2. इस प्राजधकरण न े पत्तन, पगत पररवहन और िलमाग च मत्रं ालय द्वारा िारी स्ट्टीवडगररग और तट प्रहस्ट्तन
ददिाजनदेि का अनुपालन करते हुए, एनएमपीटी के प्रास्ट्ताव के आधार पर, और जहतधारक के साथ जवजधवत परामिी
प्रदक्रया करके तथा संयुतिय सुनवाई की प्रदक्रया अपनात े हुए एनएमपीटी के स्ट्टीवडगररग और तट प्रहस्ट्तन पररचालन तथा
जनष्पादन मनक की वतचमान अपफ्रंट प्रिल्ु क अनुसूची इस प्राजधकरण द्वारा 19 माच,च 2018 के आदेि संख्या
टीएएमपी/69/2016-एनएमपीटी के द्वारा अनुमगददत दकय े गए थे। उक्त आदिे भारत के रािपत्र म ें 25 मई 2018 के
रािपत्र स.ं 195 म ें अजधसूजचत हुआ था। अजधसूजचत आदेि 23 िून 2018 स े प्रभावी हुए थ े और उनकी वैधता अवजध
3 वर्च के जलय,े अथाचत 22 िून 2021 तक, थी।
3.1. एनएमपीटी ने अपने 11 माच,च 2021 के ई-मेल के द्वारा अपने 09 माच,च 2021 के पत्र संख्या
एनएमपीटी/टीएम/टीएएमपी/2020-21 की प्राजत भेित े हुए इस प्राजधकरण द्वारा जनधाचररत दर की वैधता कग और 3 वर् च
की अवजध के जलय े बढान े के अनरु गध दकया।
3.2. एनएमपीटी द्वारा एनएमपीटी के स्ट्टीवडगररग और तट प्रहस्ट्तन पररचालन तथा जनष्पादन मानक की वतचमान
अनुसूची की वैधता का जवस्ट्तार चाहने के जलय े दकये गय ेमुख्य जनवेदन का सारांि इस प्रकार ह:ै
(i) एनएमपीटी के स्ट्टीवडगररग और तट प्रहस्ट्तन पररचालन तथा जनष्पादन मानक की वतचमान अपफ्रंट
प्रिुल्क अनुसूची इस प्राजधकरण द्वारा 19 माचच 2018 के आदेि संख्या टीएएमपी/69/2016-
एनएमपीटी के द्वारा अनुमगददत की गयी थी िग भारत के रािपत्र में 25 मई 2018 कग अजधसूजचत हुई
और 23 िून 2018 से प्रभावी हुई तथा 22 िनू 2021 तक प्रभावी ह।ै
(ii) प्राजधकरण द्वारा अनुमगददत अपफ्रंट प्रिल्ु क पत्तन प्रयगतियाओं कग 07 िून, 2018 की व्यापार सूचना
संख्या 53/2/2017/टीिीए.4 के द्वारा पररचाजलत दकये गय ेथ।े
(iii) स्ट्टीवडगररग और तट प्रहस्ट्तन ददिाजनदेि के खडं 2.3 के अनसु ार दकसी एक पत्तन की जवजभन्न वस्ट्तओंु के
जलये स्ट्टीवडगररग और तट प्रहस्ट्तन पररचालन के जलय े एक बार अपफ्रंट प्रिुल्क सीमा जनयत कर ददये
िाने पर यह उस पूरे पत्तन के जलए एक समान रूप से लागू हगगी िहााँ जवजभन्न जनिी एिेंजसय अथवा
फमों द्वारा स्ट्टीवडगररग और तट प्रहस्ट्तन पररचालन दकये िाते ह ैं और यह तीन वर्ों की अवजध के जलय े
लाग ू रहगे ी।
(iv) चूंदक, एनएमपीटी म ें स्ट्टीवडगररग और तट प्रहस्ट्तन पररचालन अपफ्रंट प्रिल्ु क 23 िून 2018 से लाग ू ह ैं
और 3 वर्च के जलय ेवैध ह ैंऔर अपफ्रंट प्रिल्ु क की वैधता 22 िनू , 2021 कग समाप्त हग रही ह।ै इसजलय,े
अपफ्रंट प्रिल्ु क के संिगधन के जलये एनएमपीटी म ें स्ट्टीवडगर और तट प्रहस्ट्तन एिटें के साथ
05 फरवरी, 2021 कग एक बैठक का आयगिन दकया गया जिसमें ्यू मंगलगर पत्तन ्यास स्ट्टीवडगर
एसगजसएिन के प्रेजिडेंट ने सूजचत दकया दक कगयला प्रहस्ट्तन के मिीनीकरण के कारण एनएमपीटी म ें
स्ट्टीवडगर की भूजमका काफी कम हग गयी ह।ै उ्ह न े यह भी बताया दक कंटेनर प्रहस्ट्तन पररचालन के
मिीनीकरण के साथ, इस वर् च के अंत तक स्ट्टीवडगररग और तट प्रहस्ट्तन कायचकलाप और कम हग िायेंगे।
अत: उ्ह न े अनरु गध दकया दक वतचमान अपफ्रंट प्रिल्ु क कग िारी रखन े का अनुरगध दकया जिसे अगल े
3 वर्च की अवजध के जलय े िारी रखा िा सकता ह।ै 05 फरवरी, 2021 कग आयगजित बैठक के कायचवृत
प्रेजर्त दकये िात े ह।ैं

एिेंट की भूजमका 2018-19 में 10 एमएमटी से काफी घट कर 2020-21 में 5 एमएमटी (लगभग) रह
गया ह।ै हग रह े भारी कागो प्रहस्ट्तन के मिीनीकरण के कारण यह 2021 के अंत तक और घटकर
2 एमएमटी हग िायेगा।
(vii) स्ट्टीवडगररग और तट प्रहस्ट्तन एिेंट के अनरु गध पर सुजवचार करत े हुए, िैसा ऊपर बताया गया ह,ै
मौिूदा दरमान कग िारी रखने का प्रस्ट्ताव दकया िाता ह ै अथाचत 23 िनू 2021 से 3 वर्च की और
अवजध के जलय े एनएमपीटी में मौिूदा जनष्पादन मानक सजहत स्ट्टीवडगररग और तट प्रहस्ट्तन सेवाओं के
अपफ्रंट प्रिुल्क िारी रख े िायें। स्ट्टीवडगररग और तट प्रहस्ट्तन सेवाओं के अपफ्रंट प्रिल्ु क की मौिूदा दरें
प्रस्ट्तुत ह।ैं
(viii) उपरगतिय कग देखत े हुए, प्राजधकरण से एनएमपीटी में स्ट्टीवडगररग और तट प्रहस्ट्तन सेवाओं के मौिूदा
अपफ्रंट प्रिल्ु क तथा जनष्पादन मानक 23 िून 2021 से 3 वर्च की और अवजध के जलये िारी रखने के
प्रस्ट्ताव कग अनुमगददत करने का अनरु गध दकया िाता ह।ै
4.1 इसके अजतररतिय, एनएमपीटी न े 22 अप्रलै , 2021 के अपने ई-मेल द्वारा 29 माच,च 2021 कग हुई एनएमपीटी के
्यासी मंडल की 7वीं आम सभा की कायचसूची और कायचवृत की एक प्रजत भेिी ह ै जिसमें इस जवर्य पर चचाच की गयी
और इसे संकल्प संख्या रेिग संख्या/181/2020-21 के द्वारा अनुमगददत दकया गया। एनएमपीटी का ्यासी मंडल यह
संकल्प करता ह ैदक:
(i) स्ट्टीवडगररग और तट प्रहस्ट्तन सेवाओं के मौिूदा अपफ्रंट प्रिल्ु क तथा मौिूदा जनष्पादन मानक कग और
3 वर्च की अवजध के जलये िारी रखने का अनुमगदन दकया िाता ह।ै
(ii) प्राजधकरण कग प्रस्ट्ताव प्रस्ट्तुत करने के जलय ेकी गयी कारचवाई दक अजभपुजि की िाती ह।ै
4.2. इसजलय,े एनएमपीटी ने एनएमपीटी में स्ट्टीवडगररग और तट प्रहस्ट्तन सेवाओं के मौिूदा अपफ्रंट प्रिल्ु क तथा
जनष्पादन मानक 23 िनू 2021 स े 3 वर् च की और अवजध के जलये िारी रखन े के प्रस्ट्ताव कग अनुमगददत करन े का अनुरगध
दकया ह।ै
5. एनएमपीटी म ें स्ट्टीवडगररग और तट प्रहस्ट्तन पररचालन की मौिूदा अपफ्रंट प्रिल्ु क और जनष्पादन मानक
अनुसूची की वैधता 22 िून, 2021 कग समाप्त हग िायेगी। एनएमपीटी द्वारा दकय े गय े जनवेदन के आधार पर, िग
एनएमपीटी ने स्ट्टीवडगर और तट प्रहस्ट्तन एिेंट के जवचार प्राप्त करने के पश्चात तैयार दकय े ह,ै और एनएमपीटी तथा
संबंजधत जहतधारक के बीच मौिूदा अपफ्रंट प्रिल्ु क कग इसकी समाजप्त स े 3 वर्च के जलय े बढा ददय े िाने पर बनी सहमजत कग
देखते हुए और दक उतिय प्रस्ट्ताव एनएमपीटी के ्यासी मडं ल द्वारा अनुमगददत ह,ै इस प्राजधकरण द्वारा 19 माच,च 2018 के
आदेि संख्या टीएएमपी/69/2016-एनएमपीटी के द्वारा एनएमपीटी के स्ट्टीवडगररग और तट प्रहस्ट्तन पररचालन तथा
जनष्पादन मनक की वतचमान अपफ्रंट प्रिल्ु क अनुसूची की वैधता कग यह प्राजधकरण इसकी समाजप्त की तारीख स े और 3 वर् च

6. पररणाम में और सामूजहक जवचार जवमिच के उपरांत-तथा ऊपर बताये गए कारण स े यह प्राजधकरण इस
प्राजधकरण द्वारा माच च 19, के आदेि संख्या 2018 टीएएमपी/69/2016-एनएमपीटी के द्वारा एनएमपीटी के स्ट्टीवडगररग
और तट प्रहस्ट्तन पररचालन तथा जनष्पादन मनक की वतचमान अपफ्रंट प्रिुल्क अनुसूची की वैधता कग इसकी समाजप्त की
तारीख से और 3 वर् चदक अवजध के जलय ेयानी 22 िून, 2024 तक, जवस्ट्तार करता ह।ै

Act, 1963 (38 of 1963), the Tariff Authority for Major Ports hereby extends the validity of the existing schedule of
Upfront tariff for Stevedoring and Shore Handling Charges and the Performance Standards of the New Mangalore
Port Trust (NMPT) approved by this Authority vide earlier Order No.TAMP/69/2016-NMPT dated 19 March 2018 as
in the Order appended hereto.

This case relates to a proposal filed by New Mangalore Port Trust (NMPT) for extension of the validity of
the existing schedule of Upfront tariff for Stevedoring and Shore Handling Charges and the Performance Standards of
the NMPT.
2. This Authority vide its Order No.TAMP/69/2016-NMPT dated 19 March 2018 has, based on the proposal of
NMPT and after following due consultation process with stakeholders and after holding joint hearing, approved the
schedule of Upfront Tariff for Stevedoring and Shore Handling operations and Performance Standards for NMPT
following the Stevedoring and Shore Handling Guidelines issued by the Ministry of Ports, Shipping and Waterways.
This Order was notified in the Gazette of India on 25 May 2018 vide Gazette No.195. The notified Order came into
effect from 23 June 2018 and validity was prescribed for a period of 3 years i.e. 22 June 2021.
3.1. The NMPT vide its e-mail dated 11 March 2021 has forwarded its letter No.NMPT/TM/TAMP/2020-21
dated 09 March 2021 requesting to extend the validity of rates fixed by this Authority for a further period of 3 years.
3.2. The main submissions made by the NMPT for seeking of extension of the validity of the existing schedule of
Upfront tariff for Stevedoring and Shore Handling Charges and the Performance Standards of the NMPT are
summarised below:
(i) The TAMP vide Order No.TAMP/69/2016-NMPT dated 19 March 2018 approved schedule of
upfront stevedoring and shore handling charges alongwith performance standards for NMPT which[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5
was notified in Gazette of India on 25 May 2018 and came into force from 23 June 2018 which is
valid till 22 June 2021.
(ii) The Upfront Tariff approved by TAMP was circulated to Port Users vide Trade Notice
No.53/2/2017/TGA.4 dated 07 June 2018.
(iii) As per Clause 2.3 of the Stevedoring and Shore handling Guidelines, once the upfront tariff caps are
set out for Stevedoring and Shore Handling operations of various commodities for a port, it will be
applicable uniformly to the entire port where the Stevedoring and Shore Handling operations are
carried out by private agencies or firm and this will be valid for a period of three years.
(iv) As the Upfront tariff for Stevedores and Shore Handling operations at NMPT came into force from
23 June 2018 and valid for 3 years, the validity of the upfront tariff will expire on 22 June 2021. As
such to know the views of Stevedores and Shore Handling Agents operating at NMPT on revision of
Upfront Tariff, a meeting was held on 05 February 2021 with the Stevedores and Shore Handling
Agents wherein the President of New Mangalore Port Trust Stevedores Association informed that
due to mechanisation of coal handling, the role of Stevedores in NMPT has been reduced
significantly. They also stated that by the mechanisation of container handling operation,
stevedoring and shore handling activities will be further reduced by end of this year. Hence, they
requested for no change in the existing upfront tariff which may be continued for further next
3 years. The minutes of the meeting dated 05 February 2021 is furnished.
(v) Further, the volume of cargo handled by the Stevedoring and Shore Handling Agents during the last
3 years is furnished as below:

(vi) It may be seen from the above table that the involvement of Stevedoring and Shore Handling Agents
in handling cargo at NMPT has been significantly reduced from about 10 MMT in 2018-19 to
5 MMT in 2020-21 (approx.) due to mechanisation of major cargo. It will further reduce by 2 MMT
by the end of the year 2021 due to upcoming mechanisation of container handling.
(vii) Considering the request of the Stevedoring and Shore Handling Agents as enumerated above, it is
proposed to continue the existing SOR i.e. Upfront tariff for Stevedoring and Shore Handling
Services as NMPT with the existing Performance Standards for a further period of 3 years w.e.f.
23 June 2021. The existing schedule of Upfront Tariff for Stevedoring and Shore Handling Services
is furnished.
(viii) In view of the above TAMP may kindly approve the proposal to continue with the existing Upfront
Tariff and Performance Standards for Stevedoring and Shore Handling Services at NMPT for a
period of 3 years from 23 June 2021.
4.1. Further, the NMPT vide its e-mail dated 22 April 2021 has forwarded the copy of the agenda and Minutes of
7th Ordinary Meeting of the Board of the Trustees of NMPT held on 29 March 2021 wherein the subject matter was
discussed and approved vide Resolution No.RESO No.181/2020-21. The Board of the Trustees of NMPT has
resolved to:
(i) Approve continuation of the existing upfront tariff and the existing performance standards for
Stevedoring and Shore handling services at NMPT for a further period of 3 years.
(ii) Ratify the action taken to submit the proposal to TAMP.
4.2. Hence, the NMPT has requested to approve the proposal to continue the existing upfront tariff and
performance standard for Stevedoring and Shore Handling Services at NMPT for a further period of 3 years from
23 June 2021.
5. The validity of the existing schedule of Upfront tariff for Stevedoring and Shore Handling Charges and the
Performance Standards of the NMPT will expire on 22 June 2021. Based on the submissions made by the NMPT6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
which is after eliciting the views of Stevedores and Shore Handling Agents by the NMPT and there is an agreement
between the NMPT and the concerned stakeholders for extension of the existing upfront tariff for 3 years beyond its
expiry and also the said proposal is approved by the Board of Trustees of the NMPT, this Authority in inclined to
extend the validity of the existing schedule of Upfront tariff for Stevedoring and Shore Handling Charges and the
Performance Standards of NMPT approved by this Authority vide Order No.TAMP/69/2016-NMPT dated 19 March
2018 from the date of its expiry for a period of three years i.e. till 22 June 2024.
6. In the result, and for the reasons given above, and based on a collective application of mind, this Authority
extends the validity of the existing schedule of Upfront tariff for Stevedoring and Shore Handling Charges and the
Performance Standards of NMPT approved by this Authority vide Order No.TAMP/69/2016-NMPT dated 19 March
2018 from the date of its expiry for a period of three years i.e. till 22 June 2024. The validity shall automatically lapse
thereafter unless specifically extended by this Authority.
