Short title and commencement.- (1) These rules may be called the Border Security Force, Assistant Commandant (Official Language) Group ‘A’ Combatised post Recruitment Rules, 2015. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Number of posts, classification and pay band and grade pay or pay scale.- The number of the said post, its classification and pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the said Schedule. 3. Method of recruitment, age limit, qualifications, etc.- The method of recruitment to the said posts, age limit, qualifications and other matters relating thereto, shall be as specified in columns (5) to (13) of the afore said Schedule. 4. Disqualifications – No person, - (a) who has entered into, or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into, or contracted a marriage with any person, shall be eligible for appointment to the said post : Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 5. Ineligibility of aliens.- No person who is not a citizen of India shall, except with the consent of the Central Government signified in writing, be appointed or employed under these rules: Provided that nothing contained in these rules shall debar the appointment or employment of a subject of Nepal or Bhutan under these rules. 6. Medical Fitness.- (1) Notwithstanding anything contained in these rules, only those persons who are in medical category SHAPE-I, shall be eligible for appointment under the provisions of these rules. (2) For the purpose of this rule, SHAPE-I means.-¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 5 (i) Medical classification done by Medical Officer after assessing fitness of the officer under given factors indicated by the code letters SHAPE, which represent the following function:- S - Psychological H - Hearing A - Appendages P - Physical Capacity E - Eye-Sight (ii) Functional capacity of an officer under each factor will be denoted by numeral 1 to 5 against each code letter, indicating declining functional efficiency. The numerals will be written next to the code letter, except that where an officer is in Grade-I in all factors, his category may be denoted by writing SHAPE-I instead of writing S H A P E . General evaluation of these numerals is as 1 1 1 1 1 under:— 1. Fit for all duties anywhere. 2. Fit for all duties but may have limitations as to type of duties and areas of employability depending on whether the duties involve severe stress or demand acuity of hearing/vision of both ears/eyes. 3. Excepting “S” factor, fit for routine or sedentary duties but may have limitations of employability at high altitude (above 2,700 meters) extreme cold areas or hilly terrain and for long assignments. 4. Temporarily unfit for duties on account of hospitalization or sick leave. 5. Permanent unfit for duties. 7. Superannuation.- (1) The person appointed under the these rules shall retire from service on the afternoon of the last day of the month in which he attains the age of fifty-seven years: Provided that the person whose date of birth is the first of a month shall retire from service on the afternoon of the last day of the preceding month of attaining the age of fifty- seven years. (2) No person shall be granted extension in service beyond the age of retirement of fifty- seven years. 8. Power to relax. - Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons. 9. Saving.– Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, Scheduled Tribes, Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] SCHEDULE Name of the post. (11) Deputation: Officers of Central Government or State Government holding analogous posts or the post in Pay Band-2(Rs.9,300-34,800) with grade pay of Rs.4800/- with two years regular service in the grade and possessing the following qualification, namely:- (i) Master’s Degree of a recognized University in Hindi with English as a compulsory or elective subject or as the medium of examination at the degree level; or Master’s degree of a recognized University in English with Hindi as a compulsory or elective subject or as the medium or examination at the degree level; or Master’s degree of a recognized University in any subject other than Hindi or English, with Hindi as the medium and English as a compulsory or elective subject or as the medium of examination at the degree level; or Master’s degree of a recognized University in any subject other than Hindi or English, with English as the medium and Hindi as a compulsory or elective subject or as a medium of a examination at the degree level; or Master’s degree of a recognised University in any subject other than Hindi or English, with Hindi and English as compulsory or elective subjects or either of the two as a medium of examination and the other as a compulsory or elective subject at the degree level; and¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 7 (ii) three years’ experience of using or applying terminology (terminological work) in Hindi and translation work from English to Hindi or vice-versa, preferably of technical or scientific literature under the Central Government or the State Government or an autonomous body or statutory organisations or public sector undertakings or Universities or recognized research or educational institutions; or three years’ experience of teaching in Hindi and English or research in Hindi or English under the Central Government or the State Governments or an autonomous body or statutory organisations or public sector undertakings or Universities or recognized research or educational institutions. Note 1: The departmental Subedar Major (Hindi Translator) in Pay Band -2 (Rs.9300-34800) and grade pay of Rs.4800/- with two years of regular service in the grade shall be considered alongwith outsiders and in case the departmental candidate is selected for appointment to the post, it shall be deemed to have been filled by promotion. Note 2: The period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department shall ordinarily not exceed three years. Note 3: The maximum age limit for appointment by deputation shall not be exceeding fifty-two years as on the date of receipt of applications. Note 4: For the purpose of appointment on deputation basis, the service rendered on a regular basis by an officer prior to the 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Commission except where there has been merger of more than one pre- revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post(s) for which that grade pay or pay scale is the normal replacement grade without any up gradation.
