4. केपीटी ने 11 अ(cid:7079)ैल, 2016 के ईमेल (cid:7367)ारा गांधीधाम टाउनिशप भू िम क(cid:7409) दर संरचना के संशोधन का अपना (cid:7079)(cid:7021) ताव (cid:7079)(cid:7021) तुत (cid:7408)कया
ह ै। (cid:7079)(cid:7021) ताव को िहतधारक(cid:7298) के साथ परामश(cid:7278) (cid:7079)(cid:7408)(cid:7059)या म(cid:7286) िलया गया था । मामले म(cid:7286) 30 जुलाई, 2016 को संयु(cid:6989) त सुनवाई का आयोजन (cid:7263)आ ।
केपीटी ने हमारे 2 अग(cid:7021) त, 2016 के (cid:7367)ारा मांगी गई सूचना / (cid:7021) प(cid:7020) टीकरण अपने 2 (cid:7408)दसबंर, 2016 के प(cid:7074) के (cid:7367)ारा (cid:7079)(cid:7021) तुत क(cid:7409) ह ै।
5.1 संशोिधत भूिम नीित और (cid:7408)दशािनदश(cid:7287) (एलपीजी) 2014 का पैरा 5.7 बताता ह ै (cid:7408)क यह नीित केपीटी, मुबंई प(cid:7004) तन (cid:7008) यास
(एमबीपीटी) और कोलकाता प(cid:7004) (cid:7004) न (cid:7008) यास (केओपीटी) टाउनिशप(cid:7298) से संबंिधत भूिम को छोड़कर, िजनके िलए अलग से नीित बनायी जाएगी,
सभी महाप(cid:7004) तन(cid:7298) के िलए लागू ह ै। अत: हमारे 10 अ(cid:7079)ैल, 2014 और 9 फरवरी, 2016 के प(cid:7074) सं(cid:6990) या टीएएमपी/8/2014 - सामा(cid:7008) य के (cid:7367)ारा
एमओएस को यह अनुरोध (cid:7408)कया गया था (cid:7408)क यह (cid:7021) प(cid:7020) ट (cid:7408)कया जाए (cid:7408)क जब तक अलग से नीित से नह(cid:7277) बनती तब तक कांडला के टाउनिशप

2016 को भी प(cid:7074) सं(cid:6990) या टीएएमपी/25/2016-केपीटी भेजे गए थे।
5.2 इस संदभ(cid:6981) म(cid:7286), एमओएस ने अपने 2 अग(cid:7021) त, 2016 के प(cid:7074) सं(cid:6990) या 8(19)/2016-टीएएमपी के (cid:7367)ारा सूिचत (cid:7408)कया ह ै (cid:7408)क गांधीधाम
टाउनिशप से संबंिधत भूिम पर क(cid:7286)(cid:7076)ीय मंि(cid:7074)मंडल के अनुमोदन (cid:7079)ा(cid:7009) त करने का (cid:7079)(cid:7021) ताव एमओएस (cid:7367)ारा बनाया जा रहा ह ै । इसिलए,
एमओएस ने केपीटी के गांधीधाम टाउनिशप क(cid:7409) दर संरचना के संशोधन के केपीटी के (cid:7079)(cid:7021) ताव को रोके रखने और इस संबंध म(cid:7286) एमओएस
(cid:7367)ारा नीित क(cid:7409) संसूचना के प(cid:7019) चात आरंभ करने का अनुरोध (cid:7408)कया ।
5.3 इस बीच केपीटी ने अपने 7 अ(cid:7079)ैल, 2017 के अपने प(cid:7074) (cid:7367)ारा इस (cid:7079)ािधकरण को अनुरोध (cid:7408)कया (cid:7408)क उसे 6 महीने क(cid:7409) और अविध
अथा(cid:6981)त ,् 30 िसत(cid:7013) बर, 2017 तक के िलए वत(cid:6981)मान दर(cid:7286) इस शत(cid:6981) पर जारी रखने क(cid:7409) अनुमित दी जाए, (cid:7408)क संशोिधत दर(cid:7286) पूव(cid:6981)(cid:7018) यापी (cid:7079)भाव से
लागू क(cid:7409) जाय(cid:7286)गी ।
5.4 ऊपर पैरा 5.2 म(cid:7286) बतायी ि(cid:7021)थित को दखे ते (cid:7263)ए एमओएस से गांधीधाम टाउनिशप (cid:6979)े(cid:7074)(cid:7298) के िलए प(cid:7349)ा (cid:7408)कराया िनधा(cid:6981)रण से संबंिधत
नीित (cid:7079)ा(cid:7009) त हो जान े के प(cid:7019) चात इस (cid:7079)ािधकरण को इस मामले म(cid:7286) अिं तम िवचाराथ(cid:6981) समय लगेगा । चूं(cid:7408)क गांधीधाम टाउनिशप भूिम क(cid:7409) दर
संरचना क(cid:7409) वैधता 31 माच(cid:6981), 2017 को समा(cid:7009) त हो गई है, यह (cid:7079)ािधकरण गांधीधाम टाउनिशप भूिम क(cid:7409) वत(cid:6981)मान दर संरचना को उसक(cid:7409)
समाि(cid:7385) क(cid:7409) तारीख से 30 िसत(cid:7013)ब र, 2017 तक अथवा केपीटी (cid:7367)ारा दायर (cid:7079)शु(cid:7016) क (cid:7079)(cid:7021) ताव के आधार पर संशोिधत प(cid:7349)ा (cid:7408)कराय(cid:7298) क(cid:7409)

6.1 सरकार (cid:7367)ारा जारी भूिम नीित (cid:7408)दशािनदरे् श 2010 (िजसके आधार पर गांधीधाम टाउनिशप भूिम क(cid:7409) दर संरचना अ(cid:7079)ैल, 2012
म(cid:7286) िनयत क(cid:7409) गई थी) अनुब(cid:7373) करते ह (cid:7289) (cid:7408)क इस (cid:7079)ािधकरण (cid:7367)ारा अनमु ो(cid:7408)दत प(cid:7349)ा (cid:7408)कराय(cid:7298) म(cid:7286) 2 (cid:7079)ितशत वा(cid:7414)षक वृि(cid:7373) तब तक होती रहगे ी जब
तक उनका संशोधन इस (cid:7079)ािधकरण (cid:7367)ारा नह(cid:7277) (cid:7408)कया जाता । इस (cid:7079)ािधकरण (cid:7367)ारा अ(cid:7079)ैल, 2012 म(cid:7286) अनुमो(cid:7408)दत आदशे म(cid:7286) भी इस संबंध म(cid:7286)
िविश(cid:7020) ट शत(cid:6981) िनधा(cid:6981)(cid:7407)रत क(cid:7409) गयी थी । यह शत(cid:6981) पोत प(cid:7407)रवहन मं(cid:7074)ालय (cid:7367)ारा जारी संशोिधत भूिम नीित (cid:7408)दशािनदश(cid:7287) , 2014 म(cid:7286) अिभभावी ह ै।
चूं(cid:7408)क मौजूदा प(cid:7349)ा (cid:7408)कराया अनुसूची म(cid:7286) जब तक प(cid:7349)ा (cid:7408)कराय(cid:7298) म(cid:7286) इस (cid:7079)ािधकरण (cid:7367)ारा संशोधनिधत नह(cid:7277) (cid:7408)कया जाता तब तक प(cid:7349)ा (cid:7408)कराय(cid:7298) म(cid:7286)
2 (cid:7079)ितशत क(cid:7409) दर पर वा(cid:7414)षक वृि(cid:7373) सरकार (cid:7367)ारा जारी (cid:7408)दशािनदश(cid:7287) (cid:7298) के अनु(cid:7272)प ह ै । इसिलए 2 (cid:7079)ितशत क(cid:7409) दर पर वा(cid:7414)षक वृि(cid:7373) गांधीधाम
टाउनिशप भू िम क(cid:7409) दर संरचना क(cid:7409) िव(cid:7021) ता(cid:7407)रत अविध के दौरान लागू रहेगी ।
6.2 (cid:7408)फर, भी इस संबंध म(cid:7286) यह नोट (cid:7408)कया जाता ह ै (cid:7408)क 2 (cid:7079)ितशत क(cid:7409) वा(cid:7414)षक वृि(cid:7373) के साथ मौजूदा प(cid:7349)ा (cid:7408)कराय(cid:7298) का िव(cid:7021) तार वत(cid:6981)मान
प(cid:7407)रद(cid:7019)ृ य म(cid:7286) िनवा(cid:6981)त से बचने के िलए अंत(cid:7407)रम (cid:7018) यव(cid:7021) था ह ै । इस संबंध म(cid:7286) केपीटी (cid:7367)ारा दायर (cid:7079)(cid:7021) ताव के आधार पर गांधीधाम टाउनिशप के

7. प(cid:7407)रेणाम म(cid:7286) और सामूिहक िवचार-िवमश(cid:6981) के उपरांत ऊपर बताये बए कारण(cid:7298) से यह (cid:7079)ािधकरण, गांधीधाम टाउनिशप भूिम क(cid:7409)

This case relates to a proposal filed by Kandla Port Trust (KPT) for extension of the validity of the rate structure for
Gandhidham Township Land of KPT.
2. The lease rental for the Gandhidham Township Land of KPT was last revised by this Authority vide Order dated
9 April, 2012. The lease rental revised by this Authority was given retrospective effect from 1 January, 2009 and validity
was prescribed for a period of five years, i.e. upto 31 December, 2013. Thereafter, this Authority has extended the validity
of the existing rate structure for Gandhidham Township Land of KPT from time to time at the request of KPT.
3. The validity of the existing rate structure for Gandhidham Township Land of KPT was last extended based on the
request of KPT (cid:118)(cid:100)(cid:105)(cid:101) Order No. TAMP/20/2010-KPT dated 08 February, 2017 from the date of expiry till 31 March, 2017
or till the date of effect of notification of the revised lease rentals based on the tariff proposal filed by the KPT, whichever
is earlier.
4. The KPT, (cid:100)(cid:101)(cid:118)(cid:105) its email dated 11 April, 2016 has submitted its proposal for revision of rate structure for
Gandhidham Township Land. The proposal was taken on consultation with the stakeholders. A joint hearing on the case
in reference was held on 30 July, 2016. The KPT has vide its letter dated 2 December, 2016 submitted additional
information/ clarifications sought by us vide our letter dated 2 August, 2016.
5.1. Para 5.7 of Amended Land Policy Guidelines (LPG) 2014 states that the Policy is applicable for all Major Ports
except for land relating to the Township areas of KPT, Mumbai Port Trust (MBPT) and Kolkata Port Trust (KOPT) for
which separate policy will be formulated. Hence, vide our letter No. TAMP/8/2014-Genl. dated 10 April 2014 and
9 February, 2016 the MOS was requested to clarify under which LPG the revision of Township area of Kandla will be
governed till separate policy is formulated. This was followed up by letters No. TAMP/25/2016-KPT dated 22 April,
2016, 28 June, 2016 and 14 July, 2016.
5.2. In the context, the MOS vide its letter No. 8/(19)/2016-TAMP dated 02 August, 2016 has informed that a proposal
seeking approval of the Union Cabinet on Land relating to Gandhidham Township is being prepared by the MOS. The
MOS has, therefore, requested to keep on hold the proposal of KPT for revision of rate structure of Gandhidham
Township of KPT and take up after the MOS conveys the policy in this regard. The policy from MOS in this regard is
awaited.
5.3. In the meantime, the KPT has, (cid:118)(cid:100)(cid:105)(cid:101) its letter dated 07 April, 2017 requested the Authority to allow it to continue to
charge at the existing rates for a further period of 6 months i.e. upto 30 September, 2017, subject to condition that revised
rates will be made applicable with retrospective effect.
5.4. In view of the position brought out in para 4.2. above, it will take time for the case for final consideration of the
Authority even after receipt of the policy relating to the fixation of lease rent for Gandhidham township areas from the
MOS. Since the validity of the rate structure for Gandhidham Township Land has expired on 31 March, 2017, this
Authority extends the validity of the existing rate structure of the Gandhidham township land from the date of its expiry
till 30 September, 2017 or till the date of effect of notification of the revised lease rentals based on the tariff proposal filed

6.1. The Land Policy Guidelines of 2010 issued by the Government (based on which the rate structure for Gandhidham
Township Land has been fixed in April 2012) stipulates that the lease rentals approved by this Authority shall be escalated
by 2% per annum till they are revised by this Authority. The Order approved by this Authority in April 2012 also
prescribes a specific condition in this regard. This condition also prevails in the amended Land Policy Guidelines, 2014
issued by the Ministry of Shipping. Since, the existing Schedule of lease rent already prescribes annual escalation @ 2%
in the lease rentals till such time the rates are revised by this Authority and in line with the guidelines issued by the
Government, the annual escalation @ 2% will continue to apply during the extended validity period of the rate structure
for Gandhidham Township Land.
6.2. However, it is to be noted in this regard that the extension of the existing lease rentals with an annual escalation of
2% is only a provisional arrangement to avoid a vacuum in the current scenario. The lease rentals to be fixed for the
Gandhidham Township based on the proposal filed by the KPT in this regard will have to be given retrospective effect, as
requested by the KPT.
7. In the result, and for the reasons given above, and based on the collective application of mind this Authority extends
the validity of the existing rate structure for Gandhidham Township Land from the date of its expiry till 30 September,
2017 or till the date of effect of notification of the revised lease rentals based on the tariff proposal filed by the KPT,
whichever is earlier.
