कोचीन पत्तन न् यास ीसीओपीएीक द्वारा दायर सीओपीएी के स्ट् एीवडोडोंरग और तए प्रहस्ट्त न प्रभारों के अप्ंए प्रिल्ु क की मौिूदा अनसु ूची और जन्‍प ादन मानकों की वडोैधता के प्रस्ट् तावडो स ेसंबंजधत ह।ै 2. इस प्राजधकरण ने सीओपीएी के प्रस्ट् तावडो के आधार पर और जहतधारकों के साथ जवडोजधवडोत् परामिप प्रदाया का अनुसरण करके और संयुि सनु वडोाई का आयोिन करने के पश् चात् सीओपीएी से प्राप् त जवडोययक प्रस्ट् तावडो का अनुमोदन 12 िुलाई, 2017 के आदेि संख् या एीएएमपी18211626-सीओपीएी द्वारा दकया था। वडोह आदिे भारत के रािपत्र म ें 22 जसतंबर, 2017 के रािपत्र संख् या 349 में अजधसूजचत हुआ था। अजधसूजचत आदेि 22 अक्त ूबर, 2017 से प्रभावडोी हुआ था और इसकी वडोैधता तीन वडोयष की अवडोजध के जलए यानी 26 अक्त ूबर, 2020 तक थी। 3.1. सीओपीएी ने 26 अक्त ूबर, 2020 के ई-मेल के द्वारा 25 अक् तूबर, 2020 का पत्र संख् या एीडी1काटस्ट्एग1 स्ट् एीवडोडोंरग11626 भेिते हुए प्राजधकरण द्वारा जनधाषररत दरों ीइस प्राजधकरण के 12 िलु ाई 1627 के आदिे संख् या एीएएमपी18211626-सीओपीएी के द्वारा अनुमोददतक की वडोैधता का जवडोस्ट् तार और 1 वडोय ष के जलए करन ेका अनुरोध दकया ह।ै 3.2. सीओपीएी द्वारा सीओपीएी के स्ट् एीवडोडोंरग और तए प्रहस्ट् तन प्रभारों के अप्ंए प्रिुल् क की मौिूदा अनुसूची और जन्‍प ादन मानकों की वडोैधता का जवडोस्ट् तार चाहन ेके जलए मख्ु य जनवडोेदनों का सार इस प्रकार ह:ै- (i) स्ट् एीवडोडोंरग नीजत में पररवडोतषनों को देखते हुए, सीओपीएी की 5 मुख्य यूजनयनों ने नई स्ट् एीवडोडोंरग नीजत के कायाषन् वडोयन के बारे में एक औ्ोजगक जवडोवडोाद दायर दकया था िो ्ेत्रीय श्रम आयुक्त ीआरएलसीक कोचीन के पास लंजबत था। अत: सीओपीएी ीस्ट् एीवडोडोंरग और तए प्रहस्ट् तन लाइसेंसीकरणक जवडोजनयम, 2019 (जवडोजनयमक की अजधसूचना के बावडोिूद भी नई दरें कायाषजन्वडोत नहीं कर सका। (ii) रेड यूजनयनों ने आरएलसी के सम् उठायी गयी आईडी का समापन 21 अगस्ट् त, 2020 को समझौता की असीलता के रूप म ें हुआ। अत: 17 अगस्ट् त, 2020 को सभी मौिूदा स्ट् एीवडोडोरों को जवडोजनयम के खडं संख् या 4 के अनुसार 66 ददन की अवडोजध के भीतर यानी 15 अक् तूबर 1616 तक, नए जवडोजनयमों को अपनान े के बारे में एक व् यापार सूचना िारी की गई। इसजलए, सीओपीएी म ें स्ट् एीवडोडोंरग और तए प्रहस्ट्त न प्रचालनों के प्रासजमक प्रिुल् क के कायाषन् वडोयन की प्रभावडोी तारीख 15 अक्त ूबर, 2020 से ही मानी िाये। (iii) प्राजधकरण के आदेि के परै ा 13(xix) के अनुसार स्ट् एीवडोडोंरग और तए प्रहस्ट्तन पररचालनों का प्रासजमक प्रिुल् क रािपत्र में आदिे की अजधसूचना की तारीख से 36 ददन की समाजि पर प्रभावडोी होंगे। महापत्तन न् यासों द्वारा प्राजधकृत प्राजधकरण द्वारा िारी 25 नवडोंबर, 2016 के रािपत्र संख् या 467 द्वारा िारी स्ट् एीवडोडोंरग और तए प्रहस्ट्त न पररचालनों के अप्ंए प्रिुल्क ददिाजनददेशिों के खडं 1.3 के अनुसार महापत्तन न् यास अजधजनयम, 1963 की धारा 41.ी3क के अंतगषत, प्राजधकरण द्वारा यथानुमोददत अजधकतम प्रिल्ु क की वडोैधता 3 वडोयष की अवडोजध के जलए ही होती ह।ै अत: वडोतषमान दरें 26 अक्त बू र, 2020 तक ही वडोैध ह।ैं (iv) इस तथ्य को ्‍ यान म ें रखकर दक सीओपीएी नई स्ट् एीवडोडोंरग नीजत को 15 अक् त ूबर, 2020 से ही कायाषजन्वडोत कर सकेगा और प्राजधकरण के 12 िलु ाई, 2017 के आदेि द्वारा जनधाषररत अप्ंए प्रिुल् क की वडोैधता 22 अक् तूबर 1616 को समाप् त होगी, प्राजधकरण से अनुरोध ह ै दक वडोह प्राजधकरण द्वारा जनधाषररत दरों की वडोैधता को 1 वडोयष की अवडोजध के जलए जवडोस्ट् ताररत करने का क्‍ए करे। संिोधन के जलए संिोजधत प्रस्ट् तावडो, मंत्रालय द्वारा िारी ददिाजनददेशिों के अनुसार, 2 वडोयष की अवडोजध की समाजि से पहले ही दायर कर ददया िायेगा। 4. सीओपीएी के स्ट्एीवडोडोंरग और तए प्रहस्ट् तन प्रभारों के अप्ंए प्रिल्ु क की मौिूदा अनुसूची और जन्‍प ादन मानकों की वडोैधता 26 अक् तूबर, 2020 को समाप् त हो गई ह।ै सीओपीएी द्वारा दकये गए जनवडोेदनों के आधार पर यह प्राजधकरण 12 िलु ाई 1627 के आदिे संख् या एीएएमपी18211626-सीओपीएी के द्वारा इस प्राजधकरण द्वारा अनुमोददत सीओपीएी के स्ट् एीवडोडोंरग और तए प्रहस्ट् तन प्रभारों के अप्ंए प्रिुल् क की मौिूदा अनुसूची और जन्‍प ादन मानकों की वडोधै ता का जवडोस्ट् तार उनकी समाजि की तारीख से 1 वडोयष की अवडोजध के जलए यानी 26 अक् तूबर 1611 तक करने को प्रवडोृत्त ह,ै बित देश[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 सीओपीएी का न् यासी मंडल सीओपीएी के स्ट् एीवडोडोंरग और तए प्रहस्ट् तन प्रभारों के अप्ंए प्रिल्ु क की मौिूदा अनुसूची और जन्‍प ादन मानकों की वडोैधता को और 1 वडोयष की अवडोजध के जलए अनुमोददत करे। 5. पररणाम म,ें और ऊपर बताए गए कारणों से तथा सामजू हक जवडोचार जवडोमिष के आधार पर यह प्राजधकरण 12 िलु ाई 1627 के आदेि संख्य ा एीएएमपी18211626-सीओपीएी के द्वारा इस प्राजधकरण द्वारा अनुमोददत सीओपीएी के स्ट् एीवडोडोंरग और तए प्रहस्ट् तन प्रभारों के अप्ंए प्रिल्ु क की मौिूदा अनुसूची और जन्‍प ादन मानकों की वडोैधता का जवडोस्ट् तार उनकी समाजि की तारीख से 1 वडोयष की अवडोजध के जलए यानी 26 अक् तूबर 1611 तक करता ह,ै बितदेश सीओपीएी का न् यासी मंडल सीओपीएी के स्ट् एीवडोडोंरग और तए प्रहस्ट् तन प्रभारों के अप्ंए प्रिल्ु क की मौिूदा अनसु ूची और जन्‍प ादन मानकों की वडोैधता को और 1 वडोयष की No.TAMP/81/2016-COPT.—In exercise of the powers conferred by Section 48 of the Major Port Trusts Act, 1963 (38 of 1963), the Tariff Authority for Major Ports hereby extends the validity of the existing schedule of Upfront tariff for Stevedoring and Shore Handling Charges and the Performance Standards of the Cochin Port Trust (COPT) approved by this Authority vide earlier Order No.TAMP/81/2016-COPT dated 21 July 2017 as in the Order appended hereto. TARIFF AUTHORITY FOR MAJOR PORTS Case No.TAMP/81/2016-COPT Cochin Port Trust(COPT) - - - Applicant QUORUM (i). Shri. T.S. Balasubramanian, Member (Finance) (ii). Shri. Rajat Sachar, Member (Economic) ORDER (Passed on this 28th day of October 2020) This case relates to a proposal filed by Cochin Port Trust (COPT) for extension of the validity of the existing schedule of Upfront tariff for Stevedoring and Shore Handling Charges and the Performance Standards of the COPT. 2. This Authority vide its Order No.TAMP/81/2016-COPT dated 21 July 2017 has, based on the proposal of COPT and after following due consultation process with stakeholders and after holding joint hearing, approved the subject proposal received from COPT. This Order was notified in the Gazette of India on 11 September 2017 vide Gazette No. 349. The notified Order came into effect from 11 October 2017 and validity is prescribed for a period of 3 years i.e. 10 October 2020. 3.1. The COPT vide its e-mail dated 16 October 2020 has forwarded its letter No.FD/Costing/ Stevedoring/2016 dated 15 October 2020 requesting to extend the validity of rates fixed by TAMP for a further period of 2 years (approved by this Authority vide Order No.TAMP/81/2016-COPT dated 21 July 2017). 3.2. The main submissions made by the COPT for seeking of extension of the validity of the existing schedule of Upfront tariff for Stevedoring and Shore Handling Charges and the Performance Standards of the COPT are summarised below: (i) Looking to the changes in the Stevedoring Policy, an Industrial Dispute was filed by the 5 major unions of COPT, which was pending before the Regional Labour Commissioner4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (RLC), Cochin over the implementation of the new Stevedoring Policy. Hence, the new rates could not be implemented even after notification of COPT (Licensing of Stevedoring and Shore Handling) Regulations, 2019 (Regulation). (ii) The ID raised by the Trade Unions before the RLC ended as failure of conciliation on 12 August 2020. Hence, a Trade Notice dated 27 August 2020 has been issued to all the existing Stevedores to switch over to the new Regulation with a changeover period of 60 days i.e. by 25 October 2020 as per Clause No.4 of the Regulation. Therefore, the effective date of implementation of normative tariff for stevedoring and shore handling operations in COPT would be only from 25 October 2020. (iii) As per Para 13(xix) of the TAMP’s Order, the normative tariff for stevedoring and shore handling operations will come into effect after expiry of 30 days from the date of notification of the Order in the Gazette. As per the Clause 2.3 of the Guidelines for Determination of Upfront Tariff for Stevedoring and Shore Handling Operations authorized by Major Port Trusts under Section 42(3) of the Major Port Trusts Act, 1963 issued by TAMP vide Gazette No.407 dated 15 November 2016, the validity of the caps tariff as approved by the TAMP is for a period of 3 years only. Thus, the present rates are valid upto 10 October 2020 only. (iv) Considering the fact that COPT could implement the new Stevedoring Policy with effect from 25 October 2020 only and the validity of upfront tariff fixed by TAMP vide Order dated 21 July 2017 will expire on 11 October 2020, approval of TAMP is requested to extend the validity of rates fixed by TAMP for a further period of 2 years. A revised proposal for revision will be submitted to TAMP as per the Guidelines issued by Ministry well before the expiry of 2 years. 4. The validity of the existing schedule of Upfront tariff for Stevedoring and Shore Handling Charges and the Performance Standards of the COPT is expired on 10 October 2020. Based on the submissions made by the COPT, this Authority in inclined to extend the validity of the existing schedule of Upfront tariff for Stevedoring and Shore Handling Charges and the Performance Standards of COPT approved by this Authority vide Order No.TAMP/81/2016-COPT dated 21 July 2017 from the date of its expiry for a period of two years i.e. till 10 October 2022 subject to Board of Trustees of COPT approves the extension of the validity of the existing schedule of Upfront tariff for Stevedoring and Shore Handling Charges and the Performance Standards for a further period of two years. 5. In the result, and for the reasons given above, and based on a collective application of mind, this Authority extends the validity of the existing schedule of Upfront tariff for Stevedoring and Shore Handling Charges and the Performance Standards of COPT approved by this Authority vide Order No. TAMP/81/2016-COPT dated 21 July 2017 from the date of its expiry for a period of two years i.e. till 10 October 2022 subject to Board of Trustees of COPT approves the extension of the validity of the existing schedule of Upfront tariff for Stevedoring and Shore Handling Charges and the Performance Standards for a further period of two years. The validity shall automatically lapse unless specifically extended by this Authority. T. S.
