3. तदनसु ार, बीपीसीएल न े 29 जुलाई, 2016 के प(cid:7074) के (cid:7367)ारा अपने दरमान(cid:7298) के सामा(cid:7008)य सशं ोधन का (cid:7079)(cid:7021)त ाव दायर
(cid:7408)कया। इस (cid:7079)(cid:7021) ताव पर परामश(cid:6981) (cid:7408)कया गया ह ै और 10 अ(cid:6989)त ूबर, 2016 को संयु(cid:6989)त सुनवाई भी हो चकु (cid:7409) ह।ै बीपीसीएल के
(cid:7079)(cid:7021) ताव से संबंिधत अित(cid:7407)र(cid:6989)त सचू ना / (cid:7021) प(cid:7020) टीकरण बीपीसीएल से मांगे गए ह।(cid:7289) बीपीसीएल का उ(cid:7275)र (cid:7079)तीि(cid:6979)त है।

Mumbai, the 28th October, 2016
No. TAMP/68/2012-BPCL.— In exercise of the powers conferred by Section 48 of the Major Port
Trusts Act, 1963 (38 of 1963), the Tariff Authority for Major Ports hereby extends the validity of the existing
Scale of Rates of the Bharat Petroleum Corporation Limited in the Jawaharlal Nehru Port Trust as in the Order
appended hereto.

This note relates to the extension of the validity of the existing Scale of Rates of the Bharat Petroleum
Corporation Limited (BPCL) in the Jawaharlal Nehru Port Trust.¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3
2.1. The existing Scale of Rates (SOR) of BPCL was last approved by this Authority vide Order No.
TAMP/68/2012-BPCL dated 4 August 2014. This Order was notified in the Gazette of India on 19 August
2014. The said Order prescribed a tariff validity till 31 March 2016.
2.2. Subsequently, this Authority vide its Order No. TAMP/68/2012-BPCL dated 21 June 2016 has
extended the validity of existing SOR of BPCL till 30 September 2016. The BPCL was also advised to file its
proposal positively by 15 July 2016, as agreed by it.
3. Accordingly, the BPCL vide its letter dated 29 July 2016 has filed a proposal for general revision of
its Scale of Rates (SOR). The proposal has been taken up on consultation. The joint hearing in this case was
held on 10 October 2016. Additional information/ clarification arising from the BPCL proposal has been
sought from BPCL. The response of BPCL is awaited.
4. In the meanwhile, the BPCL vide its letter dated 29 September 2016 has requested to grant extension
of rates till 31 December 2016.
5. Given that it may take some more time for the case to mature for final disposal, this Authority is
inclined to extend the validity of the existing SOR of BPCL upto 31 December 2016 or till the effective date
of implementation of the revised SOR, whichever is earlier.
6. If any additional surplus over and above the admissible cost and permissible return emerges for the
period post 1 April 2016, during the review of its performance, such additional surplus will be set off fully in
the tariff to be determined.
