(cid:23)(cid:24)य ेक पैकेज क(cid:18) िवषय व@त ु का कोइ लेखा उन पैकेज(cid:30) पर सुपाb Bप से िलखा होना चािहए और (cid:23)(cid:24) येक पैकेज "आयुध" या "गोला बाBद" या "भाग" और "संघटक" यथाि@थ ित शA द से िचि(cid:15) हत होगा ता(cid:4)क इसे आसानी से पहचाना जा सके । 3. व@त ुc को अनुJि0त म4 िविनdदQ+ ट से िभ(cid:15)न अ(cid:15) य (cid:4)कसी माग+ से (cid:23)वहण नहe (cid:4)कया जाएगा और व@ तुc के गंत‘ य के @ थान पर प!ंचने से पूव+ न तो (cid:23)पुंज को तोड़ा जाएगा और न ही रोका जाएगा । 4. व@त ुc को केवल (cid:4)कसी ऐसे ‘य ि(cid:28)त को (cid:23)दाय (cid:4)कया जाएगा जो उ(cid:15)ह 4 (cid:23)ा0 त करने का िविधपूव+क हकदार ह ै। 5. यह (cid:4)क िनयाि+तत मद का अंितम उपयो(cid:28)त ा (cid:23)माण प3 म4 घोिषत के अलावा (cid:23)योजन(cid:30) के िलए (cid:23)योग नहe (cid:4)कया जाना चािहए । 6. अनुJि0त अह@त ांतरणीय होगी और तीन मूल (cid:23)ितय(cid:30) म4 जारी होगी । 7. (क) िनया+त अनुJि0त क(cid:18) पहली (cid:23)ित को िनया+त क(cid:18) तारीख से दस (cid:4)दन के भीतर उसे जारी करने वाले अनुJापन (cid:23)ािधकारी को वापस (cid:4)कया जाएगा और उस तारीख को भारतीय सीमा शु(cid:6) क (cid:23)ािधका^रय(cid:30) (cid:22)ारा स(cid:11) यक् Bप से (cid:23)मािणत (cid:4)कया जाना चािहए । (ख) उसक(cid:18) दसू री (cid:23)ित को, िनयात+ अनुJि0त पर किथत िनया+त तारीख के पH चात् नA बे (cid:4)दन क(cid:18) अविध के भीतर उसे जारी करने वाले अनुJापन (cid:23)ािधकारी को वापस (cid:4)कया जाएगा, िजस पर अंत उपयो(cid:28) ता के ह@ ता/र, शासक(cid:18)य तारीख और नाम क(cid:18) मु(cid:16)ा होनी चािहए ता(cid:4)क उसे (cid:23)दाय स(cid:24)य ापन (cid:23)माण प3 के Bप म4 माना जाए : परंतु खंड (क) और खंड (ख) म4 िविनdदQ+ ट शतS के अनुपालन म4 असफलता के प^रणाम@ वBप िनया+तक के सभी लंिबत और भावी िनया+त सं‘य वहार(cid:30) को उस समय तक िनलंिबत कर (cid:4)दया जाएगा, जब तक (cid:4)क उ(cid:28) त शतS का स(cid:11) यक् Bप से अनुपालन न कर (cid:4)दया जाए । 8. िनया+त सं‘य वहार पूरा हो जाने पर, िनयात+ कता+ इस (cid:23)कार िनया+त (cid:4)कए जाने वाले अU न य् ायुध या गोला बाBद से संबंिधत िनया+त अनुJि0त , लदाई के बीजक या वायुयान के बीजक, पैiकंग सूिचय(cid:30) और िनया+त बीजक क(cid:18) मूल (cid:23)ितय(cid:30) को धारण करेगा और जब कभी जारी करने वाले अनुJापन (cid:23)ािधकारी (cid:22)ारा अपे/ा क(cid:18) जाए, उसे उ(cid:28) त द@ तावेज (cid:23)@ तुत करेगा । 9. यह (cid:4)क मूल िनया+तक सरकार क(cid:18) पूव+ (cid:23)ािधका^रता के िबना मद(cid:30) को त(cid:24) पH चात् अंत^रत (पुन:िनयाि+तत) नहe (cid:4)कया जाना चािहए । 10. यह (cid:4)क मद(cid:30) को अंत उपयो(cid:28)त ा (cid:23)माण प3 म4 यथा उपदjश+त के अलावा अपयोिजत, िवLय या (cid:4)कसी तीसरे प/ को चाह ेजो भी हो, अंत^रत नहe (cid:4)कया जाना चािहए । 11. य(cid:4)द अपेि/त हो तो स(cid:24)य ापन या (cid:23)माणन उपलA ध करवाना िजससे मद(cid:30) का धारण (cid:4)कया जाना घ^टत !आ ह ै। 12. मद(cid:30) को (cid:4)कसी (cid:23)योजन के िलए (cid:23)योग नहe (cid:4)कया जाना चािहए जो श@ 3(cid:30) के सामूिहक िवनाश के िवकास और उनक(cid:18) (cid:23)दाय (cid:23)णाली से संबंिधत ह k। 13. यह अनुJि0त भारत सरकार क(cid:18) समय-समय पर यथा संशोिधत आयात और िनया+त नीित के अनुपालन के और अधीन ह ै। 14. यह अनुJि0त अिधकतम दो वष+ या आदशे के पूण+ होने जो भी पहले हो तक िविधमा(cid:15) य है और अनुJि0 त क(cid:18) िविधमा(cid:15) यता, अपे/ाc और गुणागुण(cid:30) के आधार पर स/म (cid:23)ािधकारी (cid:22)ारा समय समय पर बढ़ायी जा सकेगी । 15. फम+ को िनदेिशत (cid:4)कया जाता है (cid:4)क (cid:23)(cid:24)य ेक परेषण के िनया+त के पH चात् संबंिधत सीमा शु(cid:6) क (cid:23)ािधकारी (cid:22)ारा स(cid:11) यक् Bप से पृQ ठां(cid:4)कत अनुJि0त क(cid:18) एक (cid:23)ित (िनया+ितत मद क(cid:18) मा3ा) (cid:23)@ तुत करे । 16. यह अनुJि0त आवेदन म4 सूिचत भरण प(cid:24)त न /लदाई प(cid:24) तन के िलए जारी क(cid:18) जा रही है । य(cid:4)द त(cid:24) पH चात् कोई प^रवत+न होता ह ै तो अनुJापन (cid:23)ािधकारी से पृQठ ांकन अपेि/त होगा । 17. िनया+त आदशे के िनQप ादन पर, िवदशे ी Lेता (अनुJि0 त म4 यथावjण+त) िनQ पादन के बारे म4 अधोह@ ता/री को और िवदशे के राजदतू ावास या िमशन को अवHय ही सूिचत करेगा । तारीख ..... माह.... 20..... Short title and commencement.–(1)These rules may be called the Arms (Third Amendment) Rules, 2018. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Arms rules, 2016- (i) in rule 90,- (a) for the word and letter “Form X”, occurring at both the places, the word and letter “Form X- A” shall be substituted; (b) in sub-rule (1), after the word “Indian Territory”, the following shall be inserted, namely:– “further the export licence shall also be governed by the extant standard operating procedure issued by Department of Defence Production in the Ministry of Defence, from time to time”; (ii) in rule 91, for the word and letter “Form X”, occurring at both the places, the word and letter “Form X- A” shall be substituted;8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (iii) in rule 92, in sub-rules (1) and (7), after the word and letter ‘Form X’, the words and letters ‘and Form X-A’ shall be inserted; (iv) in rule 99, in sub-rule (1), for the words and letter “or import and export licence in Form X”, the words and letter “or import licence in Form X or export licence in Form X-A” shall be substituted; (v) in Schedule II, in column number 8,– (a) against Item no. 9(b), for the entries, the following entries shall be substituted, namely:– “X- A”; (b) against Item no. 9(c), for the entries, the following entries shall be substituted, namely:– “X- A”; (vi) in Schedule III,- (a) in Part- I,- (i) in FORM VII, after the form but before the Conditions, the following explanation shall be inserted, namely:- “Explanation.- This Form shall apply to firearms and their following parts, namely:- (a) Barrel; (b) Cylinder; (c) Bolt; (d) Breech Block; (e) Slide; (f) Firing Pin; (g) Frame or Receiver; (h) Extractor; (i) Hammer/Striker."; (ii) in FORM X , for “ COMPOSITE IMPORT/EXPORT LICENCE FOR ARMS AND AMMUNITION Import Export Export for Re-Import In Transit ”, the following shall be substituted, namely:– “COMPOSITE IMPORT LICENCE FOR ARMS AND AMMUNITION Import In Transit Import for Re-Export Transport for Re-Export ”; (iii) after the FORM X, the following form shall be inserted, namely:- “ FORM X- A COMPOSITE EXPORT LICENCE FOR ARMS AND AMMUNITION Export Export for Re-Import Transport for Re-Export (1) (2) (3) 1. Name of End User Explanation.- This Form shall apply to firearms and their following parts, namely:- (j) Barrel; (k) Cylinder; (l) Bolt; (m) Breech Block; (n) Slide; (o) Firing Pin; (p) Frame or Receiver; (q) Extractor; (r) Hammer/Striker. CONDITIONS 1. The licence is granted as per the extant provisions under the Arms Act, 1959 and the Arms Rules, 2016 subject to provisions of the Foreign Trade (Development and Regulation) Act, 1992. 2. An Account of the contents of each package shall be legibly written thereon and each package shall be marked with the word “Arms” or “Ammunition” or “Parts and Components” as the case may be, so as to be readily recognisable. 3. The articles shall not be conveyed by any route other than that specified in the licence and bulk shall not be broken nor shall the consignment be stopped, before the articles reach the place of destination. 4. The articles shall be delivered only to a person lawfully entitled to receive them. 5. That the item(s) exported should not be used for purposes other than those declared in End User Certificate. 6. The licence shall be non-transferrable and issued in three original copies.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 7. (a) The first copy of the export licence shall be returned to the issuing licensing authority within ten days of the date of export and which date must be duly certified by the Indian customs authorities; (b) The second copy shall be returned to the issuing licensing authority within a period of ninety days after the export date stated on the export licence, which must bear the signature, an official date and name stamp of the end user, to serve as a delivery verification certificate: Provided that failure to comply with conditions specified in clause (a) and clause (b) shall result in suspension of all pending and future export transactions of the exporter till the time the said conditions are duly complied with. 8. On completion of the export transaction, the exporter shall retain one original copy of the export licence,bill of lading or airway bill, packing lists and export invoice pertaining to the firearms or ammunition so exported and shall produce the said documents whenever required to do so by the issuing licensing authority. 9. That the item(s) should not be subsequently transferred (re-exported) without the prior authorisation of the original exporting Government. 10. That the item(s) should not be diverted, sold or transferred to any third party whatsoever except as indicated in End User Certificate. 11. If required to provide verification or certification that possession of the item(s) has occurred. 12. The item (s) should not be used for any purpose that relates to development of weapons of mass destruction and their delivery systems. 13. This Licence is further subject to compliance of Export and Import Policy of the Government of India, as amended from time to time. 14. This Licence is valid for a maximum period of two years or completion of the order, whichever is earlier and the validity of Licence may be extended from time to time, based on requirements and merits, by the Competent Authority. 15. The Firm is directed to submit a copy of the Licence duly endorsed (quantity of item exported) by concerned customs authority after export of each consignment. 16. This Licence is being issued for port of loading/port of shipment indicated in the application. If there is any change subsequently, endorsement from the Licencing Authority shall be required. 17. Upon execution of the export order, foreign buyer (as mentioned in the licence) shall intimate to the undersigned and to the Embassy or Mission abroad about the execution, without fail.
