F. No. 13/12/2012-LPAI.—In exercise of the powers conferred by clause (b) of sub-section (2) of section 35
read with section 10 of the Land Ports Authority of India Act, 2010 (31 of 2010), the Land Ports Authority of India with
the previous approval of the Central Government, hereby makes the following regulations, namely:—
1. Short title and commencement.—(1) These regulations may be called the Land Ports Authority of India
(Conditions of Service of Officers and other Employees) Regulations, 2016.
(2) These shall come into force from the date of publication in the Official Gazette.
2. Application.—(1) These regulations shall apply to all the employees of the Authority whether posted or
working at its Secretariat or any integrated check post.
(2) These regulations shall not apply to a person attached to, outsourced or employed on contract by, the
Authority.
3. Definitions.—(1) In these regulations, unless the context otherwise requires,—
(a) “Act” means the Land Ports Authority of India Act, 2010 (31 of 2010);
(b) “Authority” means the Land Ports Authority of India constituted under section 3 of the Act;
(c) “Chairperson” means the Chairperson of the Authority appointed under clause (a) of section 3 of the
Act;
(d) “disciplinary authority” means —
(i) in relation to a postbearing the grade pay of six thousand and six hundred rupees or above, the
Authority;
(ii) in relation to any other post, theChairperson;
(e) “employees”includes an officer and other employees of the Authority in the whole time employment of
the Authority;
(f) “Member” means a member of the Authority;
(g)“Selection Committee” means a selection committee constituted under regulation 11;
(h) “integrated check post” means any land port specified by the Central Government under clause (d) of

(2) Words and expressions used herein and not defined, but defined in the Act, shall have the meaning respectively
assigned to them under the Act.
4. Nature and categories of posts.—The nature and categories of the posts under the Authority, their sanctioned
strengths and pay attached thereto shall be as specified in the Schedule appended to these regulations.
5. Mode of appointment.— (1) All appointment against the sanctioned posts under the Authority shall be made
through deputation basis or short term contract:
Provided that in respect of a post carrying the grade pay of ten thousand rupees, the appointment shall be made
after taking the prior approval of the Appointment Committee of the Cabinet.
6. Allocation of posts.—The inter-se allocation of the sanctioned posts amongst different offices of the Authority
shall be as decided by the Authority from time to time.
7. Power to keep a post vacant.—Nothing in these regulations shall be construed as requiring the Authority to
have at all times, employees serving in all the categories of posts.
8. Criteria for appointment.— The method of recruitment whether by deputation or short term contract shall be
determined by the Authority from time to time based on the requirements.
9. Announcement of vacancies.—The Authority shall announce in such manner, as it deems fit, the number of
vacancies to be filled and invite applications for appointment in the various posts under the Authority by circulating the
vacancies to all departments and organisations of the Central Government and the State Governments and publish the
vacancies through such advertisement, as it deems fit.
10. Prescription of forms and conditions for application.—The Authority may prescribe, as it deems fit, the
form in which application shall be submitted, the documents and certificate to be accompanied with the application, the
mode of submission, the last date for receipt of applications and the designated officer for submission of applications.
11. Constitution of Selection Committee.—(1) There shall be a Selection Committee for short listing the
candidates and making recommendations for appointment to the Authority.
(2) The Selection Committee for making recommendation for appointment to a post carrying the grade pay of six
thousand and six hundred rupees or more, shall consist of—
(a) the Chairperson— Chairman;
(b) one Member appointed under clause (b) of sub-section (3) of section 3 of the Act— Member;
(c) one representative of the Ministry of Home Affairs, not below the rank of the Joint Secretary to the
Government of India— Member;
(d) the Secretary of the Authority— Member-Convener.
(3) The Selection Committee for making recommendation for appointment to a post other than those referred to in
sub-regulation (2), shall consist of—
(a) one Member appointed under clause (b) of sub-section (3) of section 3 of the Act— Chairman;
(b) the Secretary of the Authority — Member;
(c) one representative of the Ministry of Home Affairs, not below the rank of the Deputy Secretary to the
Government of India— Member;
(d) the Director of the Authority— Member-Convener.
12. Pay, allowances and conditions of service.—(1) The pay of officers and other employee of the Authority
specified under column (2) shall be as specified in the corresponding entries under column (4) of the Schedule and shall
be fixed in accordance with such guidelines as are laid down by the Central Government in this regard.
(2) The conditions of service of the employees of the Authority in the matters of allowances, leave, provident
fund, age of superannuation, pension and retirement benefits, medical facilities and other conditions of service shall be
regulated in accordance with such rules and regulations as are prescribed by the Central Government in this regard.¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 7
13. Posting of employees.— (1) The posting of an employee at any time shall be as determined by the Authority
and no employee shall be posted to a post carrying the scale or pay or grade pay lower than to one such employee is
initially appointed.
(2) An employee may hold additional charge of more than one post for which no extra remuneration or allowances
shall be paid except as otherwise applicable under the rules or regulations of the Central Government in this regard.
14. Conduct and discipline.— All employees shall be regulated in accordance with the provisions of the Central
Civil Services (Conduct ) Rules, 1964 and the Central Civil Services ( Classification, Conduct and Appeal ) Rules, 1965,
as amended from time to time, and the instructions issued by Central Government from time to time in this regard.
15. Special provision for employees on deputation.—An employee appointed on deputation to a post under the
Authority from any State Government or Undertaking of the Central Government or a State Government shall have the
option to either opt for the rules and regulations applicable to the post for which he is appointed or to the rules and
regulations applicable to him under such State Government or Undertaking, in respect of —
(a) the pay and dearness allowance thereon; and
(b) the leave, provident fund, pension and medical facilities.
16. Other conditions of service.—Other conditions of service of the employees with respect to a matter for which
no express provision has been made in these regulations, shall be such as are admissible to the officers and other
employees of the Central Government drawing an equivalent pay.
17. Power of relax.—The Authority may in the public interest and after recording reasons in writing and with the
prior approval of the Central Government, relax any of the provisions of these regulations.
18. Interpretation.—If any question arises as regard to the interpretation of these regulations, it shall be referred
to the Central Government for determination and the decision of the Central Government thereon shall be final and
binding.

NOTIFICATION
New Delhi, the 3rd March, 2016
No. 13/12/2012-LPAI.—In exercise of the powers conferred by clause (b) of sub-section (2) of
Section 35 read with Section 10, of the Land Ports Authority of India Act, 2010 (31 of 2010), the Land Ports
Authority of India, with the prior approval of the Central Government hereby makes the following regulations
regulating the method of recruitment of the various posts in the Land Ports Authority of India, namely:-
1. Short title and commencement. – (1) These regulations may be called the Land Ports Authority of
India (Officers and Other Employees) Recruitment Regulations, 2016.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of posts, classification and scale of pay. – The number of posts, their classification and
scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these
regulations.
3. Method of recruitment, age-limit, qualification, etc. - The method of recruitment, age-limit,
qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the
aforesaid Schedule.
4. Disqualification. – No person –
shall be eligible for appointment to the said posts:
(a) who has entered into or contracted a marriage with a person having a spouse living;
or
(b) who, having a spouse living, has entered into or contracted a marriage with any person;
Provided that the Central Government may if satisfied that such marriage is permissible under the
personal law applicable to such person and the other party to the marriage and that there are other grounds for
so doing, exempt any person from the operation of these regulations.
5. Power to relax. – Where the Central Government is of the opinion that it is necessary or expedient so
to do, it may, by orders and for reasons to be recorded in writing, relax any of the provisions of these
regulations with respect to any class or category of persons.
6. Saving. – Nothing in these regulations shall affect reservations, relaxation of age limit and other
concessions required to be provided for the candidates belonging to the scheduled castes, the scheduled tribes,
the other backward classes, the ex-servicemen and the other special categories of persons in accordance with
the orders issued by the Central Government from time to time in this regard.
