L.-33004/99 सी.जी.-डी.एल.-अ.-25092024-257479 xxxGIDHxxx CG-DL-E-25092024-257479 xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 730] नई दिल्ली, बृहस्ट्प जतिार, जसतम्ब र 19, 2024/भार 28, 1946 No. 730] NEW DELHI, THURSDAY, SEPTEMBER 19, 2024/BHADRA 28, 1946 भारतीय जिमानपत्तन प्राजधकरण अजधसचू ना नई दिल्ली, 11 िुलाई, 2024 फा. स.ं ए-42011/60/2020-एचआर.—भारतीय जिमानपत्तन प्राजधकरण अजधजनयम, 1994 (1994 का 55) की धारा 42 की उप-धारा (4) के साथ पठित उप-धारा (2) द्वारा प्रित्त िजियों का प्रयोग करते हुए, भारतीय जिमानपत्तन प्राजधकरण, केन्द्र सरकार के अनुमोिन से, भारतीय जिमानपत्तन प्राजधकरण (छुट्टी) जिजनयम, 2003 म ें संिोधन करने के जलए जनम्नजलजखत जिजनयम बनाता ह,ै यथा:- 1. सजं िप्त िीर्कष और प्रारंभ - इन जिजनयमों को भारतीय जिमानपत्तन प्राजधकरण (छुट्टी) संिोधन जिजनयम, 2024 कहा िाएगा। (2). इन्द्ह ें1 अक्टूबर, 2020 से लाग ूमाना िाएगा। 2. भारतीय जिमानपत्तन प्राजधकरण (छुट्टी) जिजनयम, 2003 म,ें जिजनयम 11 के उप-जिजनयम (10) के खडं (2) के स्ट्थान पर, जनम्नजलजखत जिजनयम प्रजतस्ट्थाजपत दकया िाएगा, यथा:- (2). अप्रयुि अधष िेतन छुट्टी का नकिीकरण सेिाजनिृजत्त पर अप्रयुि अर्िषत छुट्टी और अध ष िेतन छुट्टी का नकिीकरण दकया िा सकता ह,ैइस आधार पर दक अजधकतम सीमा तीन सौ दिन होगी और अधष िेतन छुट्टी के जलए िये नकि समतुल्य छुट्टी िेतन के बराबर होगा िो अर्द् ष िेतन तथा महगं ाई भत्ते के रूप म ें स्ट्िीकायष ह ै तथा अर्िषत छुट्टी में कमी की पूर्त ष के जलए अध ष िेतन छुट्टी का कोई संरािीकरण स्ट्िीकायष नहीं होगा। 6003 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ए) अजधिर्र्षता की आयु प्राप्त करन े पर भारतीय जिमानपत्तन प्राजधकरण की सेिा छोड़ना; (बी) सेिा के िौरान मृत्यु; (सी) पचास िर्ष की आयु प्राप्त करन े पर अनुिासनात्मक कारषिाई के आधार को छोड़कर अन्द्य आधार पर त्यागपत्र सजहत सेिा समाजप्त: बिते दक कमषचारी न े सरकार या सािषिजनक िेत्र के उद्यम म ें न्द्यूनतम बीस िर् ष की सेिा की हो, जिसमें भारतीय जिमानपत्तन प्राजधकरण में न्द्यनू तम एक िर् ष की सेिा भी िाजमल हो। (2 ए) अधष िेतन छुट्टी के नकिीकरण की गणना। अध षिेतन छुट्टी की गणना और नकिीकरण के संबधं में सूत्र:- मूल िेतन का आधा + महगं ाई भत्ता िमा अधष िेतन छुट्टी की कुल संख्या, बिते दक ------------------------------------- िमा अर्िषत छुट्टी की कुल संख्या तथा िमा अध ष नकि समतल्ु य = X िेतन छुट्टी की कुल संख्या तीन सौ दिन से अजधक 30 न हो। संिीि कुमार, अध्यि [जिज्ञापन-III/4/असा./499/2024-25] नोट: मूल जिजनयम भारत के रािपत्र, असाधारण, भाग-III, खंड 4 में संख्या एएआई/पीईआरएस/ईडीपीए/आरईिी/2002 दिनांक 13 िून, 2003 के अंतगषत प्रकाजित दकए गए थे। व्याख्यात्मक ज्ञापन: भारतीय जिमानपत्तन प्राजधकरण बोड ष न े अपनी 195िीं बोडष बैिक में जनश्चय दकया ह ै दक भारतीय जिमानपत्तन प्राजधकरण छुट्टी जिजनयम, 2003 में अर्िषत छुट्टी और अधष िेतन छुट्टी के नकिीकरण संबंधी खडं को लोक उद्यम जिभाग के दििा-जनििे ों के अनरूु प सिं ोजधत दकया िाए, अथाषत ् अर्िषत छुट्टी और अधषिेतन छुट्टी को 300 दिनों की समग्र सीमा के अधीन सेिाजनिृजत्त पर छुट्टी के नकिीकरण के जलए जिचार दकया िा सकता है। अधष िेतन छुट्टी के जलए िये नकि समतल्ु य छुट्टी िेतन के बराबर होगा िो अर्द् ष िेतन तथा महगं ाई भत्ते के रूप में स्ट्िीकायष ह ै तथा अर्िषत छुट्टी म ें कमी की पूर्तष के जलए अध ष िेतन छुट्टी का कोई सरं ािीकरण स्ट्िीकायष नहीं होगा।इसे दिनांक 28 अक्टूबर, 2020 के जनगजमत मानि संसाधन प्रबंधन पठरपत्र संख्या 68/2020 के माध्यम से िारी दकया गया, जिस े 01 अक्टूबर, 2020 स े प्रभािी दकया गया। इस प्रकार, 1 अक्टूबर, 2020 के पूिषव्यापी प्रभाि स े अजधसूचना िारी करन े से दकसी भी कमषचारी के जहत पर प्रजतकूल प्रभाि नहीं पड़ेगा। AIRPORTS AUTHORITY OF INDIA NOTIFICATION New Delhi, the 11th July, 2024, F. No. A-42011/60/2020-HR.— In exercise of the powers conferred by sub-section (2) read with sub-section (4) of section 42 of the Airports Authority of India Act, 1994 (55 of 1994), the Airports Authority of India, with the approval of the Central Government, hereby makes the following regulations to amend the Airports Authority of India (Leave) Regulations, 2003, namely:- 1. Short title and commencement - These regulations may be called the Airports Authority of India (Leave) Amendment Regulations, 2024. (2). These shall be deemed to have come into force on 1st day of October 2020. 2. In the Airports Authority of India (Leave) Regulations, 2003, for clause (2), of sub-regulation (10) of regulation 11, the following regulation shall be substituted, namely: - (2). Encashment of unutilized half pay leave –[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 the unutilized earned leave and half pay leave can be considered for encashment of leave on retirement subject to the maximum limit of three hundred days and the cash equivalent payable for half pay leave shall be equal to the leave salary as admissible for half pay plus Dearness Allowance and that to make up the short fall in earned leave, no commutation of half pay leave shall be permissible. (a) leaving the service of Airports Authority of India on attaining the age of superannuation; (b) death while in service; (c) cessation of service including resignation other than on grounds of disciplinary action, on attaining the age of fifty years: Provided that the employee has rendered a minimum of twenty years of service in Government or Public Sector Enterprise including a minimum service of one year in the Airports Authority of India. (2A) Calculation of Encashment of Half Pay Leave. The formulation with respect to calculation and Encashment of half pay leave:- Half of Basic Pay + Dearness Allowance Number of Half Pay Leave at credit subject to the total of Cash equivalent = ----------------------------------------------- X earned leave and half pay 30 leave at credit not exceeding three hundred days SANJEEV KUMAR, Chairman [ADVT.-III/4/Exty./499/2024-25] Note: The principal regulations were published in the Gazette of India, Extraordinary, Part-III, Section 4 vide No. AAI/PERS/EDPA/REG/2002 dated 13th June, 2003. Explanatory Memorandum: The Airports Authority of India Board in its 195th Board Meeting resolved that, the clause on encashment of Earned Leave & Half Pay Leave in Airports Authority of India Leave Regulations, 2003 be amended in line with Department of Public Enterprises Guidelines namely “earned leave and half-pay leave can be considered for encashment of leave on retirement subject to the overall limit of 300 days. The cash equivalent payable for half-pay leave would be equal to the leave salary as admissible for half-pay plus DA and that to make up the short fall in earned leave, no commutation of half-pay leave would be permissible”. The same was issued vide Corporate Human Resource Management Circular No. 68/2020 dated 28th October, 2020, which was made effective from 01st October, 2020. As such, the interest of no employee is being adversely affected by issuing the notification by retrospective effect from 1st day of October, 2020.
