Delhi, the 27th July, 2017 THE TELECOM REGULATORY AUTHORITY OF INDIA (OFFICERS AND STAFF APPOINTMENT) (TWELFTH AMENDMENT) REGULATION, 2017 (No. 3 of 2017) No. 5-1/2014–A&P.—In exercise of the powers conferred by section 36, read with sub-section (1) of section 10, of the Telecom Regulatory Authority of India Act, 1997 (24 of 1997), the Telecom Regulatory Authority of India hereby makes the following regulation further to amend the Telecom Regulatory Authority of India (Officers and Staff Appointment) Regulation, 2001 (2 of 2001), namely:— 1.(1) This regulation may be called the Telecom Regulatory Authority of India (Officers and Staff Appointment) (Twelfth Amendment) Regulation, 2017. (2) It shall come into force from the date of its publication in the Official Gazette. 2. In regulation 3 of the Telecom Regulatory Authority of India (Officers and Staff Appointment) Regulation, 2001 (hereinafter referred to as the principal regulation), in sub-regulation (iii), in the Table A. Officers’ Cadre, under column “Grade/post”, the entry “Technical Officer (Engineering)” shall be deleted. 3. In regulation 5 of the principal regulation, in sub-regulation (i), in the Table, under column “Name of the Post”, the entry “Technical Officer (Engineering)” shall be deleted and against the post “Technical Officer (Engineering)” so deleted,--- (a) under column “Mode of recruitment”, the entry “Deputation/Absorption/Direct Recruitment”; and (b) under column “Qualification/Experience”, the entry “As in Schedule I”--- shall be deleted; 4. In regulation 14 of the principal regulation, in sub-regulation (iii), in the Table B. Staff Cadre, under column “Grade/post”, the entry “Driver (Special Grade)” and the entry “Driver (Ordinary Grade)” shall be deleted. 5. In regulation 16 of the principal regulation, --- (a) in sub-regulation (i), in the Table, under column “Name of the Post”, the entry “Driver (Special Grade)” shall be deleted and against the post “Driver (Special Grade)” so deleted,--- (i) under column “Mode of recruitment”, the entry “Promotion”; and (ii) under column “Qualification/Experience”, the entry “As in Schedule II”--- shall be deleted;¹Hkkx IIIμ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 5 (b) against the post of Driver (Grade I), in the column “Mode of recruitment”, for the entry “Promotion”, the entry “Promotion/Deputation/Absorption/Direct Recruitment” shall be substituted (c) against the post of Driver (Grade II), in the column “Mode of recruitment”, for the entry “Promotion”, the entry “Promotion/Deputation/Absorption/Direct Recruitment” shall be substituted; (d) under column “Name of the Post”, the entry “Driver (Ordinary Grade)” shall be deleted and against the post “Driver (Ordinary Grade)” so deleted,--- (i) under column “Mode of recruitment”, the entry “Promotion/Deputation/Absorption/Direct Recruitment”; and (ii) under column “Qualification/Experience”, the entry “As in Schedule II”--- shall be deleted. 6. In Schedule I to the principal regulation,--- (a) against the post of Secretary, under the heading “Qualification and experience for deputation”, for the words “holding equivalent post on regular basis”, the words “(i) holding post in the HAG (pre-revised) on substantive basis or (ii) who have been granted HAG (pre-revised) in their cadre on non-functional upgradation (NFU) basis and having four years regular service in the SAG” shall be substituted; (b) under column “Name of Post”, the entry “Technical Officer (Engineering)” shall be deleted and against the post “Technical Officer (Engineering)” so deleted, --- (i) under column “Mode of recruitment”, the entry “Deputation/Absorption/Direct Recruitment”; (ii) under column “Qualification & experience for Direct Recruit”, the entry “Engineering degree in Electronics/ Telecommunication/ Information Technology/Computer Science from a recognized University/Institutions, with three years experience in the relevant field.”; (iii) under column “Length of service for promotion”, the entry “Not Applicable”; (iv) under column “Qualification and experience for deputation”, the entry “Officers of the Central Government, Public Sector Undertakings and Statutory and Autonomous Bodies with Engineering degree in Electronics/ Telecommunication/Information Technology/Computer Science from a recognized University/Institutions, (i) holding equivalent post or (ii) with three years of regular service in grade of Section Officer or equivalent. The officer must possess the working knowledge of computer.”; and (v) under column “Age for Direct Recruit”, the entry “Not exceeding thirty years”--- shall be deleted; 7. In Schedule II to the principal regulation,--- (a) under column “Name of Post”, the entry “Driver (Special Grade)” shall be deleted and against the post “Driver (Special Grade)” so deleted,--- (i) under column “Mode of recruitment”, the entry “Promotion”; (ii) under column “Qualification & experience for Direct Recruit”, the entry “Not Applicable”; (iii) under column “Length of service for promotion/experience”, the entry “Promotion from amongst the officials with three years of regular service in the Driver Grade II in pay band-I (Rs. 5200-20200) with Grade Pay of Rs. 2800.”; (iv) under column “Qualification & experience for transfer on deputation”, the entry “Not Applicable”; and (v) under column “Age for Direct Recruit”, the entry “Not Applicable”--- shall be deleted; (b) against the post of Driver (Grade I),--- (i) under column “Mode of Recruitment”, for the entry “Promotion/”, the entry “Promotion/Deputation/ Absorption/Direct Recruitment”; (ii) under column “Qualification & experience for Direct Recruit”, the entry “(i) 8th Pass, (ii) Possessing a valid driving licence for motor cars, (iii) Knowledge of motor mechanism (should be able to remove minor defects in vehicles), (iv) experience of driving of motor cars for twelve years.”; (iii) under column “Length of service for promotion/experience” the entry “Promotion from amongst the officials with nine years of regular service in the Driver Grade-II in the pay scale of Rs. 3,050-75-4,590.”; (iv) under column “Qualification and experience for deputation”, the entry “Officials of the Central Government,6 THE GAZETTE OF INDIA: EXTRAORDINARY [PART III—SEC. 4] Public Sector Undertakings and Statutory and Autonomous Bodies holding equivalent post or with nine years of regular service as Driver Grade-II who possess the following qualifications:- (i) Pass in 8th Standard (ii) possessing a valid driving licence for motor cars (iii) knowledge of motor mechanism (should be able to remove minor defects in vehicles)”; and (v) under column “Age for Direct Recruit”, the entry “Not exceeding 45 years”, shall be substituted; (c) against the post of Driver (Grade II),--- (i) under column “Mode of Recruitment”, for the entry “Promotion/”, the entry “Promotion/Deputation/ Absorption/Direct Recruitment”; (ii) under column “Qualification & experience for Direct Recruit”, the entry “(i) 8th Pass, (ii) Possessing a valid driving licence for motor cars, (iii) Knowledge of motor mechanism (should be able to remove minor defects in vehicles), (iv) experience of driving of motor cars for three years.”; (iii) under column “Length of service for promotion/experience” the entry “Attendant who possesses the following– (i) pass in 8th Standard, (ii) possessing a valid driving licence for motor cars, (iii) knowledge of motor mechanism (should be able to remove minor defects in vehicles) and (iv) experience of driving of motor cars for three years.”; (iv) under column “Qualification and experience for transfer on deputation”, the entry “Officials of the Central Government, Public Sector Undertakings and Statutory and Autonomous Bodies holding equivalent post or with 9 years of regular service as Driver Grade-II who possess the following qualifications:- (i) Pass in 8th Standard (ii) possessing a valid driving licence for motor cars (iii) knowledge of motor mechanism (should be able to remove minor defects in vehicles)”; and (v) under column “Age for Direct Recruit”, the entry “Not exceeding 40 years”, shall be substituted; (d) under column “Name of Post”, the entry “Driver (Ordinary Grade)” shall be deleted and against the post “Driver (Ordinary Grade)” so deleted,--- (i) under column “Mode of Recruitment”, the entry “Promotion/Deputation/Absorption/Direct Recruitment”; (ii) under column “Qualification & experience for Direct Recruit”, the entry “(i) 8th pass, (ii) possessing a valid driving licence for motor cars, (iii) knowledge of motor mechanism (should be able to remove minor defects in vehicles) and (iv) experience of driving of motor cars for three years”; (iii) under column “Length of service for promotion/experience”, the entry “Attendant who possesses the following– (i) pass in 8th Standard, (ii) possessing a valid driving licence for motor cars, (iii) knowledge of motor mechanism (should be able to remove minor defects in vehicles) and (iv) experience of driving of motor cars for three years”; (iv) under column “Qualification and experience for transfer on deputation”, the entry “Officials of the Central Government, Public Sector Undertakings and Statutory and Autonomous Bodies holding equivalent post or Attendant/ Group D employee who possesses the following– (i) pass in 8th Standard, (ii) possessing a valid driving licence for motor cars, (iii) knowledge of motor mechanism (should be able to remove minor defects in vehicles) and (iv) experience of driving of motor cars for three years.”; and (v) under column “Age for Direct Recruit”, the entry “Not exceeding forty years”, shall be deleted. (e) after the Note 4 occurring at the end, the following shall be inserted, namely:— “Note 5. – The present modification shall be without prejudice to the validity of anything previously done under the Regulation.” 8. In Schedule III to the principal regulation, under column “Name of the Post”,— (a) for the entry “Technical Officer & Technical Officer (Engineering)”, the entry “Technical Officer” shall be substituted; (b) the entry “Driver (Special Grade) and the entry “Driver (Ordinary Grade)” shall be deleted.
