(ख) भारतीय पत्तन अजधजनयम, 1908 (1908 का 15) और प्रमुख पत्तन प्राजधकरण अजधजनयम, 2021 (2021 का 1) के प्रार्धानों द्वारा िाजसत दकसी भी पत्तन के अजधकार िेत्र के तहत िेत्र पर लाग ू नहीं होगा। 1599 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 3. पठरभार्ाएँ.-- (1) इन जर्जनयमों में, िब तक दक संर्दभग से अन्द्यथा अपेजित न हो,-- (क) "पहुचँ चनै ल" (एक्सेस चनै ल) स े अंतर्देिीय िलमाग ग टर्मगनल और प्राजधकरण द्वारा अनुरजित राष्ट्रीय िलमागों के मुख्य नौगम्य चनै ल के बीच का फेयरर्े अजभप्रेत ह;ै (ख) “अजधजनयम” स ेभारतीय अंतर्देिीय िलमागग प्राजधकरण अजधजनयम, 1985 (1985 का 82) अजभप्रेत ह;ै (ग) “मूल्यांकन सजमजत” से जर्जनयम 10 के अतं गतग गठित सजमजत अजभप्रेत ह;ै (घ) “प्राजधकरण” से अजधजनयम की धारा 3 के अधीन गठित भारतीय अतं र्देिीय िलमाग गप्राजधकरण अजभप्रेत ह;ै (ङ) "प्रमाणपत्र" स े तात्पय ग अतं र्देिीय िलमाग ग टर्मगनल के जर्कास और प्रचालन के जलए इन जर्जनयमों के अंतगगत प्राजधकरण द्वारा टर्मगनल जर्कासकताग और प्रचालक को दर्दया गया अनापजत्त प्रमाणपत्र ह;ै (च) " अध्यि” से प्राजधकरण का अध्यि अजभप्रेत ह;ै (छ) " मौिूर्दा अतं र्देिीय िलमागग टर्मगनल" से राष्ट्रीय िलमागग पर या उसके दकनारे जस्ट्थत मौिूर्दा अंतर्देिीय िलमाग गटर्मगनल अजभप्रेत ह,ै जिसे प्राजधकरण के अलार्ा दकसी अन्द्य इकाई द्वारा जर्कजसत दकया गया ह;ै (ि) "अंतर्देिीय िलमाग ग टर्मगनल" का अथ ग राष्ट्रीय िलमाग ग पर कागो और यात्री यातायात के जलए कोई भी िेटी ह ै और इसमें व्हारफेि , िेटी, लडैं डंग स्ट्टेि, रोल ऑन-रोल ऑफ सुजर्धाएं, अंतर्दिे ीय पत्तन , संबद्ध कागो हडैं डलगं उपकरण, भडं ारण स्ट्थान, सड़क या रेल पहुचं और टर्मगनल को राष्ट्रीय िलमाग ग के मख्ु य चैनल से िोड़न े के जलए आर्श्यक पहुचं चैनल िाजमल ह ैंऔर इसम ेंमौिूर्दा, स्ट्थायी और अस्ट्थायी अंतर्दिे ीय िलमागग टर्मगनल भी िाजमल ह;ैं (झ) "स्ट्थायी अंतर्दिे ीय िलमाग ग टर्मगनल" से राष्ट्रीय िलमागों पर या उनके साथ जस्ट्थत अंतर्दिे ीय िलमाग ग टर्मगनल अजभप्रेत ह,ै जिसमें जस्ट्थर अचल संरचनाए ं ह,ैं जिसे राष्ट्रीय िलमागों पर पठरर्हन को सुजर्धािनक बनान े के जलए िुरू दकया गया ह ैऔर इसम ेंजस्ट्थर अचल संरचनाओं र्ाला मौिूर्दा अंतर्दिे ीय िलमागग टर्मगनल भी िाजमल ह;ै (ञ) "अस्ट्थायी अंतर्देिीय िलमागग टर्मगनल" से ऐसा अंतर्दिे ीय िलमागग टर्मगनल अजभप्रेत है, िो राष्ट्रीय िलमागग पर या उसके दकनारे एक अस्ट्थायी संरचना या अस्ट्थायी संरचना ह,ै जिसे इसके आरंभ होने की तारीख से पांच र्र् ग की अर्जध के जलए राष्ट्रीय िलमागों पर पठरर्हन की सुजर्धा के जलए स्ट्थाजपत दकया गया ह;ै (ट) "टर्मगनल जर्कासकताग और प्रचालक " से तात्पयग ऐसी इकाई से ह ै जिसे इन जर्जनयमों के अंतगतग प्रमाणपत्र िारी दकया गया ह;ै और (ि) "िलयान " से अंतर्दिे ीय िलयान अजधजनयम, 2021 (2021 का 24) के अंतगतग पठरभाजर्त अतं र्देिीय िलयान अजभप्रेत ह।ै (2) इसमें प्रयुि दकन्द्त ुपठरभाजर्त नहीं दकए गए िब्लर्दों और अजभव्यजियों के र्ही अथग होंगे िो अजधजनयम में क्रमिः उनके जलए जनर्र्दगष्ट ह।ैं 4. टर्मनग ल जर्कासकता ग और प्रचालक के जलए पात्रता.-- इन जर्जनयमों के अंतगगत जनम्नजलजखत संस्ट्थाएं टर्मगनल जर्कासकताग और प्रचालक के जलए पात्र होंगी, अथागत्:-- (क) कोई भी व्यजि या साझेर्दारी फमग जिसके पास स्ट्थायी खाता संख्या, कर कटौती और सग्रं ह खाता संख्या (एकल स्ट्र्ाजमत्र् र्ाली फमग के मामले में) हो और माल और सर्े ा कर के साथ पंिीकरण हो; (ख) कंपनी अजधजनयम, 2013 (2013 का 18) के अंतगगत भारत म ेंपंिीकृत कंपनी; (ग) दकसी केन्द्रीय अजधजनयम या राज्य अजधजनयम के तहत बनाया गया सगं िन; (घ) राज्य सरकार या केंर सरकार, स्ट्थानीय प्राजधकरणों (िैसे नगर जनगम, जिला पंचायत, ग्राम पंचायत, आदर्द) या अन्द्य र्ैधाजनक संगिनों द्वारा प्रबंजधत या जनयंजत्रत कोई स्ट्र्ायत्त जनकाय, कंपनी, सार्गिजनक िेत्र का उपक्रम या रस्ट्ट या बोड;ग (ङ) सहकारी सजमजत अजधजनयम, 1912 (1912 का 2) के तहत सहकारी सजमजत के रूप में पिं ीकृत एक इकाई या भारतीय रस्ट्ट अजधजनयम, 1882 (1882 का 2) के तहत एक रस्ट्ट; और (च) उपयुगि में से दकसी का संयिु उद्यम या सघं ।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 5. अतं र्दिे ीय िलमाग ग टर्मनग ल के जर्कास के जलए प्रमाणपत्र.-- (1) जर्जनयम 4 म ें जर्जनर्र्दगष्ट प्रत्येक इकाई, िो टर्मगनल जर्कासकताग और प्रचालक बनने की इच्छुक ह,ै नए अतं र्देिीय िलमागग टर्मगनल या जर्द्यमान टर्मगनलों के जर्कास के प्रयोिनों के जलए, अनुसूची में जर्जनर्र्दगष्ट अपिे ाओं और तरीके तथा जर्जनयम 6 म ें जर्जनर्र्दगष्ट आर्ेर्दन िुल्क के साथ अनापजत्त प्रमाणपत्र प्रर्दान करन े के जलए प्राजधकरण को ऑनलाइन आर्ेर्दन करेगी। (2) मल्ू यांकन सजमजत र्दस्ट्तार्ेिों का सत्यापन करेगी तथा पुजष्ट करेगी दक आर्ेर्दक इन जर्जनयमों के अंतगगत पात्रता एर् ं अन्द्य अपेिाओं को परू ा करता ह ैया नहीं। (3) यदर्द प्रस्ट्ताजर्त अतं र्देिीय िलमाग ग टर्मगनल दकसी जर्द्यमान अतं र्देिीय िलमाग ग टर्मगनल के जनकट ह,ै तो प्राजधकरण प्रमाणपत्र प्रर्दान करने स े पूर्ग ऐसे जर्कास की तकनीकी व्यर्हायगता का आकलन करेगा, तादक यह सुजनजित दकया िा सके दक जर्द्यमान अंतर्देिीय िलमागग टर्मगनलों के प्रचालन में कोई बाधा या रुकार्ट न आए। (4) प्राजधकरण प्रासंजगक कारकों पर समुजचत जर्चार करन े तथा प्रस्ट्तार् पर मूल्यांकन सजमजत की जसफाठरिों के पिात ही प्रमाणपत्र प्रर्दान करेगा। (5) इन जर्जनयमों के अधीन प्रमाणपत्र प्रर्दान करने के जलए प्रत्येक आर्ेर्दन का जनपटारा आर्ेर्दन प्रस्ट्तुत करने की तारीख स े नब्लबे दर्दन की अर्जध के भीतर दकया िाएगा। 6. आर्र्दे न िल्ु क.-- जर्जनयम 5 में जनर्र्दष्टग आर्ेर्दक, नीचे र्दी गई सारणी के कॉलम (2) म ें जनर्र्दगष्ट अंतर्देिीय िलमाग ग टर्मगनल के जर्कास या जर्स्ट्तार के जलए कॉलम (3) में जनर्र्दष्टग गरै -र्ापसी योग्य आर्ेर्दन िुल्क िमा करेगा, अथागत:-- ताजलका क्र. स.ं अतं र्देिीय िलमाग गटर्मनग ल का प्रकार आर्र्दे न िल्ु क रु. (1) (2) (3) 1. स्ट्थायी अंतर्देिीय िलमाग ग टर्मगनल का जर्कास और मौिूर्दा अतं र्देिीय िलमाग ग15,000 टर्मगनल का मौिूर्दा िमता से 20% अजधक जर्स्ट्तार 2. मौिूर्दा अंतर्देिीय िलमागग टर्मनग ल का जर्स्ट्तार 2,000 3. अस्ट्थायी अंतर्दिे ीय िलमागग टर्मगनल का जर्कास 3,000 7. अनमु त र्स्ट्तएु .ं -- (1) अंतर्दिे ीय िलमाग ग टर्मगनल सभी प्रकार के कागो को संभाल सकता ह,ै बिते दक प्राजधकरण द्वारा इस संबंध में अजधसूचना द्वारा जनर्र्दगष्ट लाग ूकानूनों का अनपु ालन दकया िाए। (2) भारतीय िलयान अजधजनयम, 2021 (2021 का 24) और व्यापाठरक पोत पठरर्हन अजधजनयम 1958 (1958 का 44) के अतं गतग पंिीकृत सभी िलयानों को राष्ट्रीय िलमागों पर पठरचालन करन े और अतं र्दिे ीय िलमाग ग टर्मगनल पर आने की अनुमजत र्दी िा सकती ह।ै 8. टर्मनग ल जर्कासकता गऔर प्रचालक द्वारा अनपु ालन की िान ेर्ाली सामान्द्य ित ें – ( 1) प्रत्येक टर्मगनल जर्कासकताग और प्रचालक, जिसे इन जर्जनयमों के अतं गतग प्रमाणपत्र प्रर्दान दकया गया ह,ै के पास अतं र्देिीय िलमाग ग टर्मगनल के जलए आर्श्यक भूजम के संबंध में र्धै स्ट्र्ाजमत्र् या पट्टा-अजधकार होगा, और र्ह जनम्नजलजखत के जलए जिम्मेर्दार होगा – (क) पठरयोिना का जडिाइन, जनमागण और प्रचालन जिसमें सुरिा मानकों का पालन और सभी लाग ू कानूनों, पयागर्रण जर्जनयमों और र्धै ाजनक मानर्दंडों का अनुपालन सुजनजित करना िाजमल ह;ै (ख) अंतर्दिे ीय िलमागग टर्मगनल की र्ाजणजज्यक और जर्त्तीय व्यर्हायगता। (2) दकसी अंतर्दिे ीय िलमाग ग टर्मगनल के जर्कास के जलए कोई प्रमाणपत्र प्रर्दान नहीं दकया िाएगा िो अजधसूजचत जर्जिष्टता िेत्र के भीतर ह।ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] स्ट्पष्टीकरण.- इस जर्जनयमन के प्रयोिनों के जलए, अजभव्यजि "जर्जिष्टता िेत्र" का तात्पयग मौिूर्दा अंतर्दिे ीय िलमाग ग टर्मगनल से ऐसी र्दरू ी के भीतर दकसी भी िेत्र से ह,ै िैसा दक प्राजधकरण द्वारा अजधसूचना द्वारा जनर्र्दगष्ट दकया िा सकता ह।ै (3) इन जर्जनयमों के अंतगगत टर्मगनल जर्कासकताग और प्रचालक को प्रर्दान दकया गया प्रमाणपत्र प्राजधकरण के पूर् ग अनुमोर्दन से दकसी अन्द्य पि को हस्ट्तांतठरत दकया िा सकता ह।ै (4) टर्मगनल जर्कासकताग और प्रचालक, प्राजधकरण द्वारा प्रमाणपत्र िारी करने की तारीख स े पांच र्र्ग की अर्जध के भीतर स्ट्थायी अतं र्देिीय िलमाग गटर्मनग ल का प्रचालन प्रारंभ करना सुजनजित करेंगे। (5) उप-जर्जनयम (4) म ें जनर्र्दष्टग समय के भीतर स्ट्थायी अंतर्देिीय िलमाग ग टर्मगनल का प्रचालन िुरू करन े म ें जर्फलता प्रमाणपत्र को रद्द करन े के जलए उत्तरर्दायी हो सकती ह।ै (6) अस्ट्थायी अंतर्देिीय िलमागग टर्मगनल के संबंध में िारी प्रमाणपत्र पांच र्र्ग की अर्जध के जलए प्रर्दान दकया िाएगा, जिसे टर्मगनल जर्कासकताग और प्रचालक से जलजखत अनुरोध प्राप्त होने पर प्राजधकरण द्वारा बढाया िा सकेगा। 9. पहुचं चनै ल का जर्कास - मख्ु य नौर्हन चैनल को अतं र्देिीय िलमागग टर्मगनल से िोड़ने र्ाली पहुचं चैनल का जर्कास और रखरखार् टर्मगनल जर्कासकताग और प्रचालक द्वारा प्राजधकरण की र्देखरेख म ेंअपनी लागत पर दकया िाएगा। 10. आर्र्दे नों का मल्ू याकं न.-- इन जर्जनयमों के अंतगगत प्रमाणपत्र िारी करन े या अस्ट्र्ीकार करन े पर जर्चार करने तथा जसफाठरि करने के जलए प्राजधकरण के अध्यि द्वारा एक मल्ू याकं न सजमजत गठित की िाएगी। 11. प्रमाणपत्र प्रर्दान करना.- प्राजधकरण टर्मगनल जर्कासकताग और प्रचालक को फॉमग 1 म ें प्रमाणपत्र प्रर्दान करेगा, जिसम ें उसमें जनर्र्दगष्ट जनयम और ितें िाजमल होंगी। 12. र्दाजयत्र् और िजतपर्ू त.ग-- (1) प्राजधकरण अंतर्देिीय िलमागग टर्मगनल पर माल की दकसी हाजन, िजत या ह्रास के जलए उत्तरर्दायी नहीं होगा। (2) टर्मगनल जर्कासकताग और प्रचालक, अंतर्देिीय िलमाग ग टर्मगनल के जर्कास या प्रचालन के र्दौरान िीर्न या संपजत्त को हुई दकसी हाजन के जलए िजतपूर्तग या प्रजतकर के दकसी भी पाटी के र्दार्े के जर्रुद्ध प्राजधकरण को िजतपूर्तग प्रर्दान करेंगे। 13. बीमा और सरु िा प्रार्धान.-- (1) टर्मगनल जर्कासकताग और प्रचालक अतं र्देिीय िलमागग टर्मगनल पर सुजर्धाओं के जर्कास के र्दौरान सभी सुरिा आर्श्यकताओं का अनुपालन सजु नजित करेंगे। (2) टर्मगनल जर्कासकताग और प्रचालक सभी सुजर्धाओं और सुजर्धाओं के जर्कास या प्र चालन में िाजमल कर्मगयों के जलए बीमा कर्रेि प्राप्त करेंगे। 14. फीडबकै .- टर्मगनल जर्कासकताग और प्रचालक अंतर्दिे ीय िलमाग ग टर्मगनल पर एक फीडबैक रजिस्ट्टर बनाए रखगें े और सुजर्धाओं के जर्जभन्न उपयोगकतागओं से फीडबैक प्राप्त करेंगे। 15. जनरीिण.- टर्मगनल जर्कासकताग और प्रचालक प्राजधकरण के प्रजतजनजध को अंतर्देिीय िलमाग ग टर्मगनल का आर्जधक जनरीिण करन े की अनुमजत र्दगें ।े 16. प्रमाणपत्र का रद्दीकरण.-- (1) प्राजधकरण टर्मगनल जर्कासकताग और प्रचालक को दर्दए गए प्रमाणपत्र को रद्द कर सकता ह,ै यदर्द ऐसे टर्मगनल जर्कासकताग और प्रचालक -- (क) जनयमों एर्ं ितों का उल्लघं न करता ह;ै (ख) अजधजनयम के दकसी प्रार्धान का उल्लंघन करता ह;ै या (ग) कोई गरै कानूनी कायग या चकू करता ह।ै (2) प्रमाणपत्र रद्द करने के जलए नोठटस िारी करने से पहल,े प्राजधकरण टर्मगनल जर्कासकताग और प्रचालक को कारण बताओ नोठटस िारी करेगा, जिसम ें उत्तर र्देन े के जलए तीस दर्दन का समय दर्दया िाएगा और यदर्द कोई उत्तर प्राप्त नहीं होता ह,ै या यदर्द उत्तर असंतोर्िनक ह,ै तो रद्द करन े का आर्दिे िारी दकया िाएगा।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 (3) टर्मगनल जर्कासकताग और प्रचालक भी प्राजधकरण को नब्लब ेदर्दन का नोठटस र्देकर प्रमाणपत्र र्ापस कर सकत े ह।ैं (4) प्राजधकरण द्वारा प्रमाणपत्र रद्द करने या टर्मगनल जर्कासकताग और प्रचालक द्वारा प्रमाणपत्र र्ापस करने की जस्ट्थजत में, टर्मगनल जर्कासकताग और प्रचालक उप-जर्जनयम (2) के तहत रद्दीकरण के आर्दिे से एक सौ अस्ट्सी दर्दनों की अर्जध के भीतर अपनी लागत पर संरचनाओं और उपकरणों आदर्द को हटा र्देंगे। (5) इन जर्जनयमों में जनर्र्दगष्ट जनयमों और ितों के दकसी भी उल्लंघन की जस्ट्थजत म,ें प्राजधकरण को राष्ट्रीय िलमाग गया संबद्ध अर्संरचना को हुए नुकसान के जलए टर्मगनल जर्कासकताग और प्रचालक द्वारा दकए गए काय ग या चूक के कारण प्राजधकरण द्वारा उिाए गए नुकसान के जलए र्दार्ा करन े का अजधकार होगा। (6) यदर्द आर्श्यक समझा िाए तो प्राजधकरण अंतर्देिीय िलमागग टर्मगनल पठरसंपजत्तयों को, प्राजधकरण द्वारा इस संबंध म ें जनधागठरत उजचत प्रजतफल के भगु तान पर अपने अधीन ल ेसकेगा। अनसु चू ी (जर्जनयमन 5 र्देख)ें राष्ट्रीय िलमाग गपर या उसके दकनारे अतं र्देिीय िलमाग गटर्मनग ल के जर्कास और प्रचालन के जलए प्राजधकरण द्वारा अनापजत्त प्रमाण पत्र िारी करन ेके जलए आर्र्दे न। (क ) आर्र्दे क का जर्र्रण: 1. आर्ेर्दक का नाम: 2. आर्ेर्दक का पता और संपकग जर्र्रण (ईमले आईडी सजहत) 3. पैन/िीएसटी जर्र्रण/टीएएन (केर्ल एकल स्ट्र्ाजमत्र् र्ाली फमग के मामल े में) 4. एसोजसएिन का ज्ञापन ( एमओए ) / एसोजसएिन के लेख ( एओए ) 5. कंपनी के जनगमन का प्रमाणपत्र 6. रस्ट्ट या बोड गया दकसी स्ट्थानीय प्राजधकरण के जनगमन/पंिीकरण के संबंध में जनगमन का प्रमाणन, अजधसूचना 7. सोसायटी के एसोजसएिन का ज्ञापन / रस्ट्ट डीड 8. सहकारी सजमजत का पंिीकरण और उसके जनयम एर्ं जर्जनयम 9. संयुि उद्यम/संघ समझौता, इसके प्रमुख सर्दस्ट्य का नाम और प्राजधकार सजहत। 10. आर्ेर्दक की ओर से आर्ेर्दन प्रस्ट्तुत करने र्ाले अजधकृत प्रजतजनजध के पि में प्राजधकरण पत्र/पार्र ऑफ अटॉनी की प्रजत। 11. बोडग के संकल्प की प्रजत या ऐसे अन्द्य र्दस्ट्तार्ेि िो र्तगमान आर्ेर्दन प्रस्ट्ततु करने के जलए आर्ेर्दक के सिम प्राजधकारी के अनुमोर्दन को प्रमाजणत करत े हों। (ख ) अतं र्देिीय िलमाग गटर्मनग ल जर्र्रण: 1. पठरचालन िमता (मेनपार्र) के जर्र्रण के साथ पठरयोिना की पृष्ठभूजम: 2. टर्मगनल का स्ट्थान (जनर्दिे ांक/ मानजचत्र)। 3. राष्ट्रीय िलमाग.ग 4. टर्मगनल का प्रकार जलए जिम्मेर्दार होंगे। 7. टर्मगनल जर्कासकताग और प्रचालक, अंतर्दिे ीय िलमागग टर्मगनल पर प्रचालन िरूु होने के संबंध में, प्रचालन िुरू होने के पंरह दर्दनों के भीतर प्राजधकरण को जलजखत रूप में सूजचत करेंगे। 8. टर्मगनल जर्कासकताग और प्रचालक अंतर्दिे ीय िलमाग ग टर्मगनल के उपयोगकतागओं स े िल्ु क ल े सकते ह,ैं जिसम ें टर्मगनल िुल्क और अतं र्देिीय िलमाग ग टर्मगनल पर प्रर्दान की गई मल्ू यर्र्धगत सेर्ाओं स े संबंजधत कोई भी िल्ु क िाजमल ह,ै िो मौिूर्दा ठरयायत समझौतों या सिम सरकार या र्ैधाजनक एिेंजसयों द्वारा िारी अजधसूचनाओं के अनुसार प्रिुल्क जर्जनयमों के अधीन ह।ै 9. टर्मगनल जर्कासकताग और प्रचालक यह िांचने के जलए जिम्मेर्दार होंगे दक अंतर्दिे ीय िलमागग टर्मगनल पर खड़े िलयानों के पास माल चढान े या उतारन े या िलयान चलान े स े पहल े जपछली और आग े की यात्राओं के अनरूु प अंतर्देिीय िलमागग उपयोगकताग िुल्क की र्ैध रसीर्दें ह।ैं 10. टर्मगनल जर्कासकताग और प्रचालक , अंतर्देिीय िलमागग टर्मगनल पर माल की चढाने या उतारने के जलए जिपर या िलयान प्रचालक द्वारा िलमागग उपयोगकताग िल्ु क के भुगतान के बारे में प्राजधकरण को सूजचत करेंगे। 11. भारतीय अतं र्देिीय िलमाग ग प्राजधकरण टर्मगनल जर्कासकताग और प्रचालक को अंतर्दिे ीय िलमाग ग टर्मगनल पर सूचना प्रौद्योजगकी एप्लीकेिन स्ट्थाजपत करने का जनर्देि र्दे सकता ह ै तादक इसके संचालन को अन्द्य संबंजधत सूचना प्रणाजलयों के साथ एकीकृत दकया िा सके। 12. प्राजधकरण दकसी भी समय अंतर्देिीय िलमागग टर्मगनल के जनरीिण का अजधकार सुरजित रखता ह।ै 13. टर्मगनल जर्कासकताग और प्रचालक यह सुजनजित करेंगे दक –– (क) अतं र्देिीय िलमाग ग टर्मगनल के स्ट्थान का िलमाग ग के फेयरर्े , चैनल या नौगम्यता पर कोई प्रजतकूल प्रभार् नहीं पड़गे ा और इससे राष्ट्रीय िलमागग म ेंिलयानों के आर्ागमन में बाधा उत्पन्न नहीं होगी; (ख) ऐस े अंतर्देिीय िलमाग ग टर्मगनल के जर्कास, संचालन और रखरखार् से भारतीय अतं र्देिीय िलमाग ग प्राजधकरण पर कोई जर्त्तीय और िोजखम र्दाजयत्र् नहीं होगा। 14. टर्मगनल जर्कासकताग और प्रचालक को अंतर्दिे ीय िलमाग ग टर्मगनल पर प्रबंजधत दकए िान े र्ाले कागो का परू ा डेटा प्रत्येक आगामी माह के र्दसू रे दर्दन तक माजसक आधार पर उपलब्लध कराना होगा। 15. टर्मगनल जर्कासकताग और प्रचालक िहािों के बर्थिंग और चढाने या उतारने या अन्द्य गजतजर्जधयों का ठरकॉडग बनाए रखेंग,े िैसा दक भारतीय अंतर्देिीय िलमाग गप्राजधकरण द्वारा समय-समय पर अपेजित हो सकता ह।ै 16. अंतर्देिीय िलमाग ग टर्मगनल No. IWT- IWAI -230115(11)/1/2020.–––In exercise of the powers conferred by sub-section (1) read with clauses (d), (f) and (h) of sub-section (2), of section 35, clauses (b), (f) and (g) of sub-section (1) of section 14 and section 17 of the Inland Waterways Authority of India Act, 1985 (82 of 1985), the Inland Waterways Authority of India, with the previous approval of the Central Government, hereby makes the following regulations, namely:- 1. Short title and commencement. –– (1) These regulations may be called the National Waterways (construction of Jetties/Terminals) Regulations, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Application. ––These regulations shall –– a. apply to all national waterways declared under sections 2 and 3 of the National Waterways Act, 2016 (17 of 2016); b. not apply to the area under the jurisdiction of any port governed by the provisions of the Indian Port Act, 1908 (15 of 1908) and the Major Port Authorities Act, 2021 (1 of 2021). 3. Definitions. –– (1) In these regulations, unless the context otherwise requires, ––– (a) “access channel” means fairway between an inland waterway terminal and the main navigable channel of the national waterways maintained by the Authority; (b) “Act” means the Inland Waterways Authority of India Act, 1985 (82 of 1985); (c) “Appraisal Committee” means the committee constituted under regulation 10; (d) “Authority” means the Inland Waterway Authority of India constituted under section 3 of the Act; (e) “Certificate” means the No objection Certificate granted by the Authority to the terminal developer and operator under these regulations for developing and operating the inland waterway terminal; (f) “Chairman” means the Chairman of the Authority; (g) “existing inland waterway terminal” means an existing inland waterway terminal on or along the national waterways, developed by any entity other than the Authority; (h) “inland waterway terminal” means any jetty for cargo and passenger traffic on national waterway and includes wharves, jetties, landing stages, roll on- roll off facilities, inland ports, associated cargo handling equipment, storage spaces, road or rail access and the access channel required to connect the terminal with the main channel of the national waterway and also includes existing, permanent and temporary inland waterway terminal; (i) “permanent inland waterway terminal” means an inland waterway terminal on or along the national waterways, with fixed immovable structures, commissioned to facilitate transportation on national waterways and includes an existing inland waterway terminal with fixed immovable structures; (j) “temporary inland waterway terminal” means an inland waterway terminal that is a floating structure or temporary structure on or along the national waterways, set up to facilitate transportation on national waterways for a period of five years from the date of its commissioning;10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (k) “terminal developer and operator” means an entity to whom a Certificate has been issued under these regulations; and (l) “vessel” means the inland vessel as defined under the Inland Vessels Act, 2021 (24 of 2021). (2) The words and expressions used herein but not defined, shall have the meanings respectively assigned to them in the Act. 4. Eligibility for terminal developer and operator. –– The following entities shall be eligible for terminal developer and operator under these regulations, namely: –– (a) any individual or partnership firm having Permanent Account Number, Tax Deduction and Collection Account Number (in case of sole proprietorship firm) and registration with Goods and Services Tax; (b) a company registered in India under the Companies Act, 2013 (18 of 2013); (c) an organisation created under any Central Act or State Act; (d) any autonomous body, company, public sector undertaking or trusts or boards managed or controlled by the State Government or the Central Government, local authorities (like municipal corporations, zila panchayats, gram panchayats, etc.) or other statutory organisations; (e) an entity registered as a co-operative society under the Co-operative Societies Act, 1912 (2 of 1912) or a trust under Indian Trusts Act, 1882 (2 of 1882); and (f) a joint venture or consortium of any of the above. 5. Certificate for development of inland waterway terminal. –– (1) Every entity specified in regulation 4, desirous of being a terminal developer and operator shall make an application to the Authority online for the grant of a No objection Certificate, along with the requirements and in the manner as specified in the Schedule and the application fee specified in regulation 6, for the purposes of development of new inland waterway terminal or the existing terminals. (2) The Appraisal Committee shall verify the documents and confirm as to whether the applicant fulfils the eligibility and other requirements under these regulations. (3) In case the proposed inland waterway terminal is in close proximity to an existing inland waterway terminal, the Authority shall, before granting the Certificate, assess the technical feasibility of such development to ensure that the operations of the existing inland waterway terminals are not obstructed or hampered. (4) The Authority shall grant the Certificate only after proper consideration of the relevant factors and the recommendations of the Appraisal Committee on the proposal. (5) Every application for the grant of Certificate under these regulations, shall be disposed of within a period of ninety days from the date of submission of the application. 6. Application fee. –– The applicant referred to in regulation 5, shall deposit a non-refundable application fee specified in column (3) of the Table below, for the development or expansion of the inland waterway terminal specified against column (2) thereof, namely: –– Table[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 11 S.. Permitted commodities. –– (1) An inland waterway terminal may handle all type of cargos, subject to compliances with applicable laws as may be specified by the Authority by notification in this behalf. (2) All vessels registered under the Indian Vessels Act, 2021 (24 of 2021) and the Merchant Shipping Act 1958 (44 of 1958) may be permitted to operate on national waterways and to call on the inland waterway terminal. 8. General conditions to be complied with by the terminal developer and operator. –(1) Every terminal developer and operator who has been granted a Certificate under these regulations shall have a valid ownership or leasehold right in respect of the land required for the inland waterway terminal, and shall be responsible for –– (a) the design, construction and operation of the project including ensuring adherence to safety standards and compliance with all applicable laws, environmental regulations, and statutory norms; (b) the commercial and financial feasibility of the inland waterway terminal. (2) No Certificate shall be granted for development of an inland waterway terminal which is within the notified exclusivity zone. Explanation. –– For the purposes of this regulation, the expression “exclusivity zone” means any area within such distance from the existing inland waterway terminal as maybe specified by the Authority, by notification. (3) The Certificate granted to a terminal developer and operator under these regulations may be transferred or assigned to another party with the prior approval of the Authority. (4) The terminal developer and operator shall ensure commencement of operations of the permanent inland waterway terminal within a period of five years from the date of issuance of the Certificate by the Authority. (5) Failure to commence the operation of the permanent inland waterway terminal within the time specified in sub- regulation (4) may be liable to cancellation of the Certificate. (6) The Certificate issued in respect of a temporary inland waterway terminal shall be granted for a period of five years which may be extended by the Authority upon receipt of written request from the terminal developer and operator. 9. Access channel development. –– The access channel connecting the main navigational channel to the inland waterway terminal shall be developed and maintained by the terminal developer and operator at its own cost, under supervision of the Authority. 10. Appraisal of applications. –– An Appraisal Committee shall be constituted by the Chairman of the Authority for considering and recommending issuance or rejection of Certificate under these regulations.12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 11. Grant of Certificate. –– The Authority shall grant the Certificate to the terminal developer and operator in Form I, containing the terms and conditions specified therein. 12. Liabilities and indemnification. –– (1) The Authority shall not be responsible for any loss, destruction, damage or deterioration of goods at the inland waterway terminal. (2) The terminal developer and operator shall indemnify the Authority against any claims by any party towards damages or compensation for any loss caused to life or property during the development or operations of the inland waterway terminal. 13. Insurance and safety provisions. –– (1) The terminal developer and operator shall ensure compliance with all safety requirements during development of the facilities on inland waterway terminal. (2) The terminal developer and operator shall obtain insurance coverage for all facilities and the personnel involved in the development or operation of the facilities. 14. Feedback. –– The terminal developer and operator shall maintain a feedback register at the inland waterway terminal and obtain feedback from various users of the facilities. 15. Inspection. –– The terminal developer and operator shall permit the representative of the Authority to carryout periodic inspection of the inland waterway terminal. 16. Cancellation of Certificate. ––(1) The Authority may cancel the Certificate granted to the terminal developer and operator if such terminal developer and operator–– (a) commits any breach of the terms and conditions; (b) contravenes any provisions of the Act; or (c) commits an unlawful act or omission. (2) Before issuing a notice for cancellation of the Certificate, the Authority shall issue a show cause notice to the terminal developer and operator, allowing thirty days for a response and if no response is received, or if the response is unsatisfactory, the order of cancellation shall be issued. (3) The terminal developer and operator may also surrender the Certificate by giving a notice of ninety days to the Authority. (4) In case of cancellation of the Certificate by the Authority, or upon surrender of the Certificate by the terminal developer and operator, the terminal developer and operator shall dismantle and remove the structures and equipment etc., at its own cost within a period of one hundred and eighty days from the order of cancellation under sub-regulation (2). (5) In the event of any breach of the terms and conditions specified in these regulations, the Authority shall have the right to claim for damages incurred by the Authority due to an act or omission committed by the terminal developer and operator for the damage caused to the national waterway or associated infrastructure. (6) The Authority may take over the inland waterway terminal assets, if deemed necessary, upon payment of due consideration, as determined by the Authority in this behalf.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 13 SCHEDULE (See regulation 5) Application for issuance of No objection Certificate by the Authority for development and operation of inland waterway terminal on or along national waterway. Infrastructural facilities at the Inland waterway terminal. 12. Details (report/drawings) of access channel for connecting the inland waterway terminal to the national waterway’s main channel. We hereby agree to indemnify and hold harmless the Authority from any claims, damages, liabilities, or expenses arising from our any actions, omissions, or negligence or any person acting on our behalf in connection with the granting of the No objection Certificate or the operation of the Inland waterway terminal. This indemnity extends to all costs, legal fees, and expenses incurred by the Authority in defending such claims or in relation to any proceedings that may arise from the actions of the terminal developer and operator or its representatives. In exercise of powers conferred by sub-section (1), read with clauses (d), (f) and (h) of sub-section 2 of section 35, read with clauses (b), (f) and (g), of sub-section (1) under of 14 of the Inland Waterways Authority of India Act, 1985 (82 of 1985), and the ________ Regulations, -----, the Authority, hereby grants the No objection Certificate to the aforesaid application. This No objection Certificate is subject to the provisions of the regulations and the terms and conditions annexed to this Certificate. This is issued with the approval of the competent Authority Name: Designation General conditions to be complied with by the terminal developer and operator: 1. The terminal developer and operator will be responsible for compliance with all statutory requirements relating to environment laws, pollutions laws and such other applicable laws relating to safety during the development and operations of inland waterway terminal and shall obtain all statutory and non-statutory clearances that may be required for development and operations of the inland waterway terminal including structural safety and safety of operations. 2. The location of the inland waterway terminal shall not lie within the notified boundary of a wildlife sanctuary declared under the provisions of the Wildlife Protection Act, 1972 (53 of 1972) and Forest Conservation Act, 1980 (69 of 1980) or any other area notified under any law in force which prohibits such activity. 3. The terminal developer and operator will be responsible for technical design and construction of the facility and ensure adequacy with respect to the business plan and access to the facility. 4. The Access channel connecting inland waterway terminal to the main navigation channel will be developed and maintained by the terminal developer and operator at its own cost, under supervision of the Inland Waterway Authority of India.16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 5. The terminal developer and operator shall obtain all necessary clearances from the Central Government and State Governments and other authorities as may be required. 6. The terminal developer and operator will be responsible for payment of all applicable taxes, fee, charges and cess, etc. 7. The terminal developer and operator shall inform the Authority in writing regarding commencement of operations at the inland waterway terminal within fifteen days of commencement of operations. 8. The terminal developer and operator may charge fee from the users the inland waterway terminal including terminal charges and any charges related to value added services provided at the inland waterway terminal, subject to tariff regulations as per existing concession agreements or notifications issued by the competent Government or Statutory agencies, if any. 9. The terminal developer and operator shall be responsible for checking that the vessels berthed at the inland waterway terminal have the valid receipts of inland waterways user charges corresponding to the previous and onward journeys before loading or unloading or sailing of vessels. 10. The terminal developer and operator will inform the Authority of the payment of waterway user charges by the shipper or vessel operator for the loading or unloading of cargo at the inland waterway terminal. 11. The Inland Waterway Authority of India may direct the terminal developer and operator to install an information technology application at the inland waterway terminal so as to integrate it operations with other related information systems. 12. The Authority reserves the right of inspection of inland waterway terminal at any time. 13. The Terminal developer and operator shall ensure –– (a) that the location of the inland waterway terminal shall not have any adverse implication on the fairway, channel or navigability of the waterway and will not cause hindrance to the plying of vessels in National Waterway; (b) that the development, operation and maintenance of such inland waterway terminal shall have no financial and risk liability on the Inland Waterway Authority of India. 14. The terminal developer and operator shall provide the complete data on cargo handled at the inland waterway terminal on a monthly basis by the 2nd day of every subsequent month. 15. The terminal developer and operator shall maintain record of berthing and loading or unloading of vessels or other activities as may be required by the Inland Waterway Authority of India from time to time. 16. All the costs relating to changes in the planning or design of infrastructure of the inland waterway terminal due to changes in access channel connectivity of the inland waterway terminal shall be borne by the terminal developer and operator.
