वगीकरण म ेंसंिोधन करने के संबंध में वी.ओ. जचदम्बरनार पत्तन न्यास से प्राप्त प्रस्ट्ताव से सबं ंजधत ह।ै
2. सार-स्ट्वरुप, इस प्राजधकरण न े वीओसीपीटी के एसओआर के सामान् य संिोधन के जलए उनसे प्रा् त प्रस्ट्त ाव म ें
संिोजधत एसओआर और जनष्प ादन मानकों का अनुमोदन करत े हुए आदेि संख् या टीएएमपी/12/2019-वीओसीपीटी
ददनांक 10 अिूबर 2019 पाररत दकया ह।ै इस प्राजधकरण द्वारा अनुमोददत संिोजधत एसओआर और जनष्प ादन मानक
रािपत्र संख्या 363 ददनांक 22 अक्त ूबर 2020 द्वारा अजधसजू चत दकए गए थे। तत्प श् चात, जवस्ट्तृत सकारण आदिे रािपत्र
संख्या 440 ददनांक 02 ददसम्बर 2019 द्वारा रािपत्र में अजधसूजचत दकया गया था।
3.1 तत्प श् चात, वीओसीपीटी न े आदेि ददनांक 10 अक् तूबर 2019 द्वारा अपन े पत्र ददनांक 07 अप्रैल 2020 द्वारा
अनुमोददत एसओआर म ें कुछ संिोधनों के जलए एक प्रस्ट्त ाव प्रस्ट्तुत दकया ह।ै वीओसीपीटी के उक्त प्रस्ट्त ाव के संबंध म ें
जहतधारकों के साथ परामि च की जनधाचररत प्रदिया का पालन करत े हुए और आयोजित संयुक् त सुनवाई के पश् चात,
वीओसीपीटी के जवद्यमान एसओआर म ें कुछ संिोधनों के जलए इसके प्रस्ट् ताव का जनपटान करत े हुए इस प्राजधकरण न े आदिे
संख् या टीएएमपी/19/2020-वीओसीपीटी ददनांक 28 अक् तूबर 2020 पाररत दकया ह।ै उक्त आदेि 16 ददसम् बर 2020 को
रािपत्र संख्या 220 द्वारा भारत के रािपत्र में सूजचत दकया गया ह।ै
3.2 इसके पश् चात, ददनांक 28 अक्त ूबर 2020 के आदेि द्वारा अनमु ोददत एसओआर में कायाचन् वयन की तारीख के जलए
कुछ संिोधन करन े के जलए वीओसीपीटी न े अपन े पत्र ददनाकं 23 नवम् बर 2020 द्वारा एक प्रस्ट्ताव प्रस्ट् तुत दकया ह।ै
वीओसीपीटी के जवद्यमान एसओआर के कायाचन् वयन की तारीख के संबंध म ें कुछ संिोधनों के जलए इसके प्रस्ट् ताव का
जनपटान करते हुए, इस प्राजधकरण ने आदेि संख् या टीएएमपी/19/2020-वीओसीपीटी ददनांक 28 ददसम् बर 2020 पाररत
दकया ह।ै उक्त आदेि 20 िनवरी 2021 को भारत के रािपत्र में रािपत्र संख् या 37 द्वारा अजधसूजचत दकया गया ह।ै
4.1 अब, वीओसीपीटी ने अपने ई-मेल ददनांक 28 िनवरी 2021 द्वारा जनम्न जलजखत मद्दु े प्रस्ट् ततु दकए ह ै-
(i) वीओसीपीटी ने ददनांक 07 अप्रलै 2020 का प्रस्ट्त ाव प्रस्ट्त ुत करते समय 27 फरवरी 2020 को आयोजित
बोडच की बैठक के बोडच संकल् प संख् या 110 की प्रजतजलजप सलं ग् न की थी, जिसमें कागो की श्रेणी को
जनम्नजलजखत 4 श्रेजणयों में वगीकृत करने के जलए पथृ क घाट प्रभार प्रिल्ु क का अनुमोदन करने के जलए
बोडच द्वारा संकल्प जलया गया ह ै-

(ii) तथाजप, वीओसीपीटी ने अपने पत्र ददनांक 07 अप्रलै 2020 के द्वारा टीएएमपी को प्रस्ट्ताव भिे ते समय,
उपयुचि कागो को त्रुरट से ड्राई बल्क कागों की श्रेणी के स्ट्थान पर ब्रेक बल्क कागो के अंतगचत वगीकृत
दकया ह।ै तद्नुसार, टीएएमपी ने भी आदिे ददनांक 28 अिूबर 2020 द्वारा ब्रेक बल्क श्रेणी के अंतगचत
इन चार प्रकार के कागो को वगीकृत करन े का अपना अनुमोदन संसूजचत दकया ह।ै
(iii) चूूँदक, उपयुचि िम सख्ं या 1, 2 और 4 के अतं गतच जवजनर्दष्टच कागो ड्राई बल्क के स्ट्वरुप के हैं, इसजलए, इन
कागो को ड्राई बल्क के अंतगचत वगीकृत दकए िाने की िरुरत ह ै और िम संख्या 3 को ड्राई बल्क/ब्रेक
बल्क दोनों के अतं गतच वगीकृत दकए िाने की आवश्यकता ह ै क्योंदक इनका अनुमोदन वीओसीपीटी के[भाग III—खण् ड 4] भारत का रािपत्र असाधारण 3
न्यासी मंडल द्वारा भी दकया गया ह ै तादक प्रदषू ण उपकर वसूल दकया िा सके। प्रदषू ण उपकर जवद्यमान
एसओआर के अनुसार सभी ड्राई बल्क कागों के जलए वसूल दकया िाना ह।ै
(iv) उपयुचि को देखत े हुए, कागो के स्ट्वरुप पर जवचार करत े हुए और वीओसीपीटी के बोडच के अनुमोदन के
अनुसार िैसादक मद संख्या (i) में उल्लेख ह,ै कागो के प्रकारों को वगीकृत करने के जलए इस प्राजधकरण के
अनुमोदन के जलए अनुरोध दकया गया ह।ै
4.2. ददनांक 28 िनवरी 2021 को उपयुचि प्रस्ट्ताव के जसलजसले में, वीओसीपीटी ने अपने पश्चातवती ई-मेल ददनांक 03
फरवरी 2021 के द्वारा जनम्नजलजखत अनरु ोध दकया ह ै
(i). पत्र ददनांक 28 िनवरी 2021 द्वारा पत्तन का प्रमुख अनरु ोध प्रहस्ट्तन के स्ट्वरुप के अनुसार कागो के
वगीकरण अथाचत ड्राई बल्क/ब्रके बल्क के संबंध में ह।ै तथाजप, तुरन्त संदभच के प्रयोिन से वीओसीपीटी के
बोडच के न्याजसयों द्वारा अनुमोददत संकल्प के अनुसार दरों को सजम्मजलत दकया गया ह।ै तथाजप, आदेि
ददनांक 28 अिूबर 2020 द्वारा लेबर लेवी घटक के जवलय के साथ इस प्राजधकरण के अनुमोदन के
पररणामस्ट्वरुप, अब कागो के वगीकरण के साथ जनम्नानुसार, यह प्रस्ट्ताव दकया गया ह ै

ह।ै लेदकन वास्ट्तव म,ें िम संख्या 3 द्वारा जवजनर्दष्टच कागो की भांजत उि कागो का प्रहस्ट्तन ड्राई बल्क के
साथ-साथ ब्रेक बल्क के रुप म ेंदकया िा रहा ह।ै
(iii) उपयुचि को देखते हुए, िैसादक ऊपर उल्लेख दकया गया ह,ै कागो प्रहस्ट्तन के स्ट्वरुप पर जवचार करते हुए
कागो के प्रकारों के वगीकरण करने के जलए इस प्राजधकरण के अनुमोदन का अनरु ोध दकया गया ह।ै
5. वतचमान प्रस्ट्ताव म,ें वीओसीपीटी द्वारा प्रस्ट्ताजवत संिोधनों/पररवतचनों के सारांि की तलु नात्मक जस्ट्थजत और प्रिल्ु क
आदेि संख्या टीएमपी/19/2020-वीओसीपीटी ददनांक 28 अिूबर 2020 से जलए गए सगं त उद्धरण नीचे ददया गया ह ै
पत्तन द्वारा प्रस्ट्ताजवत और अनबु धं -II के अधीन आदेि सख्ं या वीओसीपीटी द्वारा अपन े प्रस्ट्ताव ददनाकं 28 िनवरी 2021 और
टीएएमपी/19/2020-वीओसीपीटी ददनाकं 28 अिूबर 2020 द्वारा इस तत्पश्चात ई-मेल ददनाकं 03 फरवरी, 2021 द्वारा अब प्रस्ट्ताजवत सिं ोधन

6.1. संक्षेप म,ें वीओसीपीटी के न्यासी मंडल के संकल्प संख्या 110 के अनुसार वीओसीपीटी का प्रस्ट्ताव चार कागो अथाचत
खली/कोपरा, पिु चारा, मक्का और उड़न राख के वगीकरण म ें संिोधन करने तक सीजमत ह ै जिन्ह ें ददनांक 07 अप्रैल 2020
की ई-मेल द्वारा प्रस्ट्तुत अपने प्रस्ट्ताव में संिोधन का अनुमोदन करन े का अनुरोध करते समय त्रुरट से पत्तन द्वारा ब्रेक बल्क
के अंतगचत वगीकृत दकया गया था।
6.2. वीओसीपीटी ने वतचमान प्रस्ट्ताव ददनांक 28 िनवरी 2021 और ई-मेल ददनांक 03 फरवरी 2021 के द्वारा इन चार
कागो अथाचत खली/कोपरा, पिु चारा, मक्का और उड़न राख के वगीकरण के जलए संिोधन के जलए अनुमोदन प्रदान करन े
का अनरु ोध दकया ह।ै पत्तन न े घाट प्रभार अनुसूची म ें ब्रेक बल्क के अंतगचत इन चारों कागो के जवद्यमान वगीकरण के स्ट्थान
पर घाट िुल्क अनुसूची में ड्राई बल्क िीषचक के अतं गतच दो कागो अथाचत खली/कोपरा और पिु चारा को एवं मक्का तथा उड़न
राख को ड्राई बल्क और ब्रेक बल्क दोनों के कागो के अंतगचत वगीकृत करन े का अनुरोध दकया ह।ै
6.3. िहां तक खली/कोपरा, पिु चारा और मक्का का संबंध है, कागो के वगीकरण में संिोधन के संबंध में पत्तन द्वारा दकया
गया अनरु ोध बोड च के न्यासी-मण्डल के ददनांक 28 फरवरी 2020 के अनुमोदन के अनुसार ह।ै िहां तक उड़न राख का संबंध
ह,ै यह देखा गया ह ै दक वीओसीपीटी के न्यासी मंडल के अनुमोदन के अनुसार इस कागो को ड्राई बल्क के अतं गतच वगीकृत
दकया गया ह।ै तथाजप, वीओसीपीटी ने उद्धरण देत े हुए कहा ह ै उड़न राख का प्रहस्ट्तन ड्राई बल्क के साथ-साथ ब्रेक बल्क के
रुप म ें दकया िा रहा ह,ै अत ड्राई बल्क और ब्रेक बल्क के अतं गचत इस कागो को वगीकृत करन े का अनरु ोध दकया ह।ै यह
जस्ट्थजत जवश्वसनीय ह।ै कागो की इन मदों के संबंध में वीओसीपीटी द्वारा आदेि संख्या टीएएमपी/19/2020-वीओसीपीटी
ददनांक 28 अिूबर 2020 म ें ददए गए घाट प्रिल्ु क के साथ लेबर लेवी का जवलय करने के पश्चात पत्तन द्वारा यथा
प्रस्ट्ताजवत जनधाचररत घाट प्रभार की संिोजधत दरो का जिस रुप में प्रस्ट्ताव दकया गया ह,ै उसमें कोई पररवतचन नहीं दकया
गया ह।ै
इस जस्ट्थजत के होते हुए, इस प्राजधकरण द्वारा पत्तन द्वारा यथा प्रस्ट्ताजवत इन चारों कागो के प्रस्ट्ताजवत वगीकरण
का अनुमोदन दकया िाता ह।ै इसके अजतररि, िहां तक न्यासी मडं ल द्वारा अनुमोददत ड्राई बल्क के रुप म ें इसके वगीकरण
के अलावा, ब्रेक बल्क कागो के अंतगतच उड़न राख के श्रणे ीकरण का संबंध है, पत्तन द्वारा उपयुचि दिाचए गए कारणों स े इस
प्राजधकरण द्वारा भी अनुमोदन दकया िाता ह,ै बिते ड्राई बल्क/ब्रेक बल्क कागो के रुप म ें इसके श्रणे ीकरण के जलए

6.4. वीओसीपीटी के बोडच के न्यासी मंडल न े अपन े बोड च के संकल्प ददनांक 27 फरवरी 2020 म ें यह संकल्प दकया ह ैदक
इस प्राजधकरण के अनुमोदन के पश्चात ही कागो के श्रेणीकरण का कायाचन्वयन दकया िाएगा। अत कागो के श्रेणीकरण के
जलए संिोधन आदेि भावी प्रभाव से लागू होगा। सामान्य दजृ ष्टकोण का अनुपालन करते हुए, इस प्राजधकरण द्वारा
अनुमोददत संिोधन इस आदिे की अजधसूचना भारत के रािपत्र में प्रकािन की तारीख स े 30 ददन की अवजध समाप्त होन े
के पश्चात लाग ू होंगे। चूूँदक, अनमु ोददत संिोधन वीओसीपीटी के जवद्यमान एसओआर का भाग होंगे, इसजलए, इन संिोधनों
की वैधता वीओसीपीटी के जवद्यमान सामान्य एसओआर की वैधता की अवजध समाप्त होने के साथ समाप्त हो िाएगी।

Trusts Act, 1963 (38 of 1963), the Tariff Authority for Major Ports hereby disposes of the proposal received
from V.O. Chidambaranar Port Trust seeking amendment in classification of cargo category approved by
this Authority vide Order No.TAMP/19/2020-VOCPT dated 28 October 2020 as in the Order appended
hereto.

This case relates to a letter received from the V.O. Chidambaranar Port Trust (VOCPT) dated 28
January 2021 as regards the amendment in the classification of category of cargo approved by this
Authority vide Order No.TAMP/19/2020-VOCPT dated 28 October 2020 with reference to its earlier
proposal by email dated 07 April 2020 regarding a few amendments in its existing Scale of Rates (SOR).
2. To recapitulate, this Authority has passed an Order No.TAMP/15/2019-VOCPT dated 10 October
2019, approving the revised SOR and Performance Standards on the proposal received from the VOCPT
for general revision of its SOR. The revised SOR and Performance Standards approved by this Authority
was notified vide Gazette No.363 dated 22 October 2019. Subsequently, the detailed Speaking Order was
notified in the Gazette vide No.440 dated 02 December 2019.
3.1. Subsequently, the VOCPT vide its letter dated 07 April 2020 filed a proposal for a few amendments
in the SOR approved vide Order dated 10 October 2019. Following the prescribed consultation process
with the stakeholders and after holding a joint hearing held on the said proposal of VOCPT, this Authority
passed an Order No.TAMP/19/2020-VOCPT dated 28 October 2020 disposing of the proposal of VOCPT
for a few amendments to its existing SOR. The said Order has been notified in the Gazette of India on 16
December 2020 vide Gazette No.550.
3.2. Subsequent to that, the VOCPT vide its letter dated 23 November 2020 again filed a proposal for a
few amendments for the date of implementation in the SOR approved vide Order dated 28 October 2020.
With constraint, this Authority passed an Order No.TAMP/19/2020-VOCPT dated 28 December 2020
disposing of the proposal of VOCPT for a few amendments with regard to date of implementation to its
existing SOR. The said Order has been notified in the Gazette of India on 20 January 2021 vide Gazette
No.37.
4.1. Now, VOCPT vide its email dated 28 January 2021 has submitted the following points:
(i) VOCPT, while submitting the proposal dated 07 April 2020, had furnished a copy of the
Board Resolution No.110 of the Board Meeting held on 27 February 2020 wherein Board
has resolved to approve separate wharfage tariff for the following 4 categories of cargo
classifying the category of cargo as below:

(ii) However, the VOCPT while sending the proposal vide its letter dated 07 April 2020 to
TAMP, classified the above cargoes inadvertently under Break Bulk Cargo instead of Dry
Bulk cargo category. Accordingly, TAMP has also communicated its approval classifying
these four cargoes under Break Bulk category vide Order dated 28 October 2020.
(iii) As the cargoes stated above under Sl. No.1, 2 & 4 are in the nature of Dry Bulk, the cargo
need to be classified under Dry Bulk and Sl. No.3 needs to be classified under both Dry
Bulk / Break Bulk as also approved by the Board of Trustees of VOCPT so that pollution
cess can be collected. Pollution cess to be collected for all dry bulk cargoes as per
prevailing SOR.
(iv) In view of the above, the approval of this Authority is requested to classify the cargoes as
stated in point no.(i) above considering the nature of cargo and as per VOCPT’s Board
approval.
4.2. In continuation to above proposal dated 28 January 2021, the VOCPT vide its subsequent email
dated 03 February 2021 has made following further submissions:
(i) The primary request of the Port vide letter dated 28 January 2021 is with regard to
classification of cargo according to nature of handling i.e. Dry Bulk/ Break Bulk. However,
for the ready reference purpose, the rates have been included as per the resolution
approved by the Board of Trustees of VOCPT. However, consequent on approval by this
Authority with merging Labour levy component vide Order dated 28 October 2020, now it is
proposed as below along with the classification of cargo:

(ii) It is further to submit that while sending the above proposal vide letter dated 28 January
2021, the cargo mentioned vide Sl. No.4 viz., Fly Ash has been mentioned inadvertently
under one category i.e., Dry Bulk. But, actually the said cargo is being handled as Dry Bulk
as well as Break Bulk similar to cargo mentioned vide Sl. No.3.
(iii) In view of the above, the approval of this Authority is requested to classify the cargoes as
stated above, considering the nature of cargo handling.
5. A comparative position of the summary of modifications/ amendments proposed by the VOCPT in
current proposal and the relevant extract from the tariff Order No.TAMP/19/2020-VOCPT dated 28 October
2020 is given below:

6.1. In short, the proposal of VOCPT is limited to amend the classification of four cargoes viz., Oil Cake/
Copra, Cattle Feed, Maize and Fly Ash as per the Board of Trustees of VOCPT vide Resolution No.110
which was inadvertently classified under Break Bulk by the port while seeking approval for the amendment
in its proposal vide email dated 07 April 2020.8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
6.2. The VOCPT in the current proposal dated 28 January 2021 and subsequent email dated 03
February 2021 has sought approval for the amendment for classification of these four cargoes viz., Oil
Cake/ Copra, Cattle Feed, Maize and Fly Ash. The port seeks classification of two cargoes viz., Oil Cake/
Copra and Cattle Feed under the heading dry bulk in wharfage schedule and Maize and Fly ash to be
classified under both dry bulk and break bulk instead of existing classification of these four cargoes under
break bulk in the wharfage schedule.
6.3. The amendment in the classification of cargo sought by the port as regards Oil Cake/ Copra, Cattle
Feed and Maize is in line with the approval of the Board of Trustees dated 28 February 2020. As regards
Fly Ash cargo, it is seen that as per the approval of the Board of Trustees of the VOCPT, this cargo is
categorised under Dry Bulk. However, the VOCPT citing that Fly ash is handled both as Dry Bulk as well
as Break Bulk, sought to classify this cargo under both dry bulk and break bulk. This position is relied
upon. There is no change proposed by the VOCPT as such in the amended wharfage rates prescribed as
proposed by the port after merger of labour levy with the wharfage in the Order No.TAMP/19/2020-VOCPT
dated 28 October 2020 in respect of these cargo items.
That being so, the proposed classification of these four cargoes is approved by this Authority as
proposed by the Port. Further, as regards the categorization of Fly ash under Break Bulk cargo, apart from
its classification as Dry Bulk approved by the Board of Trustees, is also approved by this Authority for the
reason cited by the port, subject to the VOCPT seeking approval of the Board of Trustees of the VOCPT for
categorizing it as Dry bulk/ Break bulk cargo. The VOCPT is advised to forward a copy of the approval of its
Board of Trustees in this regard for our records.
6.4. The Board of Trustees of the VOCPT has resolved in its Board Resolution dated 27 February 2020
that categorization of cargo will be implemented after approval of this Authority. Hence, amendment Order
for categorization of cargo will come into effect prospectively. Following the general approach, the
amendments approved by this Authority will come into force after expiry of 30 days from the date of
notification of the Order in the Gazette of India. Since the amendments approved will form part of the
existing SOR of VOCPT, the validity of the amendments is coterminous with the validity of the existing
General SOR of VOCPT.
7.1. In the result, and for the reasons given above and based on collective application of mind, this
Authority approves the amendments proposed by the VOCPT with the following modification in the
schedule 3.1.1 of the wharfage schedule prescribed in Annex-II attached to amendment Order
No.TAMP/19/2020-VOCPT dated 28 October 2020:
(i) The existing items under Sl. Nos.5 (ix) and (x) under the heading “Break Bulk” cargo
relating to Oil cake/ cobra and Cattle feed under schedule 3.1.1 – Wharfage is shifted
therefrom and inserted under “Dry Bulk – Other” at Sl. Nos.4 (xvii) and (xviii) respectively
and the existing items at Sl. Nos.5 (xi) and (xii) relating to Maize and Fly Ash are also
prescribed under Sr. No.4 as Sr. Nos.4 (xix) and (xx) respectively under Dry Bulk cargo
whilst retaining them under the break bulk cargo as well under Sl. No.5 with renumbering
as Sr. Nos.5 (ix) & (x) respectively. The existing prescription is replaced with the amended
prescription as tabulated below:

7.2. This Order approved may be read with the amendments to the existing SOR approved by this
Authority vide Order No.TAMP/19/2020-VOCPT dated 28 October 2020.
7.3. The amendments approved by this Authority will come into effect after expiry of 30 days from the
date of notification of the Order in the Gazette of India. The amendments approved will remain valid till the
validity of the existing General SOR of the VOCPT.
