2. टीएमआईएलएल के वत/मान दरमान िपछली वार इस (cid:15)ािधकरण (cid:14)ारा 17 िसतंबर, 2016 के आदेश सं8 या
टीएएमपी/8/2016-टीएमआईएलएल (cid:14)ारा अनुमो2दत 2कये गए थे। वह आदशे भारत के राजप= म1 10 अ( तबू र, 2016 के राजप= सं8 या
369 म1 अिधसूिचत 2कये गए थे। त?प @च ात्, 22 नवंबर, 2016 को टीएमआईएलएल (cid:14)ारा दायर समीAा आवेदन के आधार पर, इस

(cid:15)ािधकरण ने 21 जुलाई 2017 के आदेश सं8य ा टीएएमपी/83/2016-टीएमआईएलएल के (cid:14)ारा िसतंबर, 2016 के आदेश से पूव/ (cid:15)चिलत
(cid:15)शु(cid:28)क म1 4.85% क(cid:11) घटौती (cid:15)भावी क(cid:11)।
3. इस पृFठ भूिम म1, टीएमआईएलएल ने 1 अ(cid:15)ैल, 2019 से 31 माच/ 2022 तक के तीन वषIय (cid:15)शु(cid:28) क चJ के दरमान(cid:20) के
सामा(cid:8)य संशोधन के िलए 8 जनवरी, 2019 को (cid:15)’ ताव दायर 2कया। मामले को संबंिधत िहतधारक(cid:20) के साथ परामश/ के िलए िलया गया।
19 फरवरी 2019 को िवषयक मामले म1 संयु(त सुनवाई भी हो गई थी।
4.1 इसी बीच, पोत प3रवहन मं=ालय के 05 माच/ 2019 के प= सं8 या 14019/20/2009-पीजी (भाग-IV) के अनुसरण म1, इस
(cid:15)ािधकरण ने महाप(cid:5)न (cid:8)य ास(cid:20) म1 प3रचािलत पूव/ म1 (cid:15)शु(cid:28) क 2दशािनदKश 2005 (cid:14)ारा शािसत बीओटी (cid:15)चालक(cid:20) के िलए (cid:15)शु(cid:28) क 2दशािनदKश
भारत के राजप= म1 07 माच/, 2019 को राजप= सं8 या 92 म1 अिधसूिचत 2कये। 7 माच/ 2019 से (cid:15)शु(cid:28) क 2दशािनदशK , 2019 (cid:15)भावी हो
गए।
4.2. नए (cid:15)शु(cid:28) क 2दशािनदKश, 2019 हमारे 8 माच/, 2019 के प= सं8 या टीएएमपी/61/2018-िविवध (cid:14)ारा टीएमआईएलएल
सिहत सभी बीओटी (cid:15)चालक(cid:20) को संसूिचत कर 2दये गए ह।M
5. इस प3र(cid:15)ेNय म1, टीएमआईएलएल ने अपने 19 माच/, 2019 के ई-मेल (cid:14)ारा यह िनवेदन 2कया ह ै2क टीएमआईएलएल का
2019-22 के िलए दरमान(cid:20) के सामा(cid:8)य संशोधन का उनका (cid:15)’ ताव 2005 के 2दशािनदशK (cid:20) पर आधा3रत ह ै और 2क वे 2019 के (cid:15)शु(cid:28) क
2दशािनदKश(cid:20) के अनुसार नया (cid:15)’त ाव दायर करना चाहते हM। इस (cid:15)कार, टीएमआईएलएल ने अपने 8 जनवरी, 2019 के प= के (cid:14)ारा यह
अनुरोध 2कया ह ै2क उनका (cid:15)’त ाव बंद समझा जाये। टीएमआईएलएल ने यह भी बताया ह ै2क 2019-22 के िलए टीएमआईएलएल अपना
(cid:15)’त ाव (cid:15)शु(cid:28) क 2दशािनदKश, 2019 को (cid:15)चािलत करने के िलए काय/कारी 2दशािनदशK (cid:20) के (cid:15)ा, त होने पर दायर कर1गे।
6. नए (cid:15)शु(cid:28) क 2दशािनदKश, 2019 म1 संकि(cid:28)पत (cid:15)शु(cid:28) क िनधा/रण मॉडल (cid:15)शु(cid:28) क 2दशािनदशK 2005 म1 अनुबP (cid:15)शु(cid:28) क िनधा/रण
िविध से पूण/त: िभ(cid:8)न है। अत: टीएमआईएलएल (cid:14)ारा (cid:15)शु(cid:28) क 2दशािनदशK , 2005 के अंतग/त दायर (cid:15)’ ताव का उसके वत/मान (cid:15)ाRप म1

No. TAMP/7/2019-TMILL.—In exercise of the powers conferred by Section 48 of the Major Port Trusts Act,
1963 (38 of 1963), the Tariff Authority for Major Ports hereby disposes of the proposal received from TM International
Logistic Limited for general revision of its Scale of Rates , as in the Order appended hereto.

(Passed on this 29th day of March 2019)
This case relates to the proposal received from the TM International Logistics Limited (TMILL) for general
revision of its Scale of Rates (SOR).
2. The existing SOR of the TMILL was last approved by this Authority vide Order No. TAMP/8/2016-TMILL
dated
17 September 2016. This Order was notified in the Gazette of India on 10 October 2016 vide Gazette No. 369.
Subsequently, based on the review application filed by TMILL on 22 November 2016, this Authority vide its Order no.
TAMP/83/2016-TMILL dated 21 July 2017 effected a reduction of 4.85% in tariff prevailing prior to September 2016
Order, with effect from 1.9.2017 to 31.03.2019.
3. In this backdrop, the TMILL has filed a proposal dated 8 January 2019 for general revision of its SOR for the
three year tariff cycle from 1 April 2019 to 31 March 2022. The case was taken up for consultation with the relevant
stakeholders. The joint hearing on the subject case was also held on 19 February 2019.
4.1 In the meantime, in pursuance to the MOS letter No. 14019/20/2009-PG (Pt-IV) dated 05 March 2019, this
Authority has notified “Tariff Guidelines for BOT operators operating in Major Port Trust and previously governed by
2005 Tariff Guidelines” in the Gazette of India on 7 March 2019 vide Gazette No. 92. The Tariff Guidelines, 2019 has
come into effect from 7 March 2019.
4.2. The new Tariff Guidelines, 2019 has been communicated to all BOT operators including TMILL vide our
letter No. TAMP/61/2018-Misc dated 8 March 2019.
5. In this backdrop, the TMILL vide its email dated 19 March 2019 has stated that the proposal filed by TMILL
for general revision of SOR for 2019-22 is based on 2005 guidelines and that they intend to file a new proposal based on
2019 Tariff Guidelines. Thus, TMILL has requested to consider the proposal filed by TMILL vide its letter dated 8
January 2019 as closed. TMILL has stated that it will file a new proposal for 2019-22 once the Working Guidelines to
operationalize the Tariff Guidelines, 2019 is received by TMILL.
6. The tariff fixation model envisaged in the new Tariff Guidelines of 2019 is significantly different from the tariff
fixation method stipulated in the Tariff Guidelines of 2005. Hence, the proposal filed by TMILL under tariff guidelines
of 2005 cannot be processed in its present form.
7. In view of the above position, this Authority based on collective application of mind decides to close the
proposal dated 8 January 2019 filed by TMILL for general revision of its SOR, as infructuous. The revised proposal as
and when received from TMILL under Tariff Guidelines, 2019 will be considered afresh.
