2. इस (cid:19)ािधकरण न े 21 जुलाई 2017 के आदशे संIया. टीएएमपी/97/2016-एनएमपीटी के (cid:18)ारा
एनएमपीटी के लंगरगाह (cid:19)भार शु’ क ब क काग) के िन’प ादन मानक और िन’प ादन मानक(cid:24) से संब, (cid:19)ो- साहन और
शाि.तयां अनुमोCदत क(cid:14) थM। यह आदशे भारत के राजपO के 20 िसतंबर, 2017 के राजपO सIं य ा 369 मB
अिधसूिचत (cid:29)ए थे। अिधसूिचत मानक 21 अPत ूबर 2017 से (cid:19)भावी (cid:29)ए थे और उनक(cid:14) वैधता 1 वष? क(cid:14) अविध के
िलए अथा?त् 20 अP तबू र, 2018 तक थी।

(cid:19)ो-स ाहन(cid:24) तथा शाि.तय(cid:24) के संशोधन का (cid:19).त ाव दायर Cकया। एनएमपीटी के (cid:19).त ाव को (cid:19)योक् त ाT/(cid:19)योP ता
सगं ठन(cid:24) के साथ परामश? के िलए रखा गया। बोड? के संक प संIय ा 85/2018-19 के अनुसरण मB .ट ीवडोर(cid:24) के साथ
और आगे परामश? करन े के संबंध मB एनएमपीटी न े 26 फरवरी, 2019 के अपने ई-मेल के (cid:18)ारा सूिचत Cकया गया
Cक िहतधारक(cid:24) के साथ बैठक आयोिजत क(cid:14) गई थी और संशोिधत (cid:19).त ाव समीYाधीन ह ै तथा (cid:19)ािधकरण को

Mumbai, the 8th May, 2019
No. TAMP/97/2016-NMPT.—In exercise of the powers conferred by Section 48 of the Major Port Trusts Act,
1963 (38 of 1963), the Tariff Authority for Major Ports hereby extends the validity of Anchorage charges, Performance
Standards for dry bulk cargo and incentives and penalties linked to Performance Standards of New Mangalore Port Trust
as in the Order appended hereto.

(Passed on this 29th day of March, 2019)
This case relates to a proposal filed by New Mangalore Port Trust (NMPT) for extension of the validity of the
Anchorage charges, Performance Standards for dry bulk cargo and incentives and penalties linked to Performance
Standards of NMPT.
2. This Authority vide its Order No.TAMP/97/2016-NMPT dated 21 July 2017 approved Anchorage charges,
Performance Standards for dry bulk cargo and incentives and penalties linked to Performance Standards at NMPT. This
Order was notified in the Gazette of India vide Gazette No.369 on 20 September 2017. The notified norms came into
effect from 21 October 2017 and validity was prescribed for the period of 1 year i.e. 20 October 2018.
3. Subsequently, the NMPT, vide its letter dated 30 October 2018 has submitted its proposal for revision of
Anchorage charges and incentives and penalties at NMPT. The proposal of NMPT was taken on consultation with the
users/ user organisations. In pursuance of the Board Resolution no.85/2018-19 for further discussion with the stevedores
the NMPT vide its email dated 26 February 2019 has informed that the meetings have been held with the Stakeholders
and the revised proposal is under review and the revised proposal will be submitted to the Authority in due course of time
and also requested to continue the existing tariff for Dry Bulk Cargo fixed under Berthing Policy for Dry Bulk Cargo
2016 till revision.
4. In view of the position brought out above, it will take some time for the case to mature for final consideration
of this Authority after receipt of revised proposal from port. Since the validity of the Anchorage charges and incentives
and penalties has expired on 20 October 2018, this Authority extends the validity of the existing Anchorage charges and
incentives and penalties from the date of its expiry till 20 July 2019 or till the date of effect of notification of the revised
Anchorage charges and incentives and penalties on the revised proposal to be filed by the NMPT, whichever is earlier as
sought by NMPT.
5. In the result, and for the reasons given above and based on a collective application of mind, this Authority
extends the validity of the existing Anchorage charges and incentives and penalties of NMPT from the date of its expiry
till 20 July 2019 or till the date of effect of notification of the revised Anchorage charges and incentives and penalties on
the revised proposal to be filed by the NMPT, whichever is earlier. The validity shall automatically lapse unless
specifically extended by this Authority.
