This amendment modifies the Immigration Carriers Liability Rules, 2007, specifically focusing on the process of filing appeals. The key change involves mandating electronic or other approved modes for submitting appeals and related fees. The amendment also clarifies the budgetary head to which fees and penalties are to be credited. This report provides an overview of the amendment, its rationale, key changes, affected stakeholders, and expected outcomes, based solely on the provided text. **2. Introduction:** The purpose of this report is to provide information and analysis on the Immigration Carriers Liability Amendment Rules, 2021, based on the official notification issued by the Ministry of Home Affairs. This report aims to inform affected parties about the changes to appeal procedures and financial handling as described within the amendment. **3. Policy Overview:** * This document is an amendment to the Immigration Carriers Liability Rules, 2007. * The core objective of this amendment, as inferred from the text, is to modernize and potentially streamline the appeal process under the Immigration Carriers Liability Act, 2000, by introducing electronic submission options and clarifying financial procedures. **4. Background and Rationale:** This amendment appears designed to update the appeal process established under the 2007 Rules. The text indicates a move towards digital submission of appeals and fees, possibly to improve efficiency and accessibility. The specification of budgetary heads suggests a need for clearer accounting and financial management related to the Act. The previous rules, published in 2007 and amended in 2010, likely needed updating to incorporate current technologies and administrative practices. **5. Key Provisions / Changes:** The amendment introduces the following key changes to the Immigration Carriers Liability Rules, 2007: * **Rule 3 is substituted:** This signifies a complete overhaul of the appeal filing process. * **Electronic Filing:** The amended rule mandates that appeals (as referenced in subsection 1 of section 4 of the Act) by carriers, their agents or representatives, should be submitted in electronic mode or any other mode prescribed by the Central Government. * **Fee Payment:** The fee of rupees one thousand for filing an appeal must be paid through electronic mode or any other mode prescribed by the Central Government. * **Budgetary Head Clarification:** The amendment specifies that fees received and penalties imposed under the Act are to be credited to the Budgetary Head of the Ministry of Home Affairs under the Head "0070-Other Administrative Services, 60-Other Services, 117-Visa Fee, 01-Collection on visa services rendered by Ministry of Home Affairs." The effect of these changes is to shift appeal submissions and fee payments to electronic or otherwise approved methods, making the process potentially faster, easier to track, and aligning it with modern digital practices. It also standardizes the financial accounting for fees and penalties. **6. Target Audience and Stakeholders:** Based on the text, the primary target audience and stakeholders are: * Immigration carriers (airlines, shipping companies, etc.) and their agents or representatives. * The Joint Secretary to the Government of India in the Ministry of Home Affairs, who receives the appeals. * The Ministry of Home Affairs, responsible for administering the Act and managing the associated finances. **7. Implementation Aspects (Inferred):** * **Responsible Agency:** The Ministry of Home Affairs is responsible for implementing and overseeing the amended rules. The Joint Secretary is the direct recipient of appeals. * **Procedures:** Carriers and their representatives need to adopt electronic or other approved modes for submitting appeals and fees. The Central Government is authorized to prescribe these modes. * **Financial Procedures:** The Ministry of Home Affairs needs to ensure that fees and penalties are credited to the specified budgetary head. **8. Expected Outcomes / Impact of Changes:** The likely intended outcomes of these changes are: * **Increased Efficiency:** Electronic filing should expedite the appeal process and reduce administrative burden. * **Improved Transparency:** Electronic records will facilitate easier tracking and management of appeals and payments. * **Streamlined Accounting:** Standardized budgetary heads will ensure accurate and consistent financial reporting. * **Modernization:** Aligning the appeal process with digital technologies brings it in line with contemporary practices. **9. Conclusion:** The Immigration Carriers Liability Amendment Rules, 2021, represent a move towards modernizing the appeal process under the Immigration Carriers Liability Act, 2000. By mandating electronic submission of appeals and clarifying financial procedures, this amendment is expected to enhance efficiency, transparency, and accountability in the handling of immigration-related appeals. The changes are significant for immigration carriers and their representatives, requiring them to adapt to the new electronic submission and payment methods.
