मामला श्यामा प्रसाद मुकिी पत्तन (एसपीएमपी) के हजल्दया डॉक कॉम््लेक्स (एचडीसी) म ें 'एंकरेि जडस्ट्चािज' और 'बाि ज हडैं ललंग' के जलए 'स्ट्टीवडोररंग ऑपरेिन' सजहत 'स्ट्टीवडोररंग और िोर हडैं ललगं ऑपरेिन' के जलए मौिूदा अपफ्रंट प्रिल्ु क की वधै ता की अवजध के जवस्ट्तार स े संबंजधत ह।ै 2.1. एचडीसी म ें'स्ट्टीवडोररंग और िोर हडैं ललगं ऑपरेिन' के जलए मौिूदा अपफ्रंट प्रिल्ु क को इस प्राजधकरण द्वारा 19 िनवरी 2018 के आदेि संख्या टीएएमपी/79/2016-केओपीटी द्वारा अनुमोददत दकया गया था। इस आदेि को भारत के रािपत्र म ें 26 फरवरी 2018 के रािपत्र संख्या. 76 पर अजधसूजचत दकया गया था। भारत के रािपत्र म ें आदेि की अजधसूचना की तारीख स े 30 ददनों की समाजि के बाद अपफ्रंट प्रिल्ु क प्रभावी हो गया था और 3 वर्ज अथाजत 27 माच ज 2021 तक वैध था। 2.2. उि आदेि के तहत, एसपीएमपी को भारत के रािपत्र म ें आदिे की अजधसूचना स े 3 महीन े के भीतर एचडीसी म ें एंकरेि जडस्ट्चाि ज और बाि ज हडैं ललंग के जलए स्ट्टीवडोररंग संचालन के जलए अपफ्रंट प्रिल्ु क के जनधाजरण का प्रस्ट्ताव दाजखल करने की सलाह दी गई थी। इसके बाद, एसपीएमपी ने उि सुजवधा के जलए एक प्रस्ट्ताव दायर दकया और इस प्राजधकरण द्वारा एक आदेि संख्या टीएएमपी/8/2019-केओपीटी ददनांक 14 िून 2019 पाररत दकया गया । उि आदिे भारत के रािपत्र म ें11 िनू 2019 को रािपत्र संख्या. 246 के माध्यम स े अजधसूजचत दकया गया था। उि िल्ु क भारत के रािपत्र म ें आदेि की अजधसूचना की तारीख से 15 ददनों की समाजि के बाद लाग ू हुए और इनकी वैधता अवजध एचडीसी के जलए स्ट्वीकृत स्ट्टीवडोररंग और तट प्रबंधन संचालन के जलए मौिदू ा िल्ु क की वैधता अवजध के साथ 27 माच ज 2021 तक एसपीएमपी के सह-काजलक (को टर्मजनस) रहगे ी। 3.1. इस पष्ठृ भूजम म,ें एसपीएमपी के एचडीसी न े अपन े पत्र स.ं िीएम(टी)/42/1022 ददनांक 21 अप्रैल 2021 के तहत जनम्नजलजखत उल्लेख दकए ह:ैं (i) एचडीसी म ें स्ट्टीवडोररंग और िोर हडैं ललगं ऑपरेिन के जलए अपफ्रंट प्रिल्ु क को टीएएमपी के आदिे संख्या टीएएमपी/79/2016-केओपीटी ददनांक 19 िनवरी 2018 के तहत अनुमोददत दकया गया था और ददनांक 26 फरवरी 2018 के रािपत्र स ं 76 के तहत भारत के रािपत्र (िीओआई) म ें अजधसूजचत दकया गया था। इसके अलावा, एचडीसी म ें एकं रेि जडस्ट्चािज और बािज हडैं ललंग के जलए स्ट्टीवडोररंग संचालन के जलए अपफ्रंट प्रिल्ु क, टीएएमपी द्वारा, आदेि संख्या टीएएमपी/8/2019-केओपीटी ददनांक 14 िून 2019 के तहत अनुमोददत दकया गया था और भारत सरकार रािपत्र स.ं 246 ददनांक 11 िलु ाई 2019 के तहत अजधसूजचत दकया गया था और टीएएमपी के दोनों आदेि 27 माच ज 2021 तक वैध थे। (ii) चल रही महामारी की जस्ट्थजत के कारण, जिसम ें व्यापार को जवजभन्न करिनाइयों का सामना करना पड़ रहा ह,ै वतजमान श्रम दर, उपकरण दकराया िुल्क और बंदरगाह म ें कागो हडैं ललगं ऑपरेिन स े िुड़ी नई प्रस्ट्ताजवत दरों की गणना के जलए जवजभन्न अन्य सहायक खचों को संबंजधत एिेंजसयों स े एकत्र नहीं दकया िा सका ह।ै िैसा दक समझा गया ह,ै अनुमोदन के जलए प्रस्ट्ताजवत दरों को अंजतम रूप देने के जलए औपचाररक और अनौपचाररक दोनों तरह स े व्यापार स े आवश्यक िानकारी एकत्र करन े के जलए कुछ और समय की आवश्यकता होगी। (iii) इन पररजस्ट्थजतयों म,ें एचडीसी म ें 'एंकरेि जडस्ट्चाि'ज और 'बाि ज हडैं ललगं ' सजहत 'स्ट्टीवडोररंग' और 'िोर हडैं ललगं ऑपरेिन' के जलए अपफ्रंट प्रिल्ु क' के संिोजधत दरमान (एसओआर) के कायाजन्वयन के संबंध म,ें[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 अपफ्रंट प्रिल्ु क की वधै ता अवजध को आग े 6 महीन,े अथाजत 28 माच ज 2021 स े 27 जसतंबर 2021 तक या प्रभावी जतजथ तक, िो भी पहल े हो, बढाने का अनुरोध दकया गया ह ै। (iv) इसके अलावा, यह भी कहा गया ह ै दक न्यासी बोड ज के अनुमोदन स े नई दरें िल्द ही प्रस्ट्ताजवत की िाएंगी। जवस्ट्तार अवजध के दौरान ददनाकं 01 अप्रलै 2020 स े यथा-सूचकांदकत मौिूदा दरों को अप्रलै 2021 म ें कोई और सूचकांकन के जबना, िारी रखने का प्रस्ट्ताव ह ै 3.2. तदनुसार, एसपीएमपी न,े एसपीएमपी के एचडीसी म ें 'एंकरेि जडस्ट्चािज' और 'बाि ज हडैं ललंग' सजहत 'स्ट्टीवडोररंग' और 'िोर हडैं ललंग ऑपरेिन' के जलए मौिूदा अपफ्रंट प्रिल्ु क की वैधता अवजध, 28 माच ज 2021 स े 27 जसतंबर 2021 तक के जलए बढान े का अनुरोध दकया ह।ै 3.3. इसके बाद, एसपीएमपी ने अपने ई-मेल ददनांक 21 िून 2021 के हमारे माध्यम स े दकए गए अनुरोध पर, 10 िून 2021 को हुई एसपीएमपी के न्यासी बोडज की बैिक के बोड ज की कायजवाही के प्रारुप की एक प्रजत अग्रेजर्त की और सूजचत दकया दक इस मामले पर न्यासी बोडज द्वारा चचा ज की गई थी और इस ेअनुमोददत दकया गया। 4.1. चूंदक एचडीसी म ें 'एंकरेि जडस्ट्चािज' और 'बाि ज हडैं ललगं ' सजहत 'स्ट्टीवडोररंग' और 'िोर हडैं ललंग ऑपरेिन' के जलए अपफ्रंट प्रिल्ु क की वैधता अवजध पहल े ही समाि हो चुकी ह ैऔर एसपीएमपी द्वारा दकए गए अनुरोध पर आधाररत ह ै और एसपीएमपी के एचडीसी को अपना प्रस्ट्ताव दाजखल करने के जलए आवश्यक समय और प्रसंस्ट्करण के जलए आवश्यक समय पर जवचार करना ह,ै एसपीएमपी द्वारा दायर दकया िाने वाला प्रस्ट्ताव और एसपीएमपी के एचडीसी म ें 'एंकरेि जडस्ट्चाि'ज और 'बाि ज हडैं ललंग' सजहत 'स्ट्टीवडोररंग' और 'िोर हडैं ललगं ऑपरेिन' के जलए 27 माच ज 2021 के बाद अपफ्रंट प्रिल्ु क के दक्रयान्वयन आई ररिता (वेक्यूम) स े बचन े के जलए, मौिूदा अजग्रम प्रिल्ु क की वैधता अवजध म ें जवस्ट्तार करना उजचत माना िाता ह।ै 4.2. तथाजप, िैसा दक एचडीसी द्वारा वैधता अवजध को 27 जसतंबर 2021 तक बढान े का अनरु ोध दकया गया ह,ै यह अवजध िीघ्र ही समाि हो िाएगी इसजलए यह प्राजधकरण एसपीएमपी के एचडीसी म ें 'एंकरेि जडस्ट्चािज' और 'बाि ज हडैं ललगं ' सजहत 'स्ट्टीवडोररंग' और 'िोर हडैं ललगं ऑपरेिन' के जलए एसपीएमपी के एचडीसी के अनरु ोध के अनरुु प मौिदू ा अपफ्रंट प्रिुल्क की वैधता अवजध को 09 माह अथाजत 28 माच ज 2021 स े 27 ददसंबर 2021 तक या एसपीएमपी के द्वारा 'एंकरेि जडस्ट्चाि'ज और 'बाि ज हडैं ललगं ' सजहत 'स्ट्टीवडोररंग' और 'िोर हडैं ललगं ऑपरेिन' के जलए दायर दकए िाने वाल े प्रस्ट्ताव के अनुमोदन, िो भी पहले हो, के जलए आग े बढाता ह।ै टी. एस. बालसुब्रमजन यन, सदस्ट्य (जवत्त) [जवज्ञापन-III/4/असा./302/2021-22] TARIFF AUTHORITY FOR MAJOR PORTS NOTIFICATION Mumbai, the 17th September, 2021 No. TAMP/79/2016-KOPT.— In exercise of the powers conferred under Section 48 of the Major Port Trusts Act, 1963 (38 of 1963), the Tariff Authority for Major Ports hereby extends the validity of the existing upfront tariff for Stevedoring and Shore Handling operation including Stevedoring operation for anchorage discharge and barge handling at Haldia Dock Complex (HDC) of Syama Prasad Mookerjee Port (SPMP) for period upto 27 December 2021, as in the Order appended hereto.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] TARIFF AUTHORITY FOR MAJOR PORTS No. TAMP/79/2016–KOPT Syama Prasad Mookerjee Port --- Applicant QUORUM: (i) Shri. T. S. Balasubramanian, Member (Finance) (ii) Shri. Sunil Kumar Singh, Member (Economic) ORDER (Passed on this 15th day of September 2021) This case relates to the extension of the validity of the existing upfront tariff for Stevedoring and Shore Handling operation including Stevedoring operation for anchorage discharge and barge handling at Haldia Dock Complex (HDC) of Syama Prasad Mookerjee Port (SPMP). 2.1. The existing upfront tariff for stevedoring and shore handling operations at HDC was approved by this Authority vide its Order No. TAMP/79/2016-KOPT dated 19 January 2018. This Order was notified in the Gazette of India on 26 February 2018 vide Gazette No. 76. The upfront tariff had come into effect after expiry of 30 days from the date of notification of the Order in the Gazette of India and was valid for 3 years i.e. upto 27 March 2021. 2.2. Vide the above said Order, the SPMP was advised to file a proposal for fixation of upfront tariff for Stevedoring operations for anchorage discharge and barge handling at HDC, within 3 months from the notification of the Order in the Gazette of India. Subsequently, the SPMP filed a proposal for above said facility and this Authority has passed an Order No. TAMP/8/2019-KOPT dated 14 June 2019. The said order was notified in the Gazette of India on 11 June 2019 vide Gazette No. 246. The said charges came into effect after expiry of 15 days from the date of notification of the Order in the Gazette of India and its validity shall remain co-terminus with the validity of the existing charges for the stevedoring and shore handling operations as approved for HDC of SPMP, upto 27 March 2021. 3.1. In this backdrop, the HDC of SPMP vide its letter no. GM(T)/42/1022 dated 21 April 2021 has made the following submissions: (i) The upfront tariff for Stevedoring and Shore Handling operation at HDC was approved by TAMP vide Order No. TAMP/79/2016-KOPT dated 19 January 2018 and notified in the Gazette of India (GOI) vide G. No. 76 dated 26 February 2018. Further, the Upfront Tariff for stevedoring operations for anchorage discharge and barge handling at HDC was approved by TAMP vide Order No. TAMP/8/2019-KOPT dated 14 June 2019 and notified in the GOI vide G. No. 246 dated 11 July 2019 and both the TAMP Orders were valid upto 27 March 2021. (ii) Due to ongoing pandemic situation in which various difficulties faced by the Trade, the current labour rates, equipment hire charges & various other ancillary expenses connected with the cargo handling operation in the port could not be gathered from the concerned agencies for calculating the fresh proposed rates. As understood, some more time will be required to collect the necessary information from the trade both formally as well as informally to finalize the rates to be proposed for approval. (iii) Under the circumstances, it is requested to extend the validity of the Upfront Tariff for Stevedoring and Shore Handling operation including anchorage discharge and barge handling at HDC, for a further period of 6 months i.e. 28 March 2021 to 27 September 2021 or till the effective date of implementation of the revised Scale of Rates (SOR) of Upfront Tariff, whichever is earlier.. (iv) Further, it is also stated that new rates shall be proposed soon with the approval of the Board of Trustees, the existing rates as indexed w.e.f. 01 April 2020 is proposed to be continued during the extension period with no further indexation in April 2021. 3.2. Accordingly, SPMP has requested to extend the validity of the existing upfront tariff for Stevedoring and Shore handling operation including anchorage discharge and barge handling at HDC of SPMP for a period of 6 months w.e.f. 28 March 2021 till 27 September 2021.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 3.3. Subsequently, at our request, the SPMP vide its e-mail dated 21 June 2021 has forwarded a copy of the Draft Board Proceedings of the Meeting of the Board of the Trustees of SPMP held on 10 June 2021 and conveyed that the matter was discussed and approved by its Board of Trustees. 4.1. Since the validity of the upfront tariff for Stevedoring and Shore handling operation including anchorage discharge and barge handling at HDC has already expired and based the submissions made by SPMP and considering the time required for HDC of SPMP to file its proposal and the time required for processing the proposal to be filed by the SPMP and in order to avoid a vacuum in the levy of the upfront tariff for Stevedoring and Shore handling operation including anchorage discharge and barge handling at HDC of SPMP, it is felt appropriate to extend the validity of the existing upfront tariff beyond 27 March 2021. 4.2. However, given that the extension of validity period upto 27 September 2021 as requested by HDC will soon expire, this Authority based on its collective application of mind, extends the validity of the existing upfront tariff for Stevedoring and Shore handling operation including Stevedoring operations for anchorage discharge and barge handling at HDC of SPMP for a period 9 months from 28 March 2021 to 27 December 2021 or till approval of new upfront tariff for Stevedoring and Shore handling operation including Stevedoring operation for anchorage discharge and barge handling based on the proposal to be filed by the SPMP, whichever is earlier.
