और, उक्त अजधजनयम की धारा 35 की उपधारा (1) का खडं (क) और उपधारा (2), केन्द्रीय सरकार को उक्त अजधजनयम की चौथी अनुसूची में दकसी व्यजि के नाम को िोड़ने के जलए सिक्त करती है, यदि उसका यह जवश्वास ह ै दक वह आतंकवाि में सजममजलत ह ै; और, सतववंिर वसंह उर्फ सवतंिरिीत वसंह उर्फ गोल्डी बराड़, पुत्र समिेर वसंह और प्रीतपाल कौर, जिसका िन्द्म 11.04.1994 को हुआ ह ै और जिसका स्ट्थाई पता मकान सख्ं या 970/2, आिेि नगर , गली नंबर 3, श्री मुक्तसर साहबे जसिी पंिाब ह ैऔर िो इस समय ब्रामपिन, कनाडा म ेरह रहा ह,ै का बब्बर खालसा इंिरनेिनल के साथ संबद्ध ह ै ; और, बब्बर खालसा इंिरनिे नल उक्त अजधजनयम की पहली अनुसूची की िम संख्या 1 पर आंतकवािी संगठन के रूप म ेंसूचीबद्ध ह ै ; 02 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, उक्त सतववंिर वसंह उर्फ सवतंिरिीत वसंह उर्फ गोल्डी बराड़, िो दक सीमा पार के अजभकरण द्वारा समर्थफत ह,ै अनेक हत्याओं म ें सजममजलत ह ै और कट्टरपंथी जवचारधारा को मानता ह,ै राष्ट्रवािी नेताओं को धमकी भरे र्ोन करन े म ें िाजमल ह,ै दर्रौती की मागं करता ह ैऔर जवजभन्न सोिल मीजडया मंचों पर हत्याओं के िावों को पोस्ट्ि करता ह ै ; और, उक्त सतववंिर वसंह उर्फ सवतंिरिीत वसंह उर्फ गोल्डी बराड़ ड्रोन के माध्यम से सीमा-पार से उच्च श्रणे ी के िस्त्रों, गोला बारूि तथा जवस्ट्र्ोिक सामजियों की तस्ट्करी में तथा हत्याएं करन े के जलए उनकी आपूर्तफ करने में और िाप फ िूिरों को भी उपलब्ध करान े म ेंसजममजलत रहा ह ै। और, उक्त सतववंिर वसंह उर्फ सवतंिरिीत वसंह उर्फ गोल्डी बराड़ तथा उसके सहयोगी जवध्वसंक कायफ-कलापों, आतंकवािी माड्यलू तैयार करने, लजययत हत्याए ं करन े और अन्द्य राष्ट्र जवरोधी कायफकलापों सजहत अपन े कुिील इरािों के माध्यम से पंिाब राज्य में िांजत, सामुिाजयक सौहािफ और जवजध तथा व्यवस्ट्था को भंग करने के जलए षडयंत्र कर रह े ह ैं; और, उक्त सतववंिर वसंह उर्फ सवतंिरिीत वसंह उर्फ गोल्डी बराड़ के जवरूद्ध इंिरपोल, महासजचवालय (आईपीएसिी), जलयोन, फ्ांस द्वारा रेड कानफर नोटिस संख्या ए-4588/6-2022 िारी दकया गया ह;ै और, उक्त सतववंिर वसंह उर्फ सवतंिरिीत वसंह उर्फ गोल्डी बराड़ के जवरूद्ध तारीख 12.12.2022 का गरै िमानती वारंि िारी दकया गया ह ै तथा उक्त सतववंिर वसंह उर्फ सवतंिरिीत वसंह उर्फ गोल्डी बराड़ तारीख 15.06.2022 के जनगरानी (लुक आउि) पटरपत्र संख्या 2245381 के भी अधीन ह;ै और, केन्द्रीय सरकार का यह जवश्वास ह ै दक सतववंिर वसंह उर्फ सवतंिरिीत वसंह उर्फ गोल्डी बराड़ आतंकवाि म े सजममजलत ह ै और सतववंिर वसंह उर्फ सवतंिरिीत वसंह उर्फ गोल्डी बराड़ को उक्त अजधजनयम की चौथी अनुसूची के अधीन एक आतंकवािी के रूप म ें िोड़ा िाना ह ै; अतः अब केन्द्रीय सरकार, जवजधजवरुद्ध दिया-कलाप (जनवारण) अजधजनयम, 1967 की धारा 35 की उपधारा (1) के खंड (क) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, उक्त अजधजनयम की चौथी अनुसूची म ें जनम्नजलजखत संिोधन करती है, अथाफत:् - जवजधजवरुद्ध दिया-कलाप (जनवारण) अजधजनयम, 1967 की चौथी अनुसूची में ि. संख्यांक 55 और उसस े संबंजधत प्रजवजियों के पश्चात्, जनम्नजलजखत िम संख्यांक और प्रजवजियां अंत:स्ट्थाजपत की िाएगं ी, अथातफ ् :- “56. सतववंिर वसंह उर्फ सवतंिरिीत वसंह उर्फ गोल्डी बराड़”। [र्ा. सं.11034/01/2023/सी िी-I] प्रवीण वजि‍ठ , अपर सजचव टिप्पण: जवजधजवरुद्ध दिया-कलाप (जनवारण) अजधजनयम, 1967 की चौथी अनुसूची का अंजतम संसोधन अजधसूचना संख्यांक का. आ. 5491(अ), तारीख 29.12.2023 द्वारा संिोजधत दकया गया था । MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 1st January, 2024 S.O. 02(E).—Whereas, the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) (hereinafter referred to as the said Act) has been enacted to provide for more effective prevention of certain unlawful activities of individuals and associations and for dealing with terrorist activities and for matters connected therewith; And whereas, clause (a) of sub-section (1) and sub-section (2) of section 35 of the said Act empowers the Central Government to add the name of an individual in the Fourth Schedule to the said Act, if it believes that he is involved in terrorism; And whereas, Satwinder Singh @ Satinderjit Singh @ Goldy Brar son of Shamsher Singh and Preetpal Kaur born on 11.04.1994 having permanent address at House No. 970/2, Adesh Nagar, Street No. 3, Sri Muktsar Sahib City, Punjab and presently residing in Brampton, Canada is associated with Babbar Khalsa International;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 And whereas, Babbar Khalsa International is listed as a terrorist organisation at serial number 1 of the First Schedule to the said Act; And whereas, the said Satwinder Singh @ Satinderjit Singh @ Goldy Brar backed by cross border agency was involved in multiple killing and professes radical ideology, figured in making threatening calls to pro-nationalist leaders, demanding ransom and posting the claims of killings on different social media platforms; And whereas, the said Satwinder Singh @ Satinderjit Singh @ Goldy Brar has been involved in smuggling of high-grade arms, ammunitions and explosive materials through drones from across the border and supplying thereon for carrying out killings and also providing sharp shooters; And whereas, the said Satwinder Singh @ Satinderjit Singh @ Goldy Brar and his associates have been conspiring to disrupt the peace, communal harmony and law and order in the State of Punjab through nefarious designs including sabotage, raising of terror modules, carrying out targeted killings, and other anti-national activities; And whereas, Red Corner Notice No. A-4588/6-2022 has been issued against the said Satwinder Singh @ Satinderjit Singh @ Goldy Brar by INTERPOL Secretariat General (IPSG), Lyon, France And whereas, a non-bailable warrant dated 12.12.2022 has been issued against the said Satwinder Singh @ Satinderjit Singh @ Goldy Brar and the said Satwinder Singh @ Satinderjit Singh @ Goldy Brar is a subject of Look Out Circular No. 2245381 dated 15.06.2022; And whereas, the Central Government believes that Satwinder Singh @ Satinderjit Singh @ Goldy Brar is involved in terrorism and the said Satwinder Singh @ Satinderjit Singh @ Goldy Brar is to be added as a terrorist in the Fourth Schedule to the said Act; Now, therefore, in exercise of the powers conferred by clause (a) of sub-section (1) of section 35 of the Unlawful Activities (Prevention) Act, 1967, the Central Government hereby makes the following amendment in the Fourth Schedule to the said Act, namely:- In the Unlawful Activities (Prevention) Act, 1967, in the Fourth Schedule, after serial number 55 and entries relating thereto, the following serial number and entries shall be inserted, namely:- “56.Satwinder Singh @ Satinderjit Singh @ Goldy Brar ”.
