L.-33004/99 सी.जी.-डी.एल.-अ.-29122023-250971 CG-DxLx-xEG-I2D9H1x2x2x0 23-250971 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY सं. 5258] नई दिल्ली, िुििार, दिसम्ब र 29, 2023/पौष 8, 1945 No. 5258] NEW DELHI, FRIDAY, DECEMBER 29, 2023/PAUSHA 8, 1945 गहृ मत्रं ालय अजधसचू ना नई दिल्ली, 29 दिसम्बर, 2023 का.आ. 5491(अ).—जिजधजिरुद्ध दिया-कलाप (जनिारण) अजधजनयम, 1967 (1967 का 37) (जिसे इसम ें इसके पश्चात् उक्त अजधजनयम कहा गया ह)ै को व् यज‍ि यों और संगमों के कजतपय जिजधजिरुद्ध दिया-कलापों के अजधक प्रभािी जनिारण करन े तथा आतंकिािी दियाकलापों से जनपिन े के जलए और संबद्ध जिषयों का उपबन् ध करन े हते ु अजधजनयजमत दकया गया ह ै; और, उक्त अजधजनयम की धारा 35 की उपधारा (1) का खडं (क) और उपधारा (2), केन्रीय सरकार को उक्त अजधजनयम की चौथी अनुसूची में दकसी व्यजि के नाम को िोड़ने के जलए सिक्त करती है, यदि उसका यह जिश्वास ह ै दक िह आंतकिाि में सजम्मजलत ह ै; और, लखबीर ससंह उर्फ लांडा, पुत्र जनरिंन ससंह और परसमंिर कौर, जिसका िन्म 24.08.1989 को हुआ ह ै और जिसका स्ट्थाई पता ग्राम ि डाकघर हररके, जिला तरनतारन, पंिाब ह ै और िो इस समय एडमंिन, अल्बरिा, कनाडा मंे ं रह रहा ह,ै बब्बर खालसा इंिरनेिनल से संबंजधत ह ै ; 8009 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, बब्बर खालसा इंिरनेिनल उक्त अजधजनयम की पहली अनुसूची की िम संख्या एक पर आंतकिािी संगठन के रूप में ंसूचीबद्ध ह ै ; और, उक्त लखबीर ससंह उर्फ लांडा को, सीमा पार के अजभकरण द्वारा समथफन दिया िा रहा है, िह कन्धे पर रखकर चलाए िाने िाले राकेि नोदित ग्रनेड द्वारा मोहाली जस्ट्थत पंिाब राज्य आसूचना मुख्यालय के भिन पर आतंकिािी हमले म ेंसजम्मजलत था ; और, उक्त लखबीर ससंह उर्फ लांडा पंिाब राज्य, भारत में आतकं िािी दियाकलापों को करने के जलए सीमा पार स े परर‍कृत जिस्ट्र्ोिक युजक्तयों (आईईडी), िस्त्रों, उन्नत हजथयारों, जिस्ट्र्ोिकों की जिजभन्न माडयूलों को पतू ी में सजम्मजलत रहा ह ै; और, उक्त लखबीर ससंह उर्फ लांडा, आतंकिािी मोड्यूलों को तैयार करने, दर्रौती, हत्याओं, आईईडी लगाने, हजथयारों और मािक पिाथााों की तस्ट्करी तथा उनसे प्राप्त जनजधयों या आगतों का पंिाब राज्य और ििे के अन्य भागों म ें आतंकिािी कायफकलापों म ेंउपयोग करने से संबजन्धत आपराजधक मामलों म ेंभी सजम्मजलत रहा ह ै ; और, उक्त लखबीर ससंह उर्फ लांडा तथा उसके सहयोगी, लजययत हत्याएं, दर्रौती तथा भारत के जिजभन्न भागों म ें अन्य राष्ट्र जिरोधी कायफकलाप करके पंिाब राज्य में िांजत, जिजध तथा व्यिस्ट्था को भंग करन ेके जलए षडयंत्र कर रह ेह ैं ; और, उक्त लखबीर ससंह उर्फ लांडा के जिरूद्ध एक जबना समाजप्त तारीख का िारंि िारी दकया गया ह ै और उक्त लखबीर ससंह उर्फ लांडा तारीख 09.06.2021 के जनगरानी (लकु आउि) पररपत्र संख्या 2144306 के भी अधीन ह;ै और, केन्रीय सरकार का यह जिश्वास ह ै दक लखबीर ससंह उर्फ लांडा, आंतकिाि मंे ं सजम्मजलत ह ै और लखबीर ससंह उर्फ लांडा, को उक्त अजधजनयम की चौथी अनुसूची के अधीन एक आंतकिािी के रूप मंे ंिोड़ा िाना ह ै; अतः अब, केन्रीय सरकार, जिजधजिरुद्ध दिया-कलाप (जनिारण) अजधजनयम, 1967 की धारा 35 की उपधारा (1) के खंड (क) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, उक्त अजधजनयम की चौथी अनुसूची म ें जनम्नजलजखत संिोधन करती है, अथाफत:् - जिजधजिरुद्ध दिया-कलाप (जनिारण) अजधजनयम, 1967 की चौथी अनुसूची में ि. संख्यांक 54 और उससे संबंजधत प्रजिजियों के पश्चात,् जनम्नजलजखत िम संख्यांक और प्रजिजियां अंत:स्ट्थाजपत की िाएंगी, अथातफ ् :- “55. लखबीर ससंह उर्फ लांडा”। [र्ा.सं. 11034/17/2022/सी िी-I] प्रिीण िजिष्ठ, अपर सजचि रिप्पण : जिजध जिरुद्ध दिया-कलाप (जनिारण) अजधजनयम, 1967 की चौथी अनुसूची का अंजतम संसोधन अजधसूचना संख्यांक का.आ. 709(अ), तारीख 17 र्रिरी, 2023 द्वारा दकया गया था । MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 29th December, 2023. S.O. 5491(E).—Whereas, the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) (hereinafter referred to as the said Act) has been enacted to provide for more effective prevention of certain unlawful activities of individuals and associations and for dealing with terrorist activities and for matters connected therewith;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 And whereas, clause (a) of sub-section (1) and sub-section (2) of section 35 of the said Act empowers the Central Government to add the name of an individual in the Fourth Schedule to the said Act, if it believes that he is involved in terrorism; And whereas, Lakhbir Singh @ Landa son of Niranjan Singh and Parminder Kaur, born on 24.08.1989, having permanent residence at VPO Harike, District Tarn Taran, Punjab and presently residing in Edmonton, Alberta, Canada belongs to Babbar Khalsa International; And whereas, Babbar Khalsa International is listed as a terrorist organisation at serial number 1 of the First Schedule to the said Act; And whereas, the said Lakhbir Singh @ Landa backed by cross border agency was involved in the terror attack through shoulder mounted Rocket Propelled Grenade on the building of Punjab State Intelligence Headquarter at Mohali; And whereas, the said Lakhbir Singh @ Landa has been involed in supply of Improvised Explosive Devices (IEDs), arms, sophisticated weapons, explosives from across the border to various modules for carrying out terrorist activities in the State of Punjab, India; And whereas, the said Lakhbir Singh @ Landa has also been involved in various criminal cases related to raising of terror modules, extortion, killings, planting IEDs, smuggling of weapons and narcotics and using funds or proceeds thereof for terrorist acts in the State of Punjab and other parts of the Country; And whereas, the said Lakhbir Singh @ Landa and his associates have been conspiring to disrupt the peace, law and order in the State of Punjab by carrying out targeted killings, extortions and other anti-national activities in different parts of India; And whereas, an open ended warrant has been issued against the said Lakhbir Singh @ Landa and the said Lakhbir Singh @ Landa is a subject of Look Out Circular No. 2144306 dated 09.06.2021; And whereas, the Central Government believes that Lakhbir Singh @ Landa is involved in terrorism and the said Lakhbir Singh @ Landa is to be added as a terrorist in the Fourth Schedule to the said Act; Now, therefore, in exercise of the powers conferred by clause (a) of sub-section (1) of section 35 of the Unlawful Activities (Prevention) Act, 1967, the Central Government hereby makes the following amendment in the Fourth Schedule to the said Act, namely:- In the Unlawful Activities (Prevention) Act, 1967, in the Fourth Schedule, after serial number 54 and entries relating thereto, the following serial number and entries shall be inserted, namely:- “55.
