L.-33004/99 xxxGIDHxxx सी.जी.-डी.एxलx.x-GअID.-E1x7xx0 22023-243691 CG-DL-E-17022023-243691 ऄसाधारण EXTRAORDINARY भाग II—खण् ड 3—ईप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 708] नइ ददल्ली, िुिवार, फरवरी 17, 2023/माघ 28, 1944 No. 708] NEW DELHI, FRIDAY, FEBRUARY 17, 2023/MAGHA 28, 1944 गहृ मत्रं ालय ऄजधसचू ना नइ ददल्ली 17 फरवरी, 2023 का.अ. 738(ऄ).—जवजधजवरूद्ध दियाकलाप (जनवारण) ऄजधजनयम, 1967 (1967 का 37) (जिसे आसम ें आसके पश्चात् ईक्त ऄजधजनयम कहा गया ह)ै को व्यजियों और सगं मों के कजतपय जवजधजवरूद्ध दियाकलापों के ऄजधक प्रभावी जनवारण तथा अतंकवादी दियाकलापों से जनपटन े के जलए और ईससे संबंजधत जवषयों के जलए ईपबंध करने हते ु ऄजधजनयजमत दकया गया ह;ै और, ईक्त ऄजधजनयम की धारा 2 की ईपधारा (1) के खडं (ड) के ऄनुसार, ‘अतंकवादी संगठन’ से ईक्त ऄजधजनयम की पहली ऄनुसूची म ें सूचीबद्ध संगठन या आस प्रकार स े सूचीबद्ध संगठन के रूप में समान नाम के ऄधीन दियािील संगठन ऄजभप्रते ह;ै और, ईक्त ऄजधजनयम की पहली ऄनुसूची म ेंआस प्रकार के अतकं वादी संगठनों की सूची ऄतं र्ववि ह;ै और, ‘िम्मू और कश्मीर गिनवी फोसस (िेकेिीएफ)’ वषस 2020 में एक अतंकवादी सगं ठन के रूप म ें सामने अया और यह लश्कर-ए-तैयबा, िैि-ए-मोहम्मद, तहरीक-ईल-मुिाजहदीन, हरकत-ईल-जिहाद-ए-आस्ट्लामी अदद िैस े जवजभन्न प्रजतबंजधत अतंकवादी संगठनों से ऄपन ेकाडरों को बनाता ह;ै और, िम्म ू और कश्मीर गिनवी फोसस (िेकेिीएफ), संघ राज्यक्षेत्र िम्मू-कश्मीर में घुसपैठ की कोजििों, निील े पदाथों और हजथयारों की तस्ट्करी और अतंकवादी हमलों को ऄंिाम देन ेमें िाजमल है; और, िम्मू और कश्मीर गिनवी फोसस (िेकेिीएफ) जनयजमत रूप स े भारतीय सुरक्षा बलों को धमदकयां देता ह ै और संघ राज्यक्षेत्र िम्मू-कश्मीर के लोगों को जवजभन्न सोिल मीजडया प्लेटफामस का ईपयोग कर भारत के जखलाफ अतंकवादी संगठनों में िाजमल होने के जलए, ईकसाता ह;ै और, िम्मू और कश्मीर गिनवी फोसस (िेकेिीएफ) की गजतजवजधयां भारत की राष्ट्रीय सुरक्षा और संप्रभुता के जलए हाजनकारक ह;ै 1040 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, केंद्रीय सरकार का यह जवश्वास ह ै दक िम्मू और कश्मीर गिनवी फोसस (िेकेिीएफ) अतंकवाद में संजलप्त ह ै और यह भारत में अतंकवाद के जवजभन्न कृत्यों में भाग लते ा रहता ह;ै ऄतः, ऄब, केंद्रीय सरकार, जवजधजवरूद्ध दियाकलाप (जनवारण) ऄजधजनयम, 1967 की धारा 35 की ईपधारा (1) के खंड (क) द्वारा प्रदत्त िजक्तयों का प्रयोग करते हुए, ईक्त ऄजधजनयम की पहली ऄनुसूची में जनम्नजलजखत और संिोधन करती ह,ै ऄथासत ्:-- ईक्त ऄजधजनयम की पहली ऄनुसूची में िम संखयांक 42 और ईससे संबंजधत प्रजवजियों के पश्चात,् जनम्नजलजखत िम संखयांक और प्रजवजियां ऄंतःस्ट्थाजपत की िाएगी, ऄथासत् :- “43. िम्मू और कश्मीर गिनवी फोसस (िेकेिीएफ) और आसके सभी रूप और फ्रंट संगठन ।”। [फा. सं. 11034/16/2022-सीटी-I] प्रवीण वजिष्ठ, ऄपर सजचव टटप्पण : जवजधजवरूद्ध दियाकलाप (जनवारण) ऄजधजनयम, 1967 की पहली ऄनुसूची का ऄंजतम संिोधन ऄजधसूचना संखयांक का.अ. 85 (ऄ), तारीख 6 िनवरी, 2023 द्वारा दकया गया था। MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 17th February, 2023. S.O. 738(E).—Whereas, the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) (hereinafter referred to as the said Act) has been enacted to provide for more effective prevention of certain unlawful activities of individuals and associations and for dealing with terrorist activities and for matters connected therewith; And whereas, as per clause (m) of sub-section (1) of section 2 of the said Act, „terrorist organisation‟ means an organisation listed in the First Schedule to the said Act or an organisation operating under the same name as an organisation so listed; And whereas, the First Schedule to the said Act contains the list of such terrorist organisations; And whereas, „Jammu and Kashmir Ghaznavi Force (JKGF)‟ surfaced in the year 2020 as a terrorist outfit and it draws its cadres from various proscribed terrorist organisations, such as Lashker-E-Taiba, Jaish-E-Mohammed, Tehreek-ul-Mujahideen, Harkat-ul—Jehad-E-Islami, etc.; And whereas, the „Jammu and Kashmir Ghaznavi Force (JKGF)‟ is involved in infiltration bids, narcotics and weapon smuggling and carrying out terror attacks in the Union territory of Jammu and Kashmir; And whereas, the „Jammu and Kashmir Ghaznavi Force (JKGF)‟ regularly issues threats to Indian Security Forces and uses various social media platforms for inciting people of Union territory of Jammu and Kashmir to join terrorist outfits against India; And whereas, the activities of „Jammu and Kashmir Ghaznavi Force (JKGF)‟ are detrimental to the national security and sovereignty of India; And whereas, Central Government believes that the „Jammu and Kashmir Ghaznavi Force (JKGF)‟ is involved in terrorism and it has committed and participated in various acts of terrorism in India; Now, therefore, in exercise of the powers conferred by clause (a) of sub-section (1) of section 35 of the Unlawful Activities (Prevention) Act, 1967, the Central Government hereby makes the following further amendments in the First Schedule to the said Act, namely:- In the First Schedule to the said Act, after serial number 42 and entries relating thereto, the following serial number and entries shall be inserted, namely:- “43.
