(केओपीटी)] से प्राप्त प्रस्ट् तार् से सबं ंजधत ह।ै

2.1. यह स्ट् मरण कराया िाता ह ैदक एसपीएमपी ने 29 जसतंबर, 2016 के अपने पत्र के द्वारा कोलकाता और हजल्दया जस्ट्थत भूजम
और भर्नों की दकराया अनुसूची के संिोधन का प्रस्ट् तार् भेिा था। परामिी प्रदाया और संयु‍त सुनर्ाई के पश् चात इस प्राजधकरण ने
29 माच,च 2017 के आदिे संख्य ा टीएएमपी/62/2016-केओपीटी के द्वारा कोलकाता और हजल्दाया जस्ट्थत केओपीटी की भूजम और
भर्नों की दकराया अनुसूची का संिोधन दकया था। यह आदिे भारत के रािपत्र में 31 मई, 2017 के रािपत्र संख्य ा 224 में
अजधसूजचत हुआ। संिोजधत दकराया अनुसूची 07 अप्रैल, 2016 से प्रभार्ी हुई और 5 र्र्च की अर्जध के जलए यानी 06 अप्रैल, 2021
तक, र्ैध थी।
2.2. इस संबंध में, एसपीएमपी ने 20 नर्ंबर, 2020 के अपने पत्र संख्य ा िीएम(टी)/38/िीएमटी-977 के द्वारा एचडीसी की
गोदी की भीतरी िोन में ग्राहकों को आबंरटत भूजम के क्षजतपूर्तच प्रभारों के साथ-साथ लाइसेंस िुल् क के पररहार की अनुमजत का प्रस्ट् तार्
दायर दकया।
3.1. एसपीएमपी ने जनम् नजलजखत जनर्ेदन दकये ह:ैं
(i) चल रही महामारी की जस्ट्थजत के कारण व् यापाररयों, आयातकों, जनयाचतकों, पत्तन प्रचालकों, जिसपगं लाइनों,
र्ाहकों आदद सजहत, व् यापार संबंधी संभरण श्रंखंला जनम् न व् यापार प्रमात्रा के साथ रोक प प्रर्ाह के मुदों ों के कारण
अपने-अपने व् यापार को बनाए रखने में काफी ब पी चुनौती का सामना कर रह ेह।ैं असाधारण जस्ट्थजत को दखे ते हुए
और व् यापार द्वारा सामना की िा रही करानाइयों को दखे ते हुए एसपीएमपी के न् यासी मंडल ने प्राजधकरण के
अनुमोदन के जलए लाइसेंस अर्जध से इतर एचडीसी जस्ट्थत गोदी के भीतरी िोन के भीतर भूजम के दोर्पूणच प्रयोग
और अजधर्ास के क्षजतपूणच प्रभारों में छूट दने े का प्रस्ट् तार् भेिने का जनणचय जलया।
(ii) प्रस्ट् ताजर्त जिजथलता को सारणीबध च चाटच में दिाचया गया ह ैिो जनम् नर्त् ह:ै-

(v) इसके अजतरर‍ त, एसपीएमपी के समुजचत प्राजधकारी ने जनजर्दा-सह-बोली के मा‍य म से 5 र्र्च के जलए अजर्कजसत
भूजम के मामले में बोलीकताच द्वारा प्रस्ट् ताजर्त र्तचमान िुल् क पर लाइसेंस िुल् क के पररहार का प्रस्ट् तार् करने का
जनणचय जलया िैसा नीचे ामांक 17 में ददया गया ह:ै-
17. कागगो  भंडारण के जलए गोदी की भीतरी िोन के भीतर 5 र्र्च तक की अर्जध के जलए जनजर्दा-सह-बोली
के द्वारा लाइसेंस आधार पर आबंरटत भूजम के लाइसेंस के मामले में, लाइसेंस िुल् क के प्रजत पररहार का
जनम् नर्त् जर्स्ट्त ार दकया िाता ह:ै-

(vi) केओपीटी ने उ‍ त उपबंध के संदभच में केओपीटी के अ‍य क्ष महोदय का अनुमोदन प्रस्ट् तुत दकया ह।ै
(vii) सुपात्र लाइसेंसधारक को उनके जनकासी और िुटार् जनष् पादन के आधार पर भूजम के लाइसेंस िुल् क का पररहार
दने ा, बिते क्षजतपूर्तच प्रभारों में जिजथलता ग्राहकों के जलए लाभप्रद हो िो बदले में एचडीसी के मा‍य म से कागगो  में
आद्योपांत र्ंजध च की प्रत् यािा की िाती ह ै जिससे इस महामारी की जस्ट्थजत में पत्तन के रािस्ट् र् अिचन में भी र्ंजध च
होगी िबदक कुल जमलाकर व् यापार पर बुरा असर प पा ह।ै
(viii) यह अनुरोध दकया िाता ह ै दक एचडीसी के अंदरूनी िोन में ग्राहकों को आबंरटत भूजम के लाइसेंस िुल् क के साथ-
साथ क्षजतपूर्तच प्रभारों पर एचडीसी द्वारा प्रस्ट् ताजर्त पररहारों और छूटो को अनुमोददत दकया िाए। जर्र्यक
पररहार और छूटें हजल्दया जस्ट्थत कोलकता पत्तन न् यास की भूजम और भर्नों की मौिूदा दकराया अनुसूची की
र्ैधता तक प्रभार्ी रहगे ी यानी 06.04.2021 तक।
3.2. हमारे 01 ददसंबर, 2020 के पत्र के द्वारा एसपीएमपी से कुछ सूचना/स्ट्प ष् टीकरण मांगा गया था। इस संबंध में एसपीएमपी ने
अपने 09 ददसंबर 2020 के ई-मेल द्वारा अपना जनर्ेदन भेिा। एसपीएमपी स े मांगी गई सूचना और एसपीएमपी का उत्तर नीच े
सारणीबध च दकया िाता ह:ै-

भूजम नहीं होती। इन पर जर्त्त जर्भाग की सहमजत से
प्रिासजनक जनणचय जलये िाते हैं। र्तचमान मामले में, प्रस्ट् तार्
का अनुमोदन अ‍य क्ष महोदय द्वारा दकया गया ह ैऔर तदनंतर
एसपीएमपी कोलकाता के बोडच ने अनुमोदन दकया है। उ‍ त
को दखे ते हुए इस प्रस्ट् तार् को एलएसी के मा‍य म से नहीं भेिा
गया।
(ii) इस संदभच में जिन प्रयो‍ ताओं/पटाधाधारकों/प्रयो‍ ता संगानों र्तमच ान प्रस्ट्त ार् म ें जिन प्रयो‍त ाओं/पटाधाधारकों/प्रयो‍त ा
से परामिच दकया िाना ह ैउनकी सूची प्रस्ट् तुत की िाए। संगानों से परामिच दकया िाना ह ैउनकी सूची प्रस्ट् तुत ह।ै
4. जनधाचररत परामिी प्रदाया के अनुसार, एसपीएमपी के 20 नर्ंबर, 2020 और 09 ददसंबर 2020 के प्रस्ट् तार् की एक प्रजत
प्रयो‍ ताओं/प्रयो‍ ता संगानों/ पटाधाधारकों को (एसपीएमपी द्वारा प्रस्ट् तुत की गई सूची के अनुसार) उनकी रटप्प जणयां प्राप्त करने के 23
ददसंबर, 2020 के पत्र के द्वारा भेिी गई। प्रत् युत्तर में, प्रयो‍ ताओं में से एक स्ट् टील अथाटी फ इंजडया (सेल) ने 05 िनर्री 2021 के
अपने ई-मेल द्वारा अपनी रटप्प जणयां दीं। सेल द्वारा दी गई रटप्प जणयां एसपीएम की रटप्प जणयों के जलए उन् हें भेिी ग । 22 िनर्री,
2021 के अनुस्ट् मारक के बाद एसपीएमपी ने 25 िनर्री, 2021 के ई-मेल के द्वारा उत्तर ददया।
5. प्रस्ट् तार् की आरंजभक संर्ीक्षा पर, यह पाया गया दक कुछेक मुदों ों पर एसपीएमपी से अजतरर‍ त सूचना/ स्ट् पष् टीकरण अपेजक्षत
था। तदनुसार, एसपीएमपी से अजतरर‍ त सूचना/ स्ट् पष् टीकरण मांगा गया। 22 िनर्री, 2021, 04 फरर्री 2021 और 19 फरर्री
2021 के अनुस्ट् मारकों के पश् चात एसपीएमपी ने 23 फरर्री 2021 के ई-मेल द्वारा उत्तर ददया । एसपीएमपी स े मांगी गई सूचना
और उस पर एसपीएमपी का उत्तर नीचे सारणीबध च दकया िाता ह।ै

. ददन, के अनजधकंत दखल के जलए 5 गुणा से पर उनके द्वारा की गई भंडारण प्रभार लागत की तुलना करते ह।ैं चूंदक
3 गुणा करने और 60 ददन से इतर के एसएमपी, कोलकाता का लाइसेंस िुल् क अन् य प पौसी पत्तनों से ंंचा है,
मामले में मौिूदा 10 गुणा से 5 गुणा करने प्रयो‍ ता अपने पोतों को उन पत्तनों पर ले िाने को प्रर्ंत्त ह ैं िहां उन् हें अजधक
के सुजर्चार का तकाचधार प्रस्ट् तुत करे दकफायत होगी। पररणाम में, हजल्दया को आने र्ाला कागगो  पहले ही प पौसी
अनजधकंत दखल की क्षजतपूर्तच में उ‍ त पत्तनों को अंतररत दकया िा चुका ह।ै यह जस्ट्थजत एसएमपी, कोलकाता के जलए
जिजथलता प्रदान करने के जलए दकया गया खतरनाक जस्ट्थजत है। मौिूदा ग्राहकों को रोकने के जलए एसएमपी, कोलकाता
जर्श् लेर्ण भी प्रस्ट् तुत करे। के समुजचत प्राजधकारी ने दाजं डक प्रार्धानों को घटान े के साथ-साथ ग्राहकों के
लाभाथच प्रोत् साहन स्ट् कीमों का अनमु ोदन दकया। दांजडक दर में घटौती सुजनजित
करेगी दक उन प्रयो‍ ताओं पर जिन् ह ें अपनी व् यापाररक िरूरतों के अनुसार
पत्तन से कागगो  जनकासी में और समय अपेजक्षत होता है, पर अत् यजधक दंड नहीं
लगेगा। इस दांजडक घटौती से उन् हें यह सुजर्धा भी जमलेगी दक र्े गोदी से
अपना सारा कागगो  जनकास कर लेंगे और अत् यजधक क्षजतपूर्तच अदा करने से बचने
के जलए भूखंड में कागगो  का कोई भाग भी नहीं छो पेगे।
ख. आयात कागगो  के जलए िलयान स े िलयान
आधार पर भजू म का आबटं न
(i). यह दखे ा िाता ह ै दक एसपीएमपी ने िुष् क बल् क कागाच आयात के 25 एमएमटी में से, जिसे गोदी की भीतरी िोन में
जनकासी में सुधार लाने और भूजम के लाभप्रद प्रजत र्र्च भंडार दकया िाना अपेजक्षत होता है, उ‍ त कागगो  का लगभग 00%
उपयोग को प्रोत् साजहत करने के प्रयोिन से, स पक मागच से सुपुद चदकया िाता ह ैजिसके जलए कागगो  की जनकासी दर एचडीसी
अनुबध च लाइसेंस अर्जध से पूर्च लाइसेंसी में काफी धीमी है। यद्यजप, एचडीसी के डीआईिैड में आयात और जनयाचत कागगो 
भूखंड को खाली करने के लाइसेंसधारकों को के भंडारण के जलए 90270000 र्गच मीटर भूखंड उपलब् ध है, दफर भी,
प्रोत् साहन दने े की स्ट् कीम का प्रस्ट् तार् दकया है दीघचकालीन दखल के कारण भंडार क्षेत्र की काफी कमी रहती है। इसजलए,
जिसके अंतगचत आयाजतत मात्रा, लाइसेंस भूजम के दखल के ददनों को कम करने के प्रयोिन से और उपलब् ध भंडार स्ट् थान
अर्जध और भूखंड को खाली करने में जलए के अजधकतम उपयोग के जलए, उ‍ त प्रोत् साहन स्ट् कीम का प्रस्ट् तार् दकया गया ह।ै
गए र्ास्ट् तजर्क समय के आधार पर यह भी पता चला है दक यदद एसएमपी, कोलकाता, जबना दकसी जनष् पादन
लाइसेंसधारक को जर्जभन् न श्रेजणयों म ें प्रजतमान के साधारण तौर पर कागगो  भंडारण भूखंड के लाइसेंस िुल् क के
लाइसेंस िुल् क के पररहार का कुछ प्रजतित पररहार का प्रस्ट्त ार् करता, तो कम जनष्प ादन करन े र्ाल े अजधकतर प्रयो‍त ा
ददया िाता ह।ै जनकासी प्रदाया में और जर्लंब करते।
इस संबंध में, एसपीएमपी पत्तन के होने
र्ाले लाभों और प्रस्ट् ताजर्त स्ट् कीम के आधार

ङ. एसपीएमपी ने लाइसेंस अर्जध के दौरान आयात कागगो  के जलए:
प्ल ॉट के जलए कागगो  की प्रजत र्गच मीटर
िुटाई की मात्रा की र्ास्ट् तजर्क उपलजब्ध की पोत से उतरायी पूरी हो िाने के पश् चात् आयाजतत मात्रा का प्रारूप सर्ेक्षण
गणना की कोई जर्जध प्रस्ट् ताजर्त नहीं की ह,ै ररपोटच से पता लगाया िायेगा। उतारी गई सारी मात्रा संबंजधत प्रयो‍ ता को
इसे प्रस्ट् तुत ददया िाए। प्रस्ट् ताजर्त दरमानों में आबंरटत प्ल ॉट में भंडार की िायेगी। प् लॉट से सारे कागगो  की जनकासी में कुल
इसे एक सोपाजधकता के रूप में अंतर्र्चष् ट अपेजक्षत समय को उपलजब्ध के जलए सुजर्चार में जलया िायेगा।

या जनयाचत, का पता अंजतम प्रारूप सर्ेक्षण ररपोटच से लगाया िायेगा और इस
पर पररहार पररकलन के जलए सुजर्चार में जलया िायेगा।
जनयातच कागगो  के जलए:
एचडीसी प्रत् येक प्ल ॉट का स्ट् टॉक ररकाडच रखता है, जिसे प्ल ॉट का
लाइसेंसधारक अपने कब् िे के प्रत् येक प् लॉट में भंडाररत कागगो  की प्रमात्रा स े
अद्यतन करता ह।ै एक प्ल ॉट जर्जिष् ट से प्रजत र्गच मीटर कागगो  िुटाई का
पररकलन उस प् लॉट से कागगो  लदान की मात्रा स े दकया िायेगा जिसका पता
प्रत् येक और हर-एक पोत के कायच के पूरा होने के पश् चात अंजतम प्रारूप सर्ेक्षण
ररपोटच से लगाया िायेगा।
च. एसपीएमपी यह पुजि करे दक प्रस्ट् तार् के महापत्तन न् यास अजधजनयम 1963 की धारा 53 दकसी समान अथर्ा पोत
संबंध में ददया िाने र्ाला पररहार जिसे इस अथर्ा पोतों और माल की श्रेजणयों पर दरों अथर्ा प्रभारों में इस दरमान
प्राजधकरण द्वारा अनुमोददत दकया िाबा है अजधजनयम के अंतगचत प्रभार्ी दकसी दरमान के अनुसार उन पर ग्राह्य दकसी दर
का महापत्तन न् यास अजधजनयम 1963 की अथर्ा प्रभार के भुगतान से छूट अथर्ा पररहार का अथर्ा यथा लागू ऐसी दर
धारा 53 से कोई संबंध नहीं है। अथर्ा प्रभार को पूणचत अथर्ा उसके एक भाग को छो प दने े का उपबंध करता
ह।ै इसजलए, इसमें भूजम के लाइसेंस िुल् क पर दरों अथर्ा प्रभारों में छूट अथर्ा
माफी का कोई उपबंध नहीं है। अत: एसएमपी द्वारा कोलकाता द्वारा प्रस्ट् ताजर्त
पररहार का एमपीटी अजधजनयम की धारा 53 से कोई संबंध नहीं ह।ै[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 17
6. कोजर्ड-19 महामारी का दखे ते हुए और र्चुचयल बैाके आयोिन करने के बारे में पोत पररर्हन मंत्रालय के 16 अप्रैल 2020
के पत्र संख्य ा 11053/30/2020-समन् र्य के अनुपालन में र्ीजडयो कान् रेंससंग के मा‍य म से 20 िनर्री, 2021 को एक संयु‍त सुनर्ाई
का आयोिन दकया गया। संयु‍त सुनर्ाई में, एसपीएमपी ने अपन े प्रस्ट् तार् का संजक्षप्त पॉर्र प्र् ा ट प्रस्ट् तुतीकरण ददया। एसपीएमपी
और प्रयो‍ ताओं/प्रयो‍ ता संगानों/पटाधा धारकों ने अपने-अपने जनर्ेदन रखे।
7. इस मामले में परामिच संबंजधत कायचर्ाही इस प्राजधकरण के कायाचलय के अजभलेख में उपलब् ध है। संबंजधत पक्षों द्वारा की गई

8. एसपीएमपी द्वारा भेिी गई सूचना की समग्रता के आधार पर जनम् नजलजखत जस्ट्थजत उभर कर सामने आती ह:ै
(i) श् यामा प्रसाद मुकिी पत्तन (एसपीएमपी) [पूर्चर्ती कोलकाता पत्तन न् यास (केओपीटी) की भूजम और भर्नों की
दकराया अनुसूची का जपछली बार अनुमोदन महापत्तन न् यास भू-नीजत ददिाजनदिे , 2014, िुलाई 2015 में यथा
संिोजधत, के उपबंधों के अनुसार, 29 माच,च 2017 के आदिे संख्य ा टीएएमपी/62/2016-केओपीटी के द्वारा दकया
गया था। उ‍ त दकराया अनुसूची 7 अप्रैल 2016 को प्रभार्ी हुई थी और 5 र्र्च की अर्जध के जलए र्ैध थी यानी
6 अप्रैल, 2021 तक।
इस पंष् ाभूजम में, इस आधार पर दक चल रही महामारी की जस्ट्थजत के कारण व् यापाररयों, आयातकों, जनयाचतकों,
पत्तन प्रचालकों, जिसपंग लाइनों, र्ाहकों आदद सजहत, व् यापार संबंधी संभरण श्रंखंला जनम् न व् यापार प्रमात्रा के
साथ रोक प प्रर्ाह के मुदों ों के कारण अपन-े अपने व् यापार को बनाए रखने में काफी ब पी चुनौती का सामना कर रह े
ह।ैं एसपीएमपी अब एसपीएमपी की हजल्दया गोदी पररसर (एचडीसी) की गोदी की भीतरी िोन म ें ग्राहकों को
आबंरटत भूजम के क्षजतपूर्तच प्रभारों के साथ-साथ लाइसेंस िुल् क के पररहार की अनुमजत का प्रस्ट् तार् लेकर आया है।
पत्तन के प्रस्ट् तार् को न् यासी मंडल का अनुमोदन प्राप्त ह।ै
(ii) इस संबंध में, यहां यह उल् लेख करना समीचीन होगा दक भू-नीजत ददिाजनदिे , 2014 पत्तन द्वारा लाइसेंस िुल् क के
मामले में पत्तन द्वारा मंिूर की िाने र्ाली दकसी पररहार अथर्ा प्रोत्स ाहन स्ट् कीम जनधाचररत करने के जलये जर्िेर्
रूप से अजधदिे नहीं दते ी। लेदकन, पत्तन, पोत पररर्हन तथा िलमागच मंत्रालय (एमओपीएसडब् ल् यू) (पूर्चर्ती पोत
पररर्हन मंत्रालय) द्वारा िारी बर्थिंग नीजत 2016 की ओर ‍य ान आकर्र्चत कराया गया जिसमें महापत्तन न् यासों
को उच् च उत् पादकता और टनच अराउंड समय में घटौती लाने तथ पत्तन के संसाधनों का प्रभार्ी प्रयोग सुजनजित
करने के जलए पत्तन प्रयो‍ ताओं को प्रोत् साजहत करने में उसी नीजत में अंतर्र्चष् ट उपबंधों के अनुसरण म ें
प्रोत् सा हन/दडं दने े जनष् पादन मानकों के जनधाचरण का जनदेि ददया गया था। इसी प्रकार, एसपीएमपी का प्रस्ट् तार्
कागगो  की तीव्रता से जनकासी के जलए पटाधाधारकों को प्रोत् साजहत करने के प्रयोिन से लाया गया ह ै तादक उसके भू-
संसाधनों का इष् टतम उपयोग हो सके।
(iii) पत्तन का प्रस्ट् तार् नर्ंबर, 2020 में प्राप्त हुआ। तत् पश् चात्, फरर्री 2021 में पत्तन द्वारा अजतरर‍ त
सूचना/स्ट्प ष् टीकरण भेिा गया। उ‍ त प्रस्ट् तार् और पत्तन द्वारा दी गई अजतरर‍ त सूचना/स्ट्प ष् टीकरण पर इस
जर्श् लेर्ण में सुजर्चार के जलए जलया िाता ह।ै
(iv) एसपीएमपी ने लाइसेंस अर्जध से इतर भूजम के अनजधकंत दखल के जलए पटाधाधारकों द्वारा संदये क्षजतपूर्तच प्रभारों
को जि जथल करने का प्रस्ट् तार् दकया ह।ै पत्तन ने जपछले तीन र्र्ों के आंक पे प्रस्ट् तुत दकये हैं िो यह दिाचते ह ैं दक
कागगो  द्वारा लाइसेंस अर्जध के बाद भी भूजम पर दखल िारी रखता ह।ै तदनुसार, पत्तन के प्रस्ट् तार् मे मौिूदा
दरमान में 31-60 ददन के जलए र्तचमान में 5 गुणा से 3 गुणा के बीच दखल की अर्जध के जलए क्षजतपूर्तच प्रभारों म ें
घटौटी की संकल् पना की गई ह।ै इसी प्रकार, 60 ददन से अजधक की दखल अर्जध के जलए पत्तन ने मौिूदा दरमानों
में र्तचमान 10 गुणा से घटाकर 5 गुणा करने का प्रस् तार् दकया ह।ै
प्रस्ट् ताजर्त जिजथलता का कारण ऐसी घटनाएं बताई गई ह ैंदक िहां पटाधाधारकों द्वारा अर्जिष् ट कागगो  को पररत्य‍त
कर ददया िाता है तादक लाइसेंस अर्जध से इतर अनजधकंत दखल के जलए एसपीएमपी को उच् च क्षजतपूर्तच प्रभार के
भुगतान से बचा िा सके। इसके अजतरर‍ त, यह बताया गया ह ै दक एसपीएमपी का लाइसेंस िुल् क अन् य प पौसी
पत्तनों से काफी अजधक ह।ै एसपीएमपी ने यह बताया ह ै दक उन् होंने प पौसी पत्तनों को कागगो /पोतों के िाने का
अनुभर् दकया ह।ै इस प्रकार, मौिदू ा ग्राहकों को बनाए रखने और यह सुजनजित करने के जलए उन प्रयो‍ ताओं को
जिन् ह ें अपनी व् यापाररक िरूरतों के कारण कागगो  की जनकासी के जलए अजधक समय चाजहए होता है, उन् ह ें अजधक
दडं नहीं लगाया िाना चाजहए। इसजलए पत्तन क्षजतपूर्तच प्रभारों में जिजथलता का प्रस्ट् तार् लेकर आया ह।ै
इस बात पर सुजर्चार करते हुए दक एसपीएमपी के न् यासी मंडल ने प्रस्ट् तार् का अनुमोदन दकया है, और यह भी दक
चूंदक प्रयो‍ ताओं ने अनजधकंत दखल के जलए क्षजतपूर्तच प्रभारों में घटौती दकये िाने का समथचन दकया है, यह
प्राजधकरण मौिूदा दकराया अनुसूची में प्रस्ट् ताजर्त आिोधन को अनमु ोददत करने को प्रर्ंत्त है।
(v) एसपीएमपी ने उन लाइसेंसधारकों की लागू लाइसेंस फीस पर कुछ प्रजतित पररहार लागू दकया है िो अपने प्ल ॉट
पहले अभ् यर्पचत कर देंगे अथर्ा जर्जिष् ट लाइसेंस अर्जध के दौरान अजधक कागगो  िुटायेंगे।18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
एसपीएमपी ने बताया ह ै दक यद्यजप, एचडीसी के डीआईिैड में आयात और जनयाचत कागगो  के भंडारण के जलए
90270000 र्गच मीटर भूखंड उपलब् ध है, दफर भी, दीघचकालीन दखल के कारण भंडार क्षेत्र की काफी कमी रहती है।
‍ योंदक पटाधाधारको की यह नीयत रहती ह ैदक प्ल ॉट का उपयोग उस अर्जध तक िारी रखे िब तक आबंरटत दकया
गया ह ै और र्े जनकासी प्रदाया को धीमा रखते ह।ैं उनकी जनकासी और जनष् पादन मानकों के आधार पर लाइसेंस
िुल् क में प्रस्ट् ताजर्त पररहार से योग्य लाइसेंसधारकों को जनकासी प्रदाया में सुधार लाने का अर्सर जमलेगा और
एचडीसी के मा‍य म से कागगो  की जनकासी में र्ंजध च होगी और इस प्रकार पत्तन के रािस्ट्र् में भी र्ंजध च होगी।
पत्तन ने इसके समथचन में गणनाएं भी प्रस्ट् तुत की ह ैंदक प्ल ॉटों के पटाधाधारकों को ददये िाने र्ाले पररहार से तीव्र टनच
अराउंड की र्िह से स्ट् थान की उपलब् धता के कारण पत्तन को अजधक रािस्ट्र् प्राप्त होगा।
उपरो‍ त को दखे ते हुए और इस बात पर सुजर्चार करते हुए दक प्रस्ट् तार् को बोडच ने अनुमोददत दकया है, यह
प्राजधकरण कागगो  भंडारण के जलए गोदी की भीतरी िोन में लाइसेंस आधार पर भूजम के आबंटन के जलए लाइसेंस
िुल् क के प्रजत पररहार संबंधी उपबंध अंतर्र्चष् ट करने को प्रर्ंत्त ह।ै
(vi) संयोगर्ि, यद्यजप स्ट् टील अथाटी फ इंजडया जलजमटेड (सेल) ने पत्तन के प्रस्ट् तार् का स्ट् र्ागत दकया है इसने यह भी
कहा ह ै दक यह स्ट् कीम पत्तन द्वारा आयात में र्ंजध च करने की प्रोत् साहन स्ट् कीम प्रतीत होती ह ै न दक पटाधाधारकों को
पररहार दने े की। इस संबंध में पत्तन ने यह स्ट् पष् ट दकया है दक लाइसेंस िुल् क में पररहार की प्रस्ट् ताजर्त स्ट् कीम
जनस्ट् संदहे , एक प्रोत् साहन स्ट् कीम ह ै जिसके द्वारा र्ह प्रयो‍ ता िो कागगो  की ‍य ादा मात्रा को िुटायेगा, उसे इस
स्ट् कीम के अंतगचत लाभ होगा। पत्तन ने बताया ह ै दक इस प्रस्ट् तार् से पत्तन प्रोत्साहन दके र प् लॉटों को बेहतर रोल-
ओर्र कर सकेगा तादक जनष् पादन न करने र्ालें को हतोत् साजहत दकया िा सके।
(vii) अजतरर‍ त सूचना/स्ट्प ष् टीकरण दते े समय, एसपीएमपी ने लाइसेंस अर्जध के दौरान प्ल ॉट में प्रजत र्गच मीटर िुटाई
गई कागगो  की मात्रा की र्ास्ट् तजर्क उपलब् धता की गणना करने की, आयात कागगो  और जनयाचत कागगो  दोनों के जलए
अलग-अलग, एक प्रणाली का प्रस्ट् तार् दकया ह।ै उ‍ त प्रणाली का दरमानों में जनधारच रत से दकसी जद्वअथकच ता से बचा
िा सकेगा और प्रयो‍ ताओं को लाइसेंस अर्जध के दौरान प्ल ॉट में िुटाये गए कागगो  की मात्रा की गणना करने के
जलए पत्तन द्वारा अपनायी गई जर्जध स्ट् पष् ट हो िायेगी। प्रस्ट् ताजर्त जर्जध एसपीएमपी द्वारा प्रस्ट् ताजर्त पररहार के
अनुरूप ह।ै उपरो‍ त को दखे ते हुए यह प्राजधकरण पत्तन द्वारा यथाप्रस्ट् ताजर्त जर्जध को अनुमोददत करता ह।ै
(viii) इस प्राजधकरण के आदिे सामान् यत: रािपत्र अजधसूचना की तारीख से 30 ददन की समाजि के पश् चात् उत्तरर्ती
प्रभार् से लागू होते ह ैं िब तक दक संबंजधत प्रिुल् क आदिे में अन् यथा जभन् न व् यर्स्ट्थ ा का उल् लेख न दकया गया हो।
तदनुसार, यह प्राजधकरण भारत के रािपत्र में आदिे की अजधसूचना की तारीख से 30 ददन की समाजि के पश् चात्
उत्तरर्ती प्रभार् से एचडीसी में एसपीएमपी की भूजम और भर्नों के आबंटन की दकराया अनुसूची की मौिूदा
रटप्प णी संख्य ा 11 को आिोजधत करने तथा 16 ओर 17 पर नई रटप् पजणयां िो पने का अनुमोदन करता ह।ै
9.1. पररणाम में और ंपर ददये गए कारणों से तथा सामूजहक जर्चार-जर्मिच के आधार पर यह प्राजधकरण जनम् नजलजखत का
अनुमोदन करता ह:ै-
(i). पैरा – ख में ामांक 11 की मौिूदा रटप्पणी को “एचडीसी सोपाजधकताओं” के अंतगचत एसपीएमपी की भूजम और
भर्नों के आबंटन की मौिूदा दकराया अनुसूची में “आयात/जनयाचत कागगो  के मागचस्ट्थ भंडारण के जलये गोदी भीतरी
िोन में भूजम/आर्ंत्त स्ट्थान के लाईसेंस के जलये” जनम्नजलजखत से प्रजतस्ट्थाजपत दकया िाये:

11. लाइसेंस की समाजि/जनरस्ट्त ीकरण/जनधारच ण/िब्ती के बाद, यदद लाइसेंसधारी इसे अनजधकंत रूप
से अजधग्रहीत करना िारी रखता ह ै तो लाइसेंसधारी को कब् िा खाली दकए िाने तक
जनम् नजलजखत दरों पर गलत उपयोग तथा अजधहरण के जलए क्षजतपूर्तच का भुगतान करना होगा:-

से सारे कागगो  की जनकासी में कुल अपेजक्षत समय को उपलजब्ध के जलए सुजर्चार में जलया िायेगा।
प्रजत र्गच मीटर क्षेत्र में कागगो  िटु ाई के पररकलन के जलए, लाइसेंस अर्जध के दौरान एक प्ल ॉट
जर्जिष् ट के मा‍य म से कुल िुटाई गई मात्रा, चाह े आयात हो या जनयाचत, का पता अंजतम प्रारूप
सर्ेक्षण ररपोटच से लगाया िायेगा और इस पर पररहार पररकलन के जलए सुजर्चार में जलया िायेगा।20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
जनयातच कागगो  के जलए:
एचडीसी प्रत् येक प्ल ॉट का स्ट् टॉक ररकाडच रखता है, जिसे प्ल ॉट का लाइसेंसधारक अपने कब् िे के
प्रत् येक प्ल ॉट में भंडाररत कागगो  की प्रमात्रा स ेअद्यतन करता ह।ै एक प्ल ॉट जर्जिष् ट से प्रजत र्गच मीटर
कागगो  िुटाई का पररकलन उस प् लॉट से कागगो  लदान की मात्रा से दकया िायेगा जिसका पता प्रत् येक
और हर-एक पोत के कायच के पूरा होने के पश् चात अंजतम प्रारूप सर्ेक्षण ररपोटच से लगाया िायेगा।
17. कागगो  भंडारण के जलए गोदी भीतरी िोन में 5 र्र्च तक की अर्जध के जलए जनजर्दा-सह-बोली के द्वारा
लाइसेंस आधार पर आबंरटत भूजम के लाइसेंस के मामले में, लाइसेंस िुल् क के प्रजत पररहार का
जनम् नर्त् जर्स्ट्त ार दकया िाता ह:ै-

This case relates to a proposal received from Syama Prasad Mookerjee Port (SPMP) [Erstwhile
Kolkata Port Trust (KOPT)] for allowing remissions on the compensation charges as well as on the license
fees on the Land allotted to the customers in the Dock Interior Zone at Haldia Dock Complex (HDC).
2.1. It may be recalled that the SPMP vide its letter dated 29 September 2016 forwarded a proposal for
revision of Schedule of Rent for the Lands and Buildings of KOPT at Kolkata and Haldia. After following the
consultation process and joint hearing, this Authority has passed an Order No. TAMP/62/2016-KOPT dated
29 March 2017 for revision of Schedule of Rent for the Lands and Buildings of KOPT at Kolkata and Haldia.
This Order was notified in the Gazette of India on 31 May 2017 vide Gazette No 224. The revised Rent[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 21
Schedules has come into effect from 07 April 2016 and shall remain valid for a period of 5 years i.e. upto 06
April 2021.
2.2. In this connection, the SPMP vide its letter No. GM(T)/38/GMT-977 dated 20 November 2020 has
filed its proposal for allowing remissions on the compensation charges as well as on the license fees on the
Land allotted to the customers in the Dock Interior Zone at HDC.
3.1. The SPMP has made the following submissions:
(i) Due to ongoing pandemic situation, the logistics chain related to businesses including
traders, importers, exporters, port operators, shipping lines, transporters etc. are facing
huge challenge in maintaining their businesses due to lower trade volume as well as cash
flow issues. In view of this extraordinary situation and after considering the difficulties faced
by the Trade, the Board of Trustees of SPMP has decided to propose relaxation in the
compensation charges for wrongful use and occupation of land inside the Dock Interior
Zone at HDC beyond License Period, for approval of TAMP.
(ii) The proposed relaxation is shown in a tabular chart which is as follows:

(vii) Providing of remission of license fees of land to the deserving licensees based on their
evacuation and mobilization performances, providing relaxation in compensation charges
shall be beneficial for the customers who in turn are expected to increase cargo throughout
through HDC, which is turn will also increase the revenue generation of the port in the
present pandemic situation where the overall trade has got badly affected.
(viii) It is requested to approve the above stated remissions and relaxations proposed by HDC
on the compensation charges as well as on the License fees on the Land allotted to the
customers in the Dock Interior Zone of HDC. The subject remissions and relaxations shall
be effective upto the validity of the existing Schedule or Rent for Land and Buildings of
Kolkata Port Trust at Haldia i.e. 06.04.2021.
3.2. Some information/ clarification was sought from SPMP vide letter dated 01 December 2020. In this
regard, the SPMP vide its e-mail dated 09 December 2020 has made its submissions. The information
sought from SPMP and the response of SPMP thereon is tabulated below:

4. In accordance with the consultation procedure prescribed, a copy of the SPMP proposal dated 20
November 2020 and 09 December 2020 was forwarded to Users/ User Organizations/ Lessees (as per
the list furnished by SPMP) vide letter dated 23 December 2020 for seeking their comments. In response,
one of the users i.e. Steel Authority of India Limited (SAIL) vide its e-mail dated 05 January 2021 has
furnished its comments. The comments furnished by SAIL were forwarded to SPMP for its comments.
After a reminder dated 22 January 2021, the SPMP has responded vide its email dated 25 January 2021.
5. On a preliminary scrutiny of the proposal, it was seen that additional information/ clarification was
required from SPMP on few points. Accordingly, additional information/ clarification was sought from
SPMP. After reminders dated 22 January 2021, 04 February 2021 and 19 February 2021, the SPMP vide
its e-mail dated 23 February 2021 has responded. The information sought from SPMP and the reply of
SPMP thereon is tabulated below:

For Export Cargo:
HDC maintains stock records of each and every plot, which the

the Final Draft Survey Report after completion of work of each and
every vessel.
F. The SPMP to confirm that the Section 53 of MPT Act allows provisions for exemption, remission of
remissions to be granted on account rates or charges on any goods or vessels or class of goods or vessels
of the proposal to be approved by from the payment of any rate or any charge leviable in respect thereof
the Authority does not have linkage according to any scale in force under this Act or remit the whole or any
to Section 53 of the Major Port Trust portion of such rate or charge so levied. Therefore, it does not have
Act, 1963. any provisions for exemption, remission of rates or charges on license
fees of land. Hence the remission proposed by SMP, Kolkata do not
have linkage to Section 53 of the MPT Act.
6. In view of the outbreak of COVID – 19 and in pursuance of the Ministry of Shipping (MOS) letter
No. 11053/30/2020-Coord. dated 16 April 2020 to hold virtual meetings, a joint hearing on the case in
reference was held on 20 January 2021 through Video Conferencing. At the joint hearing, SPMP made a
brief power point presentation of its proposal. The SPMP and the users/ user organizations/ Lessees have
made the submissions during the joint hearing.
7. The proceedings relating to consultation in this case are available on records at the office of this
Authority. An excerpt of the comments received and arguments made by the concerned parties will be sent
separately to the relevant parties. These details will also be made available at our website
http://tariffauthority.gov.in.
8. With reference to the totality of information furnished by the SPMP the following position emerges:
(i) The Rent Schedule for the lands and buildings of Syama Prasad Mookerjee Port (SPMP)
[Erstwhile Kolkata Port Trust (KOPT)] was last approved by this Authority vide Order
No.TAMP/62/2016-KOPT dated 29 March 2017 following the provisions of the Land Policy
Guidelines for Major Port Trusts, 2014, as amended in July 2015. The said Rent Schedule
has come into effect from 7 April 2016 and is valid for a period of 5 years i.e. upto 6 April
2021.
In this backdrop, on the ground that the logistics chain related to businesses including
traders, importers, exporters, port operators, shipping lines, transporters etc. are facing[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 33
huge challenge in maintaining their business due to lower trade volume as well as cash
flow issues on account of the ongoing pandemic situation, the SPMP has come up with a
proposal seeking approval for allowing remissions on the compensation charges as well as
on the license fees on the Land allotted to the customers in the Dock Interior Zone at
Haldia Dock Complex (HDC) of SPMP. The proposal of the port has the approval of its
Board of Trustees.
(ii) In this connection, it is relevant here to mention that the Land Policy Guidelines of 2014
does not specifically mandate to prescribe any remission or incentive scheme to be
granted by port in case of licence fees. However, reference is drawn to the Berthing Policy,
2016, issued by Ministry of Ports, Shipping & Waterways (MOPSW) [erstwhile Ministry of
Shipping] wherein the Major Port Trusts are directed to prescribe the performance norms
and grant incentives / penalty in accordance with the provisions contained in the ibid policy
to encourage the port users for deriving higher productivity and achieving reduction in the
turnaround time and effective utilisation of port’s resources. Similarly, the proposal of
SPMP in reference is to encourage the lessees for the faster evacuation of the cargo and
thereby encourage optimum utilization of its land resources.
(iii) The proposal of the port was received in November 2020. Thereafter, additional
information/ clarification has been furnished by the Port in February 2021. The said
proposal alongwith the additional information/ clarification furnished by the Port is
considered in the analysis.
(iv) The SPMP has proposed to relax the compensation charges to be payable by the lessees
for unauthorized occupation of land beyond the license period. The port has furnished
statistics for the last three years, which reveals that the cargo continues to occupy the land
even beyond the license period. Accordingly, the proposal of the port envisages reduction
in the compensation charges for the period of occupation between 31-60 days from
existing 5 times to 3 times of the prevailing SOR. Likewise, for the period of occupation
beyond 60 days, the port has proposed to reduce the compensation charges from the
existing 10 times to 5 times of the prevailing SOR.
The reason for the proposed relaxation is reported to be instances where the residual
cargo is abandoned by the lessees, so as to avoid payment of high compensation charges
by them to SPMP for unauthorized occupation, beyond the licence period. Moreover, given
that the license fees of SPMP is higher than the other neighboring ports, the SPMP has
reported to have experienced a shift of cargo / vessels to the neighboring ports. Thus, in
order to retain the existing customers and to ensure that the users who required more time
to evacuate cargo from the port due to their business requirement, are not penalized
heavily, the port has come up with the proposal to relax the compensation charges.
Considering that the Board of Trustees of SPMP has approved the proposal and also since
the users have expressed their support to the reduction in the compensation charges for
unauthorized occupation, this Authority is inclined to approve the proposed modification in
the existing Rent Schedule.
(v) The SPMP has introduced certain percentage of remissions on the applicable license fees
to the licensees who surrender their plots early or mobilize more cargo during the specific
license period.
The SPMP has stated that though there is an availability of about 9,27,000 sq. mtrs. of plot
for storage of Import and Export cargo inside the Dock Interior Zone (DIZ) at HDC, yet
there is acute scarcity of storage area due to long occupation, since the lessees have the
tendency to continue to make use of the plot for the period for which it has been allotted
and delay the evacuation process. The proposed remission of license fees based on their
evacuation and mobilization performances is reported to encourage the deserving
licensees to improve the evacuation process, thereby resulting in increased cargo
throughout through HDC and thereby resulting in increased revenue generation to the port.
The port has also furnished workings to support that the amount of remission to be granted
to the lessees of plots, would enable the port to comparatively generate more revenue due
to availability of space on account of faster turnaround.34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
In view of the above and considering that the Board has approved the proposal, this
Authority is inclined to incorporate the provisions relating to remissions against license fees
for the allotment of land on license basis inside the Dock Interior Zone for storage of cargo,
as proposed by the Port.
(vi) Incidentally, though the Steel Authority of India (SAIL) has welcomed the proposal of the
Port, it has also stated that the scheme appears to be an incentive scheme for increasing
imports by the port rather than rendering remission to the lessees. In this regard, the port
has categorically stated that the proposed scheme of allowing remission in license fees is
indeed an incentive scheme through which the users, who mobilizes more volume of
cargo, will be benefitted under the scheme. The port has stated that the proposal will
enable the port to have a better roll over of the plots by way of providing incentives so that
holding of plots by non-performers can be discouraged.
(vii) While furnishing additional information/ clarification, the SPMP has proposed a
methodology for calculating the actual achievement of quantity of cargo per sq. meter
mobilized in a plot during the license period, separately for both import cargo and the
export cargo. The prescription of the said methodology in the Scale of Rates would avoid
any ambiguity and would give clarity to the users as to the method to be adopted by the
port for calculation of the quantum of cargo that has been mobilized in a plot during the
license period. The proposed methodology is in tandem to the remissions proposed by
SPMP. In view of the above, this Authority approves incorporation of the methodology as
proposed by the Port.
(viii) Orders of this Authority generally come into effect prospectively after expiry of 30 days
from the date of Gazette Notification unless otherwise different arrangement is specifically
mentioned in the respective tariff Orders. Accordingly, this Authority is inclined to grant
approval to modify the existing note at Sl. No 11 and introduce new note no. 16 and 17 in
the Rent Schedule for allotment of land and buildings of SPMP at HDC prospectively after
the expiry of 30 days from the date of Notification of the Order (to be passed) in the
Gazette of India.
9.1. In the result, and for the reasons given above and based on a collective application of mind, this
Authority approves the following:
(i) To Replace the existing Note at Sr. No. 11 in the Para-B “For licensing of land /
covered space inside Dock Interior Zone for transit storage of import / export
cargo” under the ‘HDC Conditionalities’ in the existing Rent Schedule for allotment
of land and buildings of SPMP at HDC with the following:
“
11. After the expiry/termination/ determination/ forfeiture of the licence, if the licensee
continues to occupy it unauthorizedly, the licensee shall be liable to pay
compensation for wrongful use and occupation at the following rates till vacant
possession is obtained: -
First 60 days 3 times the rate as per prevailing SOR
Continued unauthorized occupation 5 times the rate as per prevailing SOR
beyond 60 days
”
(ii) To incorporate the following two Notes at Sr. No. 16 and Sr. No. 17 in the Para-B
“For licensing of land / covered space inside Dock Interior Zone for transit storage
of import / export cargo” under the ‘HDC Conditionalities’ in the existing Rent
Schedule for allotment of land and buildings of SPMP at HDC:
“

17. Incase license of land inside the Dock Interior Zone for storage of cargo for a period upto
5 years, allotted on license through tender cum auction basis, remission against license

9.2. The SPMP is directed to suitably incorporate the above provisions in its Schedule of Rent.
9.3. The said charges shall come into effect after expiry of 30 days from the date of Notification of the
Order passed in the Gazette of India and its validity shall remain co-terminus to the validity of the existing
Schedule or Rent of SPMP i.e. upto 06 April 2021.
