## Report on Amendment to the Unlawful Activities Prevention Act, 1967
**1. Executive Summary:**
This report analyzes a specific amendment to the Unlawful Activities Prevention Act (UAPA), 1967. The amendment, enacted on April 8, 2022, adds Hafiz Talha Saeed to the Fourth Schedule of the Act, designating him as a terrorist. This action empowers the government to apply the provisions of the UAPA against him, impacting his activities and potentially those of organizations he is associated with. This report details the rationale behind the amendment, its key provisions, and its potential impact based solely on the information provided in the official notification.
**2. Introduction:**
This report aims to provide an informative overview of an amendment to the Unlawful Activities Prevention Act (UAPA), 1967, as published in the Gazette of India on April 8, 2022. The analysis is strictly based on the information contained within the provided policy text.
**3. Policy Overview:**
* **Original Policy Being Amended:** The Unlawful Activities Prevention Act (UAPA), 1967.
* **Core Objective(s) as stated or inferred from the provided text:** The UAPA aims to provide for more effective prevention of certain unlawful activities of associations and individuals, dealing with terrorist activities, and matters connected therewith. This is directly stated in the policy text.
**4. Background and Rationale:**
The amendment specifically targets Hafiz Talha Saeed, designating him as a terrorist. The rationale for this amendment, as stated in the text, is based on the belief of the Central Government that Hafiz Talha Saeed is involved in terrorism. The policy outlines the following reasons as justification: his position as a senior leader of Lashkar-e-Taiba (LeT), which is listed as a terrorist organization, his active involvement in recruitment, fund collection, planning, and executing attacks by LeT in India and against Indian interests in Afghanistan, and his propagation of jihad against India, Israel, the United States of America, and Indian interests in other western countries during sermons at LeT centers.
**5. Key Provisions / Changes:**
This is an amendment to the Fourth Schedule of the UAPA.
* **Specific Part of the Original Policy Being Changed:** The Fourth Schedule to the UAPA, which lists individuals designated as terrorists.
* **New Rule/Provision:** The amendment adds "32. Hafiz Talha Saeed" to the Fourth Schedule, following serial number 31.
* **Effect of This Change:** By adding Hafiz Talha Saeed to the Fourth Schedule, he is officially designated as a terrorist under the UAPA. This triggers the provisions of the UAPA that apply to designated terrorists, which may include restrictions on his movement, financial assets, and ability to engage in certain activities.
**6. Target Audience and Stakeholders:**
The primary target of this amendment is Hafiz Talha Saeed. Secondary stakeholders include:
* LeT (Lashkar-e-Taiba) and its members/associates.
* Individuals or entities providing support (financial or otherwise) to Hafiz Talha Saeed or LeT.
* Indian security and intelligence agencies responsible for counter-terrorism efforts.
* Financial institutions that may be required to freeze assets.
**7. Implementation Aspects (Inferred):**
* **Responsible agency/bodies mentioned:** The Central Government, specifically the Ministry of Home Affairs, is responsible for implementing this amendment.
* **Timelines or procedures specified:** The notification is effective immediately upon publication in the Gazette of India (April 8, 2022). The procedures for implementing the UAPA provisions against a designated terrorist are outlined within the UAPA itself (though not detailed in this specific text).
* **Implementation aspects related specifically to the changes:** Agencies will likely need to update their databases and intelligence to reflect Hafiz Talha Saeed's designation. They may also need to coordinate with international partners, particularly concerning financial monitoring and asset freezes.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcome of this amendment is to disrupt Hafiz Talha Saeed's activities related to terrorism. By designating him as a terrorist, the government aims to:
* Restrict his ability to recruit, raise funds, and plan attacks.
* Limit his movement and communication.
* Isolate him from sources of support.
* Deter others from associating with him or LeT.
* Strengthen India's counter-terrorism efforts and send a message that the government is serious about combating terrorism.
**9. Conclusion:**
The amendment to the UAPA, adding Hafiz Talha Saeed to the Fourth Schedule as a designated terrorist, is a significant step in India's counter-terrorism efforts. Based on the policy text, this action is motivated by his alleged involvement in terrorist activities linked to LeT. The amendment empowers the government to take action against him under the UAPA, potentially impacting his operations and those of his associates. This action reinforces the government’s commitment to preventing unlawful activities and combating terrorism.
