L.-33004/99 सी.जी.-एम.एxचxx.G-अID.-H2x6x1x 12020-223314 CG-MHxx-xEG-I2D6E1x1x2x 020-223314 असाधारण EXTRAORDINARY भाग III—खण्ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 526] नई ददल्ली, बधु वार, नवम्ब र 25, 2020/ अग्रहायण 4, 1942 No. 526] NEW DELHI, WEDNESDAY, NOVEMBER 25, 2020/AGRAHAYANA 4, 1942 महापत्तन प्रिल्ु क प्राजधकरण अजधसचू ना मुंबई, 4 नवम् बर, 2020 स.ं टीएएमपी/06/2020-सीडब्‍ल् य सू ी.—महापत्तन न्यास अजधजनयम, 1963 (1963 का 38) की धारा 48 द्वारा प्रदत्त िजियों का प्रयगग करते ुए, महापत्तन प्रिुल्क प्राजधकरण, दीनदयाल पत्तन न्यास(डीपीटी) में कंटेनर फ्रेट स्ट्टेिन (सीएफएस) पर प्रदान की गई सेवाओं से संबद्ध दरमानों में प्रिुल्क ददिाजनदेि, 2019 के तहत सामान्य संिगधन के जलए केंद्रीय भंडारागार जनगम (सीडब्‍ल्यूसी) से प्राप्त प्रस्ट्ताव का जनपटान करत े ुए, इसके साथ संलग्न आदेिानुसार संिगजधत दरमान अजधसूजचत करता ह।ै महापत्त न प्रिल्ु क प्राजधकरण मामला स.ं टीएएमपी/06/2020-सीडब्‍ल् य सू ी केन्द्र ीय भडं ारागार जनगम ----- आवदे क कगरम (i). श्री टी.एस. बालसुब्रमजनयन, सदस्ट् य(जवत् त) (ii). श्री रित सच् चर,सदस्ट् य (आ्थकक) आदिे (अक्त बू र 2020 के 28व ेंददन पाररत) यह मामला प्रिुल् क ददिाजनदिे , 2019 के तहत दीनदयाल पत् तन न् यास (डीपीटी) के कंटेनर फ्रेट स्ट्टेिन (सीएफएस) में इसके द्वारा प्रदान की गई सेवाओं के जलए दरों के सामान्य संिगधन के जलए केंद्रीय भंडारण जनगम (सीडब्‍ ल् यूसी) से प्राप्त प्रस्ट्ताव से संबंजधत ह।ै 5747 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 2.1. सीडब्‍ल्यूसी ने प्रिुल् क नीजत, 2019 का अनुपालन ददनांक 02 िनवरी 2020 और 29 फरवरी 2020 के अपने पत्र में सीडब्‍ ल् यूसी के एसओआर में सामान्य संिगधन का प्रस्ट्ताव दायर दकया ह।ै 2.2. जनधाकररत परामिक प्रदिया के अनुसार, सीडब्‍ल्यूसी के ददनांक 29 फरवरी 2020 के ई-मेल जसहत ददनांक 02 िनवरी 2020 के प्रस्ट्ताव की एक प्रजत उपयगगकताकओं/उपयगगकताक संगठनों कग उनकी रटप्पणी के जलए पररचाजलत कर दी गई थी। 2.3. इस मामले में 26 िून 2020 कग वीजडयग कॉन्फ्रेंससंग के माध्यम से एक संयुि सुनवाई आयगजित की गई थी। प्रस्ट्ताव की िांच करने पर, सीडब्‍ल्यूसी से हमारे ददनांक 01 िुलाई 2020 के ईमेल और बाद में ददनांक 28 िुलाई 2020 के पत्र और 14 अगस्ट्त 2020 के स्ट् मरण-पत्र में कुछ सबदं ओंु पर िानकारी / स्ट्पष्टीकरण प्रस्ट्तुत करने के जलए अनुरगध दकया गया था । 2.4. इसके िवाब में, सीडब्‍ल्यूसी ने अजतररि सूचना / स्ट्पष्टीकरण पर अपना उत् तर द े ददया ह,ै जिसमें उनके 18 अगस्ट्त 2020 के पत्र के तहत सीए द्वारा प्रमाजणत अद्यतन सूचना भी िाजमल ह।ैं 2.5. सीडब्‍ल्यूसी न,े सूचना/स्ट्पष्टीकरण प्रस्ट्तुत करते ुए मूल प्रस्ट्ताव में 2015-16, 2016-17 और 2017-18 के जलए जवचाररत लागत जववरण के स्ट्थ ान पर, वर्क 2016-17, 2017-18 और 2018-19 के जलए वास्ट् तजवक अद्यजतत लागत जववरण प्रस्ट् तुत दकये ह।ैं 3. इसके अलावा, हमारे ददनांक 01 िुलाई 2020 के पत्र के द्वारा डीपीटी से यह भी अनुरगध दकया गया था दक व े सीडब्‍ल्यूसी द्वारा प्रस्ट्तुत अद्यजतत लागत जववरण के संदभक में रटप्पणी/सूचना प्रस्ट्तुत करें। सीडब्‍ल्यूसी द्वारा अपने 18 अगस्ट्त 2020 के पत्र के तहत भेिी गई अद्यतन जववरणी के िवाब में, डीपीटी ने अपने ईमेल ददनांक 11 जसतंबर 2020 कग हमारे द्वारा मांगी गई िानकारी/रटप्पजणयों कग प्रस्ट्तुत दकया ह।ै 4. मामले के प्रसंस्ट्करण के दौरान एकत्र की गई िानकारी की समग्रता के संदभ कमें, इस प्राजधकरण ने प्रिुल् क ददिाजनदिे , 2019 के तहत अपने एसओआर के सामान्य संिगधन के जलए सीडब्‍ल्यूसी द्वारा दायर प्रस्ट्ताव संबंधी एक 'स्ट्पीककंग ऑडकर' पाररत दकया ह।ै 5.1. इस प्राजधकरण द्वारा पाररत 'स्ट्पीककंग ऑडकर' भारत के रािपत्र में अजधसूजचत दकए िाने की प्रदिया में है और अजधसूचना िारी हगने में कुछ और समय लगने की संभावना है। चूंदक जवस्ट्तृत 'स्ट्पीककंग ऑडकर' की अजधसूचना में कुछ समय लगेगा, यह प्राजधकरण सीडब्‍ ल् यूसी के संिगजधत दरमानों(एसओआर) कग अजधसूजचत करता ह ैिग अनुलग्नक के रूप में संलग्न है। 5.2. इस प्राजधकरण द्वारा पाररत 'स्ट्पीककंग ऑडकर' कग अलग से अजधसूजचत दकया िाएगा और सीडब्‍ल्यूसी, डीपीटी और संबंजधत उपयगगकताकओं/उपयगगकताक संगठनों कग उजचत समय पर सूजचत दकया िाएगा। 5.3. भारत के रािपत्र में एसओआर कग अजधसूजचत करने वाले इस आदेि की अजधसूचना की तारीख से 30 ददनों की समाजप्त के बाद, संिगजधत एसओआर लाग ूहग िाएंगे और संिगजधत एसओआर लागू हगने की तारीख से 3 साल की अवजध तक के जलए वैध रहगें े। टी.एस. बालसुब्रमजनयन, सदस्ट् य (जवत्त) [जवज्ञापन-III/4/असा./ 386 /2020-21] अनलु ग्न क केंद्रीय भडं ारागार जनगम (सरें ल वये रहाउससगं कॉपोरेिन) दरमान इन दरमानों में दीनदयाल पत् तन न्य ास में कंटेनर फ्रेट स्ट्टेिन पर प्रदान की िाने वाली सेवाओं और सुजवधाओं के जलए केंद्रीय भंडारागार जनगम कग देय िुल्क जनधाकररत दकए गए ह।ैं सामान्य जनयम और ित।ें (1). (i). इन दरमानों के तहत दकसी भी िुल्क के जवलंजबत भुगतान पर उपयगगकताक कग 15% की दर से दंडात् मक ब्‍ याि (िुमाकना)का भुगतान करना हगगा। इसी तरह, सीडब्‍ल्यूसी जवलंजबत वापसी(ररफंड) पर दंडात्मक ब्‍याि का भुगतान करेगा। (ii). वापसी(ररफंड) में देरी कग, सेवाओं के पूरा हगने की तारीख से 20 ददन के बाद से या उपयगगकताकओं से अपेजित सभी दस्ट्तावेिों के प्रस्ट् तुत करने पर, िग भी बाद वाली जतजथ हग, से जगना िाएगा।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 (iii). सीडब्‍ल्यूसी द्वारा जबलों के िारी हगने की तारीख के 10 ददन बाद वाली जतजथ से ही उपयगगकताकओं द्वारा भुगतान में देरी कग जगना िाएगा। हालांदक, यह प्रावधान उन मामलों में, जिनम,ें महापत् तन न्य ास अजधजनयम और / या इन दरमानों के अनुसार, िहां िुल्क का भुगतान सेवाओं का लाभ उठाने से पहले अजग्रम रुप से दकया िाना जनधाकररत ह ैलागू नहीं हगता ह।ै (2). पररत् यक् त एफसीएल कंटेनरों / पगत के स्ट्वाजमत्व वाले कंटेनरों पर संग्रहण/भंडारण िुल्क पररत्याग की जलजखत में प्राजप्त की तारीख तक या कंटेनर की लैंसडंग की तारीख से 75 ददनों तक, िग भी पहले हग, जनम्नजलजखत ितों के अध् याधीन लगाया िाएगा: (i). परेजर्ती दकसी भी समय पररत्याग(कंटेनर के) का पत्र िारी कर सकता ह।ै (ii). यदद परेजर्ती पररत्याग के ऐसे पत्र कग िारी नहीं करने का जवकल्प चुनता ह,ै तग कंटेनर एिेंट / एमएलओ पररत्याग पत्र कग इस ितक के अधीन िारी कर सकता ह ैदक, (क). लाइन कागो सजहत कंटेनर का कब्‍ िा ले लेगी और या तग इसे वापस ले िाएगी या पत् तन पररसर से हटा देगी; तथा (ख). लाइन कंटेनर कग अपने कब्‍ िे में लेने से पूवक कागो और कंटेनर पर लगने वाले सभी पत् तन िुल्कों का भुगतान करेगी। (iii). कंटेनर एिेंट / एमएलओ आवश्यक औपचाररकताओं का पालन करेगा और पररवहन और उसे खाली करने/हटाने की लागत वहन करेगा। जनधाकररत अवजध के भीतर ऐसी कारकवाई करने में उनकी जवफलता की जस्ट् थजत में, िब तक कागो कग खाली करने/हटाने के जलए जिसपंग लाइनों द्वारा सभी आवश्यक कारकवाई नहीं की िाती ह,ै तब तक कंटेनर पर संग्रहण/भंडारण िुल्क लगाया िाना िारी रहगे ा। (iv). िहां कंटेनर कग सीमा-िुल् क अजधकाररयों द्वारा अपने कब्‍ िे में / िब्‍त कर जलया गया ह ैऔर उस े75 ददनों की जनधाकररत समय सीमा के भीतर नष्ट नहीं दकया िा सकता ह,ै आवश्यक औपचाररकताओं कग देखने वाली लाइनों के जलए संग्रहण/भंडारण िुल्क कागो जवर्य के सीमा िुल्क आदेि िारी करने की तारीख से लाग ूनहीं हगगा बिते पररवहन और हटाने की लागत वहन दकए िाएंगे अन्यथा, लाइन्स / कनसाइनी द्वारा कब्‍ िाए / िब्‍त दकए गए कंटेनरों कग पत् तन पररसर से सीमा िुल्क/प्रजतबंजधत ित्रे म ें हटा ददया िाना चाजहए और उस मामले में संग्रहण/भंडारण िुल्क ऐसे जनष्कासन की तारीख से लाग ूनहीं हगगा। (3). उपयगगकताकओं कग सीडब्‍ल्यूसी के कारण उजचत स्ट्तर से अजधक देरी के जलए िुल्क का भुगतान करने की आवश्यकता नहीं हगगी। (4). य ेदरमान(एसओआर) संबंजधत वर्क की पहली िनवरी से 31 ददसंबर के बीच प्राजधकरण द्वारा घगजर्त थगक मूल्य सूचकांक (डब्‍ ल् यूपीआई ) म ेंजभन्नता के 60% की सीमा तक मुद्रास्ट्फीजत के जलए स्ट्वचाजलत वा्र्कक सूचकांकन के अध् याधीन ह।ै इस तरह के समायगजित एसओआर प्रासंजगक वर्क के 1 मई से अगले वर्क के 30 अप्रैल तक लाग ू होंगे। प्रथम वा्र्कक सूचकांक 1 मई, 2021 से हगगा। सूचकांदकत दरमान, सीडब्‍ल्यूसी द्वारा डीपीटी, संबंजधत उपयगगकताकओं और प्राजधकरण कग सूजचत दकये िाएंगे। अध्याय 1 भ-ूदकराया जहतों सजहत सभी संभाजवत िगजखमों के जलए उपयगगकताक द्वारा पयाकप्त रूप से बीमा दकया गया ह।ै इस प्रकार, दकसी भी जस्ट्थजत म,ें सीडब्‍ल्यूसी पररणामी नुकसान सजहत दकसी भी बीमा यगग्य दावे / िगजखम के जलए जिम्मेदार नहीं हगगा। जनयाकत माल गगदामों के जलए भी वही धारणा लाग ूहगगी। हालांदक, अगर आग, बाढ़, चिवात, चगरी, आदद के िगजखम के जलए दकसी भी पि द्वारा बीमा लाभ की मांग हगती ह,ै तग सीडब्‍ल्यूसी, सीएफएस, कांडला द्वारा जलजखत अनरु गध पर इसकी व्यवस्ट्था की िाएगी, जिसके जलए स्ट्ट ॉक के प्रजत 1000/- रूपये मूल्य के जलए 12.50 पैस ेप्रजत सप्ताह या उसके भाग की दर पर एडवेलगरम िुल् क प्रभाररत हगगा । (3) उपयगगकताकओं के अनुरगध पर खुले ित्रे में संग्रहीत कागो के जलए, संग्रहण/भंडारण िुल्क आच् छाददत ित्रे के जलए जनधाकररत दर स े25% कम हगगा। (4) खतरनाक माल के जलए 25% अजतररि िुल्क लगाया िाएगा। (6). सीडब्‍ल्यूसी िब उपयगगकताक द्वारा आवश्यक हगने पर आयात/जनयाकत कागो कग जवतररत/ स्ट्थानांतररत करने की जस्ट्थजत में नहीं हगगा तग कागो पर संग्रहण/भंडारण िुल्क उस अवजध के जलए प्रभाररत नहीं हगगा। (7). संग्रहण/भंडारण कारकवाई के संबंध में कागो और अन्य संबद्ध कारकों की प्रकृजत कग ध्यान में रखते ुए, धातु स्ट्िैप के जलए संग्रहण/भंडारण िुल्क, िेत्रीय आधार पर और पत्थर आदद के जलए पीएमटी आधार पर प्रभायक जनिुल्क दकया िा सकेगा । 2) कंटेनर की भराई और / या सील करने के बाद जनयाकत कंटेनरों पर तीन ददनों की जनिुल्क अवजध की अनुमजत ह।ै 3) सीएफएस में डीपीटी से लाए गए आयात कंटेनरों के जलए कंटेनर के आगमन की तारीख सजहत पांच ददनों की जनिुल्क अवजध की अनुमजत दी िाएगी। 4) जनिुल्क ददनों की जगनती करते ुए, सीमा िुल्क अजधसूजचत अवकाि और सीएफएस के गैर-पररचालन ददनों की, जनरंतर बीच में या पीछे आ िाने पर उनकी जनिुल्क अवजध में गणना नहीं की िाएगी। 5) भू-दकराए के अजतररि रीफर प्लसगंग सुजवधा िुल्क रू.275/ -प्रजत टीईय ू और रूपये 400 प्रजत एफईयू प्रजत 4 घंटे या उसके दकसी भाग की दर से प्रभाररत हगगा । 6) यह माना िाएगा दक सीएफएस, दीनदयाल पत् तन' पर प्राप्त स्ट्टॉक कग सीमा िुल्क के जहतों सजहत संग्रहण/भंडारण के दौरान सभी संभाजवत िगजखमों के जलए, उपयगगकताक द्वारा पयाकप्त रूप से बीमा दकया गया ह।ै इस प्रकार, दकसी भी जस्ट्थजत म,ें पररणामी नुकसान सजहत दकसी भी बीमा यगग्य दावे / िगजखम के जलए सीडब्‍ल्यूसी जिम्मेदार नहीं हगगा। जनयाकत माल गगदामों के जलए भी यही एक अवधारणा लागू हगगी। हालााँदक, अगर आग, बाढ़, चिवात, चगरी आदद के के जलए प्रभाररत नहीं हगगा िब सीडब्‍ ल् यूसी सीडब्‍ल्यूसी के जलए जिम्मेदार कारणों के जलए आयात / जनयाकत कंटेनरों कग जवतररत / स्ट् थानांतररत करने की जस्ट्थजत में नहीं हगगा।6 THE GAZETTE OF INDIA : औपचाररकताए ंपरू ी हगन ेपर कंटेनर की जस्ट्थजत का उजचत जनरीिण करन ेके बाद, कंटेनर याड,क कांडला पत् तन पर सड़क वाहन उपलब्‍ध कराना, उपलब्‍ध कराए गए वाहनों पर ट्मकनल ऑपरेटरों द्वारा लगड दकए गए कंटेनरों कग लेना, पत् तन (सीमा-िुल्क एस्ट्कॉटक के तहत पररवहन करना कंटेनर फ्रेट स्ट्टेिन, सीडब्‍ल्यूसी, कांडला में िहा ंभी / िब भी आवश्यक हग), तीन उच्चता तक/से उतारना (जलफ्ट-ऑफ) और सीवाई म ेंस्ट्टैककंग [िैसा दक क्लॉि नंबर XXI1 म ेंउजल्लजखत है। टीईय ू 2800 एफईय ू 4200 (ii). ररक्त ीकरण: जनधाकररत प्रदिया के अनुसार कंटेनर का ररक्त ीकरण(डी-स्ट्टकफंग); माल कग सूचीबद्ध करना और आयात गगदाम / ओपन याड क(अजधमानतः यांजत्रक उपकरणों के माध्यम स)े म ेंस्ट्टैककंग और उसी सीएफएस कॉम्प्लेक्स के भीतर ईसीवाई या दकसी अन्य जनर्दकष्ट िेत्र म ेंखाली कंटेनर ले िान ेऔर उन्हें तीन उच्चता तक(एक के ऊपर एक) लगाना (खडं सं. Tariff Authority for Major Ports Case no.TAMP/06/2020-CWC Central Warehousing Corporation --- Applicant QUORUM: (i). Shri. T.S. Balasubramanian, Member (Finance) (ii). Shri. Rajat Sachar, Member (Economic) O R D E R (Passed on this 28th day of October 2020) This case relates to the proposal received from the Central Warehousing Corporation (CWC) for general revision of its Scale of Rates for services rendered by it at the Container Freight Station (CFS) at the Deendayal Port Trust (DPT) under Tariff Guidelines, 2019. 2.1. The CWC, vide its letter its letter dated 02 January 2020 and 29 February 2020 has filed a proposal for general revision of its SOR following Tariff Policy, 2019. 2.2. In accordance with the consultation process prescribed, a copy of the CWC proposal dated 02 January 2020 along with email dated 29 February 2020 was circulated to the users/user organisations seeking their comments. 2.3. A joint hearing in this case was held on 26 June 2020 through Video Conferencing. On scrutiny of the proposal, the CWC was requested vide our email dated 01 July 2020 and subsequent letter dated 28 July 2020 followed by reminder dated 14 August 2020 to furnish information/ clarifications on a few points. 2.4. In response, the CWC has furnished its reply on additional information/ clarification alongwith revised updated forms duly certified by the CA vide its letter dated 18 August 2020. 2.5. While furnishing the information/ clarification, the CWC has furnished the updated cost statements[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 11 based on the years 2016-17, 2017-18 and 2018-19 actuals as against 2015-16, 2016-17 and 2017-18 considered by the CWC in its original proposal. 3. Further, DPT was also requested vide our letter dated 01 July 2020 to furnish comments / information with reference to the updated cost statement to be furnished by the CWC. In response to the updated statement furnished by CWC vide its letter dated 18 August 2020, DPT vide its email dated 11 September 2020 has furnished the information / comments sought by us. 4. With reference to the totality of information collected during the processing of the case, this Authority has passed a Speaking Order disposing of the proposal filed by the CWC for general revision of its SOR under Tariff Guidelines, 2019. 5.1. The Speaking Order passed by this Authority is in the process of notification in the Gazette of India and it is likely to take some more time for notification. Since notification of the detailed Speaking Order will take some time, this Authority notifies the revised SOR of the CWC which is attached as Annex. 5.2. The Speaking Order passed by this Authority will be notified separately and communicated to the CWC, the DPT and the relevant users/ user organisations in due course of time. 5.3. The revised SOR will come into force after expiry of 30 days from the date of notification of this Order notifying the SOR in the Gazette of India and shall be valid for a period of 3 years from the date the revised SOR comes into effect. BALASUBRAMANIAN, Member (Finance) [ADVT.-III/4/Exty./386/2020-21] Annex CENTRAL WAREHOUSING CORPORATION Scale of Rates This Scale of Rates sets out the charges payable to the Central Warehousing Corporation for the services and facilities provided at its Container Freight Station at Deendayal Port Trust. General Terms and Conditions. (1). (i). The user shall pay penal interest @ 15% on delayed payments of any charge under this Scale of Rates. Likewise, the CWC shall pay penal interest on delayed refunds. (ii). The delay in refunds will be counted only 20 days from the date of completion of services or on production of all the documents required from the users, whichever is later. (iii). The delay in payments by the users will be counted only 10 days after the date of raising the bills by the CWC. This provision shall, however, not apply to the cases where payment is to be made before availing the services as stipulated in the Major Port Trusts Act and/or where payment of charges in advance is prescribed in this Scale of Rates. (2). The storage charges on abandoned FCL containers/shipper owned containers shall be levied upto the date of receipt of intimation of abandonment in writing or 75 days from the date of landing of container, whichever is earlier subject to the following conditions : (i). The consignee can issue a letter of abandonment at any time. (ii). If the consignee chooses not to issue such letter of abandonment, the container Agent/MLO can also issue abandonment letter subject to the condition that, (a). the Line shall resume custody of container along with cargo and either take back it or remove it from the port premises; and (b). the Line shall pay all port charges accrued on the cargo and container before resuming custody of the container. (iii). The container Agent/MLO shall observe the necessary formalities and bear the cost of transportation and destuffing. In case of their failure to take such action within the stipulated period, the storage charge on container shall be continued to be levied till such time all necessary actions are taken by the shipping lines for destuffing the cargo. (iv). Where the container is seized/confiscated by the Custom Authorities and the same cannot be destuffed within the prescribed time limit of 75 days, the storage charges will cease to apply from the date the Customs order release of the cargo subject to lines observing the necessary formalities and bearing the cost of transportation and destuffing. Otherwise, seized/confiscated containers should be removed by the Lines/consignee from the port12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] premises to the Customs bonded area and in that case the storage charge shall cease to apply from the date of such removal. The SOR is subject to automatic annual indexation to inflation to the extent of 60% of the variation in Wholesale Price Index (WPI) announced by the Authority occurring between 1st January to 31st December of the relevant year. Such adjusted SOR will come into force from 1st May of the relevant year to 30th April of following year. The 1st annual indexation will be from 1 May, 2021. Thus, in any eventuality, CWC shall not be responsible for any insurable claims/risks including consequential losses. Same assumption will apply for export cargo warehouses. However, in case the insurance cover is required by any party against the risk of fire, flood, cyclone, theft, etc., the same will be arranged by the CWC,CFS, Kandla on a written request, for which advalorem charges at the rate of 12.50 paise per Rs. 1000/- value of the stocks will be levied, per week or part thereof. (7). 25% extra charges will be levied for hazardous cargo containers/ oversized /over dimensional containers. (8). Ground rent on container shall not accrue for the period when the CWC is not in a position to deliver/shift import/export containers for reasons attributable to the CWC. CHAPTER-II CONTAINER/CARGO HANDLING & TRANSPORTATION Sl. no. Description of Operations Rate (in `) A. IMPORT OPERATIONS (i). Import Loaded Movement + LO: Providing road vehicles at Container Yard, Kandla Port and taking over loaded containers placed by Terminal operators on the vehicles provided by the contractor, after due inspection of the condition of the container, the lock & seals and on completion of the required formalities, transporting the same to the Container Freight Station, CWC, Kandla Port (under custom escort wherever / whenever required), lift- off & stacking in the CY up to three high [As mentioned in Clause No. XXI –1 TEU 2800 FEU 4200 (ii). De-stuffing: De-stuffing the container as per the procedure laid down; inventorisation of the cargo and stacking the same in the Import Warehouse / Open Yard (preferably by means of mechanical equipment) and carrying empty containers to the ECY or any other designated area within the CFS Complex and stacking them three high [Irrespective of time lag between different operations as mentioned in Clause No.XXI-(2) (a). General cargo TEU 3000 FEU 4500 (b). Scrap/ Heavy cargo TEU 3800 FEU 5700 (iii). Examination: De-stuffing of the loaded container stacked in the yard by grounding them, wherever necessary (which may include transportation within the complex) for facilitating custom examination and stuffing the cargo back into the same container or any other containers after custom examination or loading the cargo / container on to road vehicles and stacking the loaded / empty container as the case may be in the LCY / ECY or any other designated area. RMS Container Examination: Retrieval of the loaded container stacked in the yard by grounding (which may include transportation within the complex) for facilitating Seal Verification and loading customs cleared loaded container on trailer. Cargo Delivery: Arranging Customs examination of cargo (which would include unpacking and re-packing of packages, providing suitable straps etc., or weightment, sealing wherever required on free of charge), and placing them in the stacks / open yard, if necessary, and loading the entire consignment in to trucks / vehicles provided by the importer/CHA at the import warehouse/ open yard [As mentioned in Clause No .XXI(4) (a). Carting: Unloading the cargo from the trucks / vehicles provided by CHA/Exporter/User at CWC, CFS complex and stacking the same in the Export Godown / Open Yard by means of suitable mechanical equipment or by any other appropriate means, after due inventorisation [As mentioned in Clause No. XXI(5)] Manual (PER QTL) 8.20 Mechanical (PER QTL) 10.20 (ii). Examination, Stuffing : Providing labour or appropriate equipment and arranging custom examination (which would include unpacking and re-packing of packages providing suitable straps / scales or weighment wherever / whenever required on free of cost) and re-stacking, if necessary, and consolidating the stocks / cargo, shifting of nominated empty container after retrieving the same from CFS container yard, Placing the container , stuffing , locking & sealing and subsequent internal movement of the loaded container to make space available for keeping the next container for stuffing purpose. Providing labour or appropriate equipment for customs examination (which would include weighment wherever/whenever required on free of cost), and consolidating the nominated stocks/cargo, shifting the nominated empty container after retrieving the same from CFS container yard, Placing the container at Stuffing point, stuffing the let-export cargo in to the nominated container by use of suitable mechanical equipment or by other means, locking and sealing container on completion of required formalities after following the prescribed procedure, subsequent internal movement of the loaded container to make space available for keeping the next container for stuffing purpose. [As mentioned in Clause No. XXI(7) (a). A. General Cargo TEU 3500 FEU 5250 (b). B. Scrap/ Heavy Cargo TEU 6000 FEU 9000 (iv). Transportation of Export loaded container: Providing road vehicles at CWC-CFS Kandla port, Lift-On, taking over the loaded Export Container and transportation of the same from CFS to CSY, Kandla Port (under custom escort wherever/ whenever required) and handing over the same to the port authorities, obtaining clear "EQUIPMENT INTERCHANGE REPORT" (EIR) & to submit the same to CWC-CFS authorities [As mentioned in Clause No.XXI(8) TEU 2300 FEU 3450 (v). GENERAL OPERATIONS Empty Container Movement: Providing suitable vehicles and arranging transportation of Empty Container after due inspection about condition of the container (A) from CSY- Kandla Port Trust to CWC- CFS Kandla Port (B) From any other CFS / Container yard within a road distance of 15 kms. from the CFS Kandla Port, to CWC-CFS Kandla Port, (Lift-on/off inside CSY Kandla Port/ Other designated Yard would not be on account of contractor) lift-off & stacking up to three high in CWC-CFS, CY or vice-versa [As mentioned in clause No. XXI (9)] (a). Movement/ shifting of cargo from one place/ godown/ CY to any other place/ godown/ CY for weighment or other purpose, within CWC-CFS complex (As mentioned in clause no. XXI-14) PER QTL 14 (xi). Palletization: Providing the labour for palletization of cargo including preparation of pallets of appropriate size, strapping as per requirement (material i.e. ready wooden pallets, straps, nails or other material required for the purpose of preparation of pallets will be arranged by the party) & stacking the pallets in the designated stack ([As mentioned in Clause XXI (15)] PER QTL 15 (xii). Bagging: Providing labour for filling up loose cargo/ bag cargo in to the fresh bags (materials to be provided by the party), stitching them, weighment (wherever required) & stack the same at the appropriate place.
