखाओं और अग्रणी संगठनों के साथ असम राज्य के क्षेत्रों म ें ऐसी गजतजवजधयों में िाजमल रहा ह ै िो भारत की संप्रभुता एवं अखंडता के जलए हाजनकारक ह;ै और िबदक, केंद्र सरकार की राय ह ैदक उल् फा न,े - (i) असम राज्य को भारत स ेअलग करन े के उद्दश्े य की घोषणा की हुई ह;ै (ii) अपन ेसंगठन के जलए लगातार धमकी िेने और धन उगाही के कृत् यों को िारी रखा ह;ै (iii) िबरन वसूली और हहसं ा के जलए अन्य जवद्रोही समूहों के साथ संबंध बनाए रखे ह;ैं (iv) अवैध हजथयार और गोला-बारूि रख ेह;ैं (v) 27 नवंबर, 2019 से 01 िुलाई, 2024 की अवजध के िौरान असम में जवस्ट्फोट की या जवस्ट् फोटक लगान े की कई घटनाओं सजहत, हहसं ा की सोलह घटनाए ंकी ह;ै (vi) असम में स्ट्वतंत्रता दिवस, 2024 के अवसर पर कई इम्प्रोवाइज्ड एक्सप्लोजसव जडवाइस या जवस्ट्फोटक 7596 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] लगाए; और िबदक, 27 नवंबर, 2019 से 01 िलु ाई, 2024 की अवजध के िौरान यह भी पाया गया ह ैदक: (i) पुजलस या सुरक्षा बलों की काययवाही में इसके तीन कट्टर कैडर मारे गए; (ii) इसके कैडरों के जवरुद्ध पंद्रह मामले िि य दकए गए, तीन आरोप पत्र िाजखल दकए गए तथा तीन पर मुकिमा चलाया गया; (iii) इसके कैडर सत्ताईस अन्य आपराजधक गजतजवजधयों में िाजमल रह;े (iv) इसके छप् पन कैडरों की जगरफ्तारी हुई एव ंजतरेसठ कैडरों द्वारा आत्मसमपयण दकया गया; (v) इसके पास से सत्ताईस हजथयार, पांच सौ पंद्रह राउंड गोला बारूि, नौ ग्रेनेड और िो इम्प्रोवाइज्ड एक्सप्लोजसव जडवाइस की बरामिगी हुई; और िबदक, असम सरकार न े भी जवजधजवरुद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 (1967 का 37) अजधजनयम के प्रावधानों के तहत उल् फा को जवजधजवरुद्ध संगम घोजषत करने की जसफाररि की ह;ै और िबदक, केंद्र सरकार की यह भी राय ह ै दक उल् फा की उपरोक्त गजतजवजधयां भारत की संप्रभुता और अखंडता के जलए हाजनकारक ह,ैं और यदि इन्ह ेंतुरंत रोका और जनयंजत्रत नहीं दकया िाता है, तो उल् फा खुि को दफर से संगरठत और हजथयारबंि करेगा, अपन े कैडरों का जवस्ट्तार करेगा, पररष्कृत हजथयार खरीिगे ा, नागररकों और सुरक्षा बलों के िीवन का नुकसान करेगा और इस तरह यह अपनी राष्ट्र जवरोधी गजतजवजधयों को तेि कर सकता है; और िबदक, केंद्र सरकार की यह भी राय ह ै दक उपरोक्त कारणों से, उल् फा, अपने गुटों, िाखाओं और अग्रणी संगठनों के साथ, एक जवजधजवरुद्ध संगम ह;ै अब, इसजलए, जवजधजवरुद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 (1967 का 37) की धारा 3 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, केंद्र सरकार एतद्द्वारा यनू ाइटेड जलब्रेिन फ्रंट ऑफ असम (उल्फ ा) को उसके सभी गुटों, िाखाओं और अग्रणी संगठनों के साथ जवजधजवरुद्ध संगम के रूप में घोजषत करती ह;ै केंद्र सरकार का मत ह ै दक यनू ाइटेड जलब्रेिन फ्रंट ऑफ असम की उपरोक्त गरै कानूनी गजतजवजधयों, और इसके द्वारा जवगत म ें की गई गजतजवजधयों, को ध्यान में रखत े हुए ऐसी पररजस्ट्थजतया ं मौिूि ह ैं जिसके कारण यनू ाइटेड जलब्रेिन फ्रंट ऑफ असम को, उसके सभी गुटों, िाखाओं और अग्रणी संगठनों के साथ, तत्काल प्रभाव से जवजधजवरुद्ध सगं म घोजषत करना आवश्यक हो िाता ह।ै अत: उक्त अजधजनयम की धारा 3 की उपधारा (3) के परंतुक द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए, एतद्द्वारा जनिेि दिया िाता ह ै दक यह अजधसूचना, उक्त अजधजनयम की धारा 4 के तहत दकसी आिेि के अध् यधीन, 27 नवंबर 2024 स ेतत्क ाल प्रभाव से पांच वषय के जलए प्रभावी होगी। [फा. सं. 11011/03/2024-एनई. V] जपयूष गोयल, अपर सजचव MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 25th November, 2024 S.O. 5053(E).—WHEREAS, the United Liberation Front of Asom along with all its factions, wings and front[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 organisations (hereinafter referred to as the ULFA) has been involved in such activities which are prejudicial to the sovereignty and integrity of India; AND WHEREAS, the Central Government is of the opinion that ULFA has,- (i) declared objective to secede the State of Assam from India; (ii) continued intimidation and extortion of funds for their organisation; (iii) maintained links with other insurgent groups for extortion and violence; (iv) possessed illegal arms and ammunitions; (v) indulged in sixteen criminal cases, including several cases of explosions or planting of explosives in Assam, during the period from 27th November, 2019 to 1st July, 2024; (vi) planted several improvised explosive devices or explosives in the run up to Independence Day, 2024 across Assam; AND WHEREAS, in the case of ULFA, the following has also been noted during the period from 27th November, 2019 to 1st July, 2024 :- (i) killing of three hardcore cadres in Police or Security Force action; (ii) registration of fifteen cases against its cadres with three charge sheets filed and three cadres prosecuted; (iii) involvement in twenty-seven other criminal activities; (iv) arrest of fifty-six cadres and surrender by sixty-three cadres; (v) recovery of twenty-seven arms, five hundred fifteen rounds ammunitions, nine Grenades and two improvised explosive devices; AND WHEREAS, the Government of Assam has also recommended for declaration of ULFA as an unlawful association under the provisions of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967); AND WHEREAS, the Central Government is also of the opinion that the aforesaid activities of ULFA are, detrimental to the sovereignty and integrity of India and if these are not immediately curbed and controlled, the ULFA may regroup and rearm itself, expand its cadres, procure sophisticated weapons, cause loss of lives of civilians and security forces and thereby accelerate its anti-national activities; AND WHEREAS, the Central Government is also of the opinion that for the reasons aforesaid, the ULFA together with its factions, wings and front organisations, is an unlawful association; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) of section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), (hereinafter referred to as the said Act), the Central Government hereby declares the United Liberation Front of Asom (ULFA) along with all its factions, wings and front organisations as an unlawful association; The Central Government, having regard to the unlawful activities mentioned above, and the unlawful activities committed in the past by United Liberation Front of Asom, is of the opinion that circumstances exist which render it necessary to declare the United Liberation Front of Asom alongwith all its factions, wings and front organisations to be unlawful association with immediate effect and accordingly, in the exercise of the powers conferred by the proviso to sub-section (3) of section 3 of the said Act, hereby directs that this notification shall, subject to any order that may be made under section 4 of the said Act, have immediate effect from the 27th November, 2024, for a period of five years.
